03/03/1969101 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, MARCH 3, 1969. CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel, at 8:10 P.M. The meeting opened with a prayer by Rev. James Jackson, Associate Pastor of Christ E & R Church, followed by the pledge of allegiance to the flag. Mayor Behrel introduced Girl Scout Troop 624. ROLL CALL: Roll Call indicated the following aldermen present: Rateike, Szabo, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels. Absent were Prickett, Wight. Also present were: City Comptroller Blietz, Police Chief Hintz, Deputy Fire Chief Haag, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer E. N. Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. AWARD Mayor Behrel presented Mr. Hubert Thorne and Mr. Kenneth PRESENTATION: Tierhan awards earned by them at the Water Services Distribution Institute Seminar held in November, 1968. MINUTES: It was moved by Alderman Rateike, seconded by Alderman Bonaguidi, to approve the Minutes of the regular meeting held February 17, 1969, as published. Motion declared Carried. REPORTS OF The following reports were placed on file: Health CITY OFFICIALS: Department for February, 1969; Building Department for February, 1969; Minutes of Des Plaines Public Library Board. ANNUAL City Comptroller Blietz presented to Council the Annual FINANCIAL Financial Report of the City of Des Plaines, and reviewed REPORT various items contained therein. CHIEF OF Police Chief Hintz reported that a group of twenty police POLICE officers have completed one week of in-service training and another group is in the process...entire program to be completed by March 15th. He further reported that the new jury courtroom was used for the first time this morning and that Judge Smiegel is well pleased with the quarters. JOHNNY'S MOBILE HOMES Well #6 Building Commissioner Schuepfer reported that continued efforts by the Building Department and Fire Prevention Bureau have failed to enforce certain rules and regulations presently violated by Johnny's Mobile Homes on Mannheim Road, including the illegal sign. After discussion, it was moved by Alderman Szabo, seconded by Alderman Shillington, to instruct the City Attorney to institute a law suit if the owner fails to comply with the City's ordinances, which have been violated for several years. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Binde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 0 - None ABSENT: 2 - Alderman Prickett, Wright There being fifteen affirmative votes, Motion declared Carried. City Engineer Fletcher made a progress report on the work in connection with repairing Well No. 6, stating the difficulty experienced in pulling the pump and reporting to Council the additional work necessary, including the painting of the tk bine with apoxy paint. Des j Plaines Ave. EQUIPMENT - Public Works Tractor Endloader 3/3/69 102 Page Two City Engineer Fletcher submitted a written report, dated February 24th, with respect to work to be planned for construction in the Water Department. Said report was referred to the Water and Finance Committees for study and report. Alderman Figard, Chairman, set a meeting of the Water and Finance Committees with the Commissioner of Public Works and City Engineer for 8 P.M., March 10th. City Attorney DiLeonardi reported that a suit has been filed against Scientific Machinery Movers regarding their activities constituting a nuisance. City Attorney DiLeonardi reported that he appeared in court today relative to the Kiwanis Property Case. May 1st has been set as the trial date for said case. Mayor Behrel reported that about two weeks ago, copies of the Mayor's Annual Report were mailed to members of the City Council and press, and are officially submitted at this time. It was moved by Alderman Swahs9n4.2secendedybylAlderman Whomh,,to concur with Municipal Development Committee's recommendation to concur with Des Plaines Plan Commission and vacate seven foot wide alley at the rear of 1637 and 1633 River Street, and other properties adjacent running to the creek, and authorise the City Attorney to draft the necessary ordinance. After discussion, it was moved by Alderman Szabo, seconded by Alderman Bolek to defer action for two weeks. It was moved by Alderman Swanson, seconded by Alderman Figard, to concur with Municipal Development Committee's recommendation to rezone property located at 1869 Busse'.Highway from M-2 to M-1, concurring with Des Plaines Zoning Board of Appeals in Case'69-13-R, and authorize the City Attorney to draft the necessary ordinance for further consideration by the Council. Motion declared Carried. It was moved by Alderman Swanson, seconded by Alderman Thomas, to concur with Municipal Development Committee's recommendation to concur with Des Plaines Zoning Board in Case 69-8-R, to rezone property located at 1649 Elk Boulevard to C-2 Commercial District and authorize the City Attorney to prepare the necessary ordinance for further consideration by the Council. Motion declared Carried. Alderman Rateike set a meeting of the Fire Committee and Building Control and Inspection Committee for March 13th at 7:30 P.M. Alderman Bolek, Chairman, reported that the License, Health and Inspection Committee has been notified that Jack's Cab Co., has been issued a license by the Chicago and Northwestern Railway Co. to operate a cab stand for three cars at the Cumberland Station. The application of Mr. Peter Yianibas for a Class A liquor license to operate The Spring Green Restaurant, Inc. at 485 N. Des Plaines Avenue, was referred to the License, Health and Inspection Committee for study and report. It was moved by Alderman Leer, seconded by Alderman Hinde, to concur with Streets and Traffic Committee's recommenda- tion to award the bid for a tractor endloader to P & W Industrial Sales, Inc. at a net cost of $4,841.64 and return the checks and or bid bonds of the unsuccessful bidders. It was moved by Alderman Leer, seconded by Alderman Hinde, to concur with Streets and Traffic Committee's recommendation to readvertise for bids for the two dump trucks and one carry -all truck and reject the one bid received from Des Plaines Motor Sales. Motion declared Carried. Alderman Leer, Chairman, reported that the Sidewalk Bids are being held by Street® and Traffic Committee, to allow investigation of three lowest bids. It was moved by Alderman Bonaguidi, seconded by Alderman Seitz, to authorize the Mayor to negotiate with the owners of property on the north side of Princeton Avenue, just west of 'Wolf Road, for the improvement of the north half of Princeton Avenue. Motion declared Carried. It was moved by Alderman Figard, seconded by Alderman Wagner, to concur with 'Water and Finance Committee's recommenda- tion to authorize Divane Brothers Electric Company, to install three new phase guard relays at the Sengstock Pumping Station, on a time and material basis, for an amount not to exceed $2,700.00, including cost of relays. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor NAYS: 0 - None ABSENT: 2 - Alderman Prickett, Wright There being fifteen affirmative votes, Motion declared Carried. Alderman Leer, Chairman, Elm Tree Disease Committee, reported that a total of 62 trees were removed from January 27th to March 1st, and that all dead trees on City parkways have been removed. A detailed report of dead trees on private property will be submitted at next meeting. It was moved by Alderman Hinde, seconded by Alderman Figard, to concur Judiciary Committee's recommendation to authorize the City Attorney to arrange settlement with the Lunar Oil Suit, with no damages to the City. After discussion, it was moved by Alderman Shillington, seconded by Alderman Thomas, to defer action until next meeting. Alderman Leer, Chairman, set a meeting of the Streets and Traffic Committee, for 8:30 P.M., March 13th. It was moved by Alderman Swanson, seconded by Alderman Bonaguidi, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK BE AND ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: Total $130,546.14. Following second reading, it was moved by Alderman Swanson, seconded by Alderman Hinde, to adopt Ordinance Z-8-69, amending the text of the R-5 District of the Zoning Ordinance of 1960 having to do with frontage requirements. Upon roll call, the vote was: AYES: - 13 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Ilinde, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. NAYS: 2 - Alderman Czubakowski, Wagner ABSENT: 2 - Alderman Prickett,'lvright There being thirteen affirmative votes, Motion declared Carried. Following second reading, it was moved by Alderman Rateike, seconded by Alderman Shillington, to adopt Ordinance A-1-69, annexing the Chicago and North Western Railway Co. right of way between Rand Road and River Road. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Following second reading, it was moved by Alderman Figard, seconded by Alderman Shillington, to adopt Ordinance M-13-69, establishing certain water rates for the Pleasant Manor area. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. Placed on First Reading was Ordinance B-.1-69, amending the Building Code, having to do with Tile Drains, Height of Foundations, and elevation of Ground Floor. It was moved by Alderman Leer, seconded by Alderman Hinde, to adopt MFT Resolution appropriating $27,000 Motor Fuel Tax Funds for the improvement of Wieboldt Avenue. Upon roll call, the vote was: AYES: - 15 - Alderman Rateike, Szabo, Bolek, Leer, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Sditz, Shillington, Michaels, Mayor. ZONING DOCKETS #1516, 1517 #1518 The Clerk submitted the resolution adopted by the Illinois Commerce Commission, granting permission to the Chicago and North Western Railway Co. to change grade crossings at Wolf Road to accomodate a dual lane highway. The letter from the City of Rolling Meadows regarding MAP FED unit, was placed on file. The letter from School District No. 207, regarding water service to proposed Maine Township High School North was referred to the Water Committee and City Engineer for study and report. After discussion, it was requested by Alderman Szabo, that the Mayor meet with owners of the Trumbull and Reding properties adjacent to the City limits in an effort to discuss annexation. The Clerk submitted the petition filed by Domestic Utility Service Company for certificate of convenience and necessity filed with the Illinois Commerce Commission to effect the supplying of water to Maine Township North High School proposed. It was moved by Alderman Szabo, seconded by Alderman Hinde, to authorize the City Attorney to attend the hearings on Cook Co. Zoning Dockets #1516, 1517, and 1518,to be held at Des Plaines City Hall,March 14th at 3 P.M.
