01/06/196975 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF TILE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL ROOM, CITY HALL, MONDAY, JANUARY 6, 1969 CALL TO ORDER: The regular meeting of the City Council of the City of Des Plaines was called to order by Mayor Herbert H. Behrel at 8:18 P.M. The meeting opened with a prayer by Rev. J. Jackson, Associate Pastor of Christ Evangelical and Reformed Church, followed by the pledge of allegiance to the flag. ROLL CALL: Roll Call indicated the following aldermen present: Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Absent were Alderman Leer, Swanson. Present also were: City Comptroller Blietz, Police Chief Hintz, Fire Chief Arndt, Building Commissioner Schuepfer, Commissioner of Public Works Warnicke, City Engineer Fletcher, and City Attorney DiLeonardi. There being a quorum present, the meeting was in order. MINUTES: REPORTS OF CITY OFFICIALS': WORKMEN'S COMPENSATION IIIPLEASANT MANOR SEWER & WATER MAINS RAND -CENTRAL ZONING CASE JTJLSON BLDRS. JULIUS COHEN Suit 1 It was moved by Alderman Prickett, seconded by Alderman Wright, to approve the Minutes of the regular meeting of December 16, 1968. Correction on Page six, Paragraph 4, to change 1968 to 1969. After correction, motion declared Carried. Placed on file were the flllowing reports: Building Commissioner's annual report and report for December; Health Department's annual report. City Comptroller Blietz reported that the City has renewed our Workmen's Compensation with Zurich Insurance Company at a premium reduction of 15%. Following City Engineer's recommendation, it was moved by Alderman Figard, seconded by Alderman Shillington, to advertise for bids returnable January 27th 10 a.m., City Engineer to draw the necessary specifications. Motion declared Carried. City Attorney DiLeonardi reported that the owners of the property in the Rand -Central Zoning Case have filed an appeal. It was moved by Alderman Hinde, seconded by Alderman Seitz, that the City defend the appeal and retain the firm of DiLeonardi & Hofert. Upon roll call the vote was: Alderman Swanson arrived during discussion AYES: - 14 - Alderman Rateike, Prickett, Wright, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor NAYS: 2 - Alderman Szabo, Bolek ABSENT: 1 - Alderman Leer There being fourteen affirmative votes, Motion declared Carried. City Attorney DiLeonardi reported that a suit has been filed against the City and Building Commissioner Schuppfer, Beta Development, Inc., Algonquin -Residential Corporation, and Oakton-Algonquin Corporation, having to do with the issuance of building permits on lots located in the Adelman & Brott Subdivision, by Julson Builders and Julius Cohen. It was moved by Alderman Szabo, seconded by Alderman Bolek, to retain the firm of DiLeonardi and Hofert to defend the City and Building Commissioner Schuepfer in the aforementioned case. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shilling - ton, Michaels, Mayor. NAYS: 0 - None ABSENT: 1 - Alderman Leer There being sixteen affirmative votes, Motion declared Carried. I g/ 1/6/69 76 Page two CITY PROPERTY Following considerable discussion of the factssurrounding Sunset & the property located at the corner of Sunset and Stillwell, Stillwell sold by the City to Double M Realty Company for a purchase price of $12,000, for which the City has received $1,000 deposit, pending the execution of the necessary legal closing documents, and upon such property a variation was granted by Des Plaines Zoning Board of Appeals to the contract purchasers to allow subject property to be divided from two lots to three lots, it was moved by Alderman Shillington, and after discussion, seconded by Alderman Rateike, that the City close the purchase as contracted. Upon the addition to the motion that the Council instruct the Building Commissioner not to issue any building permits on subject property, Alderman Rateike withdrew his second to the motion. It was then moved by Alderman Shillington, seconded by Alderman Michaels, that the City close the purchase as contracted ghdtto instruct the Building Commissioner to issue only two building permits, if application is received, until approval has been received from Des Plaines Zoning Board of Appeals to divide subject property into three lots, upon receipt of a new petition when Double M Realty Co. becomes owners of subject property. Upon roll call, the vote was: AYES: 9 - Alderman Prickett, Wright, Figard, Hinde, Czubakowski, Thomas, Seitz, Shillington, Michaels NAYS: 5 - Alderman Rateike, Szabo, Bolek, Wagner, Swanson ABSTAINING: Alderman Bonaguidi ABSENT: 1 - Alderman Leer There being nine affirmative votes, Motion declared Carried. REPORTS OF COMMITTEES: FIREMEN ELrIGIBILITY LIST Committee Meeting Alley between Lee & Graceland Traffic Light - Lee & Ellinwood C C & NW crossing Downtown area Parking Meter - Alley Prairie Ave. "No Parking" Third Avenue N. of Rand Committee Meeting Committee Meeting Alderman Swanson, Chairman, set a meeting of the Municipal Development Committee for January 13th at 7:30 P.M. Fire Committee Chairman requested that Mayor Behrel request the Board of Police and Fire Commission to hold an examination to establish an eligibility list for firemen. Alderman Bolek, Chairman, set a meeting of the License, Health and Inspection Committee for 7 P.M., January 9th. Alderman Hinde, reported that the Streets and Traffic Committee recommends that the First National Bank place stop signs at the alley for their customers as per their agreement and the City install "Caution" signs to slow down traffic speed in the alley. Referred to the Traffic Commission for further study and report was the installation of a traffic light at the intersection of Ellinwood and Graceland. It was moved by Alderman Hinde, seconded by Alderman Figard, to concur with Streets and Traffic Committee's recommenda- tion that Mayor Behrel communicate with the Chicago and Northwestern Railway Co. regarding the blocking of crossings in the downtown area during rush hours, including a copy of the survey conducted by Captain Blume of the Police Department. Motion declared Carried. After discussion, it was moved by Alderman Bonaguidi, seconded by Alderman Seitz, to remove the first parking meter west of the alley between Graceland and Lee, on the south sicle of Prairie Avenue and post a "No Parking from here to the Alley" sign. Motion declared Carried. It was moved by Alderman Seitz, seconded by Alderman Bolek, to post by Police Order .for a 90 clay trial period "No Parking 8 a.m. to 6 p.m., except Saturday, Sunday, or HIolidays, on the west side of Third Avenue from Rand Road north to the end of the street. Motion declared Carried. Alderman Figard, Chairman, set a meeting of the Water Committee for 8 p.m., January 14th with City Engineer and Commissioner of Public Works. Alderman Bonaguidi, Chairman, set a meeting of the Sewer e.Az Committee for 7 P.M., January 9th. Committee Meeting_ Elm Tree Disease TREE REMOVAL CONTRAC T 1/6/69 77 Page three Alderman Szabo, Chairman, set a meeting of the Building Control and Inspection Committee for 7:30 P.M., January 15th along with Fire Committee and Fire Chief Arndt. Alderman Szabo reported that Bishop's Tree Service removed 38 diseased trees last month in addition to some emergency work and that the Elm Tree Disease Committee finds this to be totally inadequate as there remains approximately 300 trees to be removed. It was moved by Alderman Szabo, seconded by Alderman Rateike, to concur with Elm Tree Disease Committee's recommendation to award a contract to Tower Tree Service to remove diseased trees under the supervision of the Commissioner of Public Works at the following costs: Up to 12", $1.60, 12" to 24", $2.05; 24" to 36", $2.65; 36" to 48", $3.25; 48" and over, $4.00, in addition to the City's present contract with Bishop Tree Service. Alderman. Michaels moved to amend the motion to terminate the contract with Bishop's Tree Service. Motion lost for want of a second. BILLS It was moved by Alderman Prickett, seconded by Alderman PAYABLE: Swanson, to adopt the following resolution: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES THAT THE FOLLOWING HILLS ARE DUE AND PAYABLE AND THE MAYOR AND CITY CLERK ARE HEREBY AUTHORIZED TO MAKE PAYMENT FOR SAME: $221,628.98. Placed on First Reading was Ordinance M-7-69, reducing the number of ClassA Liquor Licenses by one. It was moved by Alderman Shillington, seconded by Alderman Figard, to waive First Reading of Ordinance R1-8-69, providing for the purchase of a certain waterworks system in the Pleasant Manor area. Motion declared Carried. It was moved by Alderman Shillington, seconded by Alderman Michaels to adopt Ordinance M-8-69. Upon roll call, the vote was: AYES: 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor NAYS: 0 - None ABSENT: 1 - Alderman Leer There being sixteen affirmative votes, Motion declared Carried. It was moved by Alderman Prickett, seconded by Alderman Hinde, to adopt Resolution R-1-69, authorizing the Mayor and City Clerk to sign the agreement between the State of Illinois and the City re maintenance of traffic signals at Northwest Highway, State Road and Cornell Avenue in exchange dor signals at Golf Road, Wolf Road and Seegers Road. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. It was moved by Alderman Wagner, seconded by Alderman Prickett, to adopt Resolution R-2-69, authorizing Mayor and City Clerk to execute agreement between Soo Line Railroad Company and the City re relocation and revision of automatic protection at Pratt Avenue crossing, in connection with Orchard Place Improvement. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. It was moved by Alderman Prickett, seconded by Alderman Hinde, to adopt Resolution R-3-69, authorizing Mayor and City Clerk to execute agreement with Chicago and North Western Railway Company for a storm sewer in the vicinity of Wolf Road. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor. The request of Mr. Frank Schwartz for a division of land on the west side of Lee Street, north of Forest, was referred to the Plan Commission. Letter Des Plaines Historical Society Tec -Search, Inc. RESIGNATION D. Moehling Human Relations Commission APPOINTMENTS: Human Relations Commission 1/6/69 79 Page five Submitted to the Council were copies of the letter from the Des Plaines Historical Society re their request for funds to be included in the appropriation for 1969. Smbmitted to Council was the report of Tec -Search, Inc. regarding the project status andaccomplishments in the 701 Program for 1968. It was moved by Alderman Czubakowski, seconded by Alderman Hinde, to accept the resignation of Mr. Donald Moehling from the Human Relations Commission and authorize the Mayor to write a letter of commendation. Motion declared Carried. POLICE TRA Iy ING It was moved by Alderman Figard, seconded by Alderman Wagner, that Council ooncur with Mayor Behrel's appointment of the following to the Human Relations Commission - terms to expire December 31, 1971: Mrs. Lois Czubakowski, Mr. Edward Miller, and Mrs. Jean Branding. Motion declared Carried. Following the reading of the letter from Police Chief Hintz by Mayor Behrel regarding approval of fund expenditures for a fifteen month training program for Policemen, it was moved by Alderman Figard, seconded by Alderman Czubakowski, to authorize the Mayor to execute the Application for Highway Safety Project Grant for said training. Upon roll call, the vote was: AYES: - 16 - Alderman Rateike, Szabo, Prickett, Wright, Bolek, Figard, Hinde, Czubakowski, Wagner, Swanson, Thomas, Bonaguidi, Seitz, Shillington, Michaels, Mayor.
