Gentlemen:
Please be advised thaa: the above entitled cas was reached
for trial on March 7th, on which date a jury was selected and
evidence presented. Upon conclusion of the plaintiff's case,
I presented amotion for a directed verdict of "Not Guilty" and
the motion was granted. Upon instruction of the court, the
jury returned such a verdict. The Railroad's motion for a
directed verdict was refused.
This now concludes the above matter.

WELLER CREEK BRIDGE: Alderman Napieralski then brief-
ly discussed the propriety of the City repairing the foot bridge
over Weller Creek at the foot of Perry Street. The motion was
made by Alderman Napieralski and second by Alderman Johnson to
instruct the Clerk to write the City Engineer ordering him to
determine where the City Limits line lies with respect to the
said bridge and to submit a writtenieport on this matter tet
the City Council at its next regualr meeting to be held March
20, 1944. The motion was voted upon by acclamation whereupon
the Chair declared the motion carried.
ADJOURNMENT: The motion was made by Alderman Lemke an,
seconded by Vavrinek that the meeting adjourn. The motion was
voted upon by acclamation whereupon the chair declared the motion

Charles H. Garland presiding, with Aldermen Johnson, Napieralski,

(Alderman Scharringhausen was absent during the entire meeting.)
The Clerk reported nine (9) Aldermen present.

AUTHORIZE TATER WORKS IMPROVEIuENTS: The Clerk then read
the following proposed resolution:

RESOLUTION
WHEREAS, The City Council of the City of Des Plaines
has found that immediate repairs are necessary to the existing
Cater Well furnighing water to the citizens of the City and to
provide for the sinking of a new well and providi71 necessary
equipment to bring water to the surface for distribution through-
out the City; and
WHEREAS, a failure to so repair and provide additional
water facillities will seriously hamper the welfare, safety and
health of the citizens of Des Plaines; and
WHEREAS. The City is without funds to provide such im-
provements to the water rstem and funds, in part or in entirety
may be made available through the Federal Works Agency; now,
therefore,
BE 'IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES
PLAINES, COOK COUNTY, ILLINOIS:
SECTION 1. That the mayor, Charles H. Garland, be and
he is hereby authorized and directed to make application for
assistance to the Federal Works Agency for the purpose of mak-
ing repairs to the existing Cater well and to provide for the
digging of a new and additional well and to furnish necessary
equipment therefor.
SECTION 2. That the said mayor be and he is hereby
authorized and directed to execute all documents necessary there-
fore, and to furnish any and all information necessary in the
succesful prosecution of said request to the Federal Works Agency.
SECTION 3. That this resolution shall be infhll force
and effect from and after its passage and approval.

The motion was made by Alderman Lemke and seconded by Vavrinek
to adopt this proposed resolution. The Mayor put the question
and the Clerk called the roll with the following result: Ayes;
Aldermen Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe, Lemke,
McKay, Campagna and Halverson. Nays; Nora. The Mayor thereupon
declared the motion carried and the said resolution adopted.
Alderman Lemke, Chairman of the Water Committee then submitted
the following proposal and recommended its acceptance:

Gentlemen:
In accordance with our conversation of March lst, we are
hereby outlining the required items as listed in our Proposal
of February 25th, namely:
ITEM # 2:
We will use your present 14", 16 stage Pomona Turbine, and
add seven additional stages, which then will be capable of deliver-
ing 1,000 gallons per minute, against a total head of 530°.
500- Feet of 2-3/16" x 33" x 10" standard oil lubricated column.
Converting one Byron Jackson discharge head to receive:
1- 200 HP, 1160 R. P. M., 440 Volt, 3 phase, 60 cycle, ver-
ticle hollow shaft motor.
500- Feet of 4" extra heavy air line complete with:
1- Portable air compressor.
The net prive installed, which includes the removal of your
present pump will be $9,950.00.
ITEM #4:
The Control will consist of:
1- Allen-Bradley bulletin #740 resistance type starter, com-
plete with push button station, time limit relay, reversal
and phase failure relay, all mounted on an open type panel.
The net price of this equipment will be $534.00
The wiring is to be done by Hyre Electric Company at a
net price of $579.70. Wiring to include the furnishing and mount-
ing of a 600 amp. fused disconnect switch, complete with renewable
fuses, with conduit'and all necessary material to wire from the
disconnect switch to the Alien- Bradley starter, and to the motor.
ITEM S5:
We offer a simplex venturi throat low head graph recording
and intergrating flow meter, with the integrator of the wall mount-
ed type for a net price of $742.50.
We will install the above meter, which will include the necessary
cutting in on your 10" main, as well as the Peiping Tuning from a
manhole or pit, which will be furnished by the City, fbr the net sum of
$200:00.

The motion was made by Alderman Napieralski and seconded by Kehe
to concur in the recommendation accept the said proposal and pro-
ceed with the work without delay, not withstanding the filing of an
ap,lication for a grant with the Federal Works Agency, to carry
out Class "A" as recommend in the report of Alvord, Burdick &
Hawson dated February 7, 1944. The motion was voted upon by
acclamation whereupon the Payor declared the motion carried.
PERTAINING TO CUMBERLAND TERPACE SEWER: The clerk then
read the following report:
Your committee of Sam Atkins, representing the City of Des Plaines,
Felix Orfei representing the Orfei Construction Co, and Standley
Redmer representing Cumberland Terrace` met on Feb. 22nd in the
office of Mayor Garland to discuss the completion of. the Cumber-
land Terrace Sewer Project. Mr. Orfi, has agreed that he is going
through with the conditions of the bond in regards to replacement
and repairs of all damaged property caused by the construction of
Cumberland Terrace Sewer last summer.
In detail he agrees to put these streets back in approximately
their same condition, also to repair all drive ways entering into
private residences, sidewalks which he may have damaged, and also
to go over the easements where dere have been an excess amount of
dirt left.
This committee will go over the property completed by the sewer
project sometime in May after the ground has dried out and will
determine the validicity of -11 complaints which will have been
turned in. Your Chairman, through the Cumberland Terrace Civic
Club will canvas Cumberland Terrace residences to make sure that
all complaints will be in prior to this investigation.
At the meeting on the 22nd of February the committee did not think
it would be feasible to ask Wr. Orfi to do any of this work until
MayyS or the early part of June. The reason for this is that if
Mr. Orfi should rut these streets back into shape and these, streets
would be accepted' b the City as being satisfactory and then we
were to find the ground was not entirely dried out, Mr. Orfi would
have been released from his obligation and the City of DesPlaines
would have inferior streets. This date o" May or June is only a
suggestion on the part of your committee to the City Council and
we are planning to follow through with the wishes of the Council
to the best of our ability if they should see fit to start at an
earlier date.
As another subject brought up at this meeting we think it would
be advisable previous to the time of final repairs if the Council
would instruct the street department to dump cinders at some of
the locations which are rather low and get muddy due to the Spring
rains and the thawing of the ground. This condition is especially
ture along Columbia, on the Last side of Wolf Road where there
has been a number of instances after the thawing of this last snow
where people have gotten stuck coming out of their drive ways.
All these are merely sugestions and plans that were discussed
at the mentioned meeting and the committee will abide by any actions
taken by the Council about these fitters.

COMPLAINS THT BELT LINE R. R. FLOCKS WOLF ROAD:
Alderman McKay then submitted the following complaint:
On Monday eyeing March 6th I left my hone about 6:20 pm, and
walked to Washington Avenue and Wolf Road, to get the bus scheduled
to leace Cumberland Terrace at 6:27, it being my desire to attend
the Des Plaines' Businessmen's Dinner, at the Lutheran School. On
my way to the corner I noted that a freight train was blocking
Wolf Road at the C&NW crossing.
My wife and I waited in the freezing weather, and we could see
the bus on the other side of the freight train, also waiting for an
opportunity to proceed.
After waiting for 20 minutes, I started for one of the Houses
nearby, in order to phone for the squad car. However, just before
I reach the house the train star+^d. to move, at 6:41 pm. At about
6:43, the crossing was clear, but':by that time the frigid weather
had frozen the brake gear on the bus, and there was more delay
before it got going. Finally, it came along and instead of stopping
and picking up the passengers at Washington and "golf, (There were
four there at the time), it rushed passed us, went as far as
Columbia avenue, and there turned around, came back and picked
us up, at 6:57pm. The driver was having difficulty driving the
bus, because of the brake gear, and in addition he certainly was
not exercising ordinary caution, considering the condition both
of the roads and the bus. When we reached the freight crossing,
he drove the bus over the tracks so roughly that everyone, in-
cluding himself, were given a tremendous jolt, lifting all of us
out of our seats. This just about put the vheicle out of comrizion
and as the driver had evidently phoned for help before the freight
train had pulled away, he waited where he was for seven minutes,
when another bus came down Wolf Road from the north, and we trans-
ferred to it and resumed our trip;

The motion was then made by Alderman McKay and seconded b;- Lemke
to instruct the Clerk to write the Belt Line Railroad requesting
that the blocking of 1olf Road by freight trains be starred and
warning the railroad that unless this is done a complaint will
be filed with the State Commerce Commission. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried.
REQUESTFOR PERMIT FOR WIDE DRIVEWAY: The clerk than read
the following letter:

Gentlemen:
We desire to make some improvements to the driveway entering
our plat, which. driveway lies adjacent to the Soo Line rail-
way. There is attached hrerto a sketch of the proposed
improvements.
"e wish to pave and widen the apron of the present driveway,
and that part colored blue on the sketch indicates the new
Tines of the proposed widened apron. As you wi17 observe,
this will result in a change of the present souther?y curb
line o Thacker Street and will eliminate the Present sharp
line of thacker street and will eliminate the present sharp
angle of the south curb as it now exists. The proposed change
will also make available additional driving space on the
street of approximately five feet in width.
If we can obtain approval from the council to make the

proposed changes, we also i etend to replace about fifty feet
of broken sidewalk, which the city is legally obligated to
repair.
All the foregoing improvements will be made without charge
to the city, and the driveway apron and sidewalk will be
constructed in accordance with specifications meeting the
standards set up by the city.
We would appreciate your approval of our proposed plans at
your earliest opportunity.

Alderman Pflughaupt and seconded by Lemke that the said minutes

upon the mayor declared the motion carried and the said minutes
annroved.
APPOINT MEMBER OF ARCHITECTURAL COMMISSION: Mayor
Garl-nd then announced the appointment of Mr. Hugo Liedberg as
chairman and member of the Architectural Commission to complete
the unexpired term of E. R. Gernhardt expiring April 30., 1944.
The motion was made by Alderman Campggna and seconded by.
McKay that the -said a^pointment be confirmed. The motion
was voted upon by acclamation whereupon the.mayor declared the
motion carried and the said appointment confirmed.
The motion was made by Alderman Napieralski and second by
Kehe to instruct the Clerk to write Mr. Gernhardt an approp-
riate letter expressing the council's tranks for his valuable
services rendered as chairman of the Architectural Commission.

POSTPONE WIDENING OF ALGONQUIN ROAD: The Clerk
then read the following report:
Des Plaines, Illinois, March 20, 1944
To the Mayor and City Council
Your Committee on Streets -Sanitation has investigated the above
and has found: The need for a high speed highway in the center
of a strictly residential district is indeed a hazard and a
very grave error at this time.
We, your Committee on Streets and Sanitation therefore recommend:
The matter of widening Algonquin Road be indefinitely postponed
until the Cityof Des Plaines makes a formal request for the
widenirig of said highway.
