Golf Road November 12, 2014 Page 1 DES PLAINES ZONING BOARD HEFTING NOVEMBER 12, 2.014 MINUTES The Des Plaines Zoning Board Meeting altered its regularly scheduled meeting to Wednesday, November 12, 2014, at 7:30 p.m. in Room 101 of the Des Plaines Civic Center. ZONING BOARD PRESENT: Seegers, Catalano, Schell, Porada ABSENT`. Szabo, Hofhenr, Sal etnik ALSO PRESENT`. Scott Mangum, Senior Planner, Department of Community & Economic Development Gale Cerabona, Recording Secretary Chairman Seegers called the meeting to order at 7:35 p.m. & read this evening's cases. APPROVAL OF MINUTES: The minutes of October 14, 2014, will be approved at the next Zoning Board meeting. NEW BUSINESS 1. Address: 710 Second Avenue Case Number: 14-050-V Petitioner is requesting a Variation to Section 8.1-3 of the 1998 City of Des Plaines Zoning Ordinance, as amended to legalize the construction of an accessory structure (barbeque grill enclosure) with a setback of approximately zero feet from the west property line where the minimum - required setback for an accessory structure is 5 -feet in the R-1 Zoning District. Board Member Porada stated he rarely votes in favor of after -the -fact variation requests and that the Zoning Board rules require 4 votes for approval of a variation. After some discussion about future Zoning Board meeting dates & their agendas, Board Member Porada noted that three of the five cases at the next meeting is for a similar petition. Golf Road Case Number: 14-076-V Petitioner is requesting a Major Variation to Section 8.5-6 of the 1998 City of Des Plaines Zoning Ordinance, as amended: to allow an extension to an existing Commercial Mobile Radio Service Facility to allow a total height of 110 -feet, where a maximum height of 100 -feet is allowed for a Commercial Mobile Radio Service Facility in the M-1 Zoning District. PIN: 09-18-200-008-0000 Petitioner: Mike Bieniek, 10700 W. Higgins Road, Suite 240, Rosemont, IL 60018 Owner: Crown Castle International, 10 N. Martingale Road, Suite 620, Schaumburg, IL 60173 Chairman Seegers swore in Petitioners Mike Bieniek & David Kosturik, 10700 W. Higgins Road, Suite 240, Rosemont, IL 60618. Mr. Kosturik stated they are seeking a 10 ft. high extension. Plans are to mount a platform with six T - Mobile antennae & one cabinet on a concrete pad with modules to connect the wiring. Other vendors, heights were shared. Mr. Kosturik noted a lack of coverage exists at this area. Maps were identified. He stated that lower footage doesn't work. Chairman Seegers asked if tower is being increased to 110 ft. Mr. Kosturik advised — yes. Chairman Seegers asked if the Board has any questions. Board Member Porada asked: • if current heights of existing vendors are 76 ft. for Clearwire, 84 ft. for Cricket, & 100 for AT&T. Mr. Kosturik advised — yes, 110 ft. is the next best option. • how the difference between 76 & 84 ft. works. Mr. Kosturik advised — 10 ft. is recommended depending on the carrier and type of antenna • if T -Mobile currently doesn't have in -building coverage & consequently wishes to improve that. Mr. Kosturik advised — correct, trends are that 47% of households will no longer have land lines; therefore, existing coverage is no longer the standard. Chairman Seegers asked Staff to summarize the report. In reviewing this variation request, staff has considered the following information: Case #14-050-V 710 S. Second Avenue Case#14-076-V 414 E. Golf Road November 12, 2014 Page 3 The approximately 283,054 square -foot (6.5 acre) property contains a one-story brick factory as a principal use. The site has frontage on Golf and Wolf Roads and abuts railroad right of way to the west and the Metra commuter parking lot on the north. The petitioner leases an approximately 1,130 square foot portion of the lot adjacent to the west side of the building. As a freestanding, secondary principal use, the existing Commercial Mobile Radio Service Facility is permitted by right in the M-1, Limited Manufacturing Zoning District with a maximum height of 100 -feet. The 100 -foot tall monopole structure was constructed in 1999. Three cellular carriers (Clearwire, Cricket, and AT&T) currently have antennas on the pole at 76, 84, and 100 -feet respectively. The proposed 10 -foot extension to the tower would allow T -Mobile's antennas to be mounted at 107.5 feet above grade. The applicant states the need to provide additional coverage as the reason to extend the height of the tower and has provided coverage propagation maps to demonstrate estimated coverage areas. The Telecommunications Act of 1996 (47 U.S.C. S 332(c)(7)(B)(iv)) prevents municipalities from denying or conditioning cell tower zoning based upon the "environmental effects of radio frequency emissions" from cell towers to the extent they comply with FCC rules (47 C.F.R. S 1.1307 et seq.). Recommendation: Staff recommends approval of the above -requested variation for the height of the Commercial Mobile Radio Facility based on review of the information presented by the applicant and the standards and conditions imposed by Section 3.6-8 (Findings of Fact for Variations) as outlined by the City of Des Plaines Zoning Ordinance. An extension to the existing infrastructure is preferable to the construction of a new monopole structure within the vicinity. The existing tower is located approximately 300 -feet from the nearest residential property line. Zoning Board of Appeals Procedure: Under Section 3.6-7 of the Zoning Ordinance (Major Variations) the Zoning Board of Appeals has the authority to recommend that the City Council approve, approve subject to conditions, or disapprove the above-mentioned variance for the height of the Commercial Mobile Radio Facility in the M-1 Zoning District. The City Council has the final authority on the major variation requests. Board Member Catalano asked if more cell towers will fit. Mr. Mangum stated there will only be 1 on this site. Chairman Seegers asked if anyone in the audience is in favor or objects. No one responded. A motion was made by Board Member Catalano, seconded by Board Member Schell, to recommend approval of the variation as presented.
