08/18/1969MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINESJ?.ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, AUGUST 18, 1969 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines, was called to order by Mayor Herbert H. Behrel at 8:13 P.M. The meeting opened with a prayer by Rev. James Jackson of Christ E & R Church, followed by the Pledge of Allegiance to the flag. ROLL CALL: Roll call indicated the following aldermen present: Koplos, Prickett, Sherwood, Bolek, Leer, Figard, Hinde Czubakowski, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Absent were: Szabo,, Wagner, and Swanson. Also present were: Assistant City Comptroller Carlsen, Police Chief Hintz, Fire Chief Haag, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: It was moved by Alderman Prickett, seconded by Alderman Sherwood, to approve the Minutes of the regular meeting of August 4, 1969, as published. Motion declared Carried. REPORTS OF CITY Placed on file was the Statement of Cash Receipts from OFFICIALS: January 1 to July 31st. POLICE DEPT: Police Chief reported that Sgt. Timmons and Officer Carnaghi have resigned from the Police Department, in addition to Officer Chelini. It was moved by Alderman Thomas, seconded by Alderman Koplos, to authorize the Board of Fire and Police Commissioner to set up an examination for patrolmen. Motion declared Carried. SIDEWALKS City Engineer Fletcher reported on the progress of the Nimitz & Orchard Place Special Assessment improvement program North Shore stating that property owners on Nimitz and North Shore are desirous of installing sidewalks where the streets were previously improved. This matter was referred to the Streets and Traffic Committee and City Attorney for drafting of necessary ordinance. Mt. Prospect City Attorney DiLeonardi reported that the Judge over - Annexation ruled the objections of the City and United Air Lines Case in the Mt. Prospect Annexation case. Adiderman Wagner arrived at this time. After discussion, it was moved by Alderman Bolek, seconded by Alderman Prickett, that the Council continue the Mt. Prospect annexation case and appeal the court's decision when the proper time arrives. Upon roll call, the vote was: AYES: - 15 - Alderman Koplos, Prickett, Sherwood, Bolek Leer, Figard, Hinde, Czubakowski, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 2 - Alderman Szabo, Swanson There being fifteen affirmative votes, Motion declared Carried. =Alderman Szabo arrived at this time. "Drive -In" City Attorney DiLeonardi submitted a memorandum regarding Restaurants a Special Use Classification for Drive -In Restaurants. It was moved by Alderman Bolek, seconded by Alderman Leer, that copies of the restrictive covenants on property located at Oakton and Executive Way which is the proposed location of the new Post Office be forwarded to Illinois Senators and Congressman, Postmaster General and interested officials of the Post Office Department. Motion declared Carried. The subject of the Dump Site located at River and Golf Roads was discussed and Mayor Behrel requested to obtain in writing a statement from Mr. Edward DeBoer as to when the site cover-up will be finalized. It was moved by Alderman Prickett, seconded by Alderman Wagner, that Council concur with Municipal Development Committee's recommendation to concur with Zoning Board of Appeals in Cases 69-39-R, 69-40-R, 69-41-R, and deny petition to rezone property located at the southeast corner of Dale and Touhy to C-2 Commercial District. Motion declared Carried. It was moved by Alderman Prickett, seconded by Alderman Michaels, to remove from the table the motion to concur with Zoning Board of Appeals in Case 69-42-R, 1181 VanBuren Avenue. Motion declared Carried. Aldermen Shillington, Szabo, Bolek, Leer voted No. It was then moved by Alderman Prickett, seconded by Alderman Koplos to defer action until next meeting. The motion to concur with Municipal Development Committee's recommendation to authorize the City Attorney to draft the necessary ordinances to rezone property located at 1541 to 1551 Elmhurst Road, Zoning Case 69 -37 -RA, was placed before the Council. It was moved by Alderman Prickett, seconded by Alderman Shillington to table motion. Motion declared Carried. It was moved by Alderman Prickett, seconded by Alderman Figard, to concur with Municipal Development Committee's recommendation to deny zoning petition in Case 59-43-R, property located at 575, 579, and 583 Forest Avenue Motion declared Carried. It was moved by Alderman Prickett, seconded by Alderman Sherwood, to concur with Municipal Development Committee's recommendation to concur with Zoning Board of Appeals in Case 69-44-R, 1854 Berry Lane, and authorize the City Attorney to draft the necessary ordinance for further consideration by the Council. Motion declared Carried. It was moved by Alderman Thomas, seconded by Alderman Koplos, to concur with Police Committee's recommendation to adopt a resolution approving the Mutual Aid Police Agreement with surrounding municipalities. Hinde, to concur with Police and Finance Committee's Files recommendation to authorize City Comptroller to issue a purchase order to Motorola Company for radio communications center equipment at an approximate cost of $50,000 and also two custom designed police files. WATER PUMP It was :,moved by Alderman Szabo, seconded by Alderman STATION Figard, to concur with Building and Grounds Committee's Maple St. recommendation to authorize the Building and Grounds Committee and Comptroller Blietz to negotiate for the demolition of the abandoned water pump house, located at 2607 Maple Street. Later changed to 8:30 P.M. MFT - 81CS It was moved by Alderman Leer, seconded by Alderman Traffic Seitz, to concur with Streets and Traffic Committee's Signals recommendation to award the bid for Traffic Lights Third & Rand at Third and Rand Roads - MFT Section 81CS - to H- H Electric Co., low bidder of $28,435.95, and return the check or bond of -the unsuccessful bidder. Upon roll call, the vote was: AYES: - 16 - Alderman Koplos, Szabo, Prickett, Sherwood, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Harding Ave. Left -turn COMMITTEE MEETING NO PARKING The letter from the State Highway Department regarding legislation prohibiting left turns into Harding Avenue from River Road was referred to Mayor Behrel to suggest that the State Highway Department complete the island and therefore prohibiting left turns on existing rumble strip. Alderman Leer set a meeting of the Streets and Traffic Committee for Wednesday, August 27th at 8:00 P.M. It was moved by Alderman Szabo, seconded by Alderman River Street Prickett, that "No Parking 8 A.M. to 5 P.M., except Saturday, Sunday and legal holidays" be posted by Police Order on River Street from River Road east, and City Attorney be authorized to draft necessary ordinance. Motion declared Carried. VOLUNTARY ANNEXATION to Maine North Hi -School It was moved by Alderman Figard, seconded by Alderman Bonaguidi, to concur with Water Committee's recommendation to authorize the Mayor and City Attorney to negotiate the voluntary annexation to the City of the Forest Preserve property east of of Nazareth property, the Railway right of way, the of way, the Toll Road for Edison right of way, east Maine Township North High School District 63 Junior declared Carried. and adjoining the Holy Family Chicago and Northwestern Commonwealth Edison right the width of the Commonwealth of the Toll Road to the School site and site of High School site. Motion WATERMAIN It was moved by Alderman Figard, seconded by Alderman Maine North Prickett, to concur with Water Committee's recommendation Dist. 207 & that the City share the cost of a 12" watermain to 63 serve School District 207 and 63 with water at the rate of 25% as public benefit, providing the annexation mentioned above can be accomplished, and in the event the annexation is not approved, no obligation for the City to service the proposed sites of Maine North and District 63 Junior High School with water. SIGN It was moved by Alderman Wagner, seconded by Alderman Barnabys Thomas, to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Barnabys for sign at Wolf and Touhy Avenue. SIGN It was moved by Alderman Wagner, seconded by Alderman Des Plaines Thomas, to concur with Building Control and Inspection Nat'l Bank Committee's recommendation to approve the sign requests of Des Plaines National Bank for three signs at Lee and Perry Streets, but deny request to waive five foot set -back requirements. COMMITTEE MEETING Elm Tree Disease "Kiwanis" Property Alderman Koplos set a meeting of the Parking Lots Committee with Finance Committee and City Engineer for 8:30 P.M., August 27th. Alderman Leer, Chairman of the Elm Tree Disease Committee, reported that a survey indicates 548 dead trees on public property and on private property the survey is not complete. Tree trimming will be completed within the next two or three weeks. It was moved by Alderman Michaels, seconded by Alderman Bonaguidi, to concur with Judiciary Committee's recommendation to grant the request for a public hearing to owners of the property commonly known as "Kiwanis Property" and suggest a joint hearing be held before the Plan Commission and Zoning Board on proposed "Special Use Planned Development". Motion declared Carried. COMMITTEE Alderman Michaels set a meeting of the Judiciary Committee MEETING and City Code Committee for August 25th at 8 P.M. BILLS PAYABLE: It was moved by Alderman Prickett, seconded by Alderman Hinde, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $88,803.99.
