04/30/2012DES PLAINES PLAN COMMISSION APRIL 30, 2012 MINUTES DES PLAINES ILLINOIS The Des Plaines Plan Commission held its regularly scheduled meeting on Monday, April 30, 2012, at 7:00 P.M., in Room 102, City Council Chambers, of the Des Plaines Civic Center. PLAN COMMISSION PRESENT: Bar, Lane, Niemotka, Perez, Yi ABSENT: None Also present was Senior Planner, Scott Mangum, Department of Community and Economic Development. Chairman Niemotka called the meeting to order at 7:00 P.M. A motion was made by Commissioner Lane seconded by Commissioner Yi to approve the minutes of the March 12, 2012, hearings as submitted. AYES: NAYES: Lane, Yi, Bar, Niemotka, Perez None MOTION CARRIED NEW BUSINESS Chairman Niemotka read a summary of the one matter on the Agenda: Case Number 12-010-SUB Address: 1141 Everett Avenue Request: The petitioner is requesting a Tentative Plat of Resubdivision for Piotr Dabrowski's Second Addition Subdivision to create two lots (50' x 169' and 50' x 169'). PIN: 09-29-101-115-0000 Petitioner: Owner: Andrzej L. Bednarczyk, 12 S 355 Lemont Road, Lemont, IL 60439 Stanislaw Dabrowski, 2323 Douglas Avenue, Des Plaines, IL 60016 Andrzej L. Bednarczyk was sworn in. Mr. Bednarczyk stated that the Petitioner requests to subdivide the existing 100-foot wide lot into two 50-foot wide lots, each 8,459 square feet with the intention to build a brick single family home on each of the two lots, if subdivision approval is had. Mr. Bednarczyk stated that the homes would be a nice addition to the neighborhood and the storm sewer public improvements would benefit the neighborhood. Mr. Bednarczyk noted that the petitioner was requesting a zoning variance to allow for the creation of two 50-foot wide lots. Chairman Niemotka asked if the Commissioners had any questions of the Petitioner. Case #12-010-SUB April 30, 2012 Page 2 Commissioner Perez asked if the owner would live in one of the homes. Mr. Bednarczyk indicated that was the owner's intention. Mr. Bednarczyk also noted that since construction of the new home has started there has been renewed interest in purchasing a new homes. Chairman Niemotka asked about the timing of the storm sewer improvements. Mr. Bednarczyk confirmed that the improvements were underway and the owner intended to finish them soon. Chairman Niemotka inquired about the timing of the second home. Mr. Bednarczyk stated that the owner intended to start construction as soon as possible following subdivision and variance approvals, as there is demand for new construction. Commissioner Perez asked if staff had received any opposition. Mr. Mangum stated that staff had not received any contact from neighbors regarding the current request, but explained that petitions had been brought forward in 2001 and 2008 in opposition to the variation requests and noted that separate notification would be made for the variation requests. Existing Zoning R-1, Single Family Residential Existing Land Use Vacant Lot with a single family residence under construction on the westem \ portion of the lot. Surrounding Zoning North: R-1, Single Family Residential South: R-1, Single Family Residential East: R-1, Single Family Residential West: R-1, Single Family Residential Surrounding Land Use North: Single Family Residential South: Vacant Lot/Place of Worship East: Single Family Residential West: Single Family Residential Street Classification Everett Lane is a two lane local street. Case #12-010-SUB April 30, 2012 Page 3 Comprehensive Plan Traditional Single -Family Residential is the recommended use of the property. Total Acreage of Resubdivision 16,918 square feet (0.38 acres) General Information Lot Descriptions and Construction Plans: The petitioner is proposing to resubdivide the parcel into two lots, Lot #1 would have a width of 50 feet and Lot #2 would have a width of 50 feet, both would be approximately 169.3 feet deep. The proposed lots would both exceed the minimum required lot size (8,459 SF proposed versus 6,875 required), however, the minimum required lot width of 55-feet would be deficient. The applicant has filed for a Zoning Variation to create two lots with less than the required minimum lot width. This request would be considered by the Zoning Board of Appeals if the Tentative Plat is approved by the Plan Commission. The petitioner has already started construction of a new 4,003 square foot residence with attached 3-car garage on proposed Lot #1 and plans to construct a new single-family residence on Lot #2. The residence on Lot #1 would meet the minimum required setbacks if the lot were subdivided as proposed: Front (51' 6" vs. 25' required), Side (5' vs. 5' required), Rear (31' 5" vs. 25' required). In addition the new residence would meet the maximum lot coverage allowance of 30% if the subdivision were approved. Background Previous two -lot Tentative Plat requests were submitted and approved by the Plan Commission in 2001 and 2007. Additionally, the Zoning Board of Appeals granted approval of lot width variances in 2001 and 2008 with conditions to prohibit further variations and to set the houses back a minimum of 50' feet from the street. These previous approvals have expired. Tentative Plat Comments The petitioner must make the following additions/corrections to the original copy of the plat: 1. The Final Plat must include the correct utility easement provisions and have signatures from all public service utility companies; 2. The Final Plat must contain owner name and the signed and notarized owner certificate(s); 3. The Final Plat must contain the signed and notarized surveyor's certificate; 4. The Final Plat must include Certificates from the Plan Commission, Finance Director, Director of Public Works and Engineering, and Director of Community and Economic Development; 5. The Final Plat must state: "Send Tax Bill To: (Insert the name and address of the person(s) who will be paying the property taxes after the subdivision is recorded)." 6. The Final Plat must state: "Return Plat To: City of Des Plaines, Department of Community and Economic Development, 1420 Miner Street, Des Plaines, IL 60016." 7. The Final Plat must list the correct current PINs: 09-29-101-115-0000 8. Apply for lot width variation for 50-feet wide lots, instead of the required 55-feet; 9. If approved by the Zoning Board of Appeals, show zoning variance language on the original copy of plat of subdivision; Other Planning and Zoning Comments 1. All new electric, cable and telephone utilities must be placed underground. Staff Recommendations • The Department of Community and Economic Development recommends approval of the Tentative Plat, provided all comments are addressed. • The Public Works and Engineering Department recommends approval of the Tentative Plat, subject to the installation of storm sewer as part of the current building permit, public sidewalk escrow, and street trees. • The City of Des Plaines Fire Department recommends approval of the Tentative Plat. Case #12-010-SUB April 30, 2012 Page 4 Plan Commission Procedure The Plan Commission may vote to grant or deny approval of the Tentative Plat. Next Step for the Petitioner If approved, the petitioner's next steps are to comply with staff recommendations, await the decision of the Zoning Board of Appeals for the lot -width variation request, revise engineering plans per Public Works and Engineering comments, submit engineer's cost estimate of public improvements, revise the plat of subdivision as stated in the above Tentative Plat Comments, and submit the original mylar copy for staff review. Following staff review, the original mylar, with signatures from all the public utilities, will retum to the Plan Commission for Final Plat consideration. Chairman Niemotka asked if the Commissioners had any questions of Mr. Mangum. There were none. Chairman Niemotka asked if there were any other questions or comments from the audience. There were none. A motion was made by Commissioner Bar seconded by Commissioner Perez to grant approval of the Tentative Plat, subject to the comments listed in the Staff Report AYES: NAYES: Bar, Perez, Lane, Niemotka, Yi None MOTION CARRIED A motion was made by Commissioner Perez seconded by Commissioner Lane to adjourn.
