MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY
EVENING, SEPTEMBER 15, 1947, AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided with Aldermen Johnson, Hansen, Wolf, Kehe, Baines, Harm,
McKay, Halverson, and Morava. Alderman Vavrinek was absent due to a call to New
York City on business. -
OFFICIAL REPORTS: The City Clerk submitted the report of City
Treasurer, H. J. Ahbe, for the month of August.
The Superintendent of Public Works reported that the Soo Line
pedestrian crossing at Prospect Avenue had been repaired in a satisfactory manner,
and he isawaiting the loan of stencils from the State Highway Department to mark
the school crossings on the pavement. He also reported that the Savas Distribu-
ting Company had completed the installation of a new type of street marker at the
Northwestern Depot crosswalk on Miner Street as a sample, without cost or obliga-
tion, to the City.
City Engineer Fletcher reported concrete slabs received at railroad
crossings, but there would be a delay until the new rails arrive.
Chief of Police, Howard Becker, reported that four-way
were installed at Lee and Algonquin Road for a ninety day emergency.

SECOND READING OF LIQUOR ORDINANCE AMENDMENT: The Clerk read for
second reading the following proposed ordinance:
AN ORDINANCE AMENDING AN ORDINANCE
ENTITLED "AN ORDINANCE REGULATING
THE SALE OF ALCOHOLIC LIQUORS IN
THE CITY OF DES PLAINES AND REPEAL-
ING ALL OTHER ORDINANCES HERETOFORE
PASSED REGULATING THE SALE OF ALCO-
HOLIC LIQUORS" PASSED DECEMBER 15,
1941, AS AMENDED.
Mayor Pflughaupt informed the Council that no doubt some persons
in the audience desired to .speak on the ordinance, and he said that a motion was
in order. --The motion was made by Alderman Halverson, and seconded by Hansen, to
grant the request of those who desired to speak. The motion was voted upon by
acclamation,whereupon the Mayor declared the motion carried.
Reverend Brehm, Reverend Wobbe, Charles B. Robison of 1726 Van Buren, &
F. Glocke of 1746 Stockton spoke opposing the ordinance regarding the increase of
taverns. Frank J. Weber, Executive Secretary of the Illinois Liquor Dealers Associa-
tion, also stated that he opposed the increase of taverns and the amount of increase
of license fee.
Adolph Esser spoke regarding his desire for a license for his new
business of restaurant and tavern.
Charles Nolte of 1659 Algonquin Rd. stated that he was in favor of
the increase in taverns.
The Mayor put the question, and the Clerk called the roll with the
following result: Ayes: Alderman Johnson, Kehe, Harm, Halverson, and Morava.
Nays: Alderman Hansen, Wolf, Baines, and McKay. Because there was not a majority
vote of the Council, the Mayor declared the motion lost.

The motion was then made by Alderman Kehe, and seconded by Baines, to
adopt the proposed resolution. The Mayor put the question, and the Clerk called the roll
with the following result: Ayes: Aldermen Johnson, Hansen, Wolf, Kehe, Baines, Harm,
McKay, Halverson, and Morava. Nays: None. The Mayor thereupon declared the motion
carried and said resolution adopted.
PASS 1947 TAX WARRANT ORDINANCE: The Clerk read for first reading the
following proposed ordinance:

The motion was then made by Alderman Kehe, and seconded by Baines, to
suspend the rules and pass the ordinance. The Mayor put the question, and the Clerk
called the roll with the following result: Ayes: Aldermen Johnson, Hansen, Wolf,
Kehe, Baines, Harm, McKay, Halverson, and Morava. Nays: None. The Mayor thereupon
declared the motion carried, and the rules suspended the ordinance before the Council
for final passage.
The motion was then made by Alderman Kehe, and seconded by Halverson,
to pass the ordinance. The Mayor put the question, and the Clerk called the roll
with the following result: Ayes: Aldermen Johnson, Hanson, Wolf, Kehe, Baines,
Harm, McKay, Halverson, and Morava. Nays: None. The Mayor thereupon declared the
motion carried and the ordinance finally passed.

DES PLAINES SAFETY COUNCIL LETTER: The Clerk read the following
letter:

Gentlemen: --
Would like to call your attention to a matter pertaining to signs
on Seegars Road and Harvey Avenue.
When the underpass is flooded underneath the railroad tracks on
Golf Road, motorists have a tendency to turn down Seegars Road which has no outlet,
thinking they can cross the railroad tracks to get on Northwest Highway.
At the"present time there is a small "NO OUTLET" sign on the south
side of the street at Wolf and Golf Roads and it would be our suggestion that a
larger sign be placed on the north side of Seegars Road.
With reference to Harvey Avenue, west of Wo1fiRoad, a "NO OUTLET"
sign was also suggested for this street, as it is not a thru street and trucks turn
in there thinking they can cross thru to the west section of Cumberland Terrace.
(.it They then use the driveways on this street to back in and turn around.
We would also like for you to have a check made on sidewalks on
Miner Street between Pearson and Lee Streets, as a hazardous condition prevails
there.
We would like to recommend a four (4) way stop sign at Center and
Thacker Streets, instead of stop sign on Thacker Street only.
Will you please advise relative to the above.

TREASURER H. J. AHBE'S LETTER: The Clerk read the following letter:
September 15, 1947
Honorable Mayor and Members of the City Council
of the City of Des Plaines, Illinois
Gentlemen:
Special assessment warrant No. 150 for paving Third Avenue and
North Golf Cul de Sac Avenue is now in collection. Funds are now being collected
which will require the opening of a separate bank account.
May I request you to authorize the City Clerk to write the First
National Bank of Des Plaines, Illinois that said account is to be known as CITY OF
DES PLAINES SPECIAL ASSESSMENT NO. 150 ACCOUNT. Immediate passage of this request
will be greatly appreciated.

The undersigned who are property owners in the 400 block on Harvey.
Avenue, Cumberland Terrace in the City of Des Plaines respectfully request, that
for the Public safety and protection, a street light be installed within that block.

We are not making this request for our own protection but also, that
of the Cub Scouts and Boy Scouts, who meet in the basement at 436 Harvey Avenue and-
the Girl Scouts who meet at 427 Harvey Avenue.
Due to the fact that Harvey Avenue at Wolf Road does not continue
straight through and the light being placed at Wolf Road and Harvey Avenue East, we
in the 400 block do not benefit by it and are in total darkness.
Your Petitioners ask that your Honors view the premises and kindly
grant our requests.

S. H. ROSENTHAL LETTER--CROATION ORPHANAGE WATER MAIN: The Clerk
read the following letter:

Gentlemen:
September 9, 1947
This letter is written to you in behalf of the Croation Orphans Home.
You are undoubtedly familiar with the fact that, in 1926, my client
built an extension of the water main along Dempster Street from the City Limits at
Rand Road to Potter Road, at a cost of $16,867.33. This figure, of course, included
the cost of connecting up with the orphanage buildings.
May I call your specific attention to the minutes of the meeting of
the City Council of Des Plaines, held on October 18, 1926, in which the City entered
into an agreement with my client relative to this water main.
Paragraph #7 of said agreement provides as follows: "It is further
understood and agreed that the said party of the first part binds itself and the said
party of the second part binds itself not to sell water from said main, or permit
said main to be tapped, la am other person, firm or corporation as long as said
party of the second Rall shall own same."
We have, in the past, protested vague talk and rumors that H. A. Dooley
and other subdividers in the area contemplated tapping in to our main for their water
supply. As a matter of fact, Mr. Dooley had indicated that he would be willing to do
justice as soon as the development of his subdivision was well underway.
It now comes to our attention that these subdividers have reached a
point where the proposed tapping in to our main is imminent.
The Orphanage has been located in Des Plaines for many years, has
rendered useful public service, and has at all times cooperated with the City authori-
ties, and it is our intention to continue to cooperate with you in every way.
However, the Orphanage is a charitable institution, and cannot afford
to have its large investment taken away, without being adequately reimbursed.
Accordingly, we want to take this means to go on record with you to
the effect that if the City of Des Plaines permits H. A. Dooley, or any other
persons, to tap in to our main, or releases any water through our main, in violation
of the agreement above referred to, my client will have no alternative but to institute
immediate court action to protect its -rights.

The undersigned Aldermen, hereby call and request that you give notice
of a Special Meeting of the City Council of the City of Des Plaines, Illinois, to be
held on Monday, September 22, 1947, at 8 o'clock P.M. (Daylight Saving Time) for the
following purposes:
1. To reconsider the vote of the City Council taken at the last regular meeting
held on Monday, September 15, 1947 on the question of adopting an ordinance
amending the Liquor Ordinance pertaining to license fees, limitation of number
of taverns, sales to minors and unobstructed view from the streets.
2. To adopt an ordinance amending the Liquor Ordinance pertaining to license fees,
limitation of number of taverns, sales to minors and unobstructed view from the
streets.
3. To transact such other business as may lawfully come before the meeting.
This meeting is requested because the Mayor should have voted on the
adoption of the ordinance acted upon at the last regular meeting held September 15, 1947,

to cast his vote, he was deprived of his duty to vote as required under Section 9-44
of Chapter 24 of the Illinois Revised Statutes of 1945 which reads as follows:
