Pflughaupt, who presided with Aldermen Johnson, Hansen, Wolf, Kehe, Baines, Harm,
McKay, and Morava responding to roll call. Alderman Vavrinek and Halverson were
absent the entire meeting.
OFFICIAL REPORTS. The City Clerk submitted the reports of Building
Inspector, F. Scharringhausen; Electrical Inspector, A. Rieck; City Treasurer,
H. J. Ahbe; and City Clerk, Henrich, for the month of September.

Bennett Construction Company Excavators. Alderman McKay reported the

Gentlemen:
On June 9th of this year, after some unpleasant preliminaries,
Mrs. Bennett of the Bennett Construction Company, agreed to start construction at
the two excavations on Woodbridge Road in Cumberland Terrace within 30 days. As
you may recall, these excavations had been made 16 months before and had become a
menance and a nuisance.
At our regular Council meeting of July 7th I reminded those present,
including Mrs. Bennett, that the Construction Company had not up to that, time ful-
filled the promise to start construction, and it was agreed that if work had not
started in the allotted time the excavations would be filled by the City.
At the last moment the Bennett Company started work on the foun-
dations. Soon the concrete walls were in, the forms removed, dirt backfilled, and
after a while some millwork was delivered on the site. Water and sewer lines were
installed.
Incidentally, it will be recalled that at our meeting on June 9th,
the Bennett representative had requested she be permitted to install sewer connec-
tion so water which might collect in the basements could flow into our sanitary
sewer. She was informed this would not be permitted, but the sewer linea are in,
and the tile ends are not capped, and I have been informed they are not plugged
except with dirt and stone. This cannot be definitely checked except by getting
down into the basement, and this it is difficult to do without a ladder as the walls
are about seven feet high and a sheer drop all around. I would suggest, however,
that the condition be checked. The tap at the end of one of the water lines is
dripping freely, and perhaps it might be well to correct this.
The millwork which had been delivered to the job has been withdrawn,
and it looks now that the net result of the philanthropic efforts of the Bennett
Company to provide relief to the housing situation, is this -
Instead of having two excavations on Woodbridge Avenue with dirt_
banks, and a chance for a child to crawl out if he fell in, we now have two de luxe
ditches with concrete walls and which are definite traps for anyone who might fall
in. This is the net result of a 20 -month stretch since the breaking of ground for
these two homes.

of various highway intersections in and adjacent to our city limits; and, if' con-
venient, we would like to have this meeting on Tuesday evening, October 28, along
with,our regular Traffic Commission meeting.

Dear Mr. Henrich:
In reply to your committee' report dated September 15, and the letter
attached thereto from the Safety Council dated September 14, we recommend that.the
City barricade Seegers Road at the east line of Harvey Street for, according to
Engineer Fletcher, part of this road is private property and also the railroad
crossing on•the old roadbed had been disposed of.at the time the'underpass was
built.'
We also recommend that the "No Outlet" sign now in use on the east
side of Seegers and Wolf Roads be removed and moved to the west side of Wolf Road at
Harvey Street.
We recommend that the four-way stop sign be replaced at Center and
Thacker Streets. The stop signs at Center Street had been removed. several years
ago; however, it is still a dnagerous corner approaching the property of the Center
Street School, and this would reduce the speed of the motorists approaching this
corner from both the north and from the south.

Dear Mr. Henrish:
Mr. Donald Frazer, representing the Riverview Civic Club, and Alderman
Harms brought to our attention, and we discussed at length, the danger of the children
going to and rom the Riverview School crossing the Soo Line Railway right of way at
the end of Everett Street which is not an authorized crossing.
We wish to recommend that,you ask the Soo Line Railway to barricade the
foot path at the west end of Everett Street which leads across the Soo Line Railway
property to Mannheim Road.

We also recommend that a sidewalk be placed from the south end of the
"S" curve on Mannheim Road to Prospect Avenue which, after completed, will give the

You will recall that on September 9, 1947, I wrote to you concerning
the water main built by mfr client, the Croation Orphans Home, on Dempster Street
outside the City Limits.
On September 16, 1947, we received a letter from your City Clerk,
<C acknowledging receipt of our letter, and stating that the matter was referred to
to the City Attorney and to the Water Committee.
Although we were informally assured by the City Attorney, Mr. Frank
Opeka, that no water would be sold through our main until a satisfactory adjustment
is made with the Croation Home, it is now rumored that the City of Des Plaines is
supplying water to several subdivisions, through our main.
Since we have received no formal response from the City in connec-
tion with these matters, and since my client is pressing me for something definite
in this matter,'I respectfully request that you let me have a formal reply to the -
matters set forth in mfr letter of September 9, 1947.

which was a copy of a letter sent the City Council by the Des Plaines Traffic
Commission regarding the intersection of Touhy and Mannheim Roads.

A twelve hour traffic count was made at this location on Tuesday,
August 12th, between the hours of 7:00 A.M. and 7:00 P.M. A breakdown of the count
showed that traffic volumes through the intersection were slightly over 50 of that
required under the minimum warrants adopted by this Department in accordance with
the law.
An examination of accident reports of your City, as well as the State
and County police, showed a total of five accidents during 1945, 13 in 1946 and four
to July 1st in 1947. Of the total it was noted that 15 occurred during hours of day-
light. As you know, traffic through the intersection is controlled by 2 - 36" stop
signs on Touhy with 36" advance warnings. There are 36" cross road signs on Mannheim
Road. There are no restrictions on sight distance and we believe that most of the
accidents can be attributed to a violation of the stop regulation.
At this time we cannot recommend the installation of signals under.
any of our warrants, but will keep this intersection under observation.

Dear Mr. Rosenthal:
Your letter of October 9th addressed to the Mayor of the City of Des
Plaines was referred to me for reply after it was read at a regular meeting of the
Council.
First, I wish to advise that the reason you have received no formal
communication from the Water Committee, to whom your letter of September 9th was
referred, is due to the fact that the Committee has endeavored to compel an adjust-
ment of any claims that might exist and for that reason called the meeting to which
you were invited and apparently could not attend. A subsequent meeting was to be
arranged to suit your convenience, but no date has been agreed upon.
I wish to direct your attention to the fact that the City of Des Plaines
entered into•a contract with Harry A. Dooley, the owner of the subdivision directly
across from the high school and also with the Green Fields Homes, Inc., the owner of
the subdivision adjoining the high school to the south. The agreements provided for
the construction of a new main from the city limits to their properties, thru which
they would be serviced with water for which they have made application. The agree-
ments further provided that they are to procure the necessary easements and rights
of way. Water when supplied will be supplied thru a meter installed at the City
limits. To date no such application has been made nor such meter installed.
Up to the present time no request has been made with the City for water
service to either of the subdivisions to which you refer in your letter. I might add
that the City of Des Plaines has made use of the main in question, when it was com-
pelled to secure an emergency supply of water from Park Ridge and in so doing acted
within its authority under the purported contract to which you refer.
The records indicate that your clients have abandoned the use of this
main for some 17 years, during which period the City of Des Plaines, to maintain
proper circulation of water, maintained -water in said mains, especially in view of the
fact that on several occasions it was found necessary to connect with the Park Ridge
system for an emergency supply of water.
You are informed that the City of Des Plaines issued no permits to any
one to tap on this main, for the reason that the City of Des Plaines has no authority
to issue any such permits beyond its corporate limits and especially in view of the
fact that they are not the owners or lessers of said main.
