11/07/19465 ,16 - MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, HELD IN THE COUNCIL CHAMBERS, MONDAY, NOVEMBER 4. 1946 AT 8:00 P. M CALL TO ORDER: The meeting was called to order by Mayor G. Walter Pflug- haupt, who presided, with the following aldermen responding to the Clerk's rolls call: Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Harm, Halverson, and Morava. Alderman Scharringhausen was absent due to illness. OFFICIAL REPORTS: The City Clerk submitted the reports of Treasurer H. A. Ahbe, Building Inspector F. Scharringhausen, Electrical Inspector A. Rieck, and City Clerk Henrich for the month of October, 1946. Chief Becker reported on the Mihalo case, stating that Mr. Mihalo was being held for a $10,000.00 bail bond. Attorney Opeka reported that he expected summons to be issued on the owners of the Mihalo and Hunt homes within the next week, regarding condemnation proceedings. WATER COMMITTEE REPORT: Alderman Halverson reported the well down 1, 081 feet. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Harm, Halverson and Mora*a. Nays: None. The Mayor thereupon declared the motion carried and the said resolution adopted. MUNICIPAL D4VELOPMENT COMMIFTE : Alderman Napieralski reported on the County Zoning Hearing held October 25, 1946, in the City Hall. The motion was then made by Alderman Napieralski and seconded by Johnson to approve the request of re- zoning from residence to business, and the City Clerk to send a letter to the County Zoning Board informing them of the action taken so that they would receive the letter November 6, 1946. The Mayor put the question and tsked for discussion on the motion. Alderman Napieralski reported that the County Zoning Board had received two petitions; one from property owners opposing the rezoning with about 75 signatures, and another with 58 approving. He said that those opposing were under the impression that oil storage tanks would be put in the proposed garage. Mr. B. Harrer and C. Gewecke who had requested the rezoning were present and mere granted permission to speak1. They informed the Council that no oil tanks would be installed. The garage will be used for trucks. Ar. Harrer presented plans of the building, which seemed appropriate for that section. PASS ORDINANCE - PROHIBITING CONNECTIONWASTESEWERS TO STORM SEWERS: The Clair read for second reading the following proposed ordinance entitled: AN ORDINANCE PROHIBITING THE CONNECTION OF SANITARY OR INDUSTRIAL WASTE SEWERS TO STORM WATER DRAINAGE SYSTEMS. The motion was made by Alderman Halverson and seconded by Napieralski to pass the proposed ordinance. The Mayor put the question and the Clerk called the roll with the following result: Ayes: Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Harm, Hal- 1 (MINUTES CONT'D.) verson, and Morava. Nays: None. The Mayor thereupon declared the motion carried and the proposed ordinance passed. The motion was then made by Alderman Kehe and seconded by Napieralski to publish the ordinance in the DES PLAINES JOURNAL. The motion was voted upon by ac- clamation whereupon the Mayor declared the motion carried. RIVERVIEW CIVIC ASSOCIATION: The Clerk then read the following letter: November 2, 1946 Mayor G. Walter Pflughaupt andmembersof the City Council Des Plaines, Illinois 547 Gentlemen: At the Board of Directors meeting on Tuesday, October 29th, there was a discussion as to the maintenance of the streets south of Oakton. Many of the streets will need attention shortly and with winter just around the corner, as Secretary, was asked to inquire as to what provision has been or will be made for the maintenance of the existing streets before major repairs are necessary. Gw j ES PLAINES TRAFFIC COMMISSION: The Clerk read the following letter: 'd November 1, 1946 Mr. Otto Henrich, City Clerk Des Plaines, Illinois 1 1 Dear Mr. Henrich: . At a special meeting held October 29, in which we had been invited to attend with a committee of Home Towners and other civic groups, we accepted the following suggestions and wish you could present them to the next regular meeting of the City Council; First: That the present cab stand on the north side of Ellinwood Street at Center Street be moved to spaces to be provided for seven cabs, directly in back of the depot off of Miner Street. Itis understood that verbal acceptance has been granted by the Chicago and Northwestern Railway Company and that it will still leave sufficient room in back of the depot for three trucks used by the Railway Express Company. • Second: to eliminate or at least help to•eliminate double parking of buses on Miner Street, we recommend that they be granted sufficient space for one more bus between the depot cross walk and Lee Street, on the south side of Miner Street. EDWARD PRICKETT REQUEST FOR GASOLINE STATIOJj: The Clerk read the fol- lowing letter: October 29, 1946 City Council Des Plaines,I11. Gentlemen: I wish to make application for a gasoline station permit at 1574 Busse Highway. I have recently returned from service with the U. S. Army and have erected a new building at the above address intending to engage in auto rep&iir work, gasoline and lubrication services. While in the serviced contracted a spinal disease which is of a progressive nature and was told by several Army doctors that as this disease progresses I will be unable to do any heavy work. • I am an experienced automobile mechanic and this is the only trade I know. Therefore I feel that in order to secure my future, it is necessary for me to go into business for myself. I was able to secure the property and what financial aid I needed from my father and felt that this was an ideal opportunity and the location was also. ideal for my type of business. However, I must depend -on profit received on gasoline and oil sales to pay the hired help I will need to do the necessary hey work. I was born and raised in Des Plaines and naturally am anxious to establish my business in Des Plaines so that my son may also be raised here. 18 (LETTER COMM.) ZONING VIOLATION AT 1387 OAKWOOD AVENUE: The Clerk read the following letters: November 2, 1946 Hon'Mayor and City Council Des Plaines, Illinois Gentlemen: Calling your. attention to a Zoning violating in garage rear of residence at 1387 Oakwood Avenue. Made investigation and found machinery for wood working, lumber, in various stages of forming and shaping, heavy cardboard paper, a small amt of paint. On questioning the owners Mr. F.D.Wilson and W.E.Stuart, who operate as Wilson and Stuart Bo. find that they are making up advertising displays for inside store advertising. They get the lumber, paper, cloth and paint, then shade and form designs which are then decorated with cloth or paper then painted ready for window and in- terior displays. Questioning them further regarding their operating in single family resi- dence area, they stated that they did not this without first inquiring at the City Hall etc. They told me they had no intention of violating any of the ordinances or zoning. Asked them to submit a letter to the Council advising what the circumstances were in connection with starting manufacturing of their product in this location. . Mr. Frank Scharringhausen Building Inspector City of Des Plaines,I11. Respectfully F.F. Scharringhausen Building Inspector,Des Plaines,Il1. October 15, 1946 Dear Mr. Scharringhausen: We request a temporary permit to continue the business known as Wilson & Stuart Co., at our present address until the building at 1280 Northwest Highway, which we are going to rent, is completed. The builder, Mr. Anthony Collet, expects to have it finished in a month of six weeks. Due to misinformation we started in business at this address, and since learning it not in a commercial zone, we have been trying to find another building. Mr. Stuart had asked at the,City Hall if we could get a license and was told we could. We then purchased our equipment and stock, an investment of about $2,000.00 and then went down to get the license. This time we were informed that it was a mistake and we weren't in a commercial zone. Since the money to start this business was bor- rowed under the G.I.Bill of Rights, we had to start the business regardless. Our business had quickly outgrown our temporary quarters, so we are doubly anxious to move to our new quarters as soon as possible. I am sure our ineighbors would not object to our obtaining a temporary per.. mit under the circumstances, since they all know our position and what we are doing. Yours very sincerely, (signed) F.D. The motion was then made by Alderman Napieralski and seconded by Harm to allow the "neon & Stuart Co. to operate until the matter is referred back to the Council by the committee. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. CITY CLERK'S REQUEST TO CHANGE_SPEU E STREET TO OAK STREET: The City Clerk requested the change of Spruce Street to Oak Street in Des Plaines Center Subdivison, There being no buildings on Spruce St. which conflicts with Spruce Ave.,south of Oakton, 1 1 ( MINUTES COMM.) one block east of Lee Street, was the cause of request for change. The tayor referred the matter to the City Attorney for ordinance on change. 1PROVAL OF MINUTES: Each member of the Council having been supplied with copies of the *inutes of October 21st, 1946, the motioh was made by Alderman Kehe and seconded by aapieralski that the said minutes be approved. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved. ADJOURNMENT: The motion was made by Alderman Vavrinek and seconded by Wolf to adjourn. M. 549 CALL TO ORDER* The meeting was called to order by Mayor G. Halter Pflug- (;? haupt, who presided, with the following aldermen responding to roll -call: Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen, Harm, Halverson and Morava. = OFFICIAL REPORTS: City Engineer Fletcher reported the well was down 1515 feet. 'd Building Inspector Scharringhausen submitted a report on the Illinois State Inspectors' Convention held at Joliet, Illinois. PUBLIC PROTECTION REPORT: Alderman Johnson reported the Civil Service list of firemen had been posted and suggested that two firemen be appointed. Alderman Johnson then made the motion which was seconded by Napieralski that the City Clerk write to the Police and Fire Commission requesting them to appoint two firemen and inform them that an appropriation was made for the two additional men. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. ¥UNICIPAL DEVELOPMENT COMMITTEE: Alderman Napieralski reported the fol- lowing: Your Committee on Municipal Development respectfully calls your attention to the fact that the Council voted to permit temporary use of the premises at 1387 Oakwood Avenue for the present purposes of Wilson and Stuart in view of their prepa- ration to vacate the premises at an early date. We therefore recommend that the Building Inspector check the premises within the next sixty days to determine if the Council's rule has been with complied with. C. & N. W. RAILWAY PARK& Alderman Napieralski reported about the plans of beautification of the Chicago and Northwestern Railway Park. After some discussion, the motion was made by Alderman Napieralski and,seconded by Hare to adopt the beautification plan as outlined on the plat. The motion was voted upon by accla- mation whereupon the Mayor declared the motion carried. STREETS COMMITTEE: Alderman Vavrinek made the following reports: WELLER CREEK BRIDGE: Your Committeeon Streets and,Public Relations have investigated the request to repair Weller Creek_Bridge to Hawthorne and has found • 1. That this bridge is.entirely in the City limits. 2. That while the City did not construct this bridge, it has obligated itself to maintain it in repair. 3. This bridge provides passage across the creek for school children north of Des • Plaines. 4. That the cost of repairing this bri▪ dge is negligible. . We therefore recommend that the Superintendent of Public Works be in- structed to immediately repair this bridge in order to provide.a safe crossing for the school children who use it. The motion was made by Alderman Vavrinek and seconded by Wolf to concur in the report. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. . ▪ REQUEST TO RESURFACE MINER STREET: Your Committee on Streets has investi- gated and found: ▪ 1. That Ellinwood Street, as well as Miner Street, is in bad condition and requires repaving.-
