MINUTES
The Des Plaines Zoning Board Meeting held its regularly scheduled meeting on Tuesday, November 24, 2015, at
7:30 p.m. in Room 102 of the Des Plaines Civic Center.

Acting Chair Hofherr calleci the meeting to order at 7:31 p.m. & read this evening's case.
APPROVAL OF MINUTES:
A motion was made by Board Member Green, seconded by Board Member Schell, to approve the rneeting
minutes of October 27, 2015, as presented.

Mr. Cameron advised the existing structure is at the back of the property line. He noted an architect was hired
before the permit process. Mr. Cameron stated the footprint will not change. He advised the second -story
addition will increase property values.
Acting Chair Hofherr asked if the Board has any questions. There were none.

Issue: The petitioner is requesting a standard variation to Section 12-7-2-D.4 of the 1998 City of Des

In reviewing this variation request, staff has considered the following information:
The interior (7,954 square foot) lot at 1304 Campbell is non -conforming with regards to lot width (55 feet
would be required of an interior lot in a new subdivision) and is smaller than the minimum lot size of 6,265
square feet. A two story frame single-family residence with attached one -car garage currently exists on site.
The applicant started demolition and construction of a new second story addition without a permit.
Proposing a second floor addition to match the existing nonconforming rear yard setback of 5.8' at the
closest point, where a minimum setback of 25 -feet is required. A Standard Variation is requested to
maintain the existing rear yard setback. Per Section 12-3-6-F of the Zoning Ordinance, a setback that
projects more than 30% into the required setback may be allowed with a standard variation.
Recommendation: Staff recommends approval of the above -requested variation for the second story
addition structure setback based on review of the information presented by the applicant and the standards
and conditions imposed by Section 12-3-6-H (Findings of Fact for Variations) as outlined by the City of
Des Plaines Zoning Ordinance. The second story addition would not project any closer than the existing
footprint of the house. Additionally, the existing house is uniquely positioned all the way in the back of the
property.
Zoning Board of Appeals Procedure
Under Section 12-3-6-F of the Zoning Ordinance (Standard Variations) the Zoning Board of Appeals has
the authority to approve, approve subject to conditions, or deny the above-mentioned variance for the rear
yard setback of a second floor addition in the R-1 zoning district.

Acting Chair Hofherr asked if the new construction/second story has been inspected. Juan Moreno Jr. advised
— the inspector did not inspect since there was no permit. Ms. Kirincic stated a permit will be granted after
the variation has been approved.
Acting Chair Hofherr asked if the Board has any questions. There were none. Acting Chair Hofherr asked if
anyone in the audience is in favor or objects to this proposal. No one responded.
A motion was made by Board Member Saletnik, seconded by Board Member Schell, to approve the
standard variation as requested.
