CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines, Illinois, was called to order by Mayor
Ted Sherwood at 7:02 p.m. in the Eleanor Rohrbach
Memorial Council Chambers, Des Plaines Civic Center on
Monday, July 19, 1993.
ROLL CALL: Roll call indicated the following aldermen present:
Beauvais, Christiansen, Elstner, Curley, Sarlo, Haupt.
Aldermen Kisslinger and Chiropolos were absent. Alderman
Chiropolos arrived at 7:05 p.m. and Alderman Kisslinger
arrived at 7:10 p.m.
Also present were: City Treasurer Fredricks, City Manager Douthwaite,
City Comptroller Peters, Police Chief Storm, Fire Chief Clark, Public
Works Administrative Assistant Tozzo, Development Specialist D'Onofrio,
City Engineer Oakley, Human Resources and Services Department Director
Panouses, and Interim City Attorney Delort.

MINUTES OF PUBLIC HEARING HELD IN THE ELEANOR
ROHRBACH MEMORIAL COUNCIL CHAMBERS, DES PLAINES
CIVIC CENTER, MONDAY, JULY 19 1 1993
Mayor Sherwood called the Public Hearing to order at 7:05
p.m. The Public Hearing was held pursuant to legal
notice regarding consideration of Petition for Annexation
and Annexation Agreement for property located at 415 West
Touhy Avenue.
Mr. Ronald Cope, Ancel, Glink, Diamond & Cope PC, legal
counsel for the petitioners, Joseph and Arnold Rubin, was
introduced and addressed the Council. Mr. Cope requested
that the City not require his client to extend the sewer
and water lines to the west property line but if the City
did, that the City share half the cost of this project.
Mr. Cope also requested that the City permit his client
to use the existing well on the property for use of
approximately 30 gallons of water a day.
After a lengthy discussion, it was moved by Sarlo,
seconded by Haupt, that the petitioner be required to
extend the sewer and water lines to the west property
line and bear 100% of the cost; deny request for use of
existing well and further require that the well be closed
and capped. Upon roll call, the vote was:

The Public Hearing adjourned at 7:42 p.m.
The City Council reconvened at 7:43 p.m.
Alderman Christiansen requested that Item 14 be removed
from the Consent Agenda. Alderman Chiropolos requested
that Items 20 and 21 be removed.

Consent Agenda except for Items 14, 20 and 21. Motion

recommendation of Committee of the Whole on July 6, 1993,
to place on First Reading Ordinance M-38-93, AN ORDINANCE

CITY CODE OF DES PLAINES, TO UPDATE THE NUMBER OF
LICENSES ISSUED. Motion declared carried as approved
unanimously under Consent Agenda.

recommendation of Committee of the Whole on July 6, 1993,
to approve Change Order #1 to contract with Swallow
Construction Corporation, 312 E. 18th Street, Lombard,
IL 60148, for West Side Transmission Main, to incorporate
a revised plan to rehabilitate Greenleaf Avenue between
Maple Street and Greco Avenue and a five (5) day time
extension, at a net reduction to the contract of
$2,196.92. Motion declared carried as approved

1993, and approve 1993-94 Community Development Block

reduced by $34,487.63, leaving a balance of $8,636.87;
cash warranty and guarantee will be held until all

Moved by Sarlo, seconded by Curley, that Ordinance M-20-
93, AN ORDINANCE AMENDING SECTION 9-20-2 "HOMEOWNER SEWER
MAINTENANCE RESPONSIBILITY" OF CHAPTER 20, TITLE IX, OF
THE CITY CODE OF DES PLAINES AND ADDING A NEW SECTION 9-
20-3 "PROCEDURES TO DETERMINE APPLICABILITY" and
Ordinance M-39-93, AN ORDINANCE AMENDING TITLE IX OF THE
CITY CODE OF DES PLAINES TO ADD A NEW CHAPTER 23 "SEWER
FUND" be referred back to the Engineering Committee
(later changed to Committee of the Whole) for further
review and report.
Alderman Christiansen spoke against the referral back to
committee, stating that many meetings have been held on
this matter and that the aldermen have to put faith in
the Staff that their recommendation is true and accurate.
He feels many people will benefit from these ordinances.
Perry Variano, 700 Polynesian Drive, addressed the
Council and stated that while he is not in favor of a
user tax, he is in favor of Ordinance M-20-93. Mr.
Variano suggested that perhaps one of the other options
presented at a previous meeting might be considered, i.e.
let the ordinance be changed, determine what the costs
are between now and when the 1994 tax levy has to be set,
and then it could be decided whether it would be better
to have a user tax or add the cost to the property tax.

Petitioner Jerry Resudek addressed the Council and
reviewed his alternate plan.
Ms. Bernadette Richardson, 1649 Howard Avenue, addressed
the Council and spoke against this request.
Moved by Elstner, seconded by Beauvais, to recommend to
the City Council that request for Parking Pad Variation
to permit 10' x 17' Pad in front yard on the east side
of property located at 1653 Howard Avenue be denied.
Motion declared carried (approval of this matter by the
City Council will come under Consent Agenda on August 2,
1993) .

Moved by Curley, seconded by Christiansen, to recommend
to the City Council approval of resurfacing of Webster
Lane from Oakton Street to Forest Avenue as an
alternative to scheduled resurfacing of Spruce Avenue
from Howard Avenue to the south cul de sac (part of 1993
Street Resurfacing Program approved on April 5, 1993).

the City Council approval of Change Orders 1 through 5
to contract under Local Agency Agreement for Federal
Participation with Illinois Department of Transportation
(!DOT) for improvement to intersection of Des
Plaines/River Road at Algonquin Road and improvement of
Algonquin Road between the Wisconsin Central Railroad and
Des Plaines/River Road (approved on December 21, 1992),
for various items at additional net cost to the City of
$10,416.62/1990 and 1991 GO Bond Funds.
Mr. Norm Stahl, 1718 Algonquin Road, addressed the
Council with complaints about the slowness of the work.
Mr. Albert Anderson, 1623 Algonquin Road, addressed the
Council about the hazardous construction conditions.
Mr. Jack Flynn, 1271 Fargo Avenue, addressed the Council
with complaints about the contractor.
Mr. Ted Piecko, 1699 Algonquin Road, addressed the
Council with safety concerns.
City Engineer Oakley stated that he would provide an up-
to-date work schedule for residents in the area.
Alderman Christiansen stated that there would be a public
meeting regarding the residents' concerns.
Motion declared carried (approval of this matter by the
City Council will come under Consent Agenda on August 2,
1993). Alderman Christiansen voted no.
FINANCE & ADMINISTRATION Alderman Haupt, Chair
Moved by Haupt, seconded by Sarlo, to recommend to the
City Council approval of 4% cost-of-living increase for
all non-union employees, except the City Manager,
retroactive to May 1, 1993. Motion declared carried
(approval of this matter by the City Council will come
under Consent Agenda on August 2, 1993).
Moved by Haupt, seconded by Sarlo, to recommend to the
City Council the approval of the July 21, 1993 Warrant
Register in the amount of $2,038,120.29, and Resolution
R-46-93 be adopted at appropriate time this evening.

PUBLIC SAFETY Alderman Elstner, Chair
Moved by Elstner, seconded by Sarlo, to recommend to the
City Council that bid for Air Conditioning and Humidity
Control System for the Equipment Room of the 9-1-1
Communication Center on the Second Floor of the Civic
Center be awarded to the low bidder, National Heat and
Power Corporation, 7030 N. Austin Avenue, Niles, IL
60714, in the amount of $19,577/1993 GO Bond Funds.
Motion declared carried.
Mayor Sherwood assumed the chair, and declared the City
Council back in session.
Moved by Christiansen, seconded by Elstner, to suspend
the rules to permit the public to address the matter of
fireworks. Motion declared carried.
Mr. Don Rosedale, President-Des Plaines Historical
Society, addressed the Council in support of keeping the
fireworks since the Society sells food at the event as
a fundraiser.

Moved by Haupt, seconded by Christiansen, that the City's
bi-monthly water bill be used to solicit funds for
fireworks on a volunteer basis and if at least $15,000
is not collected, no fireworks be held and the funds be
put in the Social Services budget and distributed to
City-funded community organizations.
Ms. Pat Kotnaur, Executive Director and Vice President-
Des Plaines Chamber of Commerce, addressed the Council
and suggested that in the event sufficient funds are not
donated for fireworks, what is collected be used for
holiday decorations at Christmas.
Mr. Wayne Serb in, 8 3 5 Pearson Street, addressed the
Council and reminded the aldermen that this matter was
on a referendum a few years ago and the people voted for
fireworks; the City should abide by the wishes of the
people and have fireworks.
