MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS ON THE 16th
DAY OF MARCH,A.D.I937 AT THE HOUR OF
8:00 P.M.
CALL TO ORDER: The meeting was called to order
by Mayor George W.A.inder, presiding, with Aldermen Ahbe,
Carroll, Pflughaupt, Fulle, Bishop, acLuckie, Frederick,
Lemke, Schwanbeck and Campagna, responding to the roll
call. The Clerk reported all members of the Council
present.
THE JUDICIARY AND ASSESSMENT COMMITTEE: through
its chairman, Alderman Pune, announced that the City of
Des Plaines placed fifth in the state and twelfth in the
nation, in the National Traffic Safety Contest conducted
by the National Safety Council, Des Plaines being classi-
fied with cities having a population between 10,000 and
25,000. Alderman Fulle stated that this safety record
is remarkable especially in view of the fact that Des
Plaines did not seriously undertake safety work until
about six months ago.
The motion was made by Alderman Campagna and
seconded by Fulle to instruct the Clerk to send 1936
Annual Traffic Safety report of the City of Des Plaines
to the Chicago Tribune, the Chicago Herald & Examiner,
the Chicago Evening American and the Chicago Daily Aews.
The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried.
The motion was made by Alderman Fulle and
seconded by M'acLuckie to authorise the expenditure of a
sum not to exceed $30.00 for the purpose of sending officers
Foote and Flentge to the Traffic Police School at North-
western University. The Mayor put the question and the
Clerk called the roll with the following result: Ayes;
Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Bishop, Mac-
Luckie, Frederick, Lemke, Schwanbeck and Campagna. .ys;
Nbne. The Mayor thereupon declared the motion carried.
Alderman r'ul1e, chairman of the Police and License
Committee, reported four new dog -bite cases, and that dog
in one of the cases was found to be rabid. The motion was
made by Alderman f'ulle and seconded by Lemke to authorize
the Police Committee to engage a dog catcher. The motion
was voted upon by acclamation whereupon the Mayor declared
the motion carried.
THE SEWER DRAINAGE AND SANITATION COMMITTEE had
no report to offer.
THE WATER COMMITTEE had no report to offer.
THE STREETS AND SIDEWALEB COMMITTEE then submitted

Mayor Kinder then declared a recess during which time the
individual aldermen examined the said report. Mayor Kinder
then terminated the recess by calling the Council to order.
The motion was then made by Alderman Frederick and seconded
by Campagan that the Council concur in this report. The
Mayor put the question and the Clerk called the roll with
the following result: Ayes; Aldermen Ahbe, Carroll, Pflug-
haupt, Yulle, bishop, MacLuckie, Frederick, Lemke, Schwan-
beck and. Campagna. Nays; None. The Mayor thereupon declared
the motion carried and the said report concurred in.
STOP AND GO LIGHTS ALONG MINER STREET:Alderman
2rederick, chairman of the 4treets and Sidewalks Committee
then submitted final plans and specifications a system of
traffic control stop and go lights for two intersections,
namely at Des Plaines Avenue and Miner Street; and
at Lee Street and Miner Street. The motion was made b:,1
Alderman Frederick and seconded by Lemke to advertise for
bids for the installation of the said stop and go light
system subject to the approval of the State Highway Depart-
ment, the said bids to be returnable at the next regular
Council Meeting(April 5,1937). The Mayor put the question
and the Clerk called the roll with the following result:
Ayes; Aldermen Ahbe, Carroll, Pflughaupt, Fulle, Bishop,
MacLuckie, Frederick, Lemke, Schwanbeck and Campagna. Nays;
None. The Mayor thereupon declared the motion carried.
REPAIRING INCINERATOR: Alderman Lemke, chairman
of the Sewer, Drainage and Sanitation Committee then sbb-
mitted the following proposal which was read by the Clerk:

Gentlemen:
We the undersigned property owners on Washington
St. from Laurel Ave. to Western Ave., North and South side
6f the street, beg you gentlemen to take steps at once
to stop and refuse a previous petition presented by Mr.
Angelo DeMarco of 1248 Washington St. who is desirous to
have the residentail block on Washington St. from Laurel
Ave. to Western Ave. changed from residence to Commercial
property zoning.
When he came to us Mr. DeMarco misrepresented
said petition, saying he just wanted enough signatures so
he could get a permit for a small store at his home on
the corner of Laurel Ave. and Washington Street for sale
of groceries purposes.
We property owners were unaware that his petition
was in the form of a rezoning ordinance from residence to
commercial and when he obtained signatures to his petitions
we property owners signed without knowing that we were
signing our residential rights_and we did not realize until
we read it in the Des Plaines 'our.nal an article in the
legal notice column notifying property owners of the
proposed change so we at once decided on a counter peti-
tion and signed by all property owners im said block -and
beg your honorable body. to do your utmost to stop and
refuse the previous petition of Mr.Angelo DeMarco of
1248 Washington St. fox rezoning as we are satisfied to
keep our property as a residert461 district.

SUMMONS: JOHN BOECKENHAUER vs. THE CITY OF DES PLAINES:
The Clerk then reported receipt of a summons served in the
case of John Boeckenhauer vs. the City of Des Plaines, Case
NO.37-C-235. The motion was made by Alderman Lemke and seconded
by Ahbe to refer this sommons to Kenneth G.Meyer, City Attorney,
with instructions to file an appearance in the said case. The
motion was voted upon by acclamation whereupon the Mayor declared
the motion carried.
SUMMONS -DAVID B.MAIONEY vs THE CITY OF DES PLAINEST
The Clerk reported receipt of a summons served upon the City
in the case of David B.Maloney vs. The City of Des Plaines,
case No.37-S-3069. The motion was made by Alderman Campagna
and seconded by Lemke to refer this summons to Aenneth G.
Meyer with instructions to file an appearance for the City
in the said case. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.

Gentlemen:
As the representative of the Legal Department
of the City of Des Plaines, the law requires that I make
periodical reports to the City Council of the status of
affairs within said department, and accordingly A. wish
to report to you that upon my appointment as City Attorney
there were eight cases requiring my attention, namely:
Cater Vs. City - injunction suit concerning water rates.
Cuneo Vs. City - Claim for fire hosel
Public Service Co. Vs. City - Claim for electric power.
Gary Wheaton Bank Vs. City - involving S.A.#95.
Zaleski Vs. City - Judgement
Quilici Vs. City - Judgment
Purchase Vs. City - Ejectment suit.
City Vs. Purchase- injunction suit.
4f the above cases, two are still pending, namely,
the cases of Purchase Vs. City and City Vs. Purchase. The
Cater case was dismissed when the City acquired the Cater
Well, and the other cases were settled by payment from funds
realized from a funding bond issue.
During my term as City Attorney, eleven sgits were
filed involving diversion of special assessment funds by former
city treasurers. Seven of said cases are still pending,
which cases, together with the amounts involved in each case,
are as follows:

In all of the above cases I have spent a great deal
of time in conferences, exhaustive study of the law, and
audits, and 1 feel confident that 1 can defeat all or a
major portion of the claims for a judgment against the
city.

Four/the diversion suits have been disposed of and
these cases and the amounts that were claimed by the
plaintiffs, and the resultant liability of the City, are
as follows:

Equitable Life Ins.Co. Vs. City - $15,983.03 claimed.
Suit dismissed. Liability of City, None.
O'Connell Vs. City - $15,830.52. Judgment against
City - :1360.65.
Only two suits were filed against the City resulting
from transactions that had been in the hands of the present
City Council. Those cases were:
Allen R.Smart. Vs. City - Suit for auditing fees.
Jonathan Cook & Co. Vs. City - Suit for auditing fees.
The City, by Council authorization, admitted
liability to Smart & Company for 09562.50, and to Jonathan
Cook & Company for 41403.80, and judgments were entered
against the City for said amounts, which judgments were paid
through the proceeds of a funding bond issue.
The balance of the Jonathan Cook & Company claim
for 41467.00 is pending in court for trial.
The only othet pending case is that of the Gity
of Des Plaines Vs. Chicago and North Western Railway before
the Commerce Commission, upon which 1 have from time to time
reported to you.
To my knowledge, the only litigation threatened
against the City is the claim of John Boechenhauer for
alleged damages to his crops because of flood water, and
the alleged claim of David B.Maloney for attorney's fees.
In addition to the foregoing litigation, 1 have
lattended to the legal matters relative to the Softening
plant, the new Municipal Building, and acquisition of the
right of way for Golf Road.
I have also conferred with and advised the
Zoning Board, Police Commission, Board of Police Pension
Fund, Secretary of Board of Health, City Treasurer, City
Clerk, Mayor, Aldermen and Police Department, as well as
attending Council Committee meetings and preparing all
requested ordinances and resolutions.

APPROVAL OF MINUTES: Each member of the Council
having at hand a copy of the minutes of the regular Council
meeting held March 1,1937, the motion was made by Alderman
Pflughaupt and seconded by Lemke that the Council approve
the said minutes as written. The motion was voted upon
by acclamation whereupon the Mayor declared the motion
carried and the said minutes approved.
FILING WIPMENT FOR POLICE DEPARTMENT: Alderman
Palle, chairman of the Police and. License Committee, then

CENTER STRIPE ON PRAIRIE AVENUE: The motion was
made by Alderman MacLuckie and seconded by Campagna to refer the
matter 'of painting a center stripe along Prairie Avenue between
Laurel Avenue and Arlington Avenue to the Streets Committee and
the Superintendent of Public works. The motion was voted upon
by acclamatiOn whereupon the Mayor declared the motion carried.
CAP -PISTOL NUISANCE: Alderman Pflughaupt called
attention to a nuisance caused by young boys shooting cap
pistols on our streets. The motion was made by Alderman Pflug-
haupt and seconded by kacLuakie to instruct the Police Depart-
ment to stop this nuisance and if necessary to arrest the
person selling the caps to these boys. The motion was voted
upon by acclamation whereupon the Mayor declared the motion
carried.
INSPECTION TOUR-P.W.A.PROJECT 7270: Mayor h.inder then
extended to the Council an invitation from J.Albert la.Robinson
Consulting 4ngineer on the new Vater Softening Plant, to make
a tour of inspection of the new plant on Friday evening,March
19,1937 at 8:00 P.M. in order that the members of the Council
may see all parts of the plant andleservoirs before thereser-
voirs and tanks are sterilized.
ADJOURNMENT: The motion was made by Alderman Lemke
and seconded by Campagna that the Council adjourn. rhe motion
was voted upon by acclamation whereupon the Mayor declared the
motion carried and the Council re -Liar a. ourned.
