06/28/2010DES PLAINES PLAN COMMISSION JUNE 28, 2010 MINUTES The Des Plaines Plan Commission held its regularly scheduled meeting on Monday, June 28, 2010, at 7:00 P. M., in Room 102, City Council Chambers, of the Des Plaines Civic Center. PLAN COMMISSION PRESENT: Bar, Kowalski, Perez ABSENT: Kellerman, Niemotka Also present was Senior Planner Scott Mangum, Department of Community and Economic Development. Chairman Kowalski called the meeting to order at 7:00 P. M. A motion was made by Bar, seconded by Perez, to approve the minutes of the June 14, 2010, hearing. AYES: Bar, Perez, Kowalski NAYES: None MOTION CARRIED 10 -027 -SUB — 2244 Douglas Avenue June 28, 2010 Page 2 Case #10 -0027 -SUB 2244 Douglas Avenue Request: A Tentative Plat of Resubdivision for the Gianna Ada Subdivision to result in a total of two lots. Ms. Jennifer Tsalapatanis, 702 Howard Avenue, Des Plaines, Illinois, was sworn in to give testimony in this case. Ms. Tsalapatanis stated the request is for a two lot subdivision. Ms. Tsalapatanis stated that the subdivision is a simple one and added the process was started prior to the change in the economy. Ms. Tsalapatanis stated each lot would exceed the minimum lot size with each measuring 65 -feet by 185 - feet. Ms. Tsalapatanis stated the capital improvements previously scheduled to be completed in 2011 have been postponed one year, but added that the project would be tied in [to the sewer] when built. Ms. Tsalapatanis stated a vacant large, but dilapidated ranch, existed on the property and has been torn down. Ms. Tsalapatanis stated the property was in violation of City Code when it was purchased, but added that it has since been maintained in compliance. Noting a neighbor was present, Ms. Tsalapatanis stated the owner has been generous to the neighbors. Ms. Tsalapatanis stated the lots meet all regulations and reiterated each surpasses the minimum required square footage. Ms. Tsalapatanis stated all the Community Development and Engineering requirements would be met. Referencing Condition #3, Mr. Bar confirmed the lots would be built in 2012. Ms. Tsalapatanis stated that was correct. Mr. Bar inquired as to who was responsible for the cost of the capital improvements. Ms. Tsalapatanis stated the City was responsible for the cost and reiterated the improvements were planned for 2011 but have been delayed until 2012. Mr. Bar confirmed the sewers for the lots would be tied into the City's sewers. Ms. Tsalapatanis confirmed that was correct. Ms. Tsalapatanis stated, currently, many of the homes have culverts for drainage. Chairman Kowalski called for additional questions of the petitioner by members of the Board. None were raised. Single Family Residential is the recommended use of the property. Total Acreage of Resubdivision 23,774 square feet General Information The applicant began the subdivision process in 2006, receiving Tentative Plat Approval, but that approval has since lapsed without receiving approval of a Final Plat. The proposed Final Plat with utility signatures has been submitted for consideration. Lot Descriptions and Construction Plans: The Tentative plat shows the one existing parcels being split into Lot #1 and Lot #2, both resulting lots approximately 65' wide by 183' deep (11,887 square feet). No development plans have been submitted at this time, however the applicant intends to construct a single family residence on each lot. Tentative Plat Comments The petitioner must make the following additions/corrections to the original copy of the plat: 1. The Final Plat must include the correct utility easement provisions and have signatures from all public service utility companies; 2. The Final Plat must contain owner name and the signed and notarized owner certificate(s); 3. The Final Plat must include Certificates from the Plan Commission, Finance Director, Director of Public Works and Engineering, and Director of Community and Economic Development; 10 -027 -SUB — 2244 Douglas Avenue June 28, 2010 Page 4 4. The Final Plat must state: "Send Tax Bill To: (Insert the name and address of the person(s) who will be paying the property taxes after the subdivision is recorded)." 5. The Final Plat must state: "Return Plat To: City of Des Plaines, Department of Community and Economic Development, 1420 Miner Street, Des Plaines, IL 60016." Staff Recommendations • The Department of Community and Economic Development recommends approval of the Tentative Plat, provided all conditions of approval are met. • The Public Works and Engineering Department recommends approval of the Preliminary Plat, subject to conditions #1-3 listed below. • The City of Des Plaines Fire Department recommends approval of the Preliminary Plat. Conditions 1. The Final Engineering plans must show public improvements for storm sewer, sidewalks, and tree -planting (as required by the Public Works and Engineering Department). 2. Prior to approval of building permits a public storm sewer must be constructed from Jarvis Avenue. The City anticipates constructing a public storm sewer in connection with the 2012 Capital Improvement Program, to which the developer may connect. 3. Prior to the sale of one or both lots a signed agreement between the buyer and seller acknowledging that building permits will not be issued until a public storm sewer is constructed from Jarvis Avenue is required to the satisfaction of the Director of Public Works and Engineering. Plan Commission Procedure The Plan Commission may vote to grant or deny approval of the Tentative Plat. Next Step for the Petitioner If approved, the petitioner's next steps are to submit final engineering plans and an Estimate of Public Improvement Cost to the Public Works and Engineering Department. The original mylar, with signatures from all the public utilities, will return to the Plan Commission for Final Plat consideration. Chairman Kowalski called for questions of Mr. Mangum by members of the Commission. None were raised. Mr. John Banas, 2256 Douglas, Des Plaines, Illinois, was sworn in to give testimony in this case. Mr. Banas stated his home is located on a property to the south of the proposed subdivision. Stating this was the third time he has been in attendance over the proposed subdivision of the lot over the last 10-12 years, Mr. Banas inquired as why the subdivision was still at issue when the last two subdivisions that had been approved. Mr. Mangum stated the most recent subdivision was begun in 2006 and that that request has received tentative approval, but that the matter had lapsed and never received final approval from either the Plan Commission or the City Council. Noting his family room had flooded for the first time, Mr. Banas stated he had no objections as long as the sewers were installed.
