Alderman Schwanbeck requested that the claim of Marold 0. tibbitts, in
the sum of $813.49 be stricken from the resolution, whereupon the motion was
made by Alderman Johnson and seoonded by Alderman Carroll to strike the claim
of Harold 0. Tibbitts as requested and to adopt the said resolution as amended.
The Mayor put the question and the Clerk called the roll with the following
result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, uarlson,
Friott, Lemke, Schwanbeck and Campagna. The Mayor thereupon declared the
motion carried and the resolution adopted as amended.
APPROVAL OF MINUTES: Each member of the Council having been sup-
plied with a copy of the minutes of the regular Uouncil meeting held Monday,
July 24, 1939, the motion was made by Alderman Carroll, and seconded by
Alderman Jchwanbeck to approve the said minutes as presented. The motion
was voted upon by acclamation whereupon the Mayor declared the motion car-
ried and the said minutes approved.
FILLING KATION DRIVEWAYS DANGEROUS: Alderman Loos called the
Council's attention7the hazard created by permitting an unnecessarily wide
expanse of driveways to filling stations, and permitting cutting away too
much curb at such driveways, especially at corners. He cited the Standard
Oil Station on the northeast corner of Lee Street and Prairie Avenue as a
typical example of such a hazard. The motion was made by Alderman Loos
and seconded by Alderman Dopheide to refer this matter to the Streets and
Qidewalks Committee for investigation, and report at the next regular
meeting of the Council. The motion was voted upon by acclamation where-
upon the Mayor declared the motion carried.
MOTOR -SCOOTER & BICYCLE HAZARDS: Upon the request of Alderman
Loos, Mayor Ahbe referred to the Police Committee the matter of abating
the hazards created by careless bicycle and motor -scooter riders, many of
whom ride after dusk without lights.
TRAFFIC HAZARDS AT MINER STREET & DES PLAINES AVE: Upon the request
of Alderman Loos, Mayor Ahbe referred to the Streets & Sidewalks Committee
the matter of proper signing at Des Plaines Avenue and Miner Street to
prevent numberous "left turn violation by drivers coming west on Miner St.
and turning left to proceed southward on Des Plaines Avenue; also the matter
of studying the "stop and go" traffic control light at the southwest corner
of Des Plaines Avenue and Miner street with a view toward a better control
of traffic at that point.
ASKS C00PERATION IN WEED CUTTING: Alderman Dopheide publicly ap-
pealed to the press asking that the press seek the cooperation of the public
in cutting weeds, especially on vacant lots.
ADJOURNMENT: The motion was made by Alderman Schwanbeck and
seconded by Alderman Lemke that the Council adjourn. The motion w as voted
upon by acclamation whereupon the Mayor declared the motion carried and the
Council regularly adjourned.

PLAINES HELD IN THE COUNCIL CHAMBERS
ON MONDAY, AUGUST 21, 1939 AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor
Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich,
Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna
responding to the roll call. The Clerk reported all members of the
Council present.
REPORTS OF STANDING COMMITTEES: None of the standing com-
mittees of the Council had reports to offer.
ASK TO APPOINT RELIEF FIREMAN: The motion was made by
Alderman Dopheide chairman of the Fire Committee to instruct the Clerk
to give written notice to the Fire and Police Commission to appoint
a relief fireman from its eligibility list for firemen. The motion
was voted upon by acclamation whereupon the Mayor declared the motion
carried.

This cause coming on to be heard upon the petition to annex
to the City of Des Plaines the following described territory, to -wit:
Lots two (2) and three (3) in Owner's Division
of that part of the South 25.67 Chains of the
South West Quarter (Sit) of Section 8 (8), Town-
ship forty-one (41) North, Range Twelve (12),
East of the Third Principal Meridian, lying
South of the Center line of Rand Road and West
of the West line of the Chicago and Wisconsin
Railroad, in Cook County, Illinois;

and the court being fully advised in the matter having heard the
testimony of witnesses and the arguments of counsel doth find:
1. That the petition praying for the annexation of
the aforesaid real estate was filed in this court on the 28th day
of July, A.D. 1939.
2. That notice of the filing of said petition and of the
hearing on said petition was duly given according to law by publish-
ing notice thereof in a newspaper in the City of Des Plaines, Cook
County, Illinois, and by posting in five of the most public places
in the territory sought to be annexed and by delivering a copy there-
of to the City Clerk of the City of Des Plaines all on the 3rd day
of August, A.D. 1939, which said date was more than fifteen days
prior to the date fixed for the hearing on said petition.
3. That the land sought to be annexed and described in
the petition in this cause and in this order is contiguous to the
City of Des Plaines and is not within the limits of any other vil-
lage of city.
4. That said petition filed in this cause is signed by
the requisite number of legal voters and property owners as required
by law and that said petition in all respects conforms with the
requirements of an act entitled "An Act Provided for Annexing and
Excluding Territory to and from Cities, Towns, and Villages and that
Unites Cities, Towns, and Villages, Approved April 10, 1872, as
Amended."
NOW THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED by the
court that the territory described as follows, to -wit:

The following letter was then read by the Clerk:

Gentlemen:
Your attention is respectfully called to the following resolution
passed at a meeting on August 15th o f the Board of Directorsof
the Cumberland Maintenance Corporation regarding petition to an-
nex Cumberland East to Des Plaines:
"Pursuant to resolution passed by a meeting on August 10
of member of the Cumberland Maintenance, which enjoys a
paid membership of 90/ of residents in Cumberland, the Board
of Directors conveys the following resolution to the City
Council of Des Plaines and to the Federal Housing Adminis-
tration district office at Chicago.
dHEREAS there is a petition before the City Council by H.M.
Cornell to annex to the City a subdivision identified as
Cumberland East, and
WHEREAS it is understood that improvements are expected to
be petitioned regarding streets and connection into existing
city water mains and combination storm and sanitary sewers
in Cumberland, and
WHEREAS this combination storm and sanitary sewers, paid by
special assessments spread over Cumberland alone, has proven
inadequate to handle storm sewerage without experiencing back-
flow of sanitary sewerage into basements even in the present
incompletely developed state of Cumberland properties, there-
for be it
RESOUVED that the Cumberland Maintenance Corporation hereby
recommends to the Des Plaines City Council approval of the
annexation of Cumberland East, however, with the reservation
that any petition covering connections of any sanitary or storm
sewers to the existing Cumberland sewers be refused on the basis
of inadequate present capacity of the existing sewer system.
Also upon petion of street improvement for Cumberland East, when
redeived, we respectfully direct the City Council's attention
to a resolution passed by this Corporation on July llth and con-
veyed to the Council by letter of July 21, covering completion
of half streets bounding Cumberland; and recommend improvement
of the 4th Avenue between Golf and Seegers Roads, now half -paved
with a concrete stip 16' -feet wide, Le complete with concrete
identical specification to a width of 24 feet when approval of
street improvements for this subdivision are made by the City
Council."

Alderman Carroll to suspend the rule and place the proposed annexation
ordinance on final passage. The Mayor put the question upon the motion
to suspend the rules and the Clerk called the roll with the following

son, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor
thereupon declared the motion carried, the rules suspended and the pro-
posed ordinance before the Council for final disposition.

The motion was then made by Alderman Johnson and seconded by Alderman
Carroll to finally pasa the said proposed ordinance. However, the motion was
made by Alderman Carroll and seconded by Alderman Johnson to refer the said
proposed ordinance to the Council sitting as a Committee -of -the -whole on Mon-
day, August 28, 1939 at 8:00 P.M. The motion to so commit was voted upon by
acclamation whereupon the Mayor declared the motion to commit carried.
DUAL SEWER ORDINANCE: The Clerk then read for first reading a pro-
posed ordinance entitled:

The motion was made by Alderman Johnson and seconded by Alderman

the motion carried and the said proposed ordinance so referred.
ORDINANCE REGULATING DOGS: The Clerk then read for second reading
a proposed ordinance entitled:

The motion was made by Alderman Lemke and seconded by Alderman Car-
roll that the said ordinance be passed, and published in the Des Plaines
Suburban Times. The Mayor put the question and the Ckerk called the roll
with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos,
Carlson, Lemke, Schwanbeck and Campagna. Nays;- Aldermen Dopheide and Friott.
The Mayor thereupon declared the motion carried and the said ordinance passed.

WATER IN FRONT OF GEISEN'S GARAGE: Alderman Johnson requested that the
Clerk write the State Highway Department asking the state to correct the drainage
on Northwest Highway so as to eliminate the puddle of water which is usually
found in front of Geisen's garage after each rainfall.
C & NW. CROSSING AT DES PLAINES AVENUE: Alderman Loos asked that the
Clerk write the C & NW Railroad requesting that the crossing at Des Plainesbe
satisfactorily repaired.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded by
Alderman Carroll to adjourn. The motion was voted upon by acclamation whereupon
