MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS ON MONDAY., AUGUST 7. 1939 AT THE HOUR OF 8:00 P.M. CAIJ TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Henrich, Loos, 1)opheide, Carlson, .'riott, Lemke, achwanbeckand Campagna responding to the roll call. The Clerk reported all members of the Council present. REPORTS OF OFFICERS: The Ulerk then submitted the following reports: The report for July, 1939 of E.J. Friedrich, City Clerk The semi-annual report for the first half of 1939, of E.J. Friedrich, City Clerk The report for July, 1939 of Chas. M. Larson, City Treasurer The reports were ordered placed on file by the Mayor. THE JUDICIARY & ASSESSMENT COMMITTEE had no report to offer. THE POLICE & LICENSE COMMITTEE had no report to offer. THE STREETS & SIDEWALKS COMMITTEE had no report to offer. THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS, through its Chairman Alderman Loos, reported that a decision has been reached to do nothing about the old Riverview Hall until the WPL.is through using it, at which time steps will be taken to wreck the building. The Committee further reported through its chairman, Alderman Loos, that permission has been granted the Des Plaines 4oman's Club to use the 'ouncil Chambers for holding its meetings as requested in a letter recorded in the Council proceedings of July 17, 1939. THE SEWER, DRAINAGE AND SANITATION COMMITTEE: reported through its chairman, Alderman 'ampagna, that the Dog Pound has been satisfactorily repaired. THE FIRE COMMITTEE had no report to offer. THE BAND COMMITTEE had no report to offer. AMENDING DOG ORDINANCE: The Clerk then read in its entirety for second reading a proposed ordinance entitled: AN ORDINANCE TO LICENSE AND REGULATE THE KB'EPING OF DOGS AND DOG KENNELS IN THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS, AND REPEALING SECTIONS 1113 TO 1128 BOTH INCLUSIVE OF ARTICLE I, AND SECTIONS 1129 TO 1137, BOTH INCLU- SIVE OF ARTICLI II OF CHAPTER 25 OF THE MUNICIPAL CODE OF THE CITY OF DES PLAINES OF 19 28 . 167 Mayor Ahbe referred this proposed ordinance to the Council sitting as a committee -of -the -whole on Monday August 21, 1939 at 8:00 P.I. SOLICITORS' ORDINANCE: The Clerk then read for first reading the following proposed ordinance: AN ORDINANCE PROVIDING FOR THE LICENSING OF SOLICITORS WHEREAS, it is deemed advisable and to the best interests and welfare of the citizens of Des Plaines that all persons who solicit from door to door within the City of Des Plaines be registered with the De- partment of Police; and WHEREAS, such registration will permit an accurate record to be kept of all persons desiring to solicitor canvass within the City of Des Plaines and serve as a protection against undesirables or persons with criminal records soliciting or canvassing within the City; THEREFORE, BE IT ORDAINED by the City Council of the City of Les Plaines, Cook County, Illinois:' SECTION 1. SOLICITOR DEFINED. Solicitor or solicitors are here- by defined as transient merchants or transient vendors; or any person sol- iciting orders for the sale of any articles or things in the City of Des Plaines to be delivered in the future; or advertising for or soliciting orders, donations, gifts or customers for any association, organization, firm, establishment, person, corporation, or business not residing in or located within the City of Des Plaines. SECTION 2. APPLICATION FOR PERMIT TO SOLICIT. All applicants for a permit to solicit within the City of Des Plaines shall execute an application blank at the office of the Police Department of the City of Des Plaines which application blank shall give the applicant's name, address, place of birth, age, height, weight, color of hair and eyes, place of and state of nativity, and telephone number; the name of the firm, company, organization or association which he or she represents; the make of automobile and license number of the automobile, if any, to be used while making such solicitations; the articel or articles to be solicited; or purpose for which solicitation is to be made. SECTION 3. No permit shall.be granted until said application is signed and receives the written approval of the Chief of Police or other officer of the Police Department, whose duty it is to examine such appli- cants and the applicant is finger -printed and a permit fee of One ($1.00) Dollar is paid to the Clerk of the City of Des Plaines. SECTION 4. DURATION OF PERMIT. A permit to solicit within the City of Des Plaines shall give the applicant the right and privilege of soliciting within the City of Des Plaines for the purposes named in such application for a period of thirty (30) days from the date of said permit. SECTION 5. It shall be unlawful for any persons or person to call at any residence or place of business within the City of Des r'laines with the intent or purpose of soliciting as provided in this ordinance without having in his or her possession a permit authorizing such sol- icitation. SECTION 6. No permit shall be in the possession of any person other than the one to whom said permit is issued. SECTION 7. Any person violating any of the provisions of this ordinance shall be fined not more than Two Hundred ($200.00) Dollars and every day that a violation occurs shall be deemed a separate offense. SECTION 8. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED this day of A.D. 1939 City Clerk APPROVED this day of A.D. 1939 168 The motion was made by Alderman Henrich and seconded by Alder- man Carroll to suspend the rules and place the said proposed ordinance upon its final passage. The Mayor put the question on the motion to suspend the rules and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwanbeck and Campagna. Nays; None. The Mayor thereupon declared the motion carried, the rules suspended, and the proposed ordinance before the Council for final disposition. The motion was then made by Alderman ''arroll and seconded by Alderman Johnson to finally pass this proposed ordinance and order the same published in the Des Plaines Suburban Times. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Carroll, Johnson, nenrich, Loos, Dopheide, Carlson, Friott, Lemke, Schwan- beck and Campagna. Nays; None. The Mayor thereupon declared the motion carried and the said ordinance passed. ANNA SCHWIESOW vs. CITY= Kenneth G. Meyer, City Attorney pre- sented a bill from Dr. Edward Miers for physicians services in the sum of $35.00 in connection with injuries suffered by Anna Schwiesow as set forth in a claim recorded in the Council proceedings of November 7, 1938. The City Attorney stated that Mrs. Schwiesow has offered to settle her claim for an amount equal to the $35.00 doctor's bill. The motion was made by Alderman Dopheide and seconded by Alderman uarroll to deny the claim and reject the said offer of settlement. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. PEARSON STRUT - SUPPLEMENTAL APPROPRIATION: The City Engineer then submitted the following proposed resolution which was read by the Clerk: SUPPLEMENTAL RESOLUTION FOR IMPROVEMENT BY MUNICIPALITY UNDER THE MOTOR FUEL TAX LAW BE IT RESOLVED, by the City Council of the City of Des Plaines, Illinois that the following described street be improved under the Motor Fuel Tax law: PEARSON ST., which is also known as Arterial Street No. 5 from Thacker To River Rd. a dis- tance of approximately ft. and, BE IT FURTHER RESOLVED, that the proposed improvement consist of widening with concrete pavement and curb and gutter construction 16 feet wide and shall be designated as Section 6 CS. That there is hereby ap- propriated the additional sum of $6,500.00 for the improvement of said section from the municipality's allotment of Motor Fuel Tax funds. That said work shall be done by contract; and BE IT RURTHER RESOLVED, that the Clerk is hereby directed to transmit two certified copies of this resolution to the Department of Public Works and Buildings, Division of Highways, through its District zngineer's office at Chicago, Illinois. Fletcher, City Engineer, then submitted plans for concrete walks along the west side of Wolf Road in Branigar's Cumberland Terrace as outlined in the following letter: MT. Swanbeck, Chairman Streets cc Sidewalks Committee City of Des Plaines, Illinois Dear air: We hereby request, permission to instal a concrete sidewalk constructed to meet requirements of city ordinance, running from a point at the south- west corner of Golf and Wolf Roads, south along the west line of Wolf Hoad, to a point 165 feet south of the southwest corner of Washington St. and Wolf noad. We plan to commence this work immediately upon receipt of a permit there- for. Respectfully yours, Signed: HARVEY W. Prospect Realty Trust, owner of Branigar's Cumb- C\I erland Terrace, a permit to construct a concrete sidewalk in accordance with 471- the above letter and the plans submitted. The motion was made by Alderman Henrich and seconded by Alderman Dopheide to instruct the City Attorney to contact the Federal Housing Admin- istration and attempt to have the requirements regarding sidewalks in Cumb- erland Terrace removed, in order that the hazard of intermittent sidewal 1 may be avoided. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. PROVIDING OFFICE FOR BUILDING INSPECTOR: The motion was made by Alderman Henrich and seconded by Alderman Friott to instruct the t'ommittee on Public Works, Buildings and Plats to assign and properly equip an office in the Municipal Building for the Department of Building Control and Inspec- tion. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. REPORT OF ZONING BOARD OF APPEALS: The Clerk then read the fol- lowing letter: July 21, 1939 Honorable Mayor and City Council, City of Des Plaines, Des Plaines, Illinois Honorable Sirs: The Zoning Board of the City of Des Plaines, Illinois, acting upon the request of your Honorable Body, held a public hearing on July 14, 1939, in the Municipal Building on the Petition of Mr. B.W. Bennett of 674 Laurel Avenue. Mr. Bennett asked that steps be taken to protect the vicinity of his home against remodeling of single family dwellings into two flat buildings. The Zoning Board interpreted the present Ordinance as being adequate to protect Mr. Bennett's property, inasmuch as the Or- dinance states definitely that the area known as Des Plaines Manor Tract j1 is excepted from the provisions of the Ordinance permitting the erection of more than single family dwellings in residential districts. A copy of my letter of even date to City Attorney Kenneth G. Meyer is more fully explanatory. However, in view of the Merrill versus Village of Wheaton case, with which your Honorable Body is familiar it appears that a more stringent definition of a single family must be made in order that Zoning Ordinances such as ours may be legally supported. 169 170 I have therefore, asked Attorney Meyer to prepare a draft of a Zoning Ordinance worded in such a manner that our intent to restrict the usage of certain localities in the Lity to single family occupancy may be supported. Pending reply from Attorney Meyer, this phase of the Zoning Board's report is complete. The Zoning Board also heard the Petition of the Mt. Prospect Realty Trust in relation to the zoning of Lots 1 to 5 in Block 11 and Lots 3 to 6 in Block 1 in Branigar's Cumberland Terrace. Mr. Richard Branigar, his attorney, and a small group of interested citizens were present. After exhaustive investigations in which numerous questions were answered by Mr. Branigar and others, the Board voted unanimously to permit the zoning of Lots 1 to 5 in Block 11 for commercial purposes. Recommendation that this be done by ordinance is hereby made. Petition for re -zoning Lots 3 to 6 in Block 1 was denied by unanimous vote by the Board. The re -action of the Board in this matter is supported by the fact that at the present time there are sixty new dwellings in the subdivision and it was con- sidered that the families residing there have need for a small commercial area. In spite of the fact that a considerable increase in the population of this area is anticipated in the near future, the Board felt that the zoning of five lots is adequate for some- time to come. Cornell Cumberland Subdivision (completely improved), with particular attention that the one-half paved streets bounding this subdivision be fully paved as an initial requirement towards improvement of or annexation and improvement of adjacent property before being approved by the City of Des Plaines. This coveys those State highways under the joint jurisdiction of the City of Dee Plaines and this Department where we may contract for maintenance. To make the agreement effective, it must be approved by the City Council, be signed by the Mayor and the Clerk and bear the corporate seal. The certificate at the bottom of the contract must be filled in, signed and sealed. When the City has approved these copies, please return all of them to me for final completion, When State signatures are secured "II a completely signed copy will be returned for your records. When this is returned you will also receive instructions for billing and forms to be used in submitting these bills. Tibbitts as requested and to adopt the said resolution as amended. The Mayor put the question and the Clerk called the roll, with the following result: Ayes; Aldermen Carroll, Johnson, Henrich, Loos, Dopheide, 'arlson, Friott, Lemke, Schwanbeck and Campagna. The Mayor thereupon declared the motion carried and the resolution adopted as amended. APPROVAL OF MINUTES: Each member of the Council having been sup- plied with a copy of the minutes of the regular Council meeting held Monday, July 24, 1939, the motion was made by Alderman Carroll, and seconded by Alderman Jchwanbeck to approve the said minutes as presented. The motion was voted upon by acclamation whereupon the Mayor declared the motion car- ried and the said minutes approved. FILLINGATION DRIVEWAYS DANGEROUS: Alderman Loos called the Council's attention7the hazard created by permitting an unnecessarily wide expanse of driveways to filling stations, and permitting cutting away too much curb at such driveways, especially at corners. He cited the Standard Oil Station on the northeast corner of Lee Street and Prairie Avenue as a typical example of such a hazard. The motion was made by Alderman Loos and seconded by Alderman Dopheide to refer this matter to the Streets and bidewalks Committee for investigation, and report at the next regular meeting of the Council. The motion was voted upon by acclamation where- upon the Ma.yor declared the motion carried. MOTOR -SCOOTER & BICYCLE HAZARDS: Upon the request of Alderman Loos, Mayor Ahbe referred to the Police Committee the matter of abating the hazards created by careless bicycle and motor -scooter riders, many of whom ride after dusk without lights. TRAFFIC HAZARDS AT MINER STREET & DES PLAINES AVE: Upon the request of Alderman Loos, Mayor Ahbe referred to the Streets & Sidewalks Committee the matter of proper signing at Des Plaines Avenue and Miner Street to prevent numberous "lef* turn" violation by drivers coming west on Miner St. and turning left to proceed southward on Des Plaines Avenue; also the matter of studying the "stop and go" traffic control light at the southwest corner of Des Plaines Avenue and Miner otreet with a view toward a better control of traffic at that point. ASKS COOPERATION IN WEED CUTTING: Alderman Dopheide publicly ap- pealed to the press asking that the press seek the cooperation of the public in cutting weeds, especially on vacant lots. ADJOURNMENT: The motion was made by alderman Schwanbeck and seconded by Alderman Lemke that the Council adjourn.
