MINUTES OF THE REGULAR M1TING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY EVENING. JANUARY 6. 1940. AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor G. Walter Pflug
haupt, who presided, with Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Schar-
ringhausen, Harm, Halverson and Morava responding to roll call.

. OFFICIAL REPORTS: The City Clerk submitted the monthly and annual re-
ports of Building Inspector Scharringhausen, and Electrical Inspector Rieck. Also
the City Clerk's report of receipts for December, 1946.
City Engineer Fletcher reported the new well had been tested and proved
satisfactory.
WATER COMMITTEE REPORT: Alderman Halverson reported that the Water Com-
mittee had investigated the bids on the water mains from Well No. 2 to the Softening
Plant. Alderman Halverson then made the motion which was seconded by Napieralski thtt
the contract for the water mains from the new well to the Softening Plant be awarded
to Joe Divito, 1504'Whitcomb Avenue, .Des Plaines, and that the Mayor and City Clerk
be authorized to execute a contract upon the filing of a performance bond. The motion
was voted upon by acclamation whereupon the Mayor declared the motion carried.
MUNICIPAL DEVELOPMENT COMMITTEE: Alderman Napieralski made the following
report:
Your Committee on Municipal Development has investigated and has found
that the most westerly line of the Prickett property (gas station request) is 888.71ft.
from the intersection of Bussee Avenue and Miner Street and an additibnal 800 feet
from the nearest gas station. Moreover it appears that the existing ordinance is
antiq'uuted having been designed to prevent certain overdevelopment of gas stations
during the depression.
We therefore recemmend that paragraphs "A" "B" and "C" of Section 2
"Permit Restrictions" be amended in each case to show the minimum distance permissi-
ble between new and existing gas stations to be 750 feet.

resolution be adopted. The Mayor put the question and the Clerk called the roll with

The City Council of the City of Des Plaines hereby authorized Harold
J. Ahbe, City Treasurer of the City of Des Plaines to open a separate bank account
to be known as CITY OF DES PLAINES SPECIAL ASSESSMENT FORECLOSURE ACCOUNT.
Deposits to this account are to be made from the proceeds of special as-
sessment foreclosure sales which have been held by the County Treasurer.
Said funds are to remain in this account until a break -down has been made
of the foreclosure sale to determine the pro -rata amount due the outstanding bond
holders. Upon completion of such calculations, acceptable to the -City Treasuver, he
may then disburse said funds by the issuance of checks bearing his registered signature.

ADOLPH M. ESSER APPLICATION FOR TAVERN LICENSE: The Clerk read the

Gentlemen:
I herewith make formal application for a liquor license to operate a
tavern on Oakton Street in Des Plaines.
Although I realize that there exists an established quota, which changes
as taverns drop out, and which I think is very unfair to any citizen, such as myself,
who desires to entered inti this legitimate business. Under this quota system, eventual-
ly a license will bring an unbelievable sum to those who hold it, running into many
thousands of dollars, as is already apparent from recent' transfers made. It not only
is a privilege, but becomes a monopoly in favor of those who were here first, and de-
nies anyone at a future date the right to engage in this type of business without
paying a terrific penalty do do so.
I have purchased a lot on Oakton Street, and if permitted, would build a
beautiful building on it, modern in every respect, which would enhance the neighbor-
hood. I would conduct business in a clean and respectable manner. The people I
would employ would correspond to the same ideals.
For several years there has been no tavern in this area, as both Jules
Tavern and Dick Behm's Tavern closed during my term of duty with the Navy. Had I
been here at the time, I would have readily acquired one of these licenses. I have had
such plans for several years prior to my entering the military service, but did not
apply for a license as there were two such establishments in the neighborhood. When
I returned, I found that opportunity closed to me, and for that matter to any one else.
This street is zoned for commercial. establishments, and the people. are
entitled to one without having to travel so• far to satisfy their desires. The closest
tavern is over a mile away.

I believe it is just a question of time, and someone will locate in that
neighborhood. Furthermore, the method established as lo regulating the number of
taverns in Des Plaines is unjust and does not conform to our form of government as
set forth in. the Constitution under our flag that I have in a small way helped to de-
fend. I would suggest a fair method would be to limit the number of licenses according
to population as is being done in other parts of our land. One for every thousand
people would not be too many.
There are many taverns just outside of our city limits, which the city
does not have control over, which do not come under our strict supervision, or pay
the large license fees. These amounts do help to alleviate the insufficient general
tax income of our city.
I have lived inles Plaines since I was a boy, and have always tried to
build up Des Plaines and make it a better place in which to live. I feel that I am
not asking anything unreasonable. All I ask is to be on equal terms with my fellow
men, and enjoy the same rights and if there be, privileges with them.

The Mayor informed the Council that the City Ordinance governs the number of taverns
and that there cannot be any more licenses issued. The Mayor instructed the Clerk to
write Mr. Esser and return his deposit of $580.00.
S. B. GEIGER AND COMPANY PERFORMANCE BOND: The performance bond of S.B.
Geiger & Company for drilling the new well was approved by City Attorney Cpeka. The
motion was made by Alderman Halverson and seconded by Kehe to accept the performance
bond of S. G. Geiger & Co. and to place it on file in the City Clerk's office. The
motion was voted upon by acclamation whereupon the -Mayor declared the motion carried.

Pleasepf be advised that Judge Harry Fisher on December 17, 1946, entered
a judgment for Mandamus to compel the Board of Local Improvements of the City ofibs
Plaines to institute and prosecute a supplemental assessment in Spc.Assess.No.52693.
This, as you dill recall, is in connection with the Moore voucher. The
original certificate of completion and acceptance shows a deficiency in the sum of
approximately $8,000.00. Based on the present records and taking into consideration
the outstanding obligations, the deficiency amounts to.:$6,000.00. Accordingly, to
comply with the Order of Court, it will be necessary to spread a supplemental as-
sessment in the sum of $6,000.00 plus 6% or $360.00 to cover the cost thereof. ,
It is believed that this total amount will be spread against Pub.Benefits.
Upon direction, the necessary Resolution and Ordinances will be prepared
by the undersigned.

WHEREAS on the 17th day of December, 1946, a judgment order was entered
by the Circuit Court of Cook County in the above entitled cause ordering that a writ
of mandamus issue commanding the defendant City ofDes Plaines and its officers to
levy a supplemental special assessment in accordance with the terms of said order.
THEREFORE YOU, the City of Des Plaines, a municipal corporation, and its
officers above named and each of you are hereby commanded without further excuse or
delay to proceed with all lawful diligence to take all necessary official and corporate
action and all lawful steps to cause a supplemental assessment to be levied in accordance
with law and to be confirmed against the City of Des Plaines for public benefits and
the property specially benefited by the improvement constructed in the City of Des
Plaines by the widening and improving Ellinwood Street, the original assessment wherefore
is known as Des Plaines Special Assessment No. Q693 in the County Court of Cook County,
Illinois, to raise sufficient money to pay the deficiency in said assessment herein
found to be in the sum of $6000 and the costs and expenses of such supplemental
assessment in the following manner; •
1. That the City of Des Plaines, by G. Walter Pflughaupt, Elmer W.
Johnson, T. R. Napieralski, R. G. Wolf, LeRoy J. Vavrinek,Henry C. Harm, Henry
Kehe, Paul J. Scharringhausen, Walter A. Morava, Henry•Halverson, its Mintxximminti its Board of Local Improvements cause the necessary resolution to be adopted
and an estimate to be made of the amount of the deficiency in special assessment No.
52693 in the sum of $6000. and recommend to the City Gouncil,of the City of Des
Plaines the passage of an ordinance for the levying of a supplemental assessment to
pay for such deficiency in the sum of $6000.
2. That the City of Des Plaines by G. •Walter Pflughaupt, Mayor and
Hlmer M. Johnson, T. R. Napieralski, R. G.Wolf, LeRoy J. Vavrinek, Henry C. Harm,
enry Kehe, Paul J. Scharringhausen, Walter A. Morava, Henry Halverson, its City
Council pas9 and adopt a proper ordinance providing for the legging of a supplemental
assessment to pay the deficiency in special assessment 52693 in the sum of $6000.
Mayor 3. That the City of Des Plaines by its proper officers G. Walter Pflug-
haupt/and Otto W: J. Henrich, City Clerk, and the above named members of the City
Council cause to be prepared a petition to the Circuit, Superior or County Court of
Codk County praying that proper steps betaken to cause a supplemental special as-
sessment to be levied and assessed in accordance with law and that they cause said
petition designated by such ordinance to file such petition in said court.
4. That upon filing said petition the City of Des Plaines_by G. Walter
Pflughaupt, the President of the °oard of Local Improvements appoint a commissioner
to levy a supplemental special assessment according to law and cause said Commissioner
to make an assessment roll and levy and+levy and spread an assessment against the
City of Des Plaines for public benefits and against the property benefitted by said
improvement and that the City of Des Plaines cause the proper and necessary steps to
be taken for the confirmation by the Court of the supplemental assessment so levied
and spread. '
5. That the City ones Plaines by its officers cause said assessment so
confirmed to be collected and that the proceeds of said collection be.first paid to
the holders of the unpaid vouchers issued to anticipate the collection of special
assessment 52693 in accordance with law.
61 That the City of Des Plaines and each of its officers take all steps
and proceedings and do and perform all acts required and necessary to levy and col-
lect said supplemental special assessment in the sum of 46000 to pay the deficiency
in Special Assessment 52693 of The City ofDes Plaines.

Alderman Kehe, Chairman of the Finance Committee, made the following re-
port regardi2g request of Safety Council for an appropriation of $250.
hat the City Council appropriated the sum of $150.00 tor.the Safety
Council Expenditures and that the City Clerk should advise them of the action taken.
The Mayor instructed the Clerk to advise the Safety Council.
. MR. ADOLPH ESSER'S VERBAL RESIGNATION: Mr. Adolph Esser asked permission
of the Mayor to speak; the request was granted. He hhen said he tendered his resignation
as of this night. After some discussion, the Mayor referred this resignatioryfo the
Public Relation C ommittee to contact Mr. Esser.
APPROVAL OF MINUTES: Each member of the Council having received copies
of the minutes of the meeting of December 16th, 1946, the motion was made by 'lderman
Halverson and seconded by Johnson to approve the said minutes. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried and the"said
minutes approved.
ADJOURNMENT: The motion was then made by Allderman Kehe and seconded by
Harm to adjourn. The motion was voted upon by acclamation whereupon the Mayor declared

MINUTES OF THE REGULAR MEETING OF THE CITY
COUNCIL OF THE CITY OF DES PLAINES, HELD IN
THE COUNCIL CHAMBERS ON MONDAY EVENING, JANU-
ARY 20th. 1947, AT 8:00 P. M.
CALL TO ORDER The meeting was called to order by Mayor G. Walter Pflug,
haupt, who presided, with Aldermen Johnson,_Napieralski, Vavrinek, Wolf, Kehe, Schar-
ringhausen, Harm, Halverson and Morava responding to roll call.
OFFICIAL REPORTS: The City Clerk submitted the monthly report of City
Treasurer H. J. Ahbe for December 1946, and the annual 1946 Fire Department report
of Secretary Ray Kolze. The Mayor commented on the extensive report of Secretary
Kolze and that the City could be proud of the fine work, under excellent supervision,
that the Department has done. Also, he stated that the addition of the two new regu-
lar paid firemen.would help to relieve two regular department men with the increase
of calls.
