MINUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF'DES PLAINES HELD IN THE
COUNCIL CHAMBERS ON THE 19th DAY OF MARCH,A.D.
1934 AT THE HOUR OF 8:00 F.M.
The meeting was called to order by Mayor George
W.Kinder, with aldermen Ahbe, Collet, Pflughaupt, Dean, Hux-
mann, Bishop, Friott, Frederick, and Meinshausen responding
to the roll call. Alderman Enzenbacher arrived later during
the meeting.
The Judiciary and Assessment Committee had no report
to offer.
The Police and License Committee had no report to
offer.
Alderman Collet, Chairman of the Streets and Side-
walks Committee then submitted the following report, which
was read by the Clerk:

Honorable Mayor and City Council:
Your Committee, to whom the bills of the Johnson
Electric Shop were referred, have made a thorough
investigation of all the circumstances and beg to
report as follows:
We find that early in 1932, the .Superintendent of
Public ': orks was in need of additional ornamental
light posts and lanterns to replace posts and lanterns
which had been destroyed by accident and that the
then Street Committee, after a conference with the
then Mayor, Honorable Charles Hammerl, arranged with
the Johnson Electric Shop to furnish the said light
posts and lanterns.
Shortly afterwards, Mayor Hammerl, according to his
own statement, ordered that the vendor, the Johnson
Electric Shop make delivery, and on June 20th,1932
9 lamp posts and lanterns were delivered to the City
Pumping Station on Des Plaines Avenue. The City has
erected several of these light posts and we understand
that the cost of setting up these posts has been paid
for by the'parties causing the original damage.
We find that in 1932 it would have cost the City $110.00
each for these posts and lanterns laid down at the Pump-
ing Station, We therefore, feel that the price of
$80.00 for post and lantern was very reasonable at
that time, and is today less than the market price.
We therefore, recommend the approval of the two separate
bills, totalling $720.00, and that same be paid.

The motion was made by Alderman Huxmann and seconded by Pflug-
haupt to refer this report to the Finance Committee for consid-
eration and report. The roll was called on the motion with
the following result: Ayes; Aldermen Ahbe, Collet, Pflughaupt,
Dean, Huxmann, Bishop, Friott, Frederick and Meinshausen. Nays;
None. The Mayor thereupon declared the motion carried.
Alderman Ahbe, chairman of the Committee on Public
Works, Buildings and Plats made the motion whichwas seconded
by Pflughaupt to adopt Cook County Highway Department resolutions
approving the following Cook County Highway Department Plats: -
1. S.B.I. Route #46 Manheim Road through Des Plaines
2. Central Road Plat 264-A
3. Wolf Road, Plat 206-C
4. S.B.I.Route #58 - Plat 26
5. S.B.I.Route #46 - Plat 6
The roll was called on the motion with the following result:
Ayes; Aldermen Ahbe, Collet, Pflughaupt, Dean, HulciaPrin, Bishp,
Ftiott, Frederick and Meinshausen. Nays; None. The Mayor thereupon
declared the motion carried, the respedtive resolutions adopted
and the plats referred to therein approved.
The Sewer, Drainage and Sanitation Committee had no
report tocffer.
Alderman Bishop, chairman of the Wateer Committee re-
ported that due to carelessness of the State Highway Department,
while widening Rand Road, the 2* lead running from the meter
located on Garland Place and Rand Road, to the home of Theo.
Wittbold,1950 Rand Road, was damaged and caused a leak in this
lead. Be asked Carter Jenkins, engineer, whether the $20.42
estimated loss in water could be recovered by filing a claim
for damages with the State Highway Department. Mr. Jenkins
agreed to draft a letter, together with the City Clerk filing
such a claim with Mr. Kendrick Barger of the State Highway
Department.
Alderman Bishop, chairMan of the Water Committee,
reported that a past due bill of $1056.00 for water service
from the Cook County Highway Dept. will soon be paid by Cook
County. ER further reported that the City's bill of about
$900.00 for labor and materials used by the State Highway De-
partment in connection with the lowering of the wate* main
for the Golf Road underpass under the C.& N.W. tracks at
Cumberland has been approved for payment at Springfield, and
should be forthcoming in the near future.
The Clerk then read the following letter:

Gentlemen:
I represent the holders of certain special
Assessment bonds of your city which are past due and
unpaid. I append to this letter a list of such bonds.
Under the law of this State it is the duty of
a City and its Treasurer to apportion and pay out the special
assessnient funds collected for each installment eigher as to
principal or interest, upon the bonds and coupons issued
against and payable from such installment. 1 have examined the

audits made in behalf of your City with reference to these
special assessment collections and I assume that the
figures contained therein are correct. rased thereon
it is clearly apparent that the City is liable to my
clients for a considerable portion of the fact talue
of the bonds and coupons held by them. It appears that
funds are not available to the credit of these special
assessments to satisfy the liability on these bonds or
any part thereof. The shortage•is•undoubtedly due to
mistakes or misunderstandings in the application of funds
but these do not relieve the city of liability.

I appreciate/under present conditions the City has
no surplus cash out of which to satisfy this liability.
Our remedy is to bring suit on the bonds and obtain
judgement against the City for that proportionate amount
thereof representing the collections made by the City.
That would-be followed•by a mandamus order reqquiring
the City to appropriate a sufficient amount to pay the
judgment in the next appropriation ordinance.
• I assume that the 1932 and 1933 maturity of bonds
and coupons can be paid to the extent that funds have
been collected and that the collections of those years
have been kept separate for the purpose, subject only that
certain of such funds may have been lost through bank
failures. To the extent of such losses I believe that
the bondholders are also entitled to judgment.
I do not feel that it is necessary for either my
clients or the City to be subjected to substantial
expense through prosecution and defense of such liti-
gation. I am confident that if the City Countil will
authorize its officials to enter into negotiations, we
could then reach a satisfactory arrangement whereby to
fix the amount of the liability and the conditions of
payment thereof.
May I ask that you give this matter your consideration
and take such action as may seem advisable to you.

with the City Attorney for consideration and report. The motion

Gentlemen:
I have had several conferences with Attorney
b Bryant, associate of Tolman, chandler & Dickinson, with
respect to the status of the above improvement.
Messrs. Tolman, Chandler & Dickinson represent

V.W.Armstrong Company, the holder of approximately
75% of the unpaid bonds, and their Auditor has made
a thorough Check of this improvement and find that
because of diversions and misapplication of princi-
pal and interest, a personal liability judgment would
be obtainable against the city for approximately
$43,745.00, and that the facts in addition thereto
warrant a supplemental assessment in the amount of
$44,000.00. The items whereby the city could be
held personally liable for a judgment in this case
are as follows:

Communications have been addressed to the City
Council and other city officials during the past
six years in regard to this matter and nothing
definite has ever been done by the city, and the
holder of the bonds are now insisting that either
the city cooperate and take such steps as they
could be compelled by law to do or the bondholders
will be obliged to institute such proceedings to
compel action on the part of the city.
The figures above quoted can be fully explained
by the Auditor for W.W.Armstrong Company, and they
are anxious to meet with the Finance Committee or the
Council as a whole to discuss this matter more in detail,
and I strongly recommend that a date be fixed to
meet the parties concerned in this matter so that all
angles of the case can be thoroughly understood.

by Collet to refer this letter to the Finance Committee
together with City Attorney, the Mayor., the City Treasurer
and the City Clerk with instructions to consider this matter
in a meeting of the Finance Committee to be held Monday,
March 26, 1934 at 8:00 P.M. The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.

Dear Sir:
Mr. O.W.Dauber, Electrical Engineer
for this Department, has made a study of the
above project which provides for the improvement
of Miner Street from the Northwest Highway to
Rand Road.
He has informed me that there are approxi-
mately twenty wooden poles on the south side of
Miner Street between the Railroad and Rand Road which
it will be necessary to move between three and aeven
feet.
He thinks that these poles may be the
property either of the City of Des Plaines or may
belong to the Public Service Company or some other
Utility Company.
If you know or can determine whose
property the poles are, I should be glad to have
you give me this information.

Dear Mr. Harger:
Your letter of March 13th, relative to
the poles on the south side of Miner Street from
Des Plaines River to Rand Road, has beenzeceived.
Mr. Hale Olson, the engineer with the
Public Service Company informs me that these poles
are owned and used by the Public Service Company of
Northern Illinois.
I am also assured by the Telephone Company
that they have no property rights whater in them.
The City of Des Plaines has no poles what
ever carrying utility lines.

March 1,1934 of two certified copies of a
resolution designating arterial streets under
the Motor Fuel Tax Law passed by the City Council
at a meeting held on January 29,1934. Accompanying
the resolution were two city maps showing the lay-
out of arterial streets togeter with other state
highways.
I wish to advise that the resolution
will be forwarded to Springfield for approval with-
out any undue delay.

Gentlemen:
The Board of Commissioners directs me
to call your attention to the branches of trees
and shrubs recently cut and accumulated in the
parks about the city by the Federal Civil "forks
Administration tree trimming project under the
supervision of the department of kpblic works.
Since the work of the various projects is
soon to be curtailed or possibly discontinued we
would appreciate having you instruct the proper source
to remove these branches.
We appreciate that you undoubtedly have
over -looked this work in view of doing other more
important work, and for this reason we solicit your
cooperation in this clean-up activity, since these
must be removed before we can commence the usual
spring work.

The Mayor referred this matter to M.D.Wells, superintendent
of Public Works, with instructions to earry out the request
contained in the above letter.
Carter Jenkins, City Engineer, reported that he has
investigated the matter of putting the light and telephone
wires undergf'ound before widening and paving of East Miner
Street, and finds that the cost of putting these wires under-
ground would amount to approximately 36.00 per front foot or
about $150.00 per lot, which cost would have to be born by
the property -owners. The utilities insist that they will not
make this improvement unless the State Commerce Commission orders
them to do so, which means a long delay. Mr. Jenkins therefore
recommended that the poles be moved to the side of the street
adjacent to the walk line.
The Clerk then read the following resolution:

WHEREAS, a City election is to be held in the City
of Des Plaines on April 17, 1934, a nd
WHEREAS, there is considerable expense involved at
elections for the payment of judges and clerks of
election, and
WHEREAS, the Mayor aldermen, police officers and
other City Officials and employees have•not been
paid for many months and are continuing to render faith-
ful public service, and
WHEREAS, it is believed that there are -in Des Plaines,
many civic minded citizens who would be willing to donate
their time and services to the City and act as judges and
clerks of election on April 17th, without compensation.
THEREFORE, be it resolved that each alderman procure
and present at the next regular meeting of the City Council,
the names of citizens of the City who will agree to act
as judges and clerks of election on April l7th,1934, without
compensation.
BE IT FURTHER RESOLVED, that the owners of the polling

places designated for said election be re -
vested to waive the usual fee paid for the
rental thereof.
The motion was made by Alderman Huxmann and seconded by
Pflughaupt to adopt this proposed resolution. The roll
was called on the motion with the following result: Ayes;
Aldermen Pflughaupt and Huxmann. Nays; Aldermen Ahbe, Collet,
Dean, Bishop, Friott, Frederick, Enzenbacher and Meisshausen.
The Mayor thereupon declared the motion lost and the resolution
rejected.
Alderman Huxmann then transmitted to the Council a
request from the Des Plaines Garden Club asking the Council to
cooperate with the club in sponsoring a "clean-up week". The
motion was made by alderman Huxmann and seconded by Pflughaupt
to refer this matter to the Sewer, Drainage and Sanitation Com-
mittee with instructions to contact the officers of the Garden
Club and cooperate with the Club in arranging a "clean-up week",
preferably during the last week in Apri1,1934, and report the
progress in the matter to the Council. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion
carried.

Appropriation Ordinance for second reading:

MAKING APPROPRIATIONS TO DEFRAY THE

FOR MUNICIPAL PURPOSES, DESIGNATED
THE "ANNUAL APPROPRIATION BILL" FOR
THE FISCAL YEAR COMMENCING JANUARY
1,1914 AND ENDING DECEMBER 11,1914
The motion was made by Alderman Huxmann and seconded by
ileinshausen to pass and adopt this proposed ordinance as read.
The roll was called on the motion with the following result:
Ayes; Aldermen Ahue, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Enzenbacher and Meinshausen. Nays; None.
The Mayor thereupon declared the motion carried, and the
ordinance passed and adopted.
The motion was made by Alderman Huxmann and seconded
by Ahbe to instruct the Clerk to publish the 1934 Appropriation
Ordinance in the local newspaper. The roll was called on the
motion with the following result: Ayes; Aldermen Ahbe, Collet,
Pflughaupt, Dean, Huxmann, .0ishop, Friott, Frederick, Enzenbacher
and Meinshausen. Nays; None. The Mayor thereupon declared the
motion carried.
The motion was made by Alderman Huxmann and sedonded
by Ahbe to instruct the City Clerk to order the Middle States
Telephone Co. to change the telephone at Riverview Hall to a
four -party line telephone. The motionwas voted upo&by
acclamation, whereupon the Mayor declared the motion carried.
Alderman Ahbe requested. Carter Jenkins, City Engineer,
to make application to the State Highway Department for a
permit to make a service tap for one of the residences on Miner
Street, before the proposed paving of East kiner Street is
done. Mr. Jenkins agreed to comply with this request.
The motion was made by Alderman Pflughaupt and
seconded by Frederick to approve the minutes of the regular
Council Meeting of March 5,1934, as well as of the Adjourned
Council Meeting of March 6,1934 as written. The motion was
voted upon by acclamation, whereupon the Mayor declared the
motion carried and the aforementioned minutes approved.
Alderman Pflughaupt, chairman of the Finance
Committee then presented the following resolution of which
the Mayor and each of the Aldermen had been supplied a copy:

The motion was made by Alderman Pflughaupt and seconded by
Dean to adopt this proposed resolution. The roll was
called on the motion with the following result: Ayes;
Aldermen Ahte, Collet, Pflughaupt, Dean, Huxmann, Bishop,
Friott, Frederick, Enzenbacher and Meinshausen. Bays; None.
The Mayor thereupon declared the motion carried and resolution
adopted.
Iliyor Kinder then announced the appointment of
Aldermen Dean and Meinshausen as members of the Liquor
Commission. The motion was Eade by Alderman Pflughaupt and
seconded by Frederick to confirm these appointments. The
motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried and the appointments confirmed.
Alderman Pflughaupt requested the Clerk to instruct
the Chief of Police to provide "no parking" signs so as to
permit entrance at all times to the driveway between the
Thiede Building and the Echo Theatre 4uilding.
Alderman Pflughaupt suggested that themembers of
the Council consider, the advisability of changing the regu-
lar -Council meetings from the first and third Monday of
each month, to the first and third Tuesday of each month. The
motion was made by Alderman Pflughaupt and seconded by Himmann
to instruct the City Attorney to prepare a tentative ordi-,
nance making this change and submit to the Council at its
next regular meeting. The roll was called on the motion with
the following result: Ayes; Aldermen Pflughaupt, Dean, Hux-
mann, Bishop, Friott, and Meinshausen. Nays; Aldermen Ahbe,
Collet, Frederick and Enzenbaaher. The Mayor thereupon
declared the motion carried.
Alderman Bishop, chairman of the special committee
delegated to arrange new quarters for the Cook County Emer-
gency Relief Station, reported that the relief officials
have asked for permission.to use the Council Chambers.
The motion was made by Alderman Huxmann and seconded by
Frederick to grant these people desk space in the Council
• Chambers. The motion was,voted upon by acclamation,
whereupon the Mayor declared the motion carried.•
The request was,made by Alderman Frederick that
• the City Attorney.prepare.a resolution seeking to induce
the Emergency Relief Administration to employ not only
such unemployed as are on.the relief rolls, but also such
as are in need though not.on the relief rolls, and submit
this proposed resolution to the Council for consideration.
Mayor Hinder then called the CounciL's attention
to the fact that inasmuch.as the C.W.A. will discontinue March
31,1934, it will be necessary for the Council to deterMine
• the scope of any local Emergency Relief program which Des
• Plaines wishes to engage in for the benefit of its unemployed.
• The motion was made by Alderman Frederick and seconded by
Meinshausen that the Council meet as a committee of the whole
on Friday, March 23, 1934.to arrange a program of improvemeAts
• under the Federal Emergency Relief Administration. The
• motion was voted upon by acclamation whereupon the Mayor
• declared the motion. carried.

declared the motion carried and resolution adopted.
The motion was made by Alderman Meinshausen and seconded
by Pflughaupt to adjourn. The motion was voted upon by acclamation,
whereupon the Mayor declared the motion carried and the Council
regularly adjourned.

CITY COUNCIL OF THE CITY OF DES PLAINES
HFT,D IN THE COUNCIL CHAMBERS ON THE 2nd
DAY OF APRIL,A.D.1S34 AT THE HOUR OF
8:00 P.M.
The meeting was called to order by Mayor George
'T.Hinder with Aldermen Ahbe, Collet, Pflughaupt, Dean,
Huxmann, Bishop, Friott, Frederick and Meinshausen responding
to the roll call. Alderman Enzenbacher arrived shortly after
the roll call.
The Clerk then submitted the following reports:
1.The report of H.A.Becker,Chief of rolice for the calendar
month of March,1934.
2.The report of E.J.Friedrich,City Clerk, for the calendar
month of March,l934.
3.The report of C.M.Larson,City Treasurer,for the calendar
month of March,1934.
(The Mayor and each of the Aldermen was supplied with
copies of the Treasurer's report.)
Alderman Friott, chairman of the Judiciary and
Assessment Committee then submitted the following report,which
was read by the Clerk:
JUDICIARY & ASSESSMENT COMMITTEE report regarding the
letter from Robt.N.Erskine attorney for the Bondholders
on Several Special Assessments. The letter is dated March
I9th,1c34 and copy of same attached. The committee has
investigated and recommends that the matter be referred to
City Attorney to take up with Attorney for landholders.
