Alderman. Moehling requested that it be referred to the Street Committee, regarding
making Fifth Avenue one-way. Also to refer to the Street and -license and Inspection
Committees about rerouting the bus off of Fifth Avenue.
Alderman Moehling requested that regarding sidewalks at Oakton and Wolf Roads be
referred to the Board of Local Improvements. --
Alderman Moehling requested traffic on Fift i Avenue be referred to the Street
Committee.
Alderman Neff and Moehling requested the extension of Fourth Avenue from Lincoln
to Oakton be referred to the Plan Commission and the Municipal Development Committee.
Engineer Fletcher is to contact the County Highway Department about widening

CALL TO ORDER The meeting was called to order by Mayor Herbert H. Behrel, who
presided with Alderman Neff, Moehling, Flauter, Figard, Prickett, Tistle,
Massman, Bell, Jackson, Callaghan, Rateike and Wright responding to roll call.
APPROVAL OF MINUTES. The motion was made by Alderman Wright and seconded by
Figard to approve the'minutes of September 8, 1959. The motion was voted upon
by acclamation.
ENGINEER FLETCHER reported on Well No. 5 and said he thought by the next meeting
he could give the final cost.
Alderman Bell requested from Attorney Dowd an opinion on gasoline service station.
After discussion-, on motion by Alderman Massman and seconded by Blume, the
attorney is to present an amendment of Zoning Ordinance C-2 and C-3, regarding
300 feet from certain buildings.
• Alderman Callaghan reported that Attorney Burke had withdrawn the application to
increase liquor stores.
Alderman Bell reported that the Municipal Development Committee -had investigated
regarding vacating alleys south of Amling Toy Store and found the amount of'
alleys to be vacated has been:educed to 1/3 the original square foot area.
Appraiser re-evaluted the area since the original estimate was based on.Ccmnnercial
property. This is to be multi -family development. The Committee recommends
alley be vacated upon payment of $1,250.00 representing approximately 62.5 cents
per square foot. On motion by Alderman Bell and seconded by Prickett, the
Council concurred in the report.
Alderman Jackson reported the following on speed limit signs on Fifth Avenue:
"Your Committee on Streets and Traffic has investigated the above and has found:
this stretch of road serves two elementary schools - Forest and Algonquin. The
present traffic moves down this street at speeds incacess of 25 mph and creates
a hazardous condition for school children and Fifth Avenue residents. Attached
is supporting petition signed by 85 Fifth Avenue residents.

We, your Committee on Streets and Traffic, therefore recommend that a 20 mph
speed limit be posted and enforced on Fifth Avenue between Oakton and Algonquin."

Alderman Jackson reported the follozing on traffic conditions at Forest and
Fifth Avenue:
"Your Committee on Streets and Traffic has investigated the above and found:
that Fifth Avenue being the only street in the area running f roan Algonquin to
Oakton carries a heavy load of traffic during school hours. Two schools
face on Fifth Avenue - Forest and Algonquin. No crossing guard is provided
on the Fifth Avenue - Forest intersection. Attached is a supporting petition
by 80 Fifth Avenue residents.
We, your Committee on Streets and Traffic, therefore recommend: a four-way stop
on a 90 day trial basis."

Alderman Jackson reported the following on Busse Highway and Parkview Lane
parking conditions:
"Your Committee on Streets and -Traffic has investigated the above and found:
lack of sidewalks, a 40 mile an hour speed limit and parking congestion creates
=extremely hazardous condition, especially for pedestrians. This stretch also
contains a bus stop (normally a no parking zone) and is the scene of a recent
car - pedestrian accident. Attached is a letter on these conditions from
Alderman R. Blume.
We, your Committee on Streets and Traffic, therefore, recommend that no making
signs be erected along the North side of Busse Highway from the Parkview Lane -
Busse intersection to a point approximately 250 feet east."

Alderman Jackson reported on the following "no parking from 8 - 11 A. M." on
the north side of State Street:

found: thqt parking in this area by commuters is so heavy that it constitutes
a safety hazard to State Street residents and all motorists and pedestrians
using State Street. A petition signed by 22 State Street residents is attached.
We, your Committee on Streets and Traffic , therefore , recommend that signs
be erected on the north side of State Street. The signs should read 'No Parking
8:00.A.M. to 11:00 A.M.t exceptSBturday, Sundays and Holidays:" _

Alderman Jackson made the following report on letter from The American
Foundrymen's Society regarding parking conditions on the south side of State

"Your Committee on Streets and Traffic has investigated the above and has found
that commuter parking conditions are such that they not only constitute a safety
hazard but also create a hardship for this commercial, organization by denying
their visiters and members parking. This organization has provided an off-street
parking area for their employees. A letter from the American Foundrymen's
Society is attached.
We, your Committee on Streets and Traffic, • therefore recommend that an area 150
feet long, along the south side of State Street and in a line with the •
Foundrymen's property, be marked as follows: "3 hour parking except Saturdays,
Sundays and Holidays.'"

stop sign be erected on the southwest corner of the Sunset -Stillwell intersection
to protect,Stillwell traffic."

Alderman Jackson reported on load limits for several streets but on motion by

until it can be discussed with Barton and Associates.
Alderman Jackson reported the following on rerouting bus route from Fifth Avenue:
"Your Committee on Progress Report, has investigated the above and has found
after several meetings between the Health, Licensing and Inspection chairman
and a representative of the United Motor Coach Company, and a meeting of the
United Motor Coach representative with Fifth Avenue residents and Streets and -
Traffic Committee, the bus company agreed to investigate the possibility of
using an alternate route and report back at a later date.
We, your Committee on Streets and Traffic and Health, Licensing and Inspection,
therefore, recommend that. no action be taken..at this time pending bus company report."

by Alderman Tures and seconded by Tistle to award the No. 5 Pump House bid to
Esser Construction Company for $7,353.78 and the other bidders' checks be returned.

VALIQUET COMPANY ORDINANCE VIOLATION. The following report was made by Alderman
Moehling:
"To the Chairmen of the Judiciary and Building Control and Inspection Committees,
at the meeting of the City Council, held August 3, 1959, the following matter
was referred to your Committee: Violation of'city ordinance requiring build-
ing permit by Valiquet Company 1942 -Lee Street, Des Plaihes.
'Your Committee on Judiciary and Building Control and Inspection has investigated
the above and has found:
(1) Mr. Albert Valiquet, owner of Valiquet Company has reconstructed
an old, unsightly, building on the premises within the four walls and on the
concrete foundation of the building previously existing on the premises, the
frame construction of the old building being replaced with a more attractive,
more substantial concrete block construction.
(2) Reconstruction of the building was undertaken by Valiquet at the
request of and i# accordance with an agreement with Orchard Lake Homes, Inc.
to remodel and repair Valiquet •Company premises and thereby ,,,improve the general
appearance of these buildings in the midst of a residential area and contiguous
to the Subdivision developed by Orchard Lake Homes.
(3) The facts will show that Valiquet did request a building permit
from the City of Des Plaines, but that this request was made of the Building
Commissioner only after a major proportion of the walls had been r econ-
structed; that thereafter additionalnequests for a building permit were lodged
with the Building Commissioner who on or about July 1, 1959, informed Mr.
Valiquet that the permit was being withheld pending formal council action.
(4) On July 6, the Building Commissioner was instructed by the City •
Council to file a formal complaint against Valiquet Company charging violation
of the zoning ordinance of the City of Des Plains requiring a building permit
prior to reconstruction of premises in a non -conforming use.
(5) Under said ordinance the owner of property using the premises in a
non -conforming use cannot reconstruct buildings on the property for the same
use except to a limit corresponding to the assessed valuation of the property
prior to such reconstruction. The assessed valuation of the entire Valiquet
property, according to the 1958 tax bill thereon was - 412,992.00.
(6) On September 18, 1959, Nr. Kenneth P. Iempke, a qualified appraiser
of industrial and commercial property was requested by the Building License and
Inspection Committee through its Chairman: Alderman Robert Blume -to make an
appraisal of the fair market value of the land and the improvements thereon com-
prising the real property of Valiquet Company both prior to and after the re-
construction. In a comprehensive report and after taking all pertinent facts into
consideration, Mr. Lempkets opinion as to the valuation is as follows:
On September 18, 1959, the fair, as is, market value of the real
property•was $33,500., The corresponding value of the same
premises prior to reconstruction was $29,500. The value of the
reconstruction, therefore is $4,000.00
Mr. Lempke alsoestimates that the cost of additional reconstruction to complete
,the new building isabout $2,000. The reconstructed portion of the building

having a value of $4,000 and the additional construction to complete the building
being $2,000, the value of the completed reconstruction is thus less than the
assessed valuation of the entire property, that is $12,992.00
"In view of the facts'and circumstances, i.e. the limitation of the reconstruction
to within the former boundaries of the previously existing building, the re-
placement of the former unsightly building with a more desirable fire -proof
construction and the compliance by Valiquet with the ordinance controlling re-
construction of buildings under the non -conforming use provisions of Section 7,
we, your Committees on Judiciary and Building Control and Inspection therefore
jointly recommend that the penalties provided by the ordinance for failure
to obtain the building permit be enforced against Valiquet and that the action
now pending against Valiquet in the Police Magistratets Court of Des Plaines be
continued only to the assessment of the fine imposed by ordinance for such
violation. We do not recommend other or additional penalties. "

.by Rateike the. Council approved to place on passage the amending payroll ordinance.
The motion was made by Alderman Prickett and seconded by Massman to adopt the
ordinance. The,Mayor put the question and the Clerk called the roll with the

PLAN COMMISSION REPORTS. Pian Commission report on extension of'Fourth Avenue
from Lincoln Avenue to Oakton Street was that the property involved is outside
the City Limits and suggested that the interested Aldermen contact the property
owners to present a subdivision to include Fourth Avenue. The Mayor ordered
the report placed on file.
Plan Commission report on attending County Zoning hearing and found that the
proposed County Zoning map was in substantial conformity with our proposed
City Pian and that we have no objection to its adoption as presented. The Mayor
ordered the report placed on file.
The Flan Commission report4d the tentative approval of First Addition to McKay
and Nealis Sub. The Mayor ordered the report placed on file.
ADOPT'ALIEY VACATION ORDINANCE. The Clerk read for the second reading the
ordinance vacating alleyiest of White and east of Cora. The motion was made
by Alderman Tistle and seconded by Massman to adopt the above ordinance. The Mayor
put the question and the Clerk called the roll with th0 following results: Ayes:
Alderman Rateike, Blume, Wright, Tures,-Flauter, Figard, Prickett, Tistle, Massman,
Bell, Jackson, Callaghan. Nays: Neff and Moehling. The Mayor declared the motion

PETITION FOR ANNEXATION OF KOEHIER PROPERTY. The Clerk informed the Council he
had a petition for annexing land south side of Howard Street and West of Park Lake.
They referred the petition to the Municipal Development Committee and they are
to contact John Geiger about reference to Jarvis Street.

APPLICATION REZONING AT RAND AND C ORNELL. On motion by Alderman Tures and seconded
by Prickett the application was referred to the Zoning Board to call a hearing as
a -Commmission.
REZONING APPLICATION NORTH SIDE OF RAND ROAD. WEST OF THE S00 LINE. The Clerk
presented a rezoning application conditional upon annexation. On motion by
Alderman Prickett and seconded by Tistle, the application was referred to the
Zoning Board sitting as a Commission to call a hearing.
A letter from Walgreen IDrug Stores for liquor store license was referred to the
License Committee.
A letter from Glen -Plaines Civic Association regarding street paving in De Matteo
Subdivision was referred to the Engineer and Superintendent.
Traffic condition at -Walnut, Lee and First was referred to the Street Commission.
MOTOR FUFLrTAX'r RESeUTION+,ADOPTED Engineer Fletcher presented a n°solution for
Motor Fuel Tax.Funds.for.Cumberland Street Lighting . On motion by Rateike and
seconded by Callaghan the Council adopted the resolution.
