09/27/2010DES PLAINES PLAN COMMISSION SEPTEMBER 27, 2010 MINUTES The Des Plaines Plan Commission held its regularly scheduled meeting on Monday, September 27, 2010, at 7:00 P. M., in Room 102, City Council Chambers, of the Des Plaines Civic Center. PLAN COMMISSION PRESENT: Bar, Kellerman, Kowalski, Niemotka ABSENT: Perez Also present was Senior Planner Scott Mangum. Chairman Kowalski called the meeting to order at 7:00 P. M. A motion was made by Kellerman, seconded by Niemotka, to approve the minutes of the June 28, 2010, hearing. Ms. Jennifer Tsalapatanis, 702 Howard Street, was sworn in to give testimony in this case. Ms. Tsalapatanis stated t hat she was present to request Final Plat approval for a two lot subdivision. Chairman Kowalski inquired as to whether the applicant found the comments by Engineering acceptable. Ms. Tsalapatanis state that she was in agreement with the Engineering comments. Chairman Kowalski called for questions of Ms. Tsalapatanis by members of the Commission. None were raised. Chairman Kowalski called for the Staff Report to be read by Mr. Mangum. Issue: The petitioner is requesting a Final Plat of Resubdivision for the Gianna Ada Subdivision to result in a total of two lots. Development Schedule 1 Total Acreage of Resubdivision _23,774 square feet General Information The applicant began the subdivision process in 2006, receiving Tentative Plat Approval, but that approval has since lapsed without receiving approval of a Final Plat. The proposed Final Plat with utility signatures has been submitted for consideration. Lot Descriptions and Construction Plans: The Final plat shows the one existing parcels being split into Lot #1 and Lot #2, both resulting lots approximately 65' wide by 183' deep (11,887 square feet). Both proposed lots meet the Zoning Ordinance minimums for width, depth, and total area, therefore no variation have been sought. No development plans have been submitted at this time, however the applicant intends to construct a single family residence on each lot. Staff Recommendations • The Department of Community and Economic Development recommends approval of the Final Plat, provided all conditions of approval are met. • The Public Works and Engineering Department recommends approval of the Final Plat, subject to conditions #1-4 listed below. • The City of Des Plaines Fire Department recommends approval of the Final Plat. Conditions 1. The Final Engineering plans must show public improvements for storm sewer, sidewalks, and tree -planting (as required by the Public Works and Engineering Department). 2. Prior to approval of building permits a public storm sewer must be constructed from Jarvis Avenue. The City anticipates constructing a public storm sewer in connection with the 2012 Capital Improvement Program, to which the developer may connect. 3. Prior to the sale of one or both lots a signed agreement between the buyer and seller acknowledging that building permits will not be issued until a public storm sewer is constructed from Jarvis Avenue is required to the satisfaction of the Director of Public Works and Engineering. 4. Prior to approval of building permits, sidewalk escrow in the amount of $3,737.50 shall be paid. There was no comment from the public at the hearing. After reviewing the plat and considering the facts of the case, the Plan Commission voted (4-0) to recommend approval of the final plat, subject to conditions of approval. Under Sectionl 3-2-8 of the Municipal Code, the City Council shall, by resolution, approve the Final Plat and authorize and direct the mayor to affix the name of the City. The approval shall be attested by the City Clerk and sealed with the corporate seal of the City. Staff requests that this item be placed on the Committee of the Whole agenda at the October 18, 2010 City Council meeting. Chairman Kowalski called for questions or comments by members of the audience, either in favor of or in objection to the proposal. No persons came forward. Ms. Steve Goodman, 1015 N. Corporate Drive, Grayslake, was sworn in to give testimony in this case. Ms. Goodman stated t hat he was present to request Final Plat approval to combine four lots into one. Mr. Kellerman inquired as to how many homes would be built. Mr. Goodman stated that one building was proposed with 6 attached row homes, similar to the new construction across the street. Mr. Niemotka inquired whether the 12" to 12" sewer line was approved. Mr. Good man stated that the plans have been revised 7 times to meet the requirements of Engineering and that the proposed combined sewer had been changed. Chairman Kowalski called for questions of Mr. Goodman by members of the Commission. None were raised. Chairman Kowalski called for the Staff Report to be read by Mr. Mangum. Comprehensive Plan Development Schedule Total Acreage of Resubdivision _12,294 square feet General Information Lot Descriptions and Construction Plans: The Final Plat shows the four existing vacant parcels being combined into Lot #1, approximately 98' wide by 125' deep (12,294 square feet). Development plans have been submitted to construct a three-story 12,426 square -foot building containing 6 attached row home units with vehicular access to attached rear loaded two -car garages from the alley to the south of the site. The proposed development is allowed by right in the R-4 Central Core Zoning District and no variances have been requested. Staff Recommendations • The Department of Community and Economic Development recommends approval of the Final Plat, provided all conditions of approval are met. • The Public Works and Engineering Department recommends approval of the Final Plat, subject to public improvements detailed in the approved Engineer's Estimate of Public Improvement Construction Cost. • The City of Des Plaines Fire Department recommends approval of the Final Plat. Plan Commission Procedure The Plan Commission may vote to grant, grant with conditions, or deny approval of the Final Plat. Next Step for the Petitioner If approved, the Final Plat will be considered by the City Council and, if approved, recorded upon payment of any surety for public improvements, subdivision, and recording fees. Chairman Kowalski called for questions of staff by members of the Commission. None were raised.
