URGES PARTICIPATION IN TAX SALE CLAIMS: Mr.Frank Zaleski,attorney, then addressed the Council urging the City to file cross complaints to re- cover past due special assessments installments should any property in Des plains be sold at tax sales. CALL TO ORDER: The meeting was called to order by Mayor Hobart -M.Ahbe, presiding, with Aldermen Johnson, Henrich, Loos, Dopheide,Carlson, -Friott, Lemke and Campagna responding to the roll call. (Aldermen Carroll and Schwanbeck were absent during the entire meeting.) The Clerk reported eight aldermen present. Mayor Ahbe then stated that this is an adjourned regular 'meeting adjourned from Monday, May-6th,1940. PASS REVISED 1940 TAX LEVY ORDINANCE: The Cler • then read the following letter: See next page City of Des Plaines May 13,1940 The Honorable Mayor and City Council of the City of Des Plaines Gentlemen: Because the County Clerk, through error, certified to us the wrong assessed valuation it has become necessary to pass a new 1940 Tax Levy Ordinance to supercede the Tax Levy Ordinance for 1940 passed by the Council on May 6th,1940. The County Clerk originally supplied a certificate on April 19,1940 certifying the assessed valuation of the City of Des Plaines for 1939 (the latest available assessed valuation) of ::6,091,244, which was then used as a basis for the 194.0 Tax Levy Ordinance passed May 6th,1940. After carefully checking with the County Clerk I found the C'J error. The County Clerk readily admitted his error and immediately CNI supplied a certificate dated May 10,1940 giving the 1939 Assessed 7" Valuation of the City of Des Plaines as $5,082,315. Each member of the Council has been furnished with a galley proof of the revised draft of the 1940 Tax Levy Ordinance based upon the corrected valuation. 1 The new draft has been so arranged that the total of the 1940 Tax Warrants remains unaltered even though there is a difference in the amounts of tax warrants to be issued by the individual funds. M.<'I.Scott L4 Co., Inc. who purchased the 1940 Tax Warrants, as well as Holland M.Cassidy who is to approve the warrants have agreed to the changes. It is imperative that the new 1940 Levy Ordinance be passed tonight, in order that the final ordinance authorizing the issuance of Tax "Warrants may be passed at the regular Council meeting on May 2Oth,1940. The motion was made by Alderman Johnson and seconded by Henrich to suspend such rules of the Council as might prevent the passage of the said proposed ordinance at this meeting, and to place the said proposed ordinance upon its final passage. The Mayor put the question and the Clerk called the roll with the following result:Ayes; AIbrmen Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke and Campagna. Nays; None. The Mayor thereupon declared the motion unanimously carried, and the said proposed ordinance before the Council for final disposition. The motion was then made by Alderman Johnson and seconded by Carlson to finally pass and adopt the said proposed ordinance. SAFETY GATES FOR PEARSON', LEE AND GRACELAND CROSSINGS: The Clerk then read the following letter: DES PLAINES SAFETY COUNCIL April 30 1940 Mayor and City Council City of Des Plaines Des Plaines, Illinois Gentlemen: The following resolution was passed at our last regular meeting. WHEREAS, the matterof procuring the install- ation of gates at the Lee Street, Graceland Avenue, and. Pearson Street crossings of the C N W Railway has been brought before the Des Plaines Safety Council, and , WHEREAS the installation of the River Road gates has resulted in the prevention of accidents, at a- point where many fatalities have occurred. BE IT THEREFORE RESOLIM, that the Des Plaines Safety Council go on record as recommending that the City Council of the City of Les Plaines immediately demand action from the Illinois Commerce Commission, toward the installation of manually operated gates at the Lee Street, Graceland Avenue and Pearson Street crossings. AND BE IT FURTHER RESOLVED, That a copy of this resolution be transmitted to the City Council of the City of Des Plaines, Illinois. KI?ANIS DONATES REFUSE CONTAINERS: The Clerk then read the following letter: THE KI'?ANIS CLUB 02 DES PLS=INES May 8 1940 Hon.Mayor and City Council City of Des Plaines,I11. Gentlemen: For some time it has been apparent that there is a distinct need for equipment to assist our citizens in helping to keep our city clean. As an organization of business men, pledged to render effective service to our community, we are very happy at this time to announce that we are prepared to supply these badly needed refuse containers. `;e offer them as an outright gift and will agree to take care and maintain them and keep them looking sightly, if the city will agree to take care of having them emptied. It is our ambition to supply the city with a sufficient quantity to amply serve the needs of the city, and can make the first delivery of these refuse cans within the next few weeks. We have already had Marvin'`?ells, inspect a sample can, and he has expressed his approval with one or two slight changes in construction. C0NELL'S "CUM ERLANL EAST". Mayor Ahbe then called up for action the matter of the application for a permit for a sanitary sewer outlet for H.II.Cornell's "Cumberland East", action upon which was postponed by Council at its regular meeting held May 6th,1940. The Clerk introduced the matter by reading H.M.Cornell & Company s application and proposal as follows: H.M.Cornell & Co 176' \.Adams Street May 6 1940 City of Des Plaines Des Plaines, Illinois Gentlemen: At your Council meeting of April 1st a resolution was passed adopting a proposal for a :Pr project to install a sewer and street system in our Cumberland East Subdivision. This pro- posal was taken to the :':'PA office by your Engineer and the :'Triter and we were informed by Mr.McCullen that it would take a minimum of 60 days to get this project approved and that there was no assurance this project would ever be completed. ='Ie are, therefore, of the opinion that the proposal is un- workable as there is no assurance that the work could be completed in time for necessary use. At your Council meeting on April 15th a resolution was passed permitting us to install a sanitary sewer system by private contract in our Cumberland East Subdivision and to connect with the Cumberland sewer at 4th Avenue and Seegers Road by way of a sump pump. The cost of this private system to us would have been approximately ti 500.00 more than the ;IPA project. Because of opposition by Cumberland residents we have attempted to solve this sewage problem in another manner which should meet with no local opposition and which should serve the subdivision in an efficient manner. 317 H.M.Cornell & Co (contd) 7e attach hereto a plat showing the size of the sewer proposed with an outlet along the Soo Line Railroad to Teller Creek by way of a 12 inch tile from Seegers Road South. From Seegers Road North Golf Cul De Sac a 10 inch tile and on both North Golf Cul De Sac and South GolfCul De Sac a $ inch tile. The grades of the 8 and 10 inch tile to be approximately 4% while the grade of the 12 inch tile to be about approximately 6%. In presenting this proposal we want to call your attention specifically to the fact that we are called upon to create an outlet over 1000 feet from our property line and that this outlet is being paid for by us. We are also providing this outlet with a conrete head wall and back water gate for protection in times of excessive rain fall. In presenting this proposal we want you to know that its costs is in excess of c1.000.00 over the sump pump connection and is all this small subdivision of 69 lots will stand. Te trust this proposal will meet with the approval of the Council and that the necessary resolution will be passed at this meeting.
