09/16/1969196 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, SEPTEMBER 16, 1969 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines, was called to order by Mayor Herbert H. Behrel at 8:05 PLM. The meeting opened with a prayer by Rev. Gerald Dodge, Assistant Pastor of St. Mary's Catholic Church, followed by the Pledge of Allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Prickett, Sherwood, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. Absent were: Aldermen Szabo, Leer, Seitz. Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief Haag, Commissioner of Public Works Warnicke, City Engineer Fletcher, Building Commissioner Schuepfer, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. Alderman Szabo arrived immediately following roll call. WALTROP GERMANY Plaque Waltrop, Germany Mayor Behrel introduced Mr. Thomas Peterson, American Field Service student who visited Waltrop, Germany, this summer who presented the Mayor with Plague from Waltrop, Germany accompanied with letter from the Mayor. He described in detail his reception by the governing body, including the Mayor, of Waltrop, and hiss impressions of the German people and geographic environment. Following his presenta- tion, it was moved by Alderman Figard, seconded by Alderman Sherwood, to adopt a Resolution of Acceptance, to be forwarded to the Mayor of Waltrop, along with copy of Municipal Services Booklet and Chamber of Commerce booklet and write a letter of Commendation to Mr. Thomas Peterson for being a good will ambassador for the City of Des Plaines. Motion declared Carried. It was moved by Alderman Shillington, seconded by Alderman Figard, to authorize the Mayor and City Comptroller to design or locate a suitable plaque to be sent to the officials of the City of Waltrop, Germany. Upon roll call, the vote was: AYES: - 16 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 1 - Alderman Leer There being sixteen affirmative votes, Motion declared Carried. Alderman Seitz arrived during Mr. Peterson's presentation. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Swanson, to approve the Minutes of the regular meeting of September 2, 1969, as published. -The Clerk offered an amendment to Page three "Library Addition", as follows: Words "add an additional service building which will provide additional stack space" deleted and insert "build a Bookmobile garage with basement area to provide additional stack space." Following correction, Motion declared Carried. REPORTS OF CITY OFFICIALS: Police Chief Hintz reported that the infant found deceased Police Chief in the 1900 block of Ash Street was found by the coroner to be stillborn and is therefore not a homicide case. Fire Chief Fire Chief Haag reported that a survey is being conducted by the Fire Department to determine the type of equipment and cost of installation for schools and industry to /J connect to the City's Fire Alarm System. 1 9/15/69 197 Page two Adv. for Bids It was moved by Alderman Bonaguidi, seconded By Alderman Section 18 Seitz, to advertise for bids returnable October 13th at Storm Sewer 10 a.m., for Section 18 of the Storm Sewer Program, City Engineer to draft necessary specifications. Motion declared Carried. City Attorney City Attorney reported on the progress of the Beam suit, stating that he will proceed with a motion seeking the dismissal of said case against the City. He further reported on the progress of the Mt. Prospect Annexation case, stating that October 15th the court will rule on new objections filed by the City. Interpretation City Attorney DiLeonardi submitted a memorandum regarding Section the interpretation of Section 3-11-16 of the Illinois 3-11-16 Municipal Code having to do with deferment of action on Committee report. SUIT City Attorney DiLeonardi reported that a suit has been Spindler filed before the United States District Court against the City by Dean and Opal Spindler re removal of trees on Scott Street. It was moved by Alderman Prickett, seconded by Alderman Wagner, to authorize the firm of DiLeonardi, Samuelson, and Hofert to defend the City and individual members named in the suit. IIICommissioner Commissioner of Public Works Warnicke reported that of of Public the 704 stumps to be removed, 430 have been completed. Works 652 Dutch Elm diseased trees have been marked for removal, and the survey on private property of diseased trees is not completed. He further reported that the tree planting season is approaching and that it is possible to purchase 400 trees from Simonson on Wolf Road and 400 trees from Boyd Nursery in Tennessee. Agreement Sanitary Disposal Survey The agreement to conduct a sanitary disposal survey with use of bags was referred to the Sanitation Committee for study and report. After discussion, it was moved by Alderman Sherwood, seconded by Alderman Koplos to table the motion. ZONING CASE It was moved by Alderman Swanson, seconded by Alderman 69-48-R Szabo, to concur with Muni6ipal Development Committee's 1816 Rand Rd. recommendation to deny petition to rezone property located -at 1816 Rand Road from R-2 to R-4, Case 69-48-R. Motion declared Carried. ZONING CASE 67-8-R 1533 Des Plaines Ave. DEDICATION EIGHTH AVE. ZONING CASE 69 -37 -RA 1541 & 1551 Elmhurst Rd. It was moved by Alderman Swanson, seconded by Alderman Hinde, to concur with Municipal Development Committee's recommendation to concur with the report of the Zoning Board in Case 67-8-R - property located at 1533 Des Plaines Avenue, and authorize the City Attorney to prepare the amendment to the Zoning Ordinance for further consideration by the Council, to rezone from R-2 to C-2. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Hinde, to concur with Municipal Development Committee's -recommendation to accept Plat of Dedication of portion of EighthAvenue from Drake to Stone and authorize Mayor and City Clerk to execute same. It was moved by Alderman Shillington, seconded by Alderman Szabo, that Council reconsider action taken at the last regular meeting on Zoning Case 69 -37 -RA, property located at 1541 and 1551 Elmhurst Road. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Shilling ton, to authorize the City Attorney to prepare the necessary rezoning and annexation ordinance in Zoning Case 69 -37 -RA for further consideration by the Council. ZONING CASE It was moved by Alderman Swanson, seconded by Alderman 69-42-R Prickett, to concur with Municipal Development Committee's 1181 VanBuren recommendation to concur with Zoning Board of Appeals in Case 69-42-R, and authorize the City Attorney to prepare the necessary amendment to the Zoning Ordinance for further consideration by the Council. After discussion, motion was withdrawn. It was moved by Alderman Prickett, seconded by Alderman Michaels, to authorize the City Attorney to prepare the necessary amendment to the Zoning Ordinance in Case 69-42-R - rezoning property located at 1181 VanBuren to C-2 Commercial. Alderman Bolek announced the meeting of the License, Health and Inspection Committee, 8 a.m. September 16th Alderman Figard set a meeting of the Water Committee for 8:30 September 22nd. It was moved by Alderman Wagner, seconded by Alderman Swanson, to concur with Building Control and Inspection Committee's recommendation to appreve the sign request of Des Plaines National Bank for a sign 84 sq. feet to be located at the corner of Perry and Lee Streets. Motion declared Carried. SHOPPING CENTER It was moved by Alderman Wagner, secondedby Alderman Thomas, 850 Elmhurst to concur with Building Control and Inspection Committee's recommendation to approve the sign request for a Shopping Center Identification sign at 850 Elmhurst Avenue, 23'6" high by 14'. Motion declared Carried. DENY SIGN It was moved by Alderman Wagner, seconded by Alderman 1313 Rand Rd. Bonaguidi, to concur with Building Control and Inspection Committee's recommendation to deny sign request of Pool & Patio at 1313 Rand Road. Motion declared Carried. Parking Lot It was moved by Alderman Koplos, seconded by Alderman Wagner Lease to concur with Parking Lots Committee's recommendation Agreement that Cmty..:1 enter into a agreement - two year lease agreement - with Des Plaines Tomorrow Corporation based upon a 50-50 split of the gross revenue at the rate of 50 per day per parking space - the lease shall state that the Des Plaines Tomorrow Corporation may at anytime after the stated two year period, terminate said agreement upon a written ninety days notice to the City. YOUTH Alderman Sherwood, Chairman, reported that the Youth ADVISORY Activity Committee would like to organize a Youth Advisory COMMITTEE Committee, consisting of nine Des Plaines youth who are junior and seniors in High School with one adult advisor to work with the Youth Activity Committee and Youth Commission. It was moved by Alderman Thomas, seconded by Alderman Czubakowski, to give said Committee a Vote of Confidence in organizing said Youth Advisory Committee. Motion declared Carried. COMMITTEE Alderman Sherwood set a meeting of Youth Activity Committee MEETING with Youth Commission for September 18th at 8 P.M. Civil Defense Alderman Czubakowski submitted the written report of Civil Defense Director Arthur, stating that the next meeting will be held in the Des Plaines area. No Action The Plat of Dolores Resubdivision and letter from Plan Commission re same was referred to the Municipal Development Committee for study and report. It was moved by Alderman Prickett, seconded by Alderman Swanson, to adopt a resolution authorizing the Mayor and City Clerk to execute an agreement between the City of Des Plaines and the State of Illinois, regarding the improvement of Weller Creek, Stages II and III. Upon roll call, the vote was: AYES: - 16 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 1 - Alderman Leer There being sixteen affirmative votes, Motion declared Carried. It was moved by Alderman Bonaguidi, seconded by Alderman Prickett, to authorize the expenditures of Alderman Swanson and Mayor Behrel to attend the Aircraft Noise Seminar, to be held in Washington, D. C., October 8th and 9th, planned by Mayors of Hempstead, N. Y. and Englewood, California. Upon roll call, the vote was: AYES: - 16 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Alderman Czubakowski's request to post 25 mile per hour speed limit signs on Lee Street, south of Howard Street to Touhy Avenue, was referred to the Police Department for traffic survey.
