CITY COUNCIL_ OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY
EVENING, DECEMBER 1,-1947. AT 8:00 P.M.
CALL TO ORDER. The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson, Hansen, Wolf, Vavrinek, Kehe, Baines,
Harm, McKay, Halverson, and Morava responding to roll call.
OFFICIAL REPORTS. The City Clerk submitted the reports of the Build-
ing Inspector, Frank Scharringhausen; Electrical Inspector, Art Rieck; and City
Clerk, Otto W. J. Henrich, for the month of November.
Chief Becker reported about the school crossing stop signs, and was
informed to keep stop signs up to see what the State Highway Department would do
about same.
On recommendation of Chief Becker, the motion was made by Alderman
Johnson, and seconded by Halverson, that the City Attorney draft an ordinance
making Center and Thacker Streets a four way stop.
APPROVAL OF BILLS. Alderman Kehe, Chairman of the Finance Committee,
presented the following proposed resolution:

The motion was then made by Alderman Kehe, and seconded by Halverson,
to adopt the proposed resolution. The Mayor put the question, and the Clerk called
the roll with the following result: Ayes: Aldermen Johnson, Hansen, Vavrinek,_
Wolf, Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: None. The Mayor
thereupon declared the motion carried and said resolution adopted.
COMMITTEE REPORTS. Public Protection Committee. --On motion by
Alderman Johnson, and second by Wolf, to concur in the following recommendation
of the Public Protection Committee:
1. That Seegers Road at Wolf Road be par-
tially barricaded and the "NO OUTLET"
sign now in use be replaced by one hav-
ing reflector buttons.,
2. That a "NO OUTLET" sign be placed on the
west side of,Wolf Road at Harvey Street.
3. That the City Clerk write to the Soo Line,
requesting their Safety Engineer to con-
tact the Chief of Police to learn what
recommendations the Soo Line may have,
with respect to the footpath crossing
the Railway at Everett Street.

The motion was voted upon by acclamation, whereupon the Mayor de-
clared the motion carried.
On motion by Johnson, and second by Halverson, to concur in the
following recommendation of the Public Protection Committee:
1. Eliminate parking on west.side of Second
Avenue north of Prairie Avenue to rear
of the corner lot.
2. Eliminate parking on east side of Second
Avenue south of Prairie Avenue to rear
of the corner lot.
3. That a 4 -way stop be placed at this corner
for the benefit of numerous school children
who use this intersection.
4. That the street be widened in front of the
two business establishments at this inter-
section to permit diagonal parking properly
marked for that purpose.

PUBLIC PROTECTION COMMITTEE, CONT'D.
After. discussion, the motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.
The motion was then made by Alderman Harm, and seconded by McKay,
that the Superintendent of Public Works install "NO PARKING" sign fifteen feet
from the northeast corner of Prairie and Second Avenue. The motion was voted
upon by acclamation, whereupon the Mayor declared the motion carried.
Alderman Johnson reported that the Public Protection Committee
would submit a recommendation at the time that the 1948 Appropriation is made
regarding Des Plaines Safety Council recommendation to increase the police
force. --The Clerk was instructed to write a letter to Safety Council informing
them of action taken.
PUBLIC RELATION COMMITTEE. Alderman Harm reported the Veteran
Housing received their State Charter.
Alderman Harm also made the following report on the Municipal Band:
•
This committee believes that a fine, well conducted Municipal Band would be a
desirable addition to our city and well worth its cost, providing there would
be sufficient interest by capable personel to insure its success.
We have interviewed the writers of the request for the re-establishment of
this band and we are assured and satisfied that sufficient personel of excellent
quality will be available and willing to participate.
We have examined the present band ordinance found in Chapter 6, Article 3-
Seetions 195/B
We have checked the Authority of the Voters as Authorized in Secion 198, rela-
tive to finances and find a tax of 2 mills was approved by the voters for this
purpose.
We, of this committee, believe that this ordinance is quite complete as to
establishment, appointments, rules & regulations and financing.
Accordingly we.recommend that the Des -Plaines City Band be re-established
as per the provisions of this ordinance.

The motion was made by Alderman Harm, and seconded by Morava, to
concur in the report. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried.,
MUNICIPAL DEVELOPMENT COMMITTEE. Alderman Hansen reported attend-
ing the County Zoning Board Hearing. The committee recommended the approval
of the William Boettcher rezoning, but objected to the Walter Hasselman rezoning
east of Manheim Road, south of Pratt Avenue, which was intended to be used for
a trailer camp.
The motion was made by Alderman Hansen, and seconded by Halverson,
to concur in the report and that the City Clerk write to the County Zoning
Board and County Clerk informing them of the report. •
CITY ATTORNEYtS REPORT. The Clerk read the following report:

vs. Musgrave
Please be advised that the above matter involving our solicitors'
ordinance came up for hearing on an appeal before the Honorable Harold Ward
in the Criminal Court of Cook County.
After presentation of evidence and arguments of counsel, the Court
rendered a finding of not guilty, but did not render any decision on the validity
or constitutionality of the ordinance in question.
Much was said at the hearing about that provision in the ordinance
which states that permits are required for all persons who are not residents of
the City of Des Plaines. It is suggested that this discrimination be corrected
by amendment.

OPEKA'S REPORT, CONT'D.
The motion was then made by Alderman Johnson, and seconded by Hansen,
to amend the Solicitors' Ordinance regarding the item "All persons who are not resi-
dents of the City of Des Plaines." The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried.

In connection with the negotiations for the procurement of necessary
easements by Harry A. Dooley and Kimball Hill from the Croatian Home, I as in
receipt of a letter from Rosenthal & Feldman, their attorneys, indicating that the
matter will be discussed by the Board of Trustees of the Croatian Home at its next
meeting to be held December 7, 1947. Mr. Rosenthal states that he will communi-
cate with me shortly thereafter.

STATE DIVISION OF HIGHWAY LETTER. The Clerk read the following
November 25, 1947

Dear Sir:
This will acknowledge receipt of your letter of November 4,,in
which you requested a reduction in the posted speed on Miner Street, from
30 miles to 25 miles per hour.
At the request of Mr. D. R. Albano, Superintendent of Parks, of
the Des Plaines Park District, we have recently erected 2 park entrance signs on
Miner Street and we do not feel that conditions warrant a reduction in the speed
limit. •
We have noticed that the speed limit sign which is erected under
the Town Name sign at the northwest corner of Rand Road and Miner Streets desig-
nates a speed limit of 35 miles per hour. This sign will be removed and replaced
with a 30 mile per hour speed limit.

Gentlemen:
I am in receipt of your letter of November 20, 1947, requesting
me, as one of your Representatives in the General Assembly, to petition Governor
Green asking him to call a special session of the General Assembly to allot a
percentage of the tax received by the State to Municipalities.
Several weeks ago I phoned the Governor and also sent him a tele-
gram making this request. As a Mayor I think I can better appreciate the plight
of most of the Municipalities of the State better than other members of the Legis
lature.

Your letter of November 20, addressed to Governor Green, enclosing
a copy of the resolution recently passed by members of the City Council of Des
Plaines, has been referred to me during the Governor's absence from the Statehouse.
Upon his return it will be called to his attention.
In the meantime, because there has been so much erroneous talk on
State finances, I am enclosing a copy of the Governor's letter of October 29 to
the Chairman of the Commission to Stidy Revenue Laws of Illinois and hope you will
be good enough to call its contents to the attention of the members of your City
Council.

PASS ORDINANCE AMENDING LIQUOR ORDINANCE. The Clerk informed the
Council the proposed amendment to the Liquor Ordinance was before the council for
the third time.
The motion was made by Alderman Hansen, and seconded by Halverson,
to refer the proposed ordinance to the Public Protection Committee for further
study. On voice vote the Mayor declared the motion not carried. --The motion was
then made by Alderman Kehe, and seconded by Baines, to pass the proposed ordi-
nance. The Mayor put the question. --Alderman McKay spoke regarding the Club
License Fee and then made the motion to amend the section to read two hundred
fifty dollars ($250.00) instead of the one hundred dollars ($100.00). The motion
was lost for want of a second.
Alderman Johnson inquired of the City Attorney if at the request of
two alderman to refer to the committee,, if that request did not supersede the
motion to pass the ordinance. The Attorney checked the City Ordinance Book and
replied it did not.
The Mayor ordered the Clerk to call the roll with the following re-
sult: Ayes: Aldermen Johnson, Vavrinek, Wolf, Kehe, Baines, Harm, and Morava.
Nays: Aldermen Hansen, McKay, and Halverson. The Mayor declared the motion carried
and the proposed ordinance passed. (The motion was made by Alderman,Wolf, and
seconded by Baines, to publish the ordinance in the Suburban Times.) The motion was
then voted upon by acclamation, whereupon the Mayor declared the motion carried.
CUMBERLAND MAINTENANCE CORPORATION LETTER. The Clerk read the
following letter:

At a recent meeting of the Bpard of Directors of the Cumberland,
Maintenance Corporation a motion was passed to request that the Des Plaines City
Council consider amending "An ordinance amendtng,section 16 of zoning ordinance
of Des Plaines" approved the 19th day of August, 1946.
Section 16, pertaining to Building Line should provide that the
5 foot set back will apply except in such class C property where a greater build-
ing set .back has been established by previous restrictions or ordinance.
We believe that ourrequest is in keeping with the intention of the
aforsaid ordinance, and we shall greatly appreciate your favorable consideration.

The City Attorney was requested to inquire for information on the
GEORGE LAGERHAUSEN APPOINTED TO TRAFFIC COMMISSION. On motion
by Alderman Johnson, and second by Wolf, the appointment of George Lagerhausen
as member of the Traffic Commission was confirmed, to fill the unexpired term of
Lee Foster who resigned.
APPROVAL OF MINUTES. The motion was made by Alderman Baines, and
seconded by Kehe,.to approve the minutes of November 17, 1947. The motion was
voted upon by acclamation, whereupon the Mayor declared the motion carried.
The Mayor informed the Council that on Monday, December 8th, there
would be a public hearing on the new business license ordinance at 9:00 P.M. for
the businessmen or anyone interested. --At 7:30 P.M. (until the hearing) the
Council would meet to discuss the 1948 Appropriation Ordinance.
ADJOURNMENT. The motion was made by Alderman Halverson, and
seconded by Baines, to adjourn. The motion was voted upon by acclamation, where-
upon the Mayor declared the motion carried, and the Council regularly adjourned.
