within the city limits for skating.

CALL TO ORDER: Mayor tiobart M. Anbe being absent the
meeting was called to order by Edgar S. *oriedrich, City Clerk, with
Aldermen Carroll, Johnson, Pflughaupt, tienrich, Garland, Dopheide,
Friott, Lemke, Schwanbeck and(Uampagna responding to the roll call.
The Clerk then reported that Mayor Ahbe expects to arrive
later due to the fact that his presence is requested at the ceremony
being held by the American Citizen's Association for the benefit
of such as have recently reachedvoting age.
The motion was made by Alderman Lemke and seconded by
Alderman Friott that Alderman Pflughaupt serve as Mayor pro tem
until the arrival of the Mayor. The motion was voted upon by ac-

The motion was made by Alderman Carroll and seconded by
Alderman Johnson to finally pass and adopt this proposed ordinance

THE SEWER, DRAINAGE AND SANITATION COMMITTEE through
its chairman, Alderman Lopheide, reported that on February 17., 1939
the committee met with representatives of the izaak Walton League
and thoroughly discussed ways and means of ridding the Des elaines
River from pollution. tie reported further that,as was expected, the
meeting brought no definite action. the izaak Walton representatives
were assured, However, of the Council's willingness to cooperate in
every possible way to again make the Des i''laine s River a clear un-
polluted stream.
THE FIRE COMMITTEE had no report to offer.
THE BAND COMMITTEE had no report to offer.
THE CITY ATTORNEY reported that in the matter of settle-
ment of the City's claim for garbage incineration for the City of
Park Ridge he has contacted the attorneys representing the 'ark
Ridge Business Men's Committee and was informed that the City of
Des Plaines may file suit and take judgment in the name of the City
of Des Plaines without, however, vesting in the said committee
any power to compromise or settle the claim of the City of yes
Plaines for less than the full amount of the said claim. The
motion was voted upon by acclamation whereupon the chair de-
clared the motion carried.

should authorize the Mayor and City Clerk to sign.
I feel it my duty to advise you that the City, in fur-
nishing service to non-residents, would, in my opinion, be per-
forming an act outside of its governmental duties, and by reason
thereof, would be liable for any damages or injuries sustained
in the course of sucri activities.
