CALL TO ORDER The meeting was called to order by Mayor Herbert H. Behrel, who presided with Alderman Neff, Moehling, Flauter, Figard, Prickett, Tistle, Massman, Bell, Jackson, Callaghan, Rateike and Wright responding to roll call. APPROVAL OF MINUTES. The motion was made by Alderman Wright and seconded by Figard to approve the'minutes of September 8, 1959. The motion was voted upon by acclamation. ENGINEER FLETCHER reported on Well No. 5 and said he thought by the next meeting he could give the final cost. Alderman Bell requested from Attorney Dowd an opinion on gasoline service station. After discussion-, on motion by Alderman Massman and seconded by Blume, the attorney is to present an amendment of Zoning Ordinance C-2 and C-3, regarding 300 feet from certain buildings. • Alderman Callaghan reported that Attorney Burke had withdrawn the application to increase liquor stores. Alderman Bell reported that the Municipal Development Committee -had investigated regarding vacating alleys south of Amling Toy Store and found the amount of' alleys to be vacated has been:educed to 1/3 the original square foot area. Appraiser re-evaluted the area since the original estimate was based on.Ccmnnercial property. This is to be multi -family development. The Committee recommends alley be vacated upon payment of $1,250.00 representing approximately 62.5 cents per square foot. On motion by Alderman Bell and seconded by Prickett, the Council concurred in the report. Alderman Jackson reported the following on speed limit signs on Fifth Avenue: "Your Committee on Streets and Traffic has investigated the above and has found: this stretch of road serves two elementary schools - Forest and Algonquin. The present traffic moves down this street at speeds incacess of 25 mph and creates a hazardous condition for school children and Fifth Avenue residents. Two schools face on Fifth Avenue - Forest and Algonquin. No crossing guard is provided on the Fifth Avenue - Forest intersection. Attached is a supporting petition by 80 Fifth Avenue residents. This stretch also contains a bus stop (normally a no parking zone) and is the scene of a recent car - pedestrian accident. Attached is a letter on these conditions from Alderman R. Blume. We, your Committee on Streets and Traffic, therefore, recommend that no making signs be erected along the North side of Busse Highway from the Parkview Lane - Busse intersection to a point approximately 250 feet east." /s/ R. This organization has provided an off-street parking area for their employees. A letter from the American Foundrymen's Society is attached. Alderman Jackson reported the following on rerouting bus route from Fifth Avenue: "Your Committee on Progress Report, has investigated the above and has found after several meetings between the Health, Licensing and Inspection chairman and a representative of the United Motor Coach Company, and a meeting of the United Motor Coach representative with Fifth Avenue residents and Streets and - Traffic Committee, the bus company agreed to investigate the possibility of using an alternate route and report back at a later date. VALIQUET COMPANY ORDINANCE VIOLATION. The following report was made by Alderman Moehling: "To the Chairmen of the Judiciary and Building Control and Inspection Committees, at the meeting of the City Council, held August 3, 1959, the following matter was referred to your Committee: Violation of'city ordinance requiring build- ing permit by Valiquet Company 1942 -Lee Street, Des Plaihes. 'Your Committee on Judiciary and Building Control and Inspection has investigated the above and has found: (1) Mr. Albert Valiquet, owner of Valiquet Company has reconstructed an old, unsightly, building on the premises within the four walls and on the concrete foundation of the building previously existing on the premises, the frame construction of the old building being replaced with a more attractive, more substantial concrete block construction. (2) Reconstruction of the building was undertaken by Valiquet at the request of and i# accordance with an agreement with Orchard Lake Homes, Inc. to remodel and repair Valiquet •Company premises and thereby ,,,improve the general appearance of these buildings in the midst of a residential area and contiguous to the Subdivision developed by Orchard Lake Homes. (3) The facts will show that Valiquet did request a building permit from the City of Des Plaines, but that this request was made of the Building Commissioner only after a major proportion of the walls had been r econ- structed; that thereafter additionalnequests for a building permit were lodged with the Building Commissioner who on or about July 1, 1959, informed Mr. Valiquet that the permit was being withheld pending formal council action. (4) On July 6, the Building Commissioner was instructed by the City • Council to file a formal complaint against Valiquet Company charging violation of the zoning ordinance of the City of Des Plains requiring a building permit prior to reconstruction of premises in a non -conforming use. (5) Under said ordinance the owner of property using the premises in a non -conforming use cannot reconstruct buildings on the property for the same use except to a limit corresponding to the assessed valuation of the property prior to such reconstruction. The assessed valuation of the entire Valiquet property, according to the 1958 tax bill thereon was - 412,992.00. (6) On September 18, 1959, Nr. Kenneth P. Iempke, a qualified appraiser of industrial and commercial property was requested by the Building License and Inspection Committee through its Chairman: Alderman Robert Blume -to make an appraisal of the fair market value of the land and the improvements thereon com- prising the real property of Valiquet Company both prior to and after the re- construction. In a comprehensive report and after taking all pertinent facts into consideration, Mr. Lempkets opinion as to the valuation is as follows: On September 18, 1959, the fair, as is, market value of the real property•was $33,500., The corresponding value of the same premises prior to reconstruction was $29,500. The value of the reconstruction, therefore is $4,000.00 Mr. Lempke alsoestimates that the cost of additional reconstruction to complete ,the new building isabout $2,000. The reconstructed portion of the building 9/21/59 -5.. -- - having a value of $4,000 and the additional construction to complete the building being $2,000, the value of the completed reconstruction is thus less than the assessed valuation of the entire property, that is $12,992.00 "In view of the facts'and circumstances, i.e. the limitation of the reconstruction to within the former boundaries of the previously existing building, the re- placement of the former unsightly building with a more desirable fire -proof construction and the compliance by Valiquet with the ordinance controlling re- construction of buildings under the non -conforming use provisions of Section 7, we, your Committees on Judiciary and Building Control and Inspection therefore jointly recommend that the penalties provided by the ordinance for failure to obtain the building permit be enforced against Valiquet and that the action now pending against Valiquet in the Police Magistratets Court of Des Plaines be continued only to the assessment of the fine imposed by ordinance for such violation.
