MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CIVIC
CENTER, Monday, November 19, 1979
CALL TO ORDER: Following introduction of the Jr. Mayor for the evening,
Tom Boeckenhauer, the regular meeting of the City Council
of the City of Des Plaines was called to order at the
direction of Mayor Herbert H. Volberding at 8:00 P.M.
in the Council Chambers, Des Plaines Civic Center, on
November 19, 1979.
ROLL CALL: Roll Call indicated the following aldermen present:
Koplos, Kolinski, Dwiel, Kehe, Ensign, Henkes, Prellberg,
Kisslinger, Birchfield, Erbach, Tomaszewski, Sarlo, Meyer,
Seitz, Ward, Egan. Jr. City Clerk Jim Teevans called the roll
Also present were: City Treasurer Swanson, City Comptroller Blietz,
Acting Commissioner of Public Works Tiernan, City Attorney Smith, Traffic
Engineer Crowley, Assistant Engineer Perl, Director of Zoning and Planning
Richardson, Building Inspector McKoveck, Police Chief Alfano, Fire Chief
Gedroic, Health Director Branding, Environmental Officer Lindahl.
PRAYER AND The meeting opened with prayer by Father Roger Wyse,
PLEDGE pastor of Holy Family Hospital followed by the Pledge of
Allegiance to the Flag.

of the regular meeting held November 5, 1979, as published.

BILLS PAYABLE Moved by Ward, seconded by Sarlo, to adopt the following
resolution proposed by Jr. Alderman William Swanson:

Moved by Koplos, seconded by Ensign, to adopt the recom-
mendation of Water and Sewer Committee made by Jr. Alderman
David Bernstein that the City Attorney be authorized to
prepare the necessary ordinance requiring the installation
of a bypass system, complete with a locking valve, for all
buildings equipped with water meters an inch and a half
and over in size. Motion declared carried.
MAINTENANCE Moved by Erbach, seconded by Tomaszewski, to adopt the
HEATING & recommendation of the Building and Grounds Committee
AIR made by Jr. Alderman Mary Carol Boemmel to award the bid
CONDITIONING for the Maintenance of Heating and Air Conditioning for
the calendar year 1980 to Comfort Systems,
the amount of $11,484.00 per year. Upon roll call, the
vote was:

tion of Building and Grounds Committee that Council ratify
the action taken administratively upon recommendation of
Committee and council members, to authorize the Mayor and
City Clerk to sign the contract for construction of the
Ellinwood Street Satellite Parking Lot with Artley.
Paving Corporation in the amount of $29,739.25, subject
to amending Section 6 of the Lease Agreement between
The First National Bank of Des Plaines, as Trustee under
Trust #96142799 and the City of Des Plaines pertaining
to the Ellinwood Street Parking Lot to read as follows:
"6. Lessee agrees to lease up to a maximum of fifty-two (52)
spaces at grade level of the Behrel Parking Plaza for
employee parking at the rate of twenty-five dollars
($25.00) per space per month. Leasing of any spaces
in excess of twenty (20) spaces shall require the approval
of the City Council of the lease for said spaces. Said
revenues shall constitute the Lessee's defined basis
of recoupment of the amortized cost outlays for said
shopper parking lot." Upon roll call, the vote was:

tion of Municipal Development Committee to approve Plat
of Paschen Industrial Park, 185 Armstrong Road, and authorize
Mayor and C ity Clerk to execute same upon receipt of
restrictive covenants having to do with easements, which
shall be attached to Plat and approved by Planning and
Zoning Department. Motion declared carried.
Moved by Meyer, seconded by Erbach, to adopt the recommenda-
tion of Municipal Development Committee to concur with
Zoning Board of Appeals in Case 79 -68 -SU, property located
at 2655 Mannheim Road and authorize City Attorney to draft

tion of Municipal Development Committee to concur with

of Municipal Development Committee to approve the text
amendment to the Zoning Ordinance, Section 12.4.6.6 having
to do with use of property "to allow municipal or

PHASE III
Jr. Alderman Sharon Lindgren made a progress report on the
status of the Transportation Center. Moved by Meyer,
seconded by Erbach, to adopt the recommendation of
Municipal Development to authorize payment to Mr. Richard
Beebe in the amount of $975.00 for consultation work done
between 8/30/79 and 10/30/79 in connection with the
above application for funds for the Transportation Center.

mendation of License and Inspection Committee made by
Jr. Alderman Rich Finucane that Lums Corporation of Illinois
be granted a Class E liquor license presently in existence
at the restaurant, subject to compliance with all rules
and regulations of all City Departments having jurisdiction,
including Health Department, Building Department, Police
Department and Planning and Zoning Department, prior to
opening for business. Motion declared carried.
Moved by Sarlo, seconded by Meyer, to adopt the recommenda-
tion of Streets and Traffic Committee made by Jr. Alderman
Michael Greene to authorize Mayor and City Clerk to
sign the Second Addendum to the Joint Agreement for FAUS
project, Rand Road, Central Road and Mt. Prospect Road,
Village of Mt. Prospect and City of Des Plaines
Upon roll call, the vote was:

LIQUOR Moved by Seitz, seconded by Meyer, to adopt the recommenda-
FINES tion of City Code and Judiciary Committee made by Jr.
Alderman Elizabeth Kaminski to increase the maximum fine
for violations of liquor laws, under Section 5-34-31 (A)
to $1,000, City Attorney to draft the necessary ordinance.
Motion declared carried.
DES PLAINES Jr. Alderman Janet Korn, reporting for Chairman Kolinski
VALLEY of the Health and Welfare Committee recommends that the
HORSEMEN'S request of Des Plaines Valley Horsemen's Association
ASSOCIATION to construct a stable on Forest Preserve land in the
City of Des Plaines should not be considered by the City
Council and further that the request is totally inappropriate
for any further consideration by this body since the
petitioner has neither a leasehold agreement nor any other
proprietary interest in the subject property.
Alderman Meyer made a minority report stating that he
did not agree with the above report to take no action, and
that since we do not allow the owning of horses or stables
within the City of Des Plaines, we should be making a
determination as to whether we should oppose the location
as requested.
Moved by Koplos, seconded by Ward to deny the request of
Des Plaines Valley Horsemen's Association to build stabling
for horses on Forest Preserve land located in the City of
Des Plaines which is a field lying on Ballard Road, east
of Rt. 14, west of I-294 and across the street from the
Cook County Highway Department Maintenance Facility.

REFUSE RATES
At this time Jr. Alderman Lisa Pine reported that the
Building Control and Inspection Committee had no report.
Jr. Alderman Bernstein reported that the Fire Department
is refurbishing Aerial Truck No. 1.
Jr. Alderman James Weise reported that Environmental
Controls Committee has no report.
Moved by Henkes, seconded by Seitz, to adopt the recommenda-
tion of Library and Historical Committee made by Jr.
Alderman Ken Rice that the City Attorney draft an ordinance
changing the maximum tax rate for the Library from .20
to .25. Motion declared carried.
Jr. Alderman Cuny, reporting for the Sanitation Committee,
urged a favorable vote on the ordinance on second reading
this evening, increasing refuse pick up rates commensurate
with rates charged to the City by the private scavenger.
BEAUTIFICATION Jr. Alderman Brian Saari reported that the Beautification
AND FORESTRY and Forestry Committee has completed summer and fall
programs.
YOUTH Jr. Alderman Kelly Beck announced a meeting to discuss
the 1979 Youth Program for the City and to consider
the request for support of an Olympic Contender.
