284 MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON MONDAY, APRIL 1, 1940 AT THE HOUR OF 8:00 P.M. CALL TO ORDER: In the absence of Mayor Hobart M. Ahbe, the meeting was called to order by Edgar J. Friedrich, City Clerk with Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeckend Cam- pagna responding to the roll call. The Clerk then reported all aldermen present. DESIGNATION OF MAYOR PRO TEM: The motion was then made by Alderman Lemke and seconded by Alderman Schwanbeck that Alderman Carroll serve as Mayor pro tem for this meeting in the absence of Mayor Ahbe. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. Alderman Carroll then took the chair. REPORTS OF OFFICERS: The Clerk then presented the following reports: The report for March, 1940 of E.J. Friedrich, City Clerk The report for March, 1940 of C.M. Larson, City Treasurer The report for the first quarter (Jan. 1 to March 31st) of 1940 of C.M. Larson, City Treasurer The Chair ordered the said reports placed on file. THE JUDICIARY & ASSESSMENT COMMITTEE had no teport to offer. THE POLICE & LICENSE COMMITTEE had no report to offer. THE STREETS & SIDEWALKS COMMITTEE had no report to offer. THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS through its Chairman, Alderman Loos, reported orally on the matter of "Driveways" ref- erred to it December 4, 1939, and introduced a proposed ordinance which was given first reading by the Clerk and entitled: AN ORDINANCE GOVERNING THE CONSTRUCTION AND MAINTENANCE OF DRIVE7AYS OVER PARK- WAYS AND SIDEWALKS, AND REPEALING SEC- TIONS 282 TO 287, BOTH INCLUSIVE, OF THE MUNICIPAL CODE OF THE CITY OF DES PLAINES OF 1928. The Chair referred the said proposed ordinance to the Streets and Sidewalks Committee for further study and report. The Clerk then read the following report: To the Chairman Loos, Public Works, Buildings and Plats committee, at the meeting of the City Council, held March 18, 1940 the following matter was referred to your committee: The letter from the Des Plaines School of Music, C.A. Perry, director, dated march 18, 1940 was referred to your committee with full power to act. A copy of the said letter is typed upon the reverse side hereof. To the Mayor and City Council: 3-20-40 Your Committee on Public Works, Buildings and Plats has investigated the above and has found it to be a profit making school. We, your Committee, on Public Works, Buildings and Plats therefore recommend that the use of the City Hall be denied. Signed: F.A. LOOS J.W. LEMKE W. The motion was voted upon by acclamation whereupon the Chair declared the motion carried and the report concurred in. 285 The Committee on Public Works, Buildings and Plats through its chairman Alderman Loos then orally reported on the matter of inspection rates for signs over public sidewalks, and submitted a proposed ordinance which was read in its entirety for first reading by the Clerk, and bears the title: AN ORDINANCE AMENDING SECTIONS 213, 221, 222, 223, 248, 251, 253 AND 254 OF THE REVISED BUIL- DING CODE OF 1939 The motion was made by Alderman Loos and seconded by Alderman Carlson to suspend the rules and place this proposed ordinance on passage. The Chair put the question on the motion to suspend the rules and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Chair thereupon declared the motion carried, the rules suspended and the said proposed ordinance before the Council for final disposition. The motion was then made by Alderman Dopheide and seconded by Alderman Lemke to finally pass and adopt this proposed ordinance. The Chair put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeckand Campagna. Nays; None. The Chair thereupon declared the motion carried and the said ordinance passed. The motion was then made by Alderman Henrich and seconded by Alderman Loos to instruct the Clerk to cause this said ordinance to be published in the Des Plaines Journal. The motion was voted upon by acclamation whereupon the Chair declared the motion carried. THE SEWER, DRAINAGE AND SANITATION COMMITTEE: The Clerk then read the following report: To the Chairman Campagna, Swr. Drainge and San. committee, at the meeting of the City Council, held March 18, 1940, the following matter was referred to your committee: The request of the City of Park Ridge to reduce the charge for burning its garbage from a rate of $3.00 per ton to a substantially lower rate. E.J. Friedrich, City Clerk To the Mayor and City Council: 3/28/40 Your Committee on Swer. Drainage & San. has investigated the above and has found the above committee met on March 27th and discussed the matter at length and found that our present income is approximately $300.00 per month, and in view that we are quite capable of burning the garbage of Bark Ridge without material increase in the cost of, operations, We, your Committee on Sewer, Drainage and Sanitation therefore recommend that we offer for acceptance for the City of Park Ridge the following proposal: A 5 year contract at the Cost of $2.50 per ton. In the event that the transaction does not run 5 years, the City of Park Ridgewould be charged back to its original $3.00 rate. Signed: S. CAMPAGNA, Chairman FRED A. LOOS THEO. THE FIRE COMMITTEE, through its chairman, Alderman Dopheide, then submitted the following report: 286 To the Chairman Dopheide, Fire Committee, at the meeting of the City Council, held March 4, 1940, the following matter was referred to your committee: The letter from the Branigar organization addressed to the City Council dated March 1, 1940, was referred to your committee for study and recommendation. A copy of the said letter is typed upon the reverse side hereof. E.J. Friedrich, City Clerk To the Mayor and City Council: Your Committee on Fire has investigated the above and has found to report that a meeting was had with the Branigar Organization at which time this matter was discussed. It was agreed that 3 new hydrants be installed in the East section with new hydrants to be installed in the remainder of the subdivision, as the development of the west section requires. Signed: W. Nays; None. The Chair thereupon declared the motion carried and the said resolution adopted. REPORT OF BUILDING INSPECTOR: Frank F. Scharringhausen, Building Inspector, then submitted the following report: BUILDING INSPECTOR'S REPORT Due to the unfavorable weather conditions for building during the latter part of March, the permits were less than anticipated. Although comparing the total building permits for 1940 against 1939, for the first three months of each year, we are only about $3,400.00 behind last year. Total for 1st 3 mths of 1940 . . $103,918.00 Total for 1st 3 mths of 1939 . . $107,321.00 The first 3 months of 1940 vre had 19 new home permits as compared C{J with 21 for the first 3 months of 1939. During the first 3 months of 1940 there were issued 44 permits of which 19 were for new residences, the balance for alterations, garages �.� and a few miscellaneous permits. For the same period in 1939 there were issued 27 permits of which 21 were for new residences. For the same period in 1939 there were issued 14 permits of which 3 were for new residences. The average cost of homes based on the estimated cost on the 19 homes in 1940 $ 4,957.00 21 homes in 1939 4,849.00 3 homes in 1938 6,000.00 Signed FRANK F. Realtors Builders 176 W. Adams St. Chicago City of Des Plaines Des Plaines, Illinois Gentlemen: March 28, 1940 We hereby make application for permission to construct a sewer system in our Cumberland East Subdivision in accordance with plans and specifications of your City Engineer, E.N. Fletcher, on the two following proposed plans. Number one bang preferable if it can be worked out and number two as the alternative. 1 - For the City of Des Plaines to sponsor a WPA project if an easement can be obtained from the Soo Line Railroad, and if the Illinois Health Department will permit of a new connec- tion with Weller Creek at the Soo Line Railroad right-of-way. The labor to be furnished by the WPA and the materials fur- nished and paid for by this company as shown on the Engineer Fletcher's plan. Said sewer to be combination storm and san- itary sewer. This project is of no value to us unless it can be completed ready for service not later than July 1, 1940. 2 - To install by private contract and pay for by this company a sanitary sewer throughout the subdivision and to connect with the existing sewer at Seegers Road and 4th Avenue by way of a sump pump. Said pump to be furnished and operated by the City of Des Plaines. 288 There seems to be growing opposition by City Officials and citizens of Des Plaines to the septic tank method of sewage disposal. We believe that the City of Des Plaines should furnish this subdivision with a natural or artificial outlet to take the sewage, inasmuch as under plan #2 we agree to install the sewer system by private contract and pay for it, and in so doing, completely eliminate further use of septic tanks within the city limits. These matters were discussed and approved by your sewer and sanitary committee Wednesday night, March 27th. Yours very truly, H.M. CORNELL & COMPANY Signed: H.M. The motion was voted upon by acclamationwhereupon the Chair declared the motion carried. The motion was then made by Alderman Campagna and seconded by Alder- man Schwanbeck to also accept Proposition No. 2 of the foregoing letter provided, however, that the H.M. Cornell Co. furnishes and installs the sump pump referred to in the said letter. However, the motion was made by Alderman Johnson and seconded by Alderman Dopheide to refer this matter to the Council, sitting as a committee -of -the -whole for consideration at a meeting to be held Monday, April 8, 1940 at 8:00 P.M. The motion to refer was voted upon by acclamation whereupon the Chair declared the motion carried and the matter so committed. NON-RESIDENT FIRE PROTECTION: Alderman Dopheide, Chairman of the Fire Committee, then read the following: REPORT This Council adopted a Resolution on April 3, 1939 authorizing the Mayor and City Clerk to execute "Agreemtns for Fire Protection" in behalf of non-residents who do not contribute to the maintenance of the Paid Fire Department or the Volunteer Fire Department of the City of Des Plaines. This Resolution was adopted to solicit funds to combat the rising cost of maintaining the departments because of additional inter -city property which has come into being during the past two years and which requires this protection. The additional tax revenue from newly improved property has not kept pace with the additional pressure imposed upon the organization as evi- denced by records in the City Clerk's possession, which indicate that tax collections, while somewhat improved, still fall considerably short of the amount requiredto faithfully operate the departments. The purchase of new equipment has been dependent upon outside help and your Committee feels that this should not be necessary, Funds derived from the annual fire department ball could be used conveniently to purchase other much needed incidentals. After considerable thought and after various meetings and consultations, your Committee on Fire has concluded the following, viz: - To recommend to this Council that it instruct the City Clerk to write the following letter to the Fire Marshal of the Paid and Volunteer Fire De- partments of the City of Des Plaines immdediately: - Mr. Walter Lagerhausen, Fire Marshal Des Plaines Paid Fire Department and Des Plaines Volun .eer Fire Department Des Plaines, Illinois Dear Sir: Effective May 1, 1940, upon instructions of the City Council, you will inform allmembers of your Departrent that response to fire calls and fire alarms for fire protection be confined to the City of Des Plaines, and in addition thereto any other property outside of the City limits of the City of Des Plaines, only where Fire Protection Agreements have been signed and the contracts consummated. Please govern yourself accordingly. 289 Your Committee further conveys that it has no desire to impose a hardship on non-residents and earnestly recommends, and in fact, solicits contracts with all non-residents nct already accounted for. -lith only 10% of non-residents presently signed up and no new contracts coming in, their participation is urge3inmediately and in no event later than May 1, 1940. HAZARD AT RAND ROAD & MINER STREET: The Clerk then read the fol- lowing letter: C� C4 Mr. Edgar J. Friedrich, r-+ City Clerk City Hall 't Des Plaines, Illinois 1 Dear Sir: DIVISION OF HIGHWAYS Mar. 27,1940 'Phis is in reply to your letter of March 5 in regard, to the traffic hazard at the intersection of Rand Road and Miner Street. We have made an investigation and found that Rand Road (U.S. 12) passes through a residential district at this location and that there are no posted speed limits. Therefore we have decided to establish a 35 mile per hour speed limit from the intersection of Rand and. River Roads south to where the present 35 mile limit ends, w::_ich is about one-half mile south of Dempster street. It is our opinion that this will eliminate the hazard at this intersection as it was found that a speed of 50 miles per hour is common. COMPLAINT REGARDING UNFINISHED BUILDINGS: The Clerk then read the following letter: DES PLAINES VILLAS CIVIC CLUB April 1, 1940 Mr. Frank Scharringhausen, Building ComrnTssioner Des Plaines, Illinois Dear Mr. Scharringhausen: The above organization has asked me to call your attention to the dangerous condition of the uncompleted buildings on West Grant Drive in our Subdivision. These buildings are not even half completed and becaure of their standing so long without protection from the ele- ments they are gradually disintegrating and likely to cave in any day. As you are probably aware such buildings attract children as a place to play and daily children Prom all parts of Des Plaines are playing games in and around them. The,,.,-t.itute an attractive nuisance of the most dangererous kind andshould be torn down and the excavations filled in promptly before some child is seriously damaged. The purpose of this Tag Day will be to secure funds for the local Baby Clinic, and all proceeds from this Tag Day will be turned over to the said clinic. The sale will be sponsored by a local Committee of clergyren, club -women, and other prominent citizens, and organized by our representative, Mrs. Hazel Ferber. All our services to the blind, as =.ell as our Braille magazine, are avialable free to the sightless. The Brotherhood's Central States Headquarters is located in Chicago, from where the organization serves the sightless in this State. The enclosed copy of our Founder's Report gives further details about our organization and activities, should you wish them. We are sure the citizens of Des Plaines will again welcome the opportunity to give support to this worthy cause; and we trust you will grant our request. S.A. #29 and#100 - BLOCK 2 IN RIVER ADDITION: The Clerk then read the following proposed resolution: RESOLUTION WHEREAS, there was entered on September 23, 1929, an order in the County Court of Cook County in Des Plaines Special Assessment Warrints No. 29 and No. 100, affecting Block 2 in River Addition to Des Plaines, and WHEREAS� KENNETH G. MEYER, the City Attorney of this City, is also the owner of the South 122 ft. of Block 2 in River Addition, and WHEREAS, the purpose of said orders of September 23, 1929 affecting said premises,were intended as division orders, but because of the wording thereof, they do not in fact have the effect of division orders, and WHEREAS, the said KENNETH G. MEYER paid the assessments levied against the South 122 ft. of Block 2 in River Addition for the first to the sixth installments, Warrant #29 and the first and third installments, *War- rant =100, as purported to have been divided by said orders of September 23, 1929, and WHEREAS, the orders heretofore entered were not consented to by the City Council of the City of Des Plaines, and WHEREAS, the Chicago Title and Trust Company refuses to honor such orders because of the lack of such consent. NOW THEREFORE, BE IT RESOLVED by the City Council that it consent to the entry of a division order affecting the aforedescribed premises and said warrants. BE IT FURTHER RESOLVED by the City Council that the amounts here- tofore paid by the said KENNETH G. MEYER in satisfaction of the first six installments, `:Tarrant #29, and the first and third installments of 'arrant #100 on the South 1.2.2 ft. of Block 2 in River Addition, be considered as full satisfaction of the assessment lien levied against said South 122 ft. of Block 2 in River Addition for said installments. BE IT FURTHER RESOLVED that a copy of this resolution be attached to the petition for division of the assessments heretofore referred to. The motion was made by Alderman Henrich and seconded by Aldeman Dopheide to adopt the said proposed resolution. APPROVAL OF MINUTES: Each member of the Council having been supplied with a copy of the minutes of the regualr Council meeting held Monday, March 18, 1940, the motion was made by Aldeman Carlson and seconded by Alderman Dopheide to approve the said minutes as submitted. SUGGESTS CLEANING LEE-THACKER UNDERPASS: Alderman Dopheide called the Council's attention to the need for systematic and regular cleaning of the Lee -Thacker Pedestrian Underpass. The Chair referred this matter to the Superintendent of Streets. ADJOURNMENT: The motion was made by Alderman Lemke and Seconded by Alderman Schwanbeck to adjourn.
