Address: 630 Morray Court Case Number: 13-051-V Petitioner is s requesting Variations under Sections 8.1-3(C) and 7.2-4(D) of the 1998 Des Plaines Zoning Ordinance as amended, to erect an accessory structure (shed) with a side yard setback of approximately 0 feet and front yard setback of approximately 2 -feet where the minimum required side yard setback for an accessory structure is 5 -feet and an accessory structure is not allowed to project in front of the principal structure in the R-1 Zoning District. Slater, 630 Morray Court, Des Plaines, IL 60016 Chairman Seegers swore in the Petitioner, Jason D. Slater, son of owner, who lives at 105 E. Elaine Circle, Prospect Heights, IL. Petitioner began reading from a document his father wrote and stated an existing shed that is falling apart will replaced and extended 4 -feet. An additional smaller shed will be removed from the middle of the yard. The reason for the variation request is that relocating the shed would impact an existing garden, and rock wall. Additionally, the location of the shed is consistent with others in the area. Chairman Seegers clarified that the shed is 8x12, and Petitioner wishes to extend it east to become 8x16. Technically there's a double frontage lot. Chairman Seegers asked if the Board had any questions. Board Member Hofherr asked Staff if City Code allows two sheds. Mr. Mangum advised — yes, two accessory structures. Petitioner was asked if a permit was obtained. Petitioner advised — yes. Petitioner was also asked if the work has started. Petitioner advised — repair had begun due to mouse damage and then the shed was extended. Petitioner began the work and was stopped by an inspector. Board Member Szabo asked how long the owner has lived there. Petitioner advised — 28 years. Petitioner was also asked if both sheds were there originally. Petitioner advised — yes, and clarified that the small shed is being removed and the larger shed is being extended. Chairman Seegers asked if the Board had any further questions. There were none. Mr. Mangum was then asked to summarize the staff report. Slater, 630 Morray Court, Des Plaines, IL 60016 PIN: 08-24-317-007-0000 In reviewing the variation requests, staff has considered the following information: The 55 -foot wide by approximately 147 -foot deep lot at 630 Morray Court is conforming and exceeds both the minimum lot width (55' would be required of a new subdivision), and lot size (6,875 square feet would be required of a new subdivision). As a double frontage, or through lot, it has frontage on both Morray Court and Algonquin Road. The property is improved with a split level frame, single-family residence with a driveway and attached two -car garage. Two sheds are currently located on the property; a 60 square foot (6 -foot byl 0 -foot) shed along the west property line near the rear of the house and a 96square foot (8 -foot byl 2 -foot) shed on the west property line and approximately 2 feet from the north property line. The applicant proposes to remove the existing 60 square -foot shed and expand the larger shed to 128 square feet (8 -feet by 16 -feet) by extending the shed 4 -feet to the east. Work has already begun to expand and replace the shed. Per Ordinance Z-7-13, the location of the accessory structure on a double frontage lot is considered a minor variation, where a side setback variation of greater than 30% is a standard variation. Recommendation: Staff recommends approval of the requested variation based on review of the information presented by the applicant and the standards and conditions imposed by Section 3.6-8 (Findings of Fact for Variations) as outlined within the City of Des Plaines Zoning Ordinance, subject to the following condition of approval: 1. Prior to final inspection, the applicant shall remove the 60 square foot shed from the property. The existing non -conforming side yard setback would not change. A survey of the area indicates a number of properties with accessory structures within the required setbacks and located near the Algonquin Road frontage. The applicant is also proposing to remove a second shed which would reduce the number and overall size of accessory structures on the lot. Zoning Board of Appeals Procedure: Under Section 3.6-6 of the Zoning Ordinance (Standard Variations) the Zoning Board of Appeals has the authority to approve, approve subject to conditions, or disapprove the above-mentioned variances for the side setback and location of a shed within the R-1 Zoning District. Chairman Seegers asked if the Board had any further questions. Board Member Szabo asked if Petitioner, son, has lived in the home. Petitioner advised — yes. Petitioner was asked if other parcels have sheds. Petitioner advised — definitely parcels 600 and 640 as well as the majority of others.
