06/02/1969146 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, CITY HALL, MONDAY, JUNE 2, 1969 CALL TO ORDER : The regular meeting of the City Council of the City of Des Plaines, was called to order by Mayor Herbert H. Behrel at 8:05 P.M. The meeting opened with a prayer by Reverend Allen Fedder, pastor of the Emmanuel Lutheran Church, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Koplos, Szabo, Figard, Hinde, Wagner, Swanson, Thomas, Bonaguidi, Shillington, Michaels. Absent were: Prickett, Sherwood, Bolek, Leer, Czuba= kowski, Seitz. (Alderman Seitz arrived after approval of the Minutes) Also present were: City Comptroller Blietz, Police Chief Hintz, Fire Chief Haag, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer E. N. Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. PRESENTATION Mayor Behrel introduced to Council Miss Martha Bushey, OF HONOR former LaCapitan; Miss Joyce Prentice present LaCapitan; Des Plaines and Mrs. Debra Meador, Director of Des Plaines Bethel Bethel #105 #105, International Order of Job's Daughters Drill Team, and announced to Council the honors recently bestowed them for proficiency. It was moved by Alderman Figard, seconded by Alderman Koplos that the Mayor be authorized to write letters of commendation to these girls and the Drill Team. Motion declared Carried. MINUTES: MEMORIAL DAY WEEKEND REPORTS OF CITY OFFICIALS: TAX RATE OBJECTIONS KIWANIS PROPERTY COOK COUNTY ZONING DOCKET #1549 It was moved by Alderman Figard, seconded by Alderman Wagner, to approve the Minutes of the Meeting of May 19, 1969, as published. Alderman Wagner offered the following corrections: Page three, last paragraph, May 24th to May 22nd; Page four, paragraph one, strike the words "Alderman Leer further requested that Alderman" and insert "Alderman Wagner stated that Alderman would" Following corrections, Motion to approved declared Carried. Police Chief Hintz reported that only 18 accidents were recorded during the three-day Memorial Day weekend, with three minor injuries...this being far below normal. Placed on file were the following reports: Building Department, May, 1969; Health Department, May, 1969; Report of Civil Defense Director Arthur. City Attorney DiLeonardi reported that the County Division of Circuit Court had upheld the City's azgument against the Tax Rate objections. City Attorney DlLeonardi reported that the Judge in Circuit Court on the City's motion to dismiss the Kiwani's Water suit, has taken the matter under advise ment following argument on same and will report June 12th. Following the report of City Attorney DiLeonardi on the hearing of Cook County Zoning Docket #1549, it was moved by Alderman Szabo, seconded by Alderman Figard, that the City object to the rezoning of property located on the south side of Central Road, south of Milwaukee Avenue, just east of that intersection from B-2 to R-6. Motion declared Carried. COOK COUNTY ZONING DOCKET #1604 COOK COUNTY ZONING DOCKET #1554 ZONING 1869 Busse Z-12-69 6/2/69 Page two 147 It was moved by Alderman Hinde, seconded by Alderman Swanson, following the report of City Attorney Di- Leonardi on the hearing of Cook County Zoning Docket #1604, that the City Council object to the rezoning of property located on the North side of Dempster Street approx. 478 feet west of Dee Road, from R-4 to R-6. Motion declared Carried. Following the report of City Attorney DiLeonardi on the hearing of Cook County Zoning Docket #1554, it was moved by Alderman Swanson, seconded by Alderman Koplos to take no action on said Docket. Motion declared Carried. City Attorney DiLeonardi reported that the petition submitted objecting to the rezoning of property located at 1869 Busse Highway, cited in Ordinance Z-12-69, is in proper form and would require a 2/3 vote of those aldermen elected or 11 affirmative votes to' pass. MEETING President Warnicke announced a meeting of the Board of LOCAL IMPROVEMENTS:Local Improvements for 10 a.m., June 4th in the office of President Warnicke. S.A. #190 S.A. #193 S.A. #194 COMMITTEE MEETING City Attorney DiLeonardi reported that the firm of Chapman & Cutler has issued a legal opinion guaranteeing Special Assessment #190 - improvement of Orchard Place. City Clerk Rohrbach submitted to Council the Recommendation and Estimate of Cost of the Board of Local Improvements together with draft of Ordinance regarding Special. Assessments #193 and #194, - improvement of Douglas Manor Subdivision. Alderman Swanson, Chairman,. set a meeting of the Municipal Development Committee on the proposed Planned Unit Development Ordinance for June 9th at 7:30 P.M . ORDINANCE It was moved by Alderman Hinde, seconded by Alderman B-2-69 Thomas, to concur with Fire Committee's recommendation Emergency Lights to withdraw Ordinance B-2-69, providing for emergency Withdrawn lights in elevators. Motion declared Carried. MODEL ROCKETS COMMITTEE MEETING TAXI -CAB Licenses JET -RENT -A -CAR DUMP SITE RIVER & GOLF It was moved by Alderman Hinde, seconded by Alderman Shillington, to concur with Fire and City Code Committees' recommendation to take no action in amending ordinances requested in Petition submitted by Mr. Chris DeVoney to allow the launching of non -pyrotechnic model rockets. Motion declared Carried. Alderman Hinde, Chairman, set a meetcbng of the Fire Committee for 7 P.M., June 12th. It was moved by Alderman Hinde, seconded by Alderman Swanson, to concur with License Health and Inspection Committee's recommendation to increase the number of taxi -cab licenses by three and issue said three licenses in addition to one available license - total of 4 - to Jet -Rent-A-Car owned by Mr. Clayton Mott - to operate a taxi service.- City Attorney to draft the necessary amendment to the ordinance. Motion declared Carried. Following considerable discussion, it was moved by Alderman Szabo, seconded by Alderman Koplos, that Council request Arc Disposal Co., to cease dumping at the site located at River and Golf Roads, until determination and decision is reached regarding the future of subject property. After discussion, it was moved by Alderman Figard, seconded by Alderman Swanson, to defer action on said motion until next meeting. Motion declared Carried = Alderman Szabo and Alderman Koplos voting No. SOO-LINE CROSSING Pratt Ave. PARKING NORTH & FIRST COAGULANT" AID WATERMAIN GRACELAND AVENUE WATERMAIN HARDING 6/3/69 148 Page three It was moved by Alderman Koplos, seconded by Alderman Wagner, to concur with Streets and Traffic Committee's recommendation to install flashing light signals to replace existing light signals and remove gates at the Soo -Line Railroad crossing at Pratt Avenue - further to request the Soo -Line Railroad to petition the Illinois Commerce Commission to secure permission for elimination of said gatesh' Motion declared Carried. It was moved by Alderman Koplos, seconded by Alderman Hinde, to concur with Streets & Traffic and Parking Lots Committees' recommendation that the Mayor notify the owners of the industrial property on the north side of North Avenue that within ninety days "No Parking" signs will be placed by Police Order - 8 a.m. to 3 p.m., except Saturdays, Sundays, and holidays, on the north side of North Avenue from First Avenue west approximately 22 blocks. Motion declared carried. It was moved by Alderman Figard, seconded by Alderman Thomas, to concur with Water & Finance Committees' recommendation to award the bid for Coagulant Aid to the low bidder, All- state Chemical Co. in the amount of $336.00 per ton. Upon roll call, the vote was: AYES: - 12 - Alderman Koplos, Szabo, Figard, Hinde, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Giannini & Son in the amount of $33,907.00 and return the checks or bonds of the unsuccessful bidders. AVENUE SEWER FARGO RIVER TO CEDAR BUILDING CODE Amendment It was moved by Alderman Figard, seconded)by Alderman Swanson, to concur with Water Committee's recommendation to reject all bids received for the Harding Avenue Watermain, and readvertise with additional specifications returnable June 23, 1969. Motion declared Carried. It was moved by Alderman Bonaguidi, seconded by Alderman Figard, to concur with Sewer's Committee's recommendation to televise with TV camera the sewer on the south side of Fargo Avenue, from River Road to Cedar to determine cause of back-up. Fire Resistance It was moved by Alderman Wagner, seconded by Alderman Thomas, to concur with Building Control and Inspection Committee's recommendation to amend the Building Code regarding driveways, fire resistance rating, fire doors, smoke and heat vents, and sprinkler systems, and to authorize the City Attorney to draft the necessary amendment to the ordinance. It was moved by Alderman Wagner, seconded by Alderman Figard to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Nationwide Art Center for an overhanging sidewalk sign at 1507 Ellinwood. Motion declared Carried. It was moved by Alderman Wagner, seconded by Alderman Figard, to concur with Building Control and Inspection Committee's recommendation to approve sign request of Arby's for 27' sign to fireplace present sign to be located five feet behind building line. Motion declared Carried. It was moved by Alderman Wagner, seconded by Alderman Hinde, to concur with Building Control and Inspection Committee's recommendation to approve sign request of Standard Oil Co. to move originally approved sign due to improvement of intersection at Golf and Wolf Roads. It was moved by Alderman Wagner, seconded by Alderman Thomas to concur with Building Control and Inspection Committee's recommendation to approve sign request of Ladendorf Motors for sign 12 x 14'4" to be located 5" from property line on. Rand Road. Motion declared Carried. It was moved by Alderman Wagner, seconded by Alderman Shilling - ton to concur with Building Control and Inspection Committee's recommendation to approve the sign request of Corky's for a 2444" sign to be placed 5' behind property line. Motion declared Carried. Alderman Wagner, Chairman, set a meeting of the Building Control and Inspection Committee for 8 P.M., June llth. It was moved by Alderman Koplos, seconded by Alderman Hinde, to concur with Parking Lots Committee's recommendation to authorize the City Engineer to prepare the necessary plans and specifications for proposed Lot A located on the south side of Ellinwood Street owned by the Des Plaines Tomorrow Corporation for an estimated cost of $5,000 and to defer action on Lots B, C, & D until funds are available - also to authorize Mayor Behrel to negotiate a satisfactory lease agreement regarding proposed lot. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Figard, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total,$184,127.75. Alderman Swanson, Chairman, reported on the meeting of the 0"Hare Area Noise Abatement Council in which the FAA reported to representatives the efforts being made to alleviate noise, create different landing patterns, and the posGibility of including recommendations for new regulations in the near future. Alderman Bonaguidi reported on the progress of the Beautifi- cation Committee to landscape the railroad right-of-way - Chicago & Notthwestern Railroad - along Northwest Highway and requested the following items be referred to committees for study and report: Streets and Traffic and Building Control and Inspection: Development of a reasonable Sign Ordinance which would prohibit Billboard signs within a certain number of feet of certain highways within the City, giving consideration to an arbitration clause which would phase out present signs as contracts expire. Building Control and Inspection: Ordinance calling for firmer controls on landscaping on industrial and commercial tracts which abut or are across the street from residential property. Sanitation Committee: Consider an ordinance requiring covered containers for alley pick-up in Commercial Areas. Consider rewriting of Ordinance 8-12-4 pertaining to littering and dumping - recommend strong fine and explicit wording. Following second reading, it was moved by Alderman Figard, seconded by Alderman Shillington, to adopt Ordinance Z-14-69 providing for a text amendment to the Zoning Ordinance of 1960 to require Gasoline Filling Stations to be Special Uses only. Placed on First Reading was Ordinance M-29-69, for the improvement of Douglas Ave., Sprucewood Avenue, Elmira Ave., Birchwood Ave., Jarvis Ave., and Jarlath Avenue, by installing a system of Cast Iron Watermains, together with all necessary appurtenances, the cost thereof to be paid by Special Assessment. #193. The letter received from American Foundrymen's Society regarding the opening of the State Street parkway opposite the industrial access alley was referred to City Engineer Fletcher for study and report. PIPELINES The Public Notice of proposed installation of two 6" Petroleum Shell Oil Products Pipelines under and across Higgins Creek in Cook County received from Division of Waterways was referred to the City Engineer. RESIGNATION:It was moved by Alderman Bonaguidi, seconded by Alderman Figard, to accept the resignation of Mr. Edward C. Miller from the Des Plaines Human Relations Commission and authorize Mayor Behrel to write a letter of thanks and commendation. Motion declared Carried. RE- It was moved by Alderman Bonaguidi, seconded by Alderman APPOINTMENTS:Figard, to concur with Mayor Behrel's reappointment of C. Bentley Charles Bentley to the Civil Service Commission, term expiring April, 1972. Motion declared Carried. POLICE & It was moved by Alderman Bonaguidi seconded by Alderman Hinde, FIRE COM. to concur with Mayor Behrel's reappointment of Mr. Harold Ahbe to the Police and Fire Commission, term expiring April 30, 1972.
