10/30/1939203 MINUTES OF A SPECIAL COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON THE 30th DAY OF OCTOBER, 1939 AT THE HOUR OF 8:00 P.M. CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Johnson, Carroll, Henrich, Loos, Dopheide, Friott, Schwanbeck and Campagna responding to the roll call. (Alderman Carlson and Lemke were absent during the entire meeting). The Clerk re- ported a quorum present. READING OF THE CALL FOR SPECIAL MEETING: The Clerk then read the following call for special meeting and waiver of notice: October 27, 1939 To the members of the City Council of the City of Des Plaines Gentlemen: You are hereby notified that upon order of Mayor Hobart M. Ahbe, there will be a special meeting of the City Council of the City of Des Plaines at 8 P.M. Monday, Octo- ber 30, 1939 in the council chambers for the purpose of making an additional appropriation for the Motor Fuel Tax Section 6 CS (widening of Pearson Street), and to consider such other matters of city business as may need attention. Fletcher SECTION 6 -CS: The Clerk then Supplemental #3 RESOLUTION FOR IMPROVEMENT BY MUNI- ' CIPALITY UNDER THE MOTOR FUEL TAX LAW. BE IT RESOLVED by the Council of the City of Des Plaines, Illinois, following described street be improved under the motor Fuel Tax PERSON STREET, which also known as Arterial Street No. 5 from Thacker to River Road, a dista nce of approximately feet, and BE IT FURTHER RESOLVED, that the proposed improvement consist of widening with concrete pavement and curb and gutter. Note: See Resolution 1017 38 appropriating $7,500.00 See Resolution 3 13 39 appropriating 1,500.00 See Resoltuion 8/7 39 appropriating 6,500.00 construction 16 feet wide and shall be designated as Section 6 -CS. That there is hereby appropriated the additional sum of Three Thousand Five Hundred and no/100 - - - -(83,500.00) for the improvement of said section from the municipality's allotment of Motor Fuel Tax funds. That said work shall be done by contract; and, BE IF FURTHER RESOLVED, that the Clerk is hereby directed to transmit two certified copies of this resolution to the Department of Public Works and Buildings, Division of Highways, through its District Engineer's office at Chicago, Illinois. The motion was made by Alderman Johnson and seconded by Alderman Dopheide to adopt this proposed resolution. The motion was voted upon by acclamation whereupon the Mayor declared the motion unanimously carried and the said resolution adopted. CHANGE ORDER - READVERTISING MFT SECTION 6 -CS: The Clerk then read the following proposed resolution: RESOLUTION (Motor Fuel Tax Section 6 -CS) WHEREAS, subsequent to an award made October 2, 1939 by the City Council of the City of Des Plaines, the Mayor and City Clerk on October 5, 1939 entered into a contract with Milburn Bros., Inc., in the total sum of $16,891.31 for the construction of Motor Fuel Tax Section 6 -CS, also known as the widening of Pearson Street, and WHEREAS, the State Highway Department did on October 16, 1939 for- mally approve the said award and contract, and WHEREAS, it now appears that the cost of the following items included in the said contract are substantially in excess of the engineer's estimate therefor, namely: APPROX. UNIT ITEMS QUANTITY PRICE AMOUNT Concrete Light Standards with Bracket 4 each $135.00 $ 540.00 Reflector -refractor Luminaries 4 each 70.00 280.00 ff6-5000 Volt Calbe (single conductor) 1000 1nFt. .43 430.00 Series Transformers 4 each 85.00 340.00 #10-600 Volt Flat Twin Type Pole Cable 120 lnl't. 1.25 150.00 $ 1,740.00 THEREFORE BE IT RESOLVED, by the City Council of the City of Des Plaines that the said items totalling $1,740.00 be and the same are hereby deducted from the said contract with Milburn Bros., Inc., for the construction of Motor Fuel Tax Section 6 -CS; and that the City Engineer be and the same is hereby authorized and directed to file with the State Highway Department the necessary change order covering the said deduction, and BE IT FURTHER RESOLVED, that the City Clerk be and the same ishereby authorized and directed (subject to approval of the State Highway Department) to re -advertise for bids for the said items in the Des Plaines$oJurban Mmes ADOPTED by the City Council of the City of Des Plaines this day of A.D. 1939. 205 The motion was made by Alderman Johnson and seconded by Alderman Carroll to adopt this proposed resolution. The motion was voted upon by acclamation whereupon the mayor declared the motion unanimously carried and the said resolution adopted. REJECT CLAIM OF EDWIN BRANDT: The Clerk then read the fol- lowing report: To Kenneth G. Meyer, City Attorney, at the meeting of the City Council, held October 16, 1939, the following matter was referred to you: The letter of Edwin Brandt, 5723 N. Menard Ave. Chicago, Ill- inois, claiming damages in the sum of $6.75 for damage to his automobile caused by striking manhole projecting above street level. You will find a copy of the said letter typed on the reverse side hereof. Signed: E.J. Friedrich, City Clerk. To the Mayor and City Council: Your Attorney has investigda d the above and has found that the street upon which the accident occurred was under construction and in the absence of any barricades or signs indicating that travel on the street was at the risk of the driver, 1 am of the opinion that the City Cei is liable and the claim is just and should be paid. I, your Attorney, there recommend payment of the claim of $6.75. Signed: Kenneth G. Meyer, City Attorney The motion was made by Alderman Dopheide and seconded by Alder- man Carroll to reject the recommendation contained in this report and deny the said claim. The motion was voted upon by acclamation whereupon the Mayor declared the motion unanimously carried and the said claim denied. APPROVE PLAT OF "CUMBERLAND EAST": The Clerk then submitted for approval a plat entitled: H.M. Cornell's CUMBERLa'_ND EAST Being a Subdivision in the SW of Section 8, Township 41 North, Range 12 East of the 3rd ±'rincipal meri- dian in Uook County, Illinois. The motion was made by Alderman Dopheide and seconded by Alder- man Johnson to approve the said plat, and to authorize and direct the Mayor and City Clerk to sign the said plat for and in the name of the City of Des Plaines. The motion was voted upon by acclamation whereupon the mayor declared the motion unanimously carried and the said plat approved. AUTHORIZE RECOVERY OF BACK TAXES: Kenneth G. Meyer, City Attorney, then reported that he has been in touch with a law firm which offers to make the necessary audit of the County Treasure's books on a 2O7. contingent basis and recover such back taxes as have been col- lected by the County Treasurer for the City of Des Plaines, and have not been re-rnitted. The motion was made by Alderman Henrich and seconded by alderman Carroll to instruct the City Attorney to notify the law firm in question that the City Council is in favor of the plan suggested. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ADJOURNMENT: The motion was made by Alderman Schwanbeck and seconded by Alderman Johnson to adjourn.
