MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON MONDAY,
MARCH 6:, 1919 AT THE HOUR OF 8:00 P.M.
CALL TO ORDER: The meeting was called to order by
Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson,
Pflughaupt, Henrich, Garland, Dopheide, Friott, Lemke, Schwanbeck,
and Campagna responding to the roll call. the Clerk reported all
members of the Council present.
REPORTS OF OFFICERS: Tne Clerk then submitted the fol-
lowing reports:

REPORTS OF STANDING COiilMITTEES: None of the standing
committees of the Council had reports to offer.
CEDAR RAP IDS LIFE INSURANCE GO. vs CITY OF DES PLAINES:
Kenneth G. Meyer, City Attorney then reported recommending that
the City consent to a judgment ir the sum of $10,721.66 in this
ease. The motion was made by Alderman Pflughaupt and seconded by
Alderman Lemke to authorize and instruct tne City Attorney to con-
sent to the said judgment as recommended. ine motion was voted
upon by acclamation whereupon the mayor declared the motion unan-
imously carried.
BOECEENHAUER vs CITY OF DES PLAINES:A Upon the suggestion
of Kenneth G. llieyer, City Attorny, the Mayor referred to tne Ju-
diciary and Assessment Committee for study, the matter of the
case of Boeckenhauer vs City of Des Plaines for the purpose of
assisting the City Attorney in deciding whether or not to appeal
the said case.
CLAIM FOR PARK RIDGE GARBAGE INCINERATION: The Clerk
then read the following report:
To Kenneth G. Meyer, City Attorney, at the meeting of
the City Council held Feb. 20, 1939, the following matter was
referred to you:
The matter of filing suit for the claim for garbage
incineration for the City of Park Ridge was referred to you
with instructions to permit the Business Men's Committee of
the City of Park Ridge to take judgment against the City of
Park Ridge in the name of t:ze City of Des Plaines, without,
however, vesting in the said committee any power to compromise
or settle the claim of the City of Des Plaines for less than
the full amount of the claim.

Please be advised that the Uity Council of the
City of Des Plaines has authorized me to transmit to you
tie claim of the City of Des Plaines against the City of
Park Ridge in the atao4nt of 13,201.88 for incinerator ser-
vice rendered by tne City of Des Plaines to the City of
Park Ridge for tne months of April to December 1938, both
inclusive.
You are authorized to take judgment against the
City of nark Ridge in favor of the Uity of Des Plaines for
said amount with the distinct understanding that there will
be no charge to tele City of Des Plaines for costs, fees or
other expenses and that you or tae committee which you re-
present shall nave no power or authority to settle or com-
promise the above claim for less than the full amount of
$3,201.88.
As I mentioned to you over the telephone, the City
Council o`f my city prefers that in entitling your case,
Des Plaines be not used as the first named plaintiff so
that the court records will not show a case pending by the
title of Des Plaines vs r'ark Ridge. This request is made
so that citizens of Park Ridge will not get the impression
that our city is an aggressor against yours,

GITY GASOLINE ?UMP: Tae motion was made by Alderman
Carroll, chairman of the police and License committee, and se-
conded by Alderman Schwanbeck to instruct the Mayor to appoint
a committee of three Aldermen to study the advisability of in-
stalling a city gasol"i"ne pump. The motion was voted upon by
acclamation wiier:eupon: .tfe Mayor declared the motion carried.
The Mayor then appointed Aldermen uarroll, Dopheide, and Lemke
to serve on tne said committee.
REFUNDING WATER REVENUE BONDS: Kenneth G. Meyer, City
Attorney, then submitted the following proposed ordinance which
was read by the Clerk for .fimt reading, and bears the title:
AN ORDINANCE authorizing and providing for
the issue of 156,000 Water Revenue Refund-
ing Bonds of the City of Des Plaines, Cook
County, Illinois, prescribing all the de-
tails of said bonds and providing for the
collection, segregation and distribution of
the revenue of the waterworks system of
said City for the purpose of paying the cost
of the operation and maintenance thereof,
providing an adequate depreciation fund there-
for and paying the principal and interest of
said Water Revenue Refunding Bonds.

The Mayor ordered this proposed ordinance filed for
second reading.
OAKTON STREET WIDENING AT 'RIVER ROAD: Tae Clerk
then submittdd a set of plans together with the following
proposed resolution:
RESOLUTION
WHEREAS, the Superintendent of highways of and
for Cook County, Illinois, has submitted plans for the `im-
provement of a Highway known as Oakton Street Widening at
River Road, within the corporate limits of the City of Des
Plaines, and
WHEREAS, the improvement of said highway serves
the public convenience and necessity,
THEREFORE, BE IT RESOLVED, by the Mayor and City
Council of the C=ity of Des Plaines that the said plans be
and they are hereby approved; that the County of Cook be
and is hereby authorized and empowered to proceed with the
work of construction in accordance with said plans.
BE IT FURTHER RESOLVED, that the County of Cook
be and it is hereby relieved and discharged of any and all
liability for any and all damages to property, and for any
and all damage done to or sustained by the pavements within
the City by reason of the detoruing of traffic, or the
hauling of material, or from any other cause incident to the
impro"Vement of the highway aforesaid.

City Engineer the motion was made by Alderman Campagna and se-

SMOKE NUISANCE COMPLAINT: The Clerk then read the

Gentlemen:
I take occasion to call to your attention the gen-
eral disregard of the City ordinances relative to smoke
nuisances by many of tae places of business of our City.

On February 24, 1939, at 5:40 P.M., 1 got off the
Northwestern train and happened to have occasion to wait at
the corner of Lee and Ellinwood Streets. My attention was
attracted to the chimney of the Des .Plaine:- Theater which at
that time and until 5:57, a period of seventeen minutes, belched
forth a cloud of dense black smoke. At the same time, the
building on Miner Street in which the Svoboda store is located,
was contributing its dense black smoke continuously from 5:40
to 5:50. The Chicago and .Northwestern itailway station and
crossing men's houses are also flagrant violators of the
ordinances.
I am citing only t nese few because of my specific
observation on this day. On many other occasions 1 have no-
ticed violations by other places In our business district.
No community can progress as a desirable place to
live in when a large portion of the places of business whose
existence is dependent upon the residents of the community,
persistently violate such a necessary health and cleanliness
measure as the provisions against smoke nuisances and the or-
dinances should be vigorously enforced against such violators.
In this day and age there is no justification for such
conditions on the ground of economy or for any other reason.
Modern fire appliances do away with practically all smoke,
even in the cheapest fuels, and in a short period of use, pay
for their cost.

1939. 1 take this action with deep regret, but pressure of
other duties prevents me from giving the time necessary to
execute my duties as Alderman as efficiently as 1 think
necessary.
1 would like to take this opportunity of thanking the Mayor
and gentlemen of the Council for the siiendid cooperation and
help they gave me as a new member of the Council and the
cooperative consideration 1 nave received in my various pro-
posals.

The motion was made by Alderman Garland and seconded
by Alderman Dopheide to accept this resignation. The Mayor
as well as a number of Aldermen expressed regrets at Alderman
Garland's resignation. The motion was voted upon by acclamation
wnereupon the Mayor declared the motion carried and the said
resignation accepted.
Alderman Garland trien vacated his chair and the Mayor
declared an Aldermanic vacancy in the Third Ward.
The motion was made by Alderman campagna and seconded
by Alderman Johnson that tne Council express its tnanks to Mr.
Garland for the valuable service he has rendered the City of Des
Plaines as Alderman of the Third Ward. The motion was voted
upon by a standing vote in which not only the Council but also
the attending audience unanimously responded. The Mayor there-
upon declared the motion unanimously carried.

Alderman Friott to suspend the rules and place this proposed ordinance
upon its final passage. The Mayor put the question and the Clerk
called the roll .with the following result: Ayes; Aldermen Carroll,

and Campagna. Nays; None. The Mayor thereupon declared the motion

The motion was made by Alderman Pflughaupt and seconded
by Alderman Lemker to adopt this proposed resolution. The Mayor
put the question and the Clerk called the roll with the following

been supplied witn a copy of the minutes of the regular Council
meting held February 20, 1939 and also a copy of the minutes of
the special council meeting veld February 27, 1939: the motion
was made by Alderman Yriott and seconded by Alderman Lemke to
approve the said minutes as written. ine motion was voted upon by
acclamation whereupon the Mayor declared the motion carried and the
said minutes approved.
ARRANGE MEETING WITH BOARD OF HEALTH: The motion was
made by Alderman Dopheide and seconded by Alderman Lemke to instruct
tne Clerk to request the members of the Board of Health to meet
with tne City Council at 9:00 P.Mi. Monday, March 13, 1939 in the
Council Chambers. me motion was voted upon by acclamation where-
upon the Mayor declared the motion carried.
CORRECTING INCORRECT HOUSE NUMBERS: Alderman Dopheide
reminded the members of the Uouncil that the matter of a city-wide
movement to correct incorrect house numbers was referred to the
Streets and Sidewalks Committee, and inquired as to wnat action has
been taken. For further action the Mayor referred the matter to
the City Attorney, the City Engineer, and Alderman Dopheide.
ADJOURNMENT: The motion was made by Alderman Lemke and
seconded by Alderman Dopheide tnat the Council adjourn.to 7:30
P.M. Monday, March 13, 1939. The motion was voted upon by accla-
mation whereupon the Mayor declared the motion carried and the
Council so adjourned.
