CALL TO ORDER: The meeting was called to order by Mayor Hobart M. Ahbe, presiding, with Aldermen Carroll, Johnson, Pflughaupt, Henrich, Garland, Dopheide, friott, Lemke, Schwan- beck, and Campagna responding to the roll call. The Clerk reported all members of the Council present. REPORTS OF OFFICERS: The Clerk then read the report of the receipts of the City Clerk's office for May, 1938, and distributed the cash report of Chas. M. Larson, city Treasurer, as of May 31, 1938. to offer. offer. offer. THE JUDICIARY AND ASSESSMENT COMMITTEE: had no report THE POLICE AND LICENSE COMMITTEE: had no report to THE STREETS AND SIDEWALKS COMMIri'TRE: had no report to THE COMMITTEE ON PUBLIC WORKS, BUILDINGS, AND PLATS: through its chairman, Alderman Campagna, stated that no decision has been reached regarding the old dismantled City scale stored in the basement of the Municipal Building. THE GARBAGE COMMITTEE: through its chairman, Alder- man Dopheide, reported that the new Chevrolet Garbage Truck has been delivered and is giving satisfactory service. THE FIRE COMMITTEE: through its chairman, Alderman Garland, reported that the proposed new "Fire Ordinance* is now ready and will no doubt be submitted to the Council at its next regular meeting. THE BAND COMMITTEE: had no report to offer. MRS. FRANK YLRKINS - 3173.00 !CLAIM: Mrs. Frank Perkins, wife of the late Frank Perkins, Contractor, who installed the Stop and Go traffic signal lights along miner Street personally addressed the Council urgently requesting that the following claim be paid: Perkins Electric To City of Des Plaines Dr. Des Plaines, Ill. Installing Traffic Signals at Ellinwood St. and Lee St. (MFT Section 3 -CS) Extra Work. Installing 80 ft. 3 inch pipe Extra work and new Cam in Control $120.00 .QQ $173.00 Mayor Ahbe referred this matter to the Streets and Sidewalks Committee for report at the next regular meeting of the Council. .PROPOSED SALE OF "RIVERVIEW HALL": The Clerk then read the following letter: 6 8 I&ADDEN, MCCIA & MEYER Attorneys at Law Chicago, Illinois June 1, 1938 City Council City of Des Plaines Illinois in re: Sale of Riverview ttty Hall tExlusive of Land) Gentlemen: In accordance with your request for an opinion as to the procedure with respect to the sale of personal property, 1 wish to advise that the law authorized cities to sell personal property when same is no longer necessary or useful to the city and such sale must be authorized by an ordinance passed by three-fourths of the members of the City Council. The sale can be made with or without ad- vertising as the City Council may deem necessary. When any personal property owned by the city is to be turned in as part payment for the pur- chase of a new article, then there must be publica- tion for bids and the notice must then specify the article that is to be turned in as part payment. As a rule of law a building situated on land is considered part of the real estate. how- ever, the owner of the land can convert the build- ing into personal property by selling it separate and apart from the land, and therefore it is my opinion that the Council can sell the building known as the Riverview City Hall if the attached ordinance is passed by three-fourths of the members of the City Council. While publication for bids is not required I am assuming that you will want to publish for bids and have therefore included such provisions in the ordinance. Very truly yours, Signed: KENNETH G. AN `ORDINANCE AUTHORIZING THE SALE OF THE BUILDING KNOWN AS THS "RIVER - VIEW CITY HALL*, DES PLAINES, ILL. WHEREAS, the City of Des Plaines is the owner of Lots 23, 24, and 25 in Block 3 in Diefendorf's Addition to River- view, situated in Des Plaines, Illinois, and WHEREAS, there is situated on said premises a two- story frame structure commonly known as The Riverview City Hall" and WHEREAS, said wooden structure located on said prem- ises is deemed by the City Council to be no longer necessary or useful to the City of Des Plaines, and that said building is not necessary to the City of Des Plaines, and W.ii R AS,, said building is badly in need of repair and its upkeep is costing this City unnecessary expense, 639 THEREFORE BE IT ORDAINES by the City Council of the City of Des Plaines, SECTION 1. That the two-story frame structure, known as the Riverview City Hall and located on Lots 23, 24, and 25 in .block 3 in Diefendorf's Addition to River- view in Des Plaines, be sold for the highest and best bid obtained therefor; SECTION 2. That said building shall be sold for cash with the understanding that the buyer thereof shall remove said building from said premises within days from the acceptance of such bid, and leave said premises clear of all debris and fill any excava- tion so that said premises will be level and in conform- ity with adjoining lots; SECTION 3. Advertisement for bids for the purchase of said City Hall shall be published in the and the bidders shall be required to submit with their bids a cashier's check or certified check for the amount of said bid, plus a deposit of Wen Dollars (110.00) to assure compliance with the provisions with respect to clearing and grading said premises after the removal of said building. SECTION 4. Said deposit of Ten Dollars ($10.00) shall be returned to the successful bidder upon report to the City Council by the Superintendent of Public Works that said bidder has satisfactorily cleared and leveled said premises; SECTION 5. Upon failure of the purchaser to clear and level said premises within then (10) days after the removal of said building, he shall forfeit said de- posit of Ten Dollars 010.00) and said sum shall be applied toward the cost of clearing and grading said premises; This ordinance shall become in full force and effect upon and after its passage and approval according to law. Passed tnis day of 19313. Approved this Gity Clerk day of 1938. Mayor Mayor Ahbe ordered this proposed ordinance filed for second reading. REDUCING BLOWING OF FIRE SIREN: Alderman i-tenrich then called attention to disturbance caused by the fire siren at night. He suggested an arrangement by which the use of the siren could be eliminated each night after midnight. Mayor Ahbe referred this matter to the Fire Committee for study and report. PROPOSED NEW U.S. POST OFFICE BUILDING: Alderman Garland then introduced the following proposed resolution: RESOLUTION Urging the Building of a New Govern- ment -Owned Post Office Building For Des Plaines WHEREAS, the United States Government several years ago appropriated funds for the purpose of purchasing a site and erecting thereon a new United States Post Office in the Gity of Des Plaines, Illinois, and 640 WHEREAS, the press recently listed Des Plaines among the cities for which allotments have been made for the construction of such new Post Office Buildings, and WHEREAS, Des Plaines is one of the few munici- palities in the ten thousand population class withouta Government-owned Post Office Building, and WHEREAS, the construction of such a new Post Office Building at this time would greatly alleviate suf- fering by providing employment for the many local unem- ployed building tradesmen in and about Des Plaines, and WHEREAS, the Honorable Leonard W. Schuetz, Congress- man for the Seventh Congressional District of Illinois has in the past demonstrated his keen interest in the welfare of Des Plaines and its residents, THEREFORE BE IT RESOLVED, that the City Council of the City of Des Plaines does for and in behalf of the residents of the City of Des Plaines heartily endorse the building of a new Yost Office Building in Des Plaines and respectfully requests the Honorable Leonard W. Schuetz, Congressman of the Seventh Congressional District of Illinois to urgently petition the Post Office Department of the Federal Government to act immediately to purchase a site, prepare plans and specifications, and proceed with construc- tion of the said Government-owned Post Office Building for Des Plaines, and BE IT FURTHER RESOLVED, that the City Clerk of the said City of Des Plaines, Illinois, be and he is hereby instructed to forward forthwith to the Honorable Leonard W. Schuetz, Congressman from the Seventh Congressional District of Illinois, a certified, copy of this resolution. MATERIALS FOR PAVING RIVERVIEW STREETS - MFT SECT. 4GS : The Clerk then read the following proposed resolution: RESOLUTION WHEREAS, the City Council of the City of Des Plaines did on the 24th day of January, 1938 by resolution appropriate the sum of $11,096.00 for the improvement of White Street, also known as Arterial Street No. 2, which improvement is also designated as Section 4 -CS, and WHEREAS, plans, specifications, and estimates for the said improvement were approved by the Division of Highways of the State of Illinois on June 6, 1938, and WHEREAS, it is necessary fox the City of Des Plaines to purchase crushed stone and other materials for the said improve- ment, 641 THEREFORE BE IT RESOLVED, by the City Council of the City of Des Plaines that the City Clerk be and he is hereby directed, subject to approval of the Division of Highways of the State of Illinois, to advertise for sealed bids for furnishing and delivering the following materials for the said improvement: 1700 Cu. yds. DESIGNATING ADDITIONAL ARTERIAL STREETS: The Clerk then read the following proposed resolution: RESOLUTION FOR DESIGNATION OF ARTERIAL STREETS UNDER THE MOTOR FUEL TAX LAW BE IT RESOLVED by the Council of the City of Des Plaines, Illinois, that the following described streets be designated as Arterial Streets, subject to the approval of the Department of Public Works and Buildings, State of Illinois. BEGINNING at Thacker Street and extending along Pearson Street to Des Plaines Avenue to be known as Arterial Street No. 5, BEGINNING at Lee Street and extending along First Avenue and Craceland Avenue to Rand Road to be known as Arterial Street o. 6, BEGINNING at Miner Street and extending along Garland Place to Rand Road to be known as Arterial Street No. 7, BEGINNING at Lee Street and extending along Prospect Avenue, Circle Avenue, and EVetett Street to White street to be known as Arterial Street No.. 8, and; BE IT FURTHER RESOLVED, that the Clerk is hereby directed to transmit to certified copies of this resolution to the Department of Public Works and Buildings, through its District office at (Jhicago, Illinois. APPLICATION FOR SHOOTING GALLERY PERMIT: The Clerk then read the following letter: 1501 Towler Ave. Evanston, ill. May 31, 1938 Gentlemen: Am writing you for permission to open a short range shooting gallery in Des Plaines. The gallery is 9 ft. wide, 12 ft. long, and 7 ft. high. All steel walls, it is doubly protected with heavy steel on back of target boxes. it uses 22 rifles with special target shells which will not rebound or splatter. The equipment is all new and in first class condi- tion. Gallery is also covered by accident and liability insurance. TRIMMING OF TREES IN PARKWAY: Alderman tienrich called the Council's attention to the many parkway trees which need trimming and suggested that a plan be devised by which the property owners would be urged to trim the trees in their re- spective parkways. This matter was referred to the Streets & Sidewalks Committee by the Mayor. 643 TO EXPLAIN PENSION FUNDS: The motion was made by Alderman Dopheide and seconded by Alderman Carroll to instruct the City Attorney to arrange to fully explain to the person- nel of the Police Department, the Fire Department, and the City Council the benefit provisions of both the Policemens' Pension Law and the Firemens' Pension Law. The motion was voted upon by acclamation whereupon the mayor declared the motion carried. APPROVAL OF MINUTES: Each member of the Council having at hand a copy of the minutes of the regular council meeting held Monday, May 23, 1938, the motion was made by Alderman Henrich and seconded by Alderman Lemke to approve the said minutes as written. The motion was voted upon by acclamation whereupon the Mayor dellared the motion carried and the said minutes approved. B.P.O.E. SAFETY MEETING: Mayor Ahbe then announced that on June 21, 1938 at 9:30 .v.-11. the Des Plaines Elks will conduct a Safety Meeting in the Elk's Club Rooms. All are invited to attend. MEETING WITH BUILDING INSPECTOR: Mayor Ahbe then announced that the Building inspector requests an informal meeting with the members of the Council immediately after the close of this meeting to discuss an application for building permit for a number of buildings on Thacker Street just West of First Avenue. ADJOURNMENT: The motion was made by Alderman Dopheide and seconded by Alderman Garland to adjourn.
