MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY -
EVENING. DECEMBER 15, 1947, AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe, Harm,
McKay,&Halverson responding to roll call. --Aldermen Baines and Morava were absent
the entire meeting. -
OFFICIAL REPORTS. The City Clerk submitted the report of the City
Treasurer H. J. Ahbe for the month of November.
lifSuperintendent of Public Works E. R. Warnicke reported the demolishing
the Mihale building.
COMMITTEE REPORTS. Alderman Harm reported the following on the Illinois
Commerce Commission Hearing for water system in Des Plaines Countryside Subdivision:
• Hearing of the Illinois Commerce Commission application
of the Higgins Water Company for a system in Des Plaines
Countryside, Higgins and Devon west•of River Road.

"I attended, with our city attorney) a hearing before the Illinois
Commerce Commission with respect to the application of.the Higgins Water Company for
a Certificate of Convenience & Necessity to construct, operate and maintain a water
system in the Town Improvement Corporations, Des Plaines Countryside Subdivision
located just outside our city limits in the vicinity of Higgins Road Devon Avenue
and Touhy Avenues. .
"We were present only as interested parties and were able to gather
these facts from a questioning by the commissioner:
"The supply of Water is to come from a well to be drilled.
"It is estimated that eventually about 250 homes or more are to be
serviced from this well and system to be installed, the number beingdetermined by
the amount of ground which might be taken for the new allocation of the Airport by

--At present there are 16 homes under construction, but 70% of the
is are sold. Temporary rates are to be $4.00 per month,with a rate of about 75¢
r 1 M ft. thereafter when meters are installed. (Estimated cost was•put at
$72,000.00.) Funds were to come from stock subscribed for the corporation and from
the sub -dividers and late on some securities offered. Discussion indicated that
some previous effort was made to buy water from Des•Plaines, and of their desire to
use it if available.
"Due to another engagement and the lateness of the hour, I was unable
to stay for the finish of the hearing, however, Mr. Opeka remained.-
"Upon the hearing, your city attorney questioned the feasibility of
four inch mains. The witnesses testified that they did not compare with specifica-
tions of neighboring communities; such mains are not usually and customarily installed
except for short distances only.
"The corporation is incorporated for $1,000.00. The subdivider will
help to pay the cost of construction on a per lot basis. The well is to be sunk
about 350 feet, and is to be treated in some manner so that it will pass the state
tests.
"The evidence disclosed that they would prefer to buy water from the
City of Des Plaines, and that they will again make an effort to procure that source
of supply."

Illkun Alderman McKay reported that City Attorney Opeka had investigated •
ty Zoning Board hearing on setbacks, and that they could not find any objections
as far as the city was concerned.
APPROVAL OF BILLS. Alderman Kehe, Chairman of the Finance Committee,
presented the following proposed resolution: .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DES PLAINES THAT THE FOLLOWING BILLS ARE DUE AND
PAYABLE AND THAT THE MAYOR AND CITY CLERK BE AND

The motion was then made by Alderman Kehe, and seconded by Harm, to adopt
the proposed resolution. The Mayor put the question, and the Clerk called the roll with
the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek, Wolf, Kehe,.Harm,
McKay, and Halverson. Nays: None. The Mayor thereupon declared the motion carried
and said resolution adopted.
LETTER FROM SENATOR A. J. BIDWELL. The Clerk read the following letter:

City of Des Plaines, Illinois
Dear Mr. Henrich:
I am in receipt of your letter of November 20th with reference to my
petitioning for a special session of the General Assembly for the purpose of allocating
an equitable percentage of the taxes from any or all of the following sources of revenue:
Retailers' Occupation Tax,
Public Utility Act,
Liquor Control Act, and
Cigarette Tax Act.
•
I am sorry to inform you that we had appropriated at the last session of
the General Assembly, all these monies, and they are definitely earmarked for the next
biennium. It would be quite futile to call an extra session for the division of these
taxes.
I would suggest when the next General Assembly convenes (in 1949) that
your municipality have a definite, specific and workable program.
I wonder if it would be possible for me to get a last financial report
made by the City of Des Plaines.

DFS PLAINES SAFETY COUNCIL LETTER. The Clerk read the following letter:

Gentlemen: --
December 14th, 1947.
The Des Plaines Safety Council have three (3) items, which we are giving
you for your immediate action and attention.
They are as follows:
First - The City Council to contact the State Highway Depart-
ment, requesting that they install a concrete walk
along the retaining wall on the south side of Cumber-
land Station, leading from the Station to the inter-
section at Golf and Wolf Roads.
Second - Have the Police Department check sppeding on the
Northwest Highway at Cumberland Station between 5
and 7 P.M. •
Third
Remove the white line on the street on Bittersweet
Court, as motorist have a tendency to follow that
white line instead of continuing on Mannheim Road
at the curve.
Please advise.

The Mayor referred items two and three to the Public Protection Committee.
e motion was made by Alderman McKay, and seconded by Wolf, that the City Clerk write
the State Highway Department regarding item one. --The motion was voted upon by
acclamation, whereupon the Mayor declared the motion carried.
F. SCHARRINGHAUSEN REZONING. The Clerk informed the City Council that
he had a copy of a letter written by F. Scharringheusen, Building Inspector, for
A. H. James, Secretary of Zoning Board of Appeals. This letter was in regard to a
rezoning hearing held on October 7, 1947. The report of the Zoning Board said that the
description of the property involved was not complete and that a new hearing could be
requested. The Mayor referred the letter to the Zoning Board of Appeals for a re -hearing.
DES PLAINES SPECIAL ASSESSMENT NO. 121 (No. 52.693). The Clerk reported
on the following letter:

Ak You are hereby notified that on the 1st day of December, 1947, the City
of Des Plaines, Illinois, filed a petition in the office of the Clerk of the County
Court of Cook County praying that steyt s may be taken to levy a supplemental special
assessment to pay the deficiency in the assessment heretofore levied to pay the bonds
and vouchers issued in payment of the cost of the improvement, the cost of the land
acquired, together with the amount required to pay the interest accrued and accruing
the bonds and vouchers and the cost of making, levying and collecting the supple-
ntal assessment for the improvement described as follows:
Widening, curbing, grading, paving and
otherwise improving Ellinwood Street,
from Des Plaines Avenue to Lee Street;
Pearson Street from Ellinwood Street to
the Chicago & North Western Railway and
Center Street from Ellinwood Street to
Prairie Avenue, in the City of Des Plaines,
Cook County, Illinois.
An assessment roll was returned and filed in the said proceeding in the
office of the Clerk of said Court, on the 3rd day of December, A.D. 1947, said proceed-
ing being known as Des Plaines Special Assessment No. 151, which is now pending; that
the total amount of the deficiency in the cost of the improvement as estimated is the
sum of $6,630.00, the amount assessed against the City of Des Plaines, Illinoisfor
public benefits being $6,360.00. 5

Said assessment is payable in one installment and does not bear interest.
Application will be made to said County Court of Cook County, at Chicago, in said
County, for the confirmation of said assessment on the 22nd day of December, 1947, at
ten O'clock in the forenoon or as soon thereafter as the business of the Court will
permit. All persons desiring may file objections in said Court before said day and
may appear on the hearing and make their defense.

PASS BUSINESS LICENSE ORDINANCE. The Clerk read for first reading the
following proposed ordinance entitled:
AN ORDINANCE AMENDING CERTAIN '
SECTIONS AND CHAPTERS OF THE
REVISED ORDINANCES OF THE CITY
OF DES PLAINES OF 1928 RELATING
TO LICENSES.
The motion was made by Alderman Kehe, and seconded by Johnson, to sus-
pend the rules and pass the proposed ordinance. The Mayor put'the question, and the
Clerk called the roll with the following result: Ayes: Aldermen Johnson, Hansen,
Vavrinek, Wolf, Kehe, Harm, McKay, and Halverson. Nays: None. The Mayor thereupon
declared the motion carried, and the proposed ordinance put before the Council for
final passage. The Motion was then made by Alderman Kehe, and seconded by Johnson,
to pass the proposed ordinance. After discussion, the motion was made by Alderman.
Johnson, and seconded by Kehe, to amend the Parking Lot to one ($1.00) dollar per car
space, minimum of fifteen 415.00) dollars. --The Mayor put the question, and the Clerk
called the roll with the following result: Ayes: Alderman Johnson, Hansen, Vavrinek,
Kehe, Harm, McKay, and Halverson. Nays: Alderman Wolf. The Mayor thereupon declared
the motion carried. After discussion, the Mayor put the question, and the Clerk called
the roll to pass the proposed ordinance with the following result: Ayes: Aldermen
Johnson, Hansen, Vavrinek, Wolf, Kehe, Harm, McKay, and Halverson. Nays: None. --The
Mayor thereupon declared the motion carried and the proposed ordinance passed.
The motion was made by Alderman Kehe, and seconded by Johnson, to pbblish
the ordinance in the Des Plaines Journal. The motion was voted upon by acclamation. The
Mayor thereupon declared the motion carried.
APPROVAL OF MINUTES. The motion was made by Alderman Johnson, and seconded
by Hansen, to.approve the minutes of December 1, 1947. The motion was voted upon'by
acclamation, whereupon the Mayor declared the motioncarried.
ADJOURNMENT. The motion was made by Alderman Wolf, and seconded by
Vavrinek, to adjourn. The motion was voted upon by acclamation, whereupon the Mayor
declared the motion carried and the meeting regularly adjourned.
