MINUTES OF THE ADJOURNEDOMETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES HELD IN THE COUN-
CIL CHAMBERS ON MONDAY, APRIL 24,
1939 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order by
Mayor att t Ahbe, presiding, with Aldermen Carroll, Johnson,
Henridla VoloYelde, Lemke, Friott, Campagna and Schwanbeck
responding to the roll call. The Clerk pro tem reported all
members of the council present.
DESIGNATE CITY CLERK PRO TEM: The Clerk then read
a proposed ordinance entitled:
AN ORDINANCE DESIGNATING
A CITY CLERK PRO TEM
WHEREAS, Edgar J. Friedrich, the duly elected,
qualified and acting City Clerk of the City of Des Plaines
is unable to attend to his official duties as City Clerk
because of illness; and
WHEREAS it is essential to the proper functioning
of city affairs that a City Clerk pro tem be appointed to
exedute and fulfill the duties of the City Clerk during the
temporary absence of the said City Clerk from his said official
duties;

THEREFORE, BE IT ORDAINED by the City Council of
of Des Plaines, Cook County, Illinois:
Section 1. That Pearl Koelling be and is hereby
as City Clerk pro tem, of the City of Des Plaines;
Section 2. That the said Pearl Koelling, City Clerk
pro tem, is hereby vested with the powers and duties accompanying
the office of the City Clerk of the City of Des Plaines, and
is hereby granted the power and authority to execute on behalf
of the City all warrants, contracts, purchase orders, certifi-
cates, bonds,' vouchers and other documents which would require
the signature of the City Clerk and to affix the City seal to
all such documents upon which the City seal is required;
Section 3. This ordinance shall be in full force and
effect from and'after its passage and until the return of the
City Clerk of the City of Des Plaines to his official duties
unless previously repealed by ordinance.

The motion was made by Alderman Carroll and seconded
by Alderman Henrich to suspend the rules and place this pro-
posed ordinance upon its final passage. The Mayor put the
question and the Clerk pro tem called the roll with the fol-
lowing result: Ayes; Aldermen Carroll, Johnson, Henrich, Pflug-
haupt, Dopheide, Lemke, Friott, Campagna and Schwanbeck. Nays;
None. Manor Ahbe then declared the motion carried and the
proposed ordinance before the council for final disposition.

The motion was then made by Alderman Carroll and
seconded by Alderman Johnson to finally pass and adopt this
proposed ordinance. The Mayor put the question and the Clerk
pro tem called the roll with the following result: Ayes;
Aldermen Carroll, Johnson, Henrich, Pflughaupt, Dopheide,
Lemke, Priott, Campagna and Schwanbeck. Nays; None. The
Mayor thereupon declared the motion carried and the said
ordinance passed.
SALE OF 1939 TAX WARRANTS: Kenneth G. Meyer, City
Attorney, then announced that the City Council was ready to
hear auction bids on the purchase of 1939 Tax Anticipation
Warrants. Bids were to be made on the basis of the City's
standing the cost of legal opinion and printing. The final
bids were as follows:

The motion was made by Alderman Pflughaupt and
seconded by Alderman Carroll to refer these bids to the
Finance Committee for study and consideration. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried and the bids so referred.
Mayor Ahbe then declared a ten minute recess in
order to give the Finance Committee an opportunity to study
the bids. At the close of the recess the Mayor reconvened
the council by calling the meeting to order.
Alderman Pflughaupt, Chairman of the Finance
Committee, then made the motion which was seconded by Alderman
Carroll, to accept the bid of Angell, Simpson & Co to purchase
approximately $33,000.00 of 1939 City of Des Plaines Tax Anti-
cipation Warrants at a premium of $12.50. Said Warrants to
bear interest at the rate of 1 5/8 % per annum, and the City
is to pay the cost of printing and legal opinion, and to in-
struct the Mayor and City Clerk to sign this proposal in accep-
tance thereof. The Mayor put the question and the City Clerk
pro tem called the roll with the following result: Ayes; Aldermen
Carroll, Johnson, Henrich, Pflughaupt, Dopheide, Lemke, Friott,
Campagna and Schwanbeck. Nays; None. The Mayor thereupon
declared the motion carried.
THE JUDICIARY AND ASSESS/J.-PINT COMMITTEE: The Clerk pro
tem then read the following report:
To the Chairman Johnson, Judiciary and Assessment com-
mittee, at the meeting of the City Council, held February 20,
1939, the following matter was referred to your committee:
The question of discontinuing the service of the
Des Plaines Business Men's Ass'n. in reporting the "New
Families Visited" for which the City now pays the Ass'n.
$250 monthly.

To the Mayor and City Council: Your Committee on
Judiciary and Assessment has investigated the above and has
found that this is certainly a step in the right direction and
the thought a very good one. But inasmuch as the business men
are the only ones benefited we feel that it is unjust to ask
the taxpayers to support this service. We feel that the ex-
penses should be paid entirely by the Business Men's Ass'n.
We, your Committee on Judiciary and Assessment there-
fore recommend that the monthly payment of $2.50 to the Business
Men's Ass'n. be discontinued.

The Clerk pro tem then read the following report:
To the Chairman Elmer Johnson, Judiciary and Assessment
Committee, at the meeting of the City Council, Held March 6, 1939
the following matter was referred to your committee:
The case of Boeckenhauer vs the City of Des Plaines
was referred to your committee for the purpose of assisting
the City Attorney in determining whether or not the City
should appeal this case to a higher court.

We, your Committee on Judiciary and Assessment, recom-
mend that unless Mr. Boeckenhauer will agree to reduce his
judgment to $750.00, the City Attorney should appeal the
judgment.

THE POLICE AND LICENSE COMMITTEE: had no report to
offer.
THE STREETS AND SIDEWALKS COMMITTEE: had no report to
offer.
THE COMMITTEE ON PUBLIC WORKS, BUILDINGS AND PLATS:
had no report to offer.
THE SEWER, DRAINAGE AND SANITATION COMMITTEE: had no
report to offer.
THE WATER COMMITTEE: had no report to offer.
THE FIRE COMMITTEE: The Clerk pro tem then read the
following report:
To the Chairman Johnson, Fire Committee, at the meeting
of the City Council, held March 20, 1939, the following matter
was referred to your committee:
The matter of eliminating the numerous fire calls
to extinguish burning prairies. It was suggested that
all large vacant areas have dried grass and weeds burned
off under the supervision of the Fire Department with
relief or WPA labor.

Your Committee on Fire has investigated the above and
has found that due to the City's liability in the event of
damage done to trees, bushes or homes as a result of fire
We, your Committee on Fire therefore recommend that the
burning of vacant prairies not be attempted. From investigation
in other cities where this has been tried, we find the same
was discontinued for reasons stated above.

The motion was,made by Alderman Campagna and seconded
by Alderman Henrich to concur in this report. The motion was
voted upon by acclamation whereupon the Mayor declared the motion
carried and the report concurred in.
MALONEY CASE: Kenneth G. Meyer, City Attorney, reported
that the briefs on the Maloney case have been prepared and copies
are available to each alderman.
REQUEST FOR WPA GRANT: City Bngineer, E.N. Fletcher,
urged the City Council to submit its request for a WPA grant.
Suggestions for such projects were (a) Painting correct street
numbers on curb fronting each lot in the city (b) conducting a
lot usage survey in business as well as redidential areas (c)
locating and indicating on curbs the position of buffalo boxes
on each lot. The motion was made by Alderman Johnson and
seconded by Alderman Lemke to instruct the City Engineer to
prepare a request for a grant of WPA funds for the purpose of
painting the correct street numbers on curb fronting each lot
on which a building is located. The motion was voted upon by
acclamation whereupon tale Mayor declared the motion carried and
the engineer so instructed.
THE BUILDING INSPECTOR: Frank F. Scharringhausen
reported a steady growth in building activities, especially
in Branigar's Cumberland Terrace.
TOWNSEND CLUB REQUEST: The Clerk pro tem then read
the following letter:

City of Des Plaines:
The Townsend National Recovery Plan Headquarters
has requested me to appeal to your body in behalf of the
Townsend Des Plaines Club #1 relative to securing the use
of the Council Chambers for the evening of Friday, May 26,
1939.
They were so pleased with the results obtained
at the last meeting about October 1938, that they feel sure
we can again draw a large audience and help boost the City
of Des Plaines.
It is our intention to hold this meeting for
educational purposes. No admission will be charged, but
a free-will offering will be taken.

The motion was made by Alderman Schwanbeck and secon-
ded by Alderman Campagna to grant the Townsend Des Plaines Club
#1 permission to ase the council chambers on Friday evening,
May 26, 1939. The motion was voted upon by acclamation where-
uppn the Mayor declared the motion carried and the permission
granted.
SHRUBBERY FROM CUMBERLAND: The Clerk then read the
following letter:

Therefore, by resolution of the Board of Directors of this
.et Corporation, the City of Des Plaines or the Des Plaines ark
Board, upon approval of the City Government, is requested
to remove this shrubbery and plant it in more suitable lo-
cations, leveling the ground and seeding it to grass suitable
for mowing.

Gentlemen:
The residents of Cumberland have agreed to the advisability
of removing the shrubbery from .the parkways along Golf and
Wolf Roads.
This is advisable for several reasons. First the shrubbery
in its current unmaintained condition is uncomplimentary
to the community and its rank growth creates a safety hazard
along the thoroughways. Second, while the Cumberland Main-
tenance Corporation has always mowed the grass of all Cumber-
land Parkways, and has contracted to mow all parkways and
vacant lots during the year 1939, our funds do not permmt
the cultivating, shearing and pruning of shrubs as they
should be maintained. In their present state these shrubs
add to the expense and costs of moving the parkways.
You are advised that the residents between Sixth and Seventh
Streets of Golf Road wish to retain and maintain all the
shrubbery in that block on the south side of the road. Also
the seven residents of Wolf Road have maintained that shrub-
bery in front of their residences and some may wish to con-
tinue to do so. Therefore, we suggest that agency removing
shrubbery obtain individual Approval for each residence
before removing shrubbery before it.
Should we be able to offer any cooperation in this regard,
please advise us.

The motion was made by Alderman Pflughaupt and seconded
by Alderman Carroll to adopt this proposed resolution. The
Mayor put the question and the Clerk pro tem called the roll

Pflughaupt, Dopheide, Lemke, Friott, Campagna and Smhwanbeck.
Nays: None. The Mayor thereupon declared the motion carried
and the said resolution adopted.
PURCHASER FOR RIVERVIEW HALL: Mayor Ahbe then announaed
that the Riverview Gospel Tabernacle is interested in purchasing
the Riverview Town Hall site for the purpose of establishing a
biblical institute. The motion was made by Alderman Johnson and
seconded by Alderman Dopheide to instruct n.enneth G. Meyer,
City Attorney, to prepare the necessary papers to put the legal
steps in progress. Tile motion was voted upon by acclamation
whereupon the mayor declared the motion carried and the Uity
Attorney so instructed.
The motion was then made by Alderman Lemke and seconded
by Alderman Friott to authorize the mayor to designate four real
estate agents of Des Plaines to act as a committee to appraise
the Riverview Village Hall site. The motion was voted upon by
acclamation whereupon the mayor declared the motion carried.
mayor Ahbe then named the following realtors to act
on this appraisal committee: W.L. 21ew, Walter Tallant, b.F.
Sidamiller, and miss L. Bennett.
SALVATION ARMY BAND CONCERT: Mayor Ahbe then presented
a request from the salvation Army for permit to conduct a band
concert at Ellinwood And Lee Streets on Wednesday evening, April
26, 1939 at 7 o'clock. The nation was made by Alderman Campagna
and seconded by Alderman Schwanbeck to grant this permission.
The motion was voted upon by acclamation whereupon the mayor
declared the motion carried and permission granted.
BOY SCOUT COUNCIL MEETING: Mayor Ahbe announced
that members of Des Plaines Boy Scout `Proops will conduct a
City Council meeting in the council chambers on Saturday
afternoon, may 6, 1939 at 2 o'clock. All members of the
City Council were urged to be present.
REPAIR TO STREET SWEEPER: Alderman Schwanbeek, chair-
man of Streets and Sidewalks committee, then reported that the
street sweeper is again in need of repair. The motion was
made by Alderman Carroll and seconded by Alderman Henrich to
authorize the Streets and Sidewalks committee to purchase the
necessary parts to put the street sweeper in working order.
The Mayor put the question and the Clerk pro tem called the
roll with the following result: Ayes; Aldermen Carroll, Johnson,
Henrich, Pflughaupt, Lemke, Friott and Schwanbeck. Nays; Cam-
pagna. The Mayor thereupon declared the motion carried.
CANVAS OF VOTES: Mayor Ahbe then appointed a spec-
ial committee consisting of Aldermen Pflughaupt, Johnson, and
Campagna for the purpose of canvassigg the official return of
the City Election held Tuesday, April 18, 1939. The committee
then studied the said returns and introduced the following

City of Des Plaines, Illinois, that:
JAMES J. CARROLL, JR., be and is,
declared elected as Alderman of the
First Ward for a four-year term
and until his successor is elected
and qualified.
FRED LOOS be and is declared elected
as Alderman of the Second Ward for
a four-year term and until his
successor is elected and qualified.
WALTER L: DOPHEIDE be and is declared
elected as Alderman of the Third Ward
for a four-year term and until his
successor is elected and qualified.
CLIFFORD CARLSON be and is declared
elected as an alderman of the Third
Ward to fill a vacancy for a two-year
term and until his successor is elected
and qualified.
ERNEST FRIOTT be and is declared
elected as Alderman of the Fourth.

The motion was made by Alderman of lughaupt and
seconded by Alderman Uampagna to adopt this proposed reolution.
The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried and the resolution adopted.
APPROVAL OF MINUTES: Each member of the Council
having at hand a copy of the minutes of the regular council
meeting of AOril 3rd, 1939 and also April 17th, 1939 the motion
was made by Alderman Carroll and seconded by Alderman Schwanbeck
to approve the said minutes as written. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried and the said minutes approved.
ADJOURNMENT: The motion was made by Alderman Lemke
and seconded by Alderman Johnson to adjourn. The motion was
voted upon by acclamation whereupon the mayor declared the
motion carried and the council regularly adjourned.
