MINUTES OF THE REGULAR MEETING
OF THE CITY COUNCIL OF THE CITY
OF DES PLAINES, ILLINOIS, HELD
IN THE COUNCIL CHAMBERS, CITY
HALL, MONDAY, NOVEMBER 3, 1969
CALL TO ORDER: The regular meeting of the City Council of the City of
Des Plaines, was called to order by Mayor Herbert H.
Behrel at 8:10 P.M. The meeting opened with a prayer
by Rev. Michael Kivi, pastor of Grace Lutheran Church, followed by the
Pledge of Allegiance to the flag.
ROLL CALL:
Roll Call indicated the following aldermen present:
Koplos, Prickett, Sherwood, Bolek, Leer, Figard, Hinde,
Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz,
Shillington, Michaels. Absent was Alderman Szabo.
Present also were: City Comptroller Blietz, Police Chief Hintz, Fire
Chief Haag, Commissioner of Public Works Warnicke, Building Commissioner
Schupfer, City Engineer Fletcher, and City Attorney DiLeonardi.
There being a quorum present, the meeting was in order.

MINUTES:
Mayor Behrel announced the presence of Cub Pack 164,
Den 5 and introduced the leaders as follows:
Mrs. Nancy Casey, Mrs. Mary Giblin, and Mrs. Norma
Lucansky.
It was moved by Alderman Prickett, seconded by Alderman
Swanson, to approve the Minutes of the regular meeting
Of October 20, 1969, as published. Motion declared
Carried.
REPORTS OF Placed on file were the following reports: Fire Depart -
CITY OFFICIALS'' ment Quarterly report; Health Department - October;
Building Department, October.
Police Chief
Police Chief Hintz reported that the Police Department
received 100 calls October 31st from 3 p.m. to 8 a.m.
relating to Halloween pranks.
Fire Chief Fire Chief Haag reported that he attended the International
Fire Chief's convention, finding it to be informative.
Further that one of the ambulances was involved inan
accident in which two firemen were injured.
Bt�i�elg-- Building Commissioner Schuepfer reported that a new
Commissioner plumbing inspector was hired today and that the City
is readvertising for the position of Electrical
Inspector as previous applicants did not meet the
qualifications.
LEGAL SUIT City Attorney DiLeonardi reported that a suit has been
Ballard & filed against the City by the property owners and
Potter Cities Service Oil Company in Zoning Case 69 -49 -SU,
ZONING CASE regarding the use of property located at Ballard and
69 -49 -SU Potter Roads as a gasoline service station. It was
moved by Alderman Sherwood, seconded by Alderman Michaels,
to authorize the City Attorney to defend the City in
said case. Upon roll call, the vote was:
AYES: - 14 - Alderman Koplos, Prickett, Sherwood, Bolek,
Leer, Figard, Czubakowski, Wagner, Thomas,
Bonaguidi, Seitz, Shillington, Michaels,
Mayor.

Moratorium reviewing Illinois cases relative to a moratorium on'

Drive -In the submission of the draft of an ordinance amending
Restaurants the Zoning Ordinance by permitting drive-in restaurants
as special uses only in the C-2 and C-3 Commercial
categories, it was moved by Alderman Sherwood, seconded
by Alderman Michaels, to authorize the City Attorney to
petition the Zoning Board of Appeals for aforementioned

Zoning recommendation to concur with reports of the Plan Com -
69 -50 -SU mission and Zoning Board in Case 69 -50 -SU, 1560 Mt.
Mt. Prospect Prospect Road, to grant Special Use for Gasoline Service
Station, and authorize the City Attorney to prepare the
necessary amendment to the Zoning Ordinance for further
consideration by the Council. Upon roll call, the vote
was:

Hinde, Czubakowski, Swanson, Thomas,

POLICE It was moved by Alderman Thomas, seconded by Alderman
UTILITY Bonaguidi, to concur with Police Committee's recommenda-
VAN tion to advertise for bids returnable November 24th at
10 a.m. for a Police Utility Van - specifications to be
written by Police Chief. Motion declared Carried.
RESOLUTION Following the reading of Resolution R-17-69, authorizing
R-17-69 the Mayor to negotiate with representative members of
Police the Police Department who may be officers of the Des
Department Plaines Chapter of the CCPA and establishing an arbi-
tration panel to hear and mediate disputes between the
City and the Police Department relating to economic and
non -economic working conditions, it wasmmoved by Alderman
Figard, seconded by Alderman Prickett, to adopt Resolution
R-17-69 - Upon roll call, the vote was:
AYES: - 15 - Alderman Koplos, Prickett, Sherwood, Bolek,
Leer, Figard, Hinde, Czubakowski, Swanson,
Thomas, Bonaguidi, Seitz, Shillington,

FIRE It was moved by Alderman Hinde, seconded by Alderman
EQUIPMENT Figard, to concur with Fire Committee's recommendation
ENGINE #6 to authorize the repair of Fire Equipment Engine #6,
Repairs by Charles Equipment Company at a cost not to exceed
$4,500. Upon roll call, the vote was:

CHLORIDE Shillington, to concur with Streets and Traffic Committee's
recommendation to award the bid for Calcium Chloride
to the low bidder, Dow Chemical Company in the amount
of $49.60 per ton delivered. Upon roll call, the vote was:

STOP SIGNS It was moved by Alderman Leer, seconded by Alderman
Bradley, Shillington, to concur with Streets and Traffic Committee's
Brentwood recommendation to post stop signs for Dulles Road to
Dulles stop for Bradley, Brentwood Drive to stop for Dulles,
Beau and a 4 -way stop at Dulles and Beau Drive, authorizing
the City Attorney to draft the necessary amendment.
Motion declared Carried.
DRIVEWAY It was moved by Alderman Leer, seconded by Alderman
Howard St. Wagner, to concur with Streets and Traffic Committee's
J. L. Williams recommendation to approve driveway permit of J. L.
Williams Co. for a driveway on Howard Street - 70'2".
Motion declared Carried.
DRIVEWAY It was moved by Alderman Leer, seconded by Alderman
Touhy & Wolf Koplos, to approve the driveway permits of J. L. Williams
J. L. Williams and Co. for the following driveways to serve warehouse
and office at the southeast. corner of Touhy and Wolf Rds:
72'4", includes island; 47'2L, includes island; and
62'4" , all entering Wolf Road. Motion declared

PARKING
Revised
System
& Saturdays
Alderman Leer reported that the Streets and Traffic
Committee has investigated the system of Parking in
the entire City and recommends the City Attorney draft
an ordinance prohibiting parking on one side of the
street Mondays, Wednesdays, Fridays, and Sundays,
and on the other side of the street,. Tuesdays, Thursdays,
on those streets upon which the alternate parking
schedule now exists.
MFT It was moved by Alderman Leer, seconded by Alderman
RESOLUTION Bolek, to adopt resolution appropriating $20,000 motor
Section 87CS fuel tax funds for planning of the extension of Thacker
Street across the river and the underpass on River
Road under the railroad tracks ad Miner Street, requesting
further that H. W. Lochner Co. submit a proposal for
said planning. Upon roll call, the vote was:

RESOLUTION Shillington, to concur with Streets and Traffic
SECTION 88CS Committee's recommendation to adopt resolution appro-
priating $5,000 motor fuel tax funds for working drawings
for an underpass or an overpass of the C&NW Railway
freight line west of Wolf Road, to be drawn by E. N.
Fletcher. Upon roll call, the vote was:

DEMPSTER Following the reading of a letter from Thomas G.
AND Cots, Superintendent of Highways, Cook County, re
MARSHALL the traffic control devices at the intersection of
Dempster and Marshall Streets, it was moved by Alderman
Shillington, seconded by Alderman Figard, to communicate
with Mr. Cots requesting details which they claim
do not meet the warrants set forth in the State's
Manual of Uniform Traffic Control Devices for Streets
and Highways and determine if pedestrian traffic was
taken into consideration?. Motion declared Carried.
WATERMAIN It was moved by Alderman Figard, seconded by Alderman
SEEGERS RD. Thomas, to concur with Water Committee's recommendation
to award the bid for the Seegers Road Watermain to
J. B. Divito Company, in the amount of $11,835.00 and
return checks and or bonds of the unsuccessful bidders.
Upon roll call, the vote was:

BIDS Thomas, to concur with Water Committee's recommendation
WATER to advertise for bids returnable November 24th at 10 a.m.
Circulating for work on the circulating equipment in the new section
of the Water Softening Plant and recarbonation equipment
in the old section of said plant - specifications to
be drawn by the City Engineer and Commissioner of
Public Works. Motion declared Carried.
ADV. BIDS It was moved by Alderman Figard, seconded by Alderman
Lime beds Hinde, to concur with Water Committee's recommendation
to advertise for bids for the cleaning of the lime
pits, returnable November 24th at 10 a.m. Motion
declared Carried.

Fargo Ave. Thomas, to concur with Sewer Committee's recommendation
to advertise for bids returnable November 24th at 10 a.m.
for Fargo Avenue Sanitary Sewer - City Engineer to
prepare necessary specifications. Motion declared

STORM SEWER
SECTION 18A
River Street
It was moved by Alderman Bonaguidi, seconded by Alderman
Thomas, to concur with Sewer Committee's recommendation
to advertise for bids for Section 18A of the storm
sewer program - River Street - returnable November 24th
at 10 a.m. - specifications to be prepared by City
Engineer. Motion declared Carried.
PARKING LOT It was moved by Alderman Koplos, seconded by Alderman
ELLI NWOOD ST. Bonaguidi, to concur with Parking Lots and Finance
Committee's recommendation to award the contract for
the improvement of the Parking Lot on Ellinwood Street
to the low bidder, Rock Road Construction Co., in the
amount of $6,219.00 and return checks and or bonds of
unsuccessful bidders. Upon roll call, the vote was:

Non -Resident the necessary amendment to the ordinance increasing
the non-resident parking permit fee to $25 for a six
month period from January 1, 1970 to June 30, 1970,
or any portion thereof. Motion declared Carried.
PARKING METERS It was moved by Alderman Leer, seconded by Alderman
POST OFFICE Bolek to post signs on Graceland Avenue in front of
the Post Office - "For Post Office Use Only - 15
Minute Limit", and not replace the former parking meters.

CITY Alderman Prickett, Chairman of the Special Committee
ENGINEER to recommend a candidate for City Engineer, reported
that the Committee recommends Mr. Robert E. Bowen.
It was moved by Alderman Prickett, seconded by Alderman
Figard, to concur with Mayor Behrel's appointment of
Mr. Robert E. Bowen as City Engineer. Motion declared
Carried and Mr. Bowen was introduced to the Council at
this time, along with Mrs. Bowen. //�

SECTION 84CS Figard, to concur with Streets and Traffic Committee's
Seeger Rd. recommendation to award the bid for MFT Section 84CS,

extension to the low bidder, Rock Road Construction
Company, in the amount of $57,963.50 and return the
checks and or bonds of the unsuccessful bidders.

Michaels, to concur with Forestry Committee's recom-
mendation to award ahcohtract to Towers Tree Experts,
Inc. to remove approximately 300 trees at a cost of
$2.71 per diameter inch, contract to expire December
30, 1969. Upon roll call, the vote was:

to Council the estimate of costs and feasibility of
a Forestry Department within the City of Des Plaines.
Motion declared Carried.

Alderman Sherwood, Chairman, announced the events of
Youth Appreciation Week as follows: Saturday, November
8th at 9 a.m. - swearing in ceremony; Thursday, November
13th tour and dinner; November 15, City tour and lunch.
It was moved by Alderman Figard, seconded by Alderman
Shillington, to authorize Civil Defense Director Arthur
to proceed with negotiations with the University of
Illinois to set a meeting for the City of Des Plaines
regarding emergency teaching principles. Motion declared
Carried.
It was moved by Alderman Prickett, seconded by Alderman
Swanson, to adopt the following resolution: BE IT
RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES

RESOLUTION
AIRPORT
It was moved by Alderman Swanson, seconded by Alderman
Figard, to concur with Special Aeronautics Committee's
recommendation to authorize the City Attorney to
draft a resolution urging the City of Chicago Airport
Authority to expedite plans for construction of another
airport elsewhere. Motion declared Carried.
AIRPORT NOISE It was moved by Alderman Prickett, seconded by Alderman
ABATEMENT Thomas, to concur with Mayor Behrel's appointment of
COUNCIL Mr. A. H. Castle, 1029 W. Grant Drive, to represent
Des Plaines on the O'Hare Noise Abatement Council.
Motion declared Carried.
ORDINANCE Following second reading, it was moved by Alderman
Z-21-69 Prickett, seconded by Alderman Swanson, to adopt Ordinance
1181 VanBuren Z-21-69, rezoning property located at 1181 VanBuren to
C-2 Commercial District. Upon roll call, the vote was:
AYES: - 2 - Alderman Prickett, Bonaguidi.

ORDINANCE Placed on First Reading was Ordinance B-6-69 amending
B-6-69 the Building Code by adding all property situated within
Conflagration the C-4 and R-5 Zoning Districts to the Conflagration
Hazard Dist. Hazard District Number One.
ORDINANCE Placed on First Reading was. Ordinance M-47-69 - The
M-47-69 Position iiidssification and Compensation Plan -
Salary Salary Ordinance. Granted permission by the Council
Attorney William Jacobs addressed the Council speaking
for the Department of Public Works, requesting larger
increases in salaries for Public Works employees.
ORDINANCE It was moved by Alderman Thomas, seconded by Alderman
M-48-69 Swanson, to waive First Reading of Ordinance M-48-69
Plant & Fence having to do with Plant and Fence Restrictions on
Restrictions Parkways. Motion declared Carried. It was moved by
Parkways Alderman Thomas, seconded by Alderman Swanson, to adopt
Ordinance M-48-69. Upon roll call, the vote was:

Placed on First Reading was Ordinance T-25-69 providing
for four way stop signs at the intersections of
Welwyn Avenue and Cedar Street and White Street and
Riverview.
It was moved by Alderman Czubakowski, seconded by Alderman
Wagner, to waive First Reading of Ordinance T-26-69,
providing for "No Parking At Anytime, except Saturdays
Sundays or legal holidays on Plainfield Avenue from
Howard Street north to Plainfield School. Motion declared
Carried. It was moved by Alderman Czubakowski, seconded
by Alderman Wagner, to adopt Ordinance T-26-69.
Upon roll call, the vote was:
AYES: - 16 - Alderman Koplos, Prickett, Sherwood, Bolek,
Leer, Figard, Hinde, Czubakowski, Wagner,
Swanson, Thomas, Bonaguidi, Seitz,
Shillington, Michaels, Mayor.

Placed on First Reading was ';Ordinance T-27-69 prohibiting
a vehicle exceeding 6,000 pounds gross weight to be
driven upon Bellaire Avenue from Ballard Road to Dead
End thereof and Church Street from Bellaire Avenue to
Lyman Avenue.
Placed on First Reading was Ordinance T-28-69 providing
for a 3 -way stop sign at the intersection of Waikiki and
Third Avenues.
Placed on First Reading was Ordinance T-29-69 increasing
the meter rate for ten hour meters in city parking lots
from 25 to .50.
The letter from Des Plaines Zoning Board of Appeals re
Case 69 -6 -SU - Special Use of property located at 955
S. Elmhurst Road for Gasoline Service Station, was
referred to the Municipal Development Committee for study
and report.
The request of Allied Supermarkets, Inc. for liauor license
for the K Mart Food Store to sell packaged beer only at
1111 Oakton Street was referred to the License Health
and Inspection Committee.
The Public Notices from Department of Public Works and
Buildings re proposed installation of a 2 inch gas main
over and across Weller Creek by Northern Illinois Gas
Co. and proposed construction of a concrete Parking
Deck, partially overhanging Willow Creek were referred
to City Engineer for research.

of the following Cook Co. Zoning Dockets: 1590, 1645,
1637, 1638, 1674, 1681. Upon roll call, the vote was:

The request of Thomas Realty for a lot division on
Seminary Avenue was referred to the Plan Commission for
study and report.
The letter from Des Plaines Zoning Board of Appeals
re 69-54-A - Planned Unit Development Ordinance was
referred to the City Attorney for drafting of final
ordinance.
LIQUOR LICENSE The revised Liquor License Application submitted by the
APPLICATION Mayor was referred to City Attorney for approval prior
to printing.
TREE CONTRACT
WAIVE ADV.
It was moved by Alderman Leer, seconded by Alderman
Koplos to waive the advertising for bids prior to
awarding of contract to Tower Tree Experts, Inc. to
remove approximately 300 trees, described on page six
of this meetings record. Motion declared Carried.
FENCE - between Alderman Bolek's request for text amendment requiring
C-2 and developer of Commercial property to erect a fence
Residential where residential property abuts was referred to the
Building Control and Inspection Committee for study
and report.
ARCHDIOCESE Mayor Behrel described the holdings of property of
PROPERTY the Archdiocese north and south of Central Road on the
Central Rd. border of City limits and explained to Council prior
conversations regarding the installation of watermain
on Central Road to serve property on the north side
of Central Road, west of River Road, at an estimated
cost of $30,000. Members of Council verbally agreed
that the Mayor should continue negotiations with the
Archdiocese regarding annexation and possibility of
the City installing said watermain to serve the property.
ADJOURNMENT: It was moved by Alderman Shillington, seconded by Alderman
Sherwood, that the regular meeting of the $ity Council
adjourn. Motion declared �arried.
