10/01/19561 407 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL, DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, OCTOBER 1, 1956, AT 8:00 P.M. CALL TO ORDER. The meeting was called to order by Mayor Kenneth G. Meyer who presided with Alderman Schubert, Dunlap, Tures, Wolf, Neff, Wexler, Prickett, Tistle, Nelsen, Bell, McKay and Davis responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Prickett and seconded by Wolf to approve the minutes of September 17, 1956. Alderman McKay requested a correction that there was first reading on Ordinance Official Plan Map. The motion was voted upoh by acclamation with correction made. OFFICIAL REPORTS. The Clerk submitted the reports of Building Commissioner and Clerk for September and the nine months report of Fire Chief Kolze. APPROVE CARLSON SUBDIVISION PLAT. Alderman Schubert reported that Mr. Carlson had submitted a new plat and that the Plan Commission has approved the plat that the owner has agreed to make the required public improvements. That the plat has been properly :T3 signed and attested and meets thexequirements of our ordinances except for the ® variations noted in the Plan Commission's letter of approval. The Municipal Develop- i!� went Committee recommends that the plat be approved and the Mayor and Clerk authorized to sign the same when a proper bond in the amount of 1;15,000.00 is presented to com- ,74 plete the improvements within one year. On motion by Alderman Schubert and second by et Dunlap the Council concurred in the report. 1 1 Alderman Schubert reported on petition to disannex some land about 18 acres on niver Road south of Touhy. On motion by Alderman Schubert and second by Bell the Council approved to deny disannexation. Alderman Martin appeared at this time. RESOLUT ION ON CITY PLAN REFERRED TO ZONING BOARD. On motion by Alderman Schubert and second by Dunlap the Council referred the above resolution to the Zoning Board to hold hearings on the following: 1. The property on the north side of Thacker Street beginning at the eastern edge of the right-of-way of the Northwestern Belt Line and extending generally easter- ly to a point 638.97 feet east of the eastern line of Sixth Avenue, including Lots 27 thru 37 in Block H and Lots 43 thru 70 in Block F of Cherry Highlands Second Addition to Des Plaines in Section 18 Township 41 North Range 12 east of the Thir Principal Meridian. 2. The property lying on the east side of Lee Street from Prairie Avenue to Thacker Street. On the west side of lee Street. From Prairie Ave. to Oakwood Ave. 3. The property on the West side of River Road from south side of Bennett Place to a point 144.5 ft. south of the south side of Kennicott Ct. comprising Lots 1 thru 10 in Blk 2 and Lots 1 thru 10 in Blk 5 and Lots lthru 5 in Blk 6 in Whites Steel Car Addition to Riverview being a subdivision in the NE 1/4 of the NW 1/4 of Sec 28-41-12. 4. The property on the West side of River Rd. from the southerly line of Stockton Ave. to the northerly line of Birchwood Ave. and on the north side of Howard Ave. westerly to the west line of Birch St. extended in a northerly direction. 5. The property on South side of Prospect between Pine & Chestnut Ave. including Lots 1 thru 10 in Blk 1 of Baker's Add'n to Riverview, a subdivision of the S1/2 of the SW 1/4 of the NE 1/4 of Section 29-41-12. 6. The property lying on the north side of Devon Ave. between River Rd. and Higgins Road.. Alderman Wolf reported on the application for sign at 1516 Miner Street, that they are going to change the type of sign. 408 10-1-56 BID ON NON -ARTERIAL STREETS TO SKOKIE VAT.LFY ASPHALT COMPANY. The motion was made by Alderman Bell and seconded by Wolf to award the bid on improving non -arterial streets to Skokie Valley Asphalt Company for $6,125.88, with completion extended to July 16, 1957. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Wolf, Neff, Wexler, Martin, Prickett, Tistle, Nelsen, Bell, McKay and Davis. Nays: None. The Mayor declared the motion carried. NEW TYPE TRAFFIC SIGNALS. Alderman Bell reported on the new type traffic lights for Ellinwood and Miner Street crossings. That the Street Committee recommends install- ation.of lights as recommended and replacement of equipment as specified. The motion was made by Alderman Bell and seconded by Martin to concur in the report. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Wolf, Neff, Wexler, Martin, Nelsen, Bell and Davis. Nays: Alderman Prickett, Tistle and McKay. The Mayor declared the motion carried. CUMBERLAND STREET LIGHTS. Alderman Bell said that the Cumberland Street Lights was to be discussed. Alderman Davis said they had a meeting and a representative was present with a letter from Mr. Clark, president of the Cumberland Maintenance Corporation. After the letter was read and discussion, on motion by Alderman Davis and second by Dunlap the City Engineer was instructed to prepare plans to be presented to the Board of Local Improvements so that Board can call a hearing. TO ADVERTISE BIDS FOR TRUCK. On motion by Alderman Bell and second by Martin the City Clerk is to advertise bids for a truck to be used by the several departments with the Street Department be charged for 50 per cent and the Garbage and Sewer.Departments each 25 per cent. The Superintendent to prepare specifications, bids to be returned November 5, 1956 meeting. Alderman Bell requested that each Alderman investigate and report to him on what streets are in need of improvement. This is for the five year plan. NEW FIRE DISTRICT CONTRACTS. The motion was made by Alderman Prickett and seconded by Wexler that the Mayor and Clerk be authorized to execute the new contracts for fire districts. AWARD BID ON WATER MAIN ON MINER STREET. The motion was made by Alderman Tures and seconded by Schubert that the bid on Miner Street water main be awarded to low bidder, the Clyde Wilber Plumbing and Heating Company for $10,352.50. Alderman Wolf said he thought the local bidder should receive the bid, which was about $1,000.00 higher. At request, Engineer Fletcher reported the Plumbing Company was a small company but he had received good reports on their work. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Neff, Wexler, Martin, Prickett, Tistle, Nelsen, Bell, McKay and Davis. Nays: Alderman Wolf. The Mayor declared the motion carried. Alderman McKay reported the following regarding proration of $68,000.00 fore- closure funds. The Finance Committee met with the City Treasurer and representatives of E. F. Laurin and ASsociates. The results of this meeting are that E. F. Laurin and Associates will instruct the City Treasurer as to procedures for proration of these funds. Further, the Finance Committee will investigate the possibility �f outside assistance to expidite this work, also the approximate cost and whether said cost may be legally charged as expense to these funds. On motion by AldermanMcKay and second by Martin the Council concurred in the report. APPROVAL OF BILLS. Alderman McKay presented the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOW- ING BILLS ARE DUE AND PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME. 1 Total 03,416.88. ( schedule of bills placed before each Alderman and on file with City Clerk.) The motion was made by Alderman McKay and seconded by Martin to adopt the resolution. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap. Tures, Wolf, Neff, Wexler, Martin, Prickett, Tistle,Nelsen, 8611, McKay and Davis. Nays: None. The Mayor declared the motion carried. 10-1-56 A. L. SENGSTOCK LETTER ON SALARY. The Clerk read the following letter: In connection with the new ordinance placing the Police Magistrate on a monthly salary, I understand that the City Council does not have an appropriation for this purpose for the balance of my term, which expires on May 1, 1957. In order to protect the City of Des Plaines, and to indicate that I am agreeable to perform the functions of the Office of Police Magistrate in conformity with the terms of the new Ordinance, I agree as follows: "That all Court Costs collected in the trial of the cases in the Police Court, and eminating from arrests by the Des Plaines Police Department, shall be turned over to the City of Des Plaines. That for the balance of my term expiring May 1st, 1957, I will hear all of said cases for and on a basis of $3600.00 per year, payable bi-monthly. That in the event the total amount of Court Costs turned into the City of Des Plaines, Illinois, by me, for such period, does not equal the amount of pro -rata salary for that period, based on $3600.00 per year, that I will accept such amount of Court costs as are collected, in lieu of said pro -rata salary; and should there be a deficiency in said amount of court costs, resulting in over - CD payment to me, I agree to reimburse the City of Des Plaines for such overpayment." The Mayor declared the motion carried. 1 1 City Attorney Eley reported that a police woman could be employed as police patrolman. On motion by Alderman McKay and second by Schubert that the Fire and Police Commission be instructed to certify a police woman was approved by Council. On motion by Alderman Wolf and second by Prickett the Council approved theMayor's appointment of Marshall Howard as attorney for the zoning case of land at Wolf and Rand Road. This motion was approved after a five minute recess in w hich time Alderman Davis conferred with several citizens from Cumberland regarding an attorney from that area. It was agreed that Thomas,Burlage was to confer with Attorney Howard. TO ADVERTISE BIDS FOR CLEANING 300 CATCH BASINS. On motion by Alderman Wexler and second by Bell that bids be advertised for cleaning 300 catch basins, with bids returned by October 15. The Clerk read a report from Chief 'Wigham regarding noise at Kraml Dairy at 1311 Oakwood Avenue. The Mayor ordered the report placed on file. The • motion was made by Alderman Dunlap and seconded by Scnubert to rent electronic sound equipment regarding noise at Busse Highway near Mason Lane and rear of Algonquin -Lee Shopping Center. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert,Dunlap, Wolf, Tures, Neff, Wexler, Martin, Tistle, Nelsen, Bell and McKay. Nays: Alderman Wolf and Davis. The Mayor declared the motion carried. ZONING VARIATION. The Clerk informed the. Council that the Zoning Board had granted A & P parking lot variation. Attorney Eley said this was granted with certain pro- visions. Tne Mayor referred same to Street Committee including driveway permits. Alderman McKay reported the following: The question has come up again about the possibility of getting sidewalks along Wolf Road - between Cumberland Terrace and Prairie Avenue. Hannifin could probably be persuaded to acquiesce (along the east side of Wolf) if the Park Board would agree to install the walks along the Wolf Road side of the new West Side Park and Playground. If these two sections could be arranged it should be simple to, work out the short section between Greenview and Prairie. There should be sidewalk along Wolf Road as indicated, at least on one side, especially now that the West side park is in operation. Will you please refer to the Streets Committee for consideration and recommend- ation. The Mayor referred same to Street Committee. 409 410 10-1-56 Alderman McKay reported the following: On June 4th the Traffic Commission recommendation in connection with the Wolf - Golf roads intersection in Cumberland Terrace for 4 -way stops, was accepted by the City Council, and City Clerk was to write the State Highway Dept. I think he did so and reported reply to the effect that they would look into the matter. Will you please have the City Clerk write again and urge t(hat a;stop sign be erected against west -bound traffic along Golf Wolf at this corner, as soon as possible? The Clerk was so ordered by the Mayor. Alderman Mcltay reported the following: You will recall that sometime after the destructionby fire of the Cumberland C&NW station the City Clerk wrote the Illinois Commerce Commission asking that the railroad be required to provide adequate shelter. The Commission replied they would have the matter looked into when one of their inspectors was inl the neighborhood. Later, the General Manager of the C&NW attended a meeting in CuEnberland, and I under- stand promised to take action to remedy the situation. As nothing has been done to provide reasonable shel1dr and as cold and inclement weather is undoubtedly on the way, will you pleased have the City Clerk write Mr. C. C. Channon, General Manager of the C&NW, that if we do not have prompt action we will have to press the matter with the Commerce Commission. The enclosed portion of the ticket office now available to the public is so small and cramped with a stove, bench and a large crate for newspapers, that it is difficult to get to the ticket window if 5 or 6 people are in the office tryint to get to or from the window. There is less than half as much enblosed space available to the public at this station than there was 16 years ago, although the traffic has increased greatly. The Mayor ordered the Clerk to write the letter and send copy to Commerce Com- mission. J. P. TUTHILL LETTER ON PROSPECT AVENUE CROSSING. Mr. Tuthill suggests the City enter into an agreement with Soo Line Railroad about the Prospect Avenue railroad gates. The Mayor referred the letter to the City Attorney. The Clerk read two letters from J. P. Tuthill, one that Touhy-Mannheim Road intersection is number nine on the State list to be signalized. The;other letter that as soon as a traffic volume count is made at Touhy and Scott Street he will report about traffic signs. Alderman Bell requested that the Clerk write to Mr. Tuthill about the 35 M.P.H. signs on Touhy between River Road and Mannheim. The Clerk informed the Council that letters had been received from the Governor and Chairman of State Toll Highway Commission that no change in plans could be made for Toll Road through proposed shopping center, but that they would look further into the matter. The Clerk read a letter Alderman Dunlap had received from Mr. Tuthill regarding maintenance of the grass at intersection Rand, River and Lee Streets. The Mayor referred the letter to the Park District. TABLE ORDINANCE REGARDING FEES FOR VACATING STREETS AND ALLEYS.�The Clerk read for second reading the ordinance regarding fees for vacating street' and 'alleys. After discussion the motion was made by Alderman Prickett and seconded by Schubert the ordinance be tabled. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Tures, Wexler, Martin, Prickett, Tistle, Nelsen, and Bell. Nays:: Alderman Dunlap, Wolf, Neff and McKay. The Mayor declared the motion carried. Alder- man Davis was excused to leave the meeting before this item was discussed. 10-1-56 ORDINANCE ON PARKING NORTHWEST HIGHWAY DEFERRED. The Clerk read for second reading the ordinance of parking on Northwest Highway. On motion by Alderman McKay and second by Wexler the ordinance was deferred to next meeting. ORDINANCE ADOPTING OFFICIAL PLAN MAP DEFERRED. The Clerk read for second reading the above ordinance. On motion by Alderman Prickett and. second by Wexler the ordinance was deferred until the Zoning Board completes hearings on rezoning. FIRST READING ORDINANCE ON PARKING NORTHWEST HIGHWAY. The Clerk read for first reading the ordinance to restrict parking on Northwest Highway, State Street and Broadway. The Mayor ordered it placed on file for second reading. III LETTER - NORTHSHIRE CIVIC CLUB FOR STREET DANCE. The Clerk read the above letter. On motion by Alderman McKay and second by Bell the request be granted but that they obtain a $50,000 - $100,000 bond protecting the City. PETITION TO CHANGE ROSE AVENUE TO ROSE DRIVE. The Clerk informed the Council he had a petition to change Rose Avenue to Rose Drive. The Mayor referred same to Street Com- mittee. PETITIONS REGARDING WOLF ROAD TRAFFIC. The Clerk read a letter from H. L. Kinser, a�. President, Safety Council, regarding petitions he had received on Wolf Road traffic. The Mayor referred same to Street Committee. et ADOPT RESOLUTION REGARDING POLICE MAGISTRATE SALARY. Attorney Eley read the above resolution. The motion was made by Alderman Wolf and seconded by Martin to adopt the resolution. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Schubert, Dunlap, Tures, Wolf, Neff, Wexler, Martin, Prickett,Tistle, Nelsen, Bell and McKay. Nays: None. The Mayor declared the motion carried. 1 1 Alderman Prickett reported a Mr. Kelley, 1400 block Center Street, was refused a variation on lot to build. Attorney Eley said this was under the old ordinance. The Mayor referred same to Building Control and Inspection Committee. The motion was made by Alderman Martin and seconded by Neff the Attorney draft an ordinance, that on all new annexation 10% of land must be dedicated for park and/or school. The Mayor put the question and the Clerk called the roll. Ayes: Alderman Dunlap, Neff, Wexler, Martin, Tistle, Nelsen, Bell and McKay. Nays: Alderman Schubert, Tures, Wolf and Prickett. The Mayor declared the motion carried. Alderman Nelsen reported that the Ward changes were to be discussed. It was decided to hold a meeting of the Committee of the Whole October 10, 1956 regarding same. Alderman Neff requested that the Building Commissioner report if a permit was issued for the Lighthouse'sign at River and Touhy or when the sign was erectedl ADJOURNMENT.
