MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, JUNE 17, 1946, AT 8:00 P. M.
CALL TO ORDER: The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided, with Aldermen Johnson, Napieralski, Vavrinek, Wolf,
Kehe, Scharringhausen, McKay, Harm and Halverson responding to roll call.
There being no objections, the Mayor allowed.Mr. Edd Schlagel to ad..
dress the Council. He said that due to the Arlington Park races, trains have
been added to the service. Although the signals and gates were in perfect
order and also policemensome of the crossings, the train whistles were
blown unnecessarily. He asked the Council to try to have the Chicago and
Northwestern Railway eliminate this whistling;and the Mayor instructed the
City Clerk to write the Chicago and Northwestern Railway and also the Soo
Line Railway, whose trains were doing likewise.
OFFICERS' REPORTS: The City Clerk submitted the report of City
Treasurer H. A. Ahbe for the month of May, 1946.
STREETS COMMITTEE: Alderman Scharringhausen, Chairman, reported
on the petition of Cumberland lot owners of Lots 1 to 16 and 24 to 39 in
Block Nine (9) regarding vacating of the alley. He said there were no
object%ons. The motion -was then made by Alderman Scharringhausen and
rpt seconded by Johnson that the City Attorney prepare the necessary ordinance
�,1 for vacating the alley, and substitute instead of said alley a ten (10)
foot easement for public utilities. The motion was voted upon by ocelo-
t= motion whereupon the Mayor declared the motion carried.
'd Alderman Scharringhausen reported that the streets in Cumberland
Terrace had been repaired by Wallen Brothers. At the April 1st meeting a
complaint had been received that the above compantes machines had damaged
these streets.
MUNICIPAL DEVELOPMENT COMMITTEE: Alderman McKay made the following
report}

REPORT OF MUNICIPAL DEVELOPMENT COMMITTEE ON HEARING OF ZONING BOARD OF
APPEALS OF COOK COUNTY HELD IN DES PLAINES CITY HALL, JUNE 5, 1946.
Gentlemen:
As we were advised at Council meeting of June 3rd, the above hearing
was to consider three petitions.
The first petition considered was that involving property located on
the west side of Greenwood Avenue just south of Florence Avenue in Maine Town-
ship. Petitioner sought a variation from the strict application of Section 16
of the Cook County Zoning Ordinance which does not permit expansion of a non-
conforming use in the R-4 district. I+ was.disclosed that there is now a
building on the lot in question 48 feet long by 22 feet wide and petitioner de-
sires to erect an annex. Existing building is used for storage of beer add
soft drinks, and it is proposed to use the annex for same purpose.
The Board asked if the City of Des Plaines wished to say anything
either opposed or in favor of the petition and I stated that inasmuch as the
property was so close to Fork Ridge we felt that that City should take any
action necessary either in favor of or in opposition to the project. I ad-
vised that as the addition was to be used fon the same business now conducted
in existing building, we would not be inclined ,to oppose the petition, and
would accept the judgment of the Board in the matter.
When the City of Park Ridge was called upon, Alderman McKinstry re-
quested and was granted five days in which to make known the position of Parkiidge.

The second petition considered was that involving property located
on the north side of the intersection of Devon Avenue and Higgins Road, pe-
titioner seeking to rezone from present classification as an R-4 to a B-1
District, or such variation as might be granted. Mr. Klein speaking as pea.
titioner•explained his desire was to increase from frontage of 450 feet to
620 feet for business purposes in this particular location. In the course
of his comments he stated that one of the reasons for.requesting extra
frontage was that they may desire to erect a hotel. Speaking for the City
of Des Plaines, I advised the Board that.we were not opposed to the petition,
and would be inclined to accept the judgment of the Board.

Mr. McKinstry advised that Park Ridge was opposed to the petition.

The final petition concerned property located on the south side 6f
Touhy Avenue about 200 feet west of River Road. Petitioner sought to rezone
from present classification as an R-4 to a B-1 District or such variation as
the Board of Appeals might have power to grant.
Mr. Klein, petitioner in this matter also, request rezoning to B-1
of 300 foot frontage onlbuhy. This property is close to the existing wilding
known as the County House.
I advised the Board that the City of Des Plaines was,not opposed to
the petition. Mr. McKinstry advised the Board that Park Ridge was opposed
to the petition.

in the report. The motion was voted upon by acclamation whereupon the Mayor
declared the motion carried and.the report concurred in.

Dear Sir:
Referring to your letter of May 15, 1946, in regard to the maintenance
of the railroad right of way'through the business district of Des Plaines.
I have now received a letter written by your City Clerk to our Di-
vision Engineer - Mr. C. H. Perry, requesting lease to be reinstated. I
interpret this letter to mean that you were successful in getting the Park
Board to assume the entire maintenance cost of the parkways; and we are
handling with our Land Commissioner on this basis. Will you please advise
if this understanding is correct?
For your information, we have a program for oiling the roadbed
through suburban towns in this territayr, which will be carried out as soon
as the oil is received. We expect to have this program completed this month.

Alderman Napieralski Laid that Chief Engineer Meyer had promised to pay part
of- the cost of maintenance of the Northwestern Park and that he would again
communicate with him regarding same.

The motion was then made by Alderman Kehe and seconded by Harm to adopt the
said proposed resolution. The Mayor put the question and -the Clerk called the
roll with the following result: Ayes: Aldermen Johnson, Napieralski, Vavrinek,
Wolf, Kehe, Scharringhausen, McKay, Harm and Halverson. Nays: None. The Mayor
thereupon declared the motion carried andthe said resolution adopted.
KLEIN DEVON,HIGGINS,TOUHY PROPERTY: Alderman McKay and Napieralski
reported on covenants of Klein property. Alderman Napieralski stated it was
necessary to make some changes in the covenants. The motion was then made
by Alderman McKay and seconded by Napieralski that the City Clerk inform,by
letter, Mr. Klein that the Council would acquiesce to make these changes.
The Motion was voted upon by acclamation whereupon the Mayor chola; ed the
motion carried.
CANCEL BOND OF ROLAND FISCHER: The City Clerk reported having re-
ceived the form for cancelation of the bond of Roland W. Fischer. The motion
was made by Alderman Kehe and seconded by Napieralski that the Mayor and City
Clerk execute the cancelation of Roland W. Fischer's bond. The motion was
voted upon by acclamation whereupon the Mayor -declared the motion carried.
DOALL AND HACK MACHINE COMPANIES: The Clerk read the following:

Gentlemen:
Since the DoAll Company has located its principal place of busi-
ness on Laurel Avenue and the Hack MachineCompany and other industries are
Iodated on West Harding Avenue, there is considerable traffic on these two
streets, and the intersection of Harding Avenue anu Laurel Avenue has been
the scene of several adcidents.
In order to teduce the possibility of future accidents, the under-
sigrea respectfully request your honorable body to take into consideration
the advisability of establishing Harding Avenue as a through street at
'Laurel Avenue, and the placing of stop signs on Laurel at Harding.
We also wish to draw to your attention the hazardous intersection
of Laurel Avenue and Northwest Highway, at which intersection there re-
cently was an accident between a bus and a passenger car. Quite frequently
a car is parked on the shoulder of Northwest Highway in front of the machine
shop located at the Northeast corner of Laurel Avenue and Northwest Highway,
and when a car is parked at this location, it is impossible to see oncoming
Westbound traffic on Northwest Highway without first driving a car out into
the traveled wad of Northwest Highway.
In the interest of safety, parking should be prohibited on the North
side of Northwest Highway for a reaQonabls distance East, of Laurel Avenue.
Trusting you will give these two matters your immediate attention
and that you will take the necessary action required to eliminate the hazards,

CHICAGO AND NORTHWESTERN RAILWAY CROSSING RESOLUTION: The Clerk read
a resolution for the improvement by the Municipality under the Motor Fuel Tax
Law of the crossings of the Chicago and,Northwestn Railway at Pearson Street,
Graceland Avenue and Lee Street. Streets by contract at a cost of $13,500.00.
The motion was made by Alderman Johnson and seconded by Kehe to adopt
the said resolution. After several *inutes of discussion, the Mayor put the
question. The Mayor,not being able to determine on a voice vote,requested the
Clerk to call the roll with the following result: Ayes' Johnson, Vavrinek,
Wolf, Kehe, Scharringhausen, McKay and Halverson. Nays' Napieralski and Harm.
The Mayor thereupon declared the motion carried and the resolution adopted.
RESOLUTION TO Rii•EASE MEYER COAL COMPANY: The Clerk read the fol-
lowing proposed resolution:
R E S O L U T I O N
WHEREAS the City of Des Plaines sustained damages in the sum of One Hundred
Fifteen' Dollars ($115.00) to one of its fire hydrants which was struck by a
truck owned by the Meyer Coal and Material Company on December 14, 1945; and
W$.�"REAS, repairs to said fire hydrant were made by the said Meyer Coal and
Material Company and paid for by the said Meyer Coal and Material Company,
now, therefore,
BE IT RESOLVED By the City Council of the City of Des Plaines,(bok County,
Illinois, that the Mayor and City Clerk be and they are here -by authorized
and directed to execute a release of any. and all claims for damages to public
property resulting from an accident under date of December 14, 1945, and oc-
casioned by a truck owned by the Meyer Coal and Material Company.
The motion was made by Alderman Kehe and seconded by Johnson to adopt the
said proposed resolution. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried and the said resolution adopted.
ORDINANCE -VACATING ROSE AVENUE'$. The Clerk read for first reading
the following proposed ordinance entitled:
AN ORDINANCE AMENDING AN ORDINANCE ENTITLED
"AN ORDINANCE VACATING CERTAIN PORTIONS OF
ROSE AVENUE IN SPKINGS' SUBDIVISION IN THE
CITY OF DES PLAINES, ILLINOIS", PASSED APRIL 8,1946.
The motion was made by Alderman Kehe and seconded by Halverson to suspend
the rules and place the proposed ordinance on final passage. The Mayor pit
the question and the Clerk called the roll with the following result: Ayes:
Alderman Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen, McKay,
Harm and Halverson. Nays: None. The Mayor thereupon declared the motion car-
ried and the proposed ordinance before the Council for final passage. The
motion was then made by Alderman Kehe and seconded by Halverson to pass the
said proposed ordinance. The Mayor put the question and the Clerk called the
roll with the following result: Ayes: Aldermen Johnson, Napieralski, Vavrinek,
Wolf, Kehe, Scharringhausen, McKay, Harm and Halverson. Nays: None. The Mayor
thereupon declared the motion carried and the proposed ordinance finally passedl
PASS 1946 TAX LEVY ORDINANCE: The Clerk read for first reading the
following proposed ordinance entitled:
AN ORDINANCE
PROVIDING FOR THE LEVYING OF AN ASSESSMENT OF TAXES
FOR THE FISCAL YEAR OF THE CITY OF DES PLAINES, COOK
COUNTY, ILLINOIS, COMMENCING JANUARY 1st, 1946, AND
ENDING DECEMBER 31st, 1946.
The motion was made by Alderman Kehe and seconded by Halverson that the City
Coungil, having studied the said proposed ordinance, suspend the rules and
Place the proposed ordinance on final passage. The Mayor put the question
arid the Clerk called the roll with the following result: Ayes: Alderman
Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen, McKay, Harm
and Halverson. Nays: None. The Mayor thereupon declared the motion carried
and the said proposed ordinance before the Council for final passage. The
motion was then made by Alderman Kehe and seconded by Napieralski to finally
pass the proposed /ordinance. The Mayor put the question and the Clerk called
the roll with the following result: Ayes: Aldermen Johnson, Napieralski, Vavri-
nek, Wolf, Kehe, Scharringhaasen,McKay, Harm and Halverson. Nays: None. The
Mayor thereupon declared the motion carried aml theproposed ordinance finally passed.

VENDING MACHINES: Alderman Johnson, Chairman of the Public Protection
Committee, reported that the City Clerk referred the matter of having an ordi-
nance A ared on vending machines; due to canteens and gum machines now in
use. The motion was made by alderman Johnson and seconded by Scharringhausen
that the City Attorney prepare a vending machine ordinance. The motion was
voted upon by gcnlamation whereupon the Mayor declared the motion carried.
MR. E. R. GERNHARDT CONDOLENCE: The motion was made by Alderman
Napieralski and seconded by Johnson that a letter of condolence be sent to
Mrs. E. R. Gernhardt by the City Clerk, due to the death of Mr. E. R. Gern-
hardt, who had contributed his service as member of the City Architectural
Commission and other committees during Wad. War II. The motion was voted
upon by acclamation whereupon the Mayor declared the motion carried.
APPROVAL OF MINUTES: Each member of the Council ha„ing been sup-
plied with a copy of the minutes of the regular meeting of June 3, 1946, the
motion was made by Alderman Halverson and seconded by Napieralski that the
minutes be approved. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said minutes approved.
ADJOURNMENT: The motion was made by Alderman McKay and sedonded by
Harm to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared.the $otion carried and the Council regularly adjourned.

CALL TO ORDER: The meeting was called to order by Mayor G. Walter
Pflughaupt, who presided, with Aldermen Napieralski, Vavrinek, Wolf, Kehe,
Sdharringhausen, McKay, Harm and Halverson responding to roll call. Alder-
man Johnson was absent the entire meeting.
OFFICERS' REPORTS: The City Clerk submitted the reports of Building
Inspector F. Scharringhausen, Electrical Inspector A. Rieck and City Clerk
Henrich for the month of June, 1946.
COMMITTEE REPORTS: Alderman Halverson, Chairman of the Water Com-
mittee, reported about the water being shut off due to the severe storm on
Friday, Juhe 28th, while the Fire Department was at a fire.
SAFETY COUNCIL: Mrs. E. Pfeifer made the following report on shrub-
bery on corners hazard to motorists:
Your Committee on Study of shrubbery has investigated the above and
has found after an inspection trip, obstruction to motorists at
the following intersections:
Center and Forest Avenues, River and Van Buren, River
and Algonquin, River and Henry, Seventh and Golf Road
(beth corners).
I, your Committee on Study of shrubbery, therefore recommend: that
for the safety of motorists, same be removed.

At a recent meeting of the Traffic Commission, motion was made and
carried suggesting that the City extend the one hour parking restriction on
the east side of Lee Street, from the Miner Street alley, north to Park Place.
