MINUTES OF THE REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF DES
PLAINES, HELD IN THE COUNCIL CHAMBERS,
MONDAY, JANUARY 7. 1946. AT 5:00 P. M.
CALL TO ORDER: The meeting was called to order by Mayor G. Walter
Pflughaupt, with Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharring-
hausen, McKay, Harm, Campagna and Halverson responding to roll call.
REPORTS OF OFFICERS: The Clerk submitted the reports of Building
Inspector Scharringhausen for the month of December and of Electrical Inspector
Rieck for the month of December; also their report,of the year 1945. The City Clerk
submitted his report of cash received for the month of December. The Clerk sub-
mitted the report,of Chief of Police H. Becker of the 52nd Annual International As-
sociation of Chiefs of Police Convention.
COMMITTEE REPORTS: The Street Committee, through its Chairma4
Alderman Campagna, reported that the light was going to be installed at Golf Road
near,the railroad station, which light had been gequested by Alderman McKay. Al-
derman Campagna also reported that a light would be installed at -East Grant and
Thacter as 9,equested by Alderman Kehe.
Alderman Campagna reported that they were cleaning the streets"
and walks as fast as possible and putting cinders and salt on cross -walks.
Alderman Halverson reported the water consumed as follows: Max-
imum, 1,167,000; Minimum, 810,000; Total 27,757,000.
n/ Alderman Mc ay, Chairman of the municipal Development Committee,
Cts reported attending the County Zoning Hearings and said the City was not involved.
Ga He informed the County Zoning Board of 4'ppeals to that affect.

RE: Oakton Gardens Water Supply Contract
Gentlemen:
Pursuant to direction of the Council, I have been in communication
with the Oakton Gardens Community Club relative to a draft of a contract for a
source of water supply.
I have been advised that this matter is now at an end for the
time being due to the fact that several of thosewho originally pledged their share
of the cost have withdrawn their pledge, and the remainder do not feel justified
in absorbing such shares of cost.
Accordingly, you are advised that no further action is contemplated
at this time.

Dear Sir:
In answer to your second letter concerning the centerline needed
on Route 58 in the City of Des Plaines, it is surely evident to you that it would
be impossible to do such work any more this season. We wil,lkeep this particular
job in mind for one of the first attempts in the centerlining in the Spring of 1946.

PASS JUKE BOX AND AUTOMATIC AMUSEMENT MACHINES ORDINANCE: The
Clerk then read for second reading the following proposed ordinance:
AN ORDINANCE MENDING CHAPTER 18 OF THE'REVISED
ORDINANCES OF THE CITY OF DES PLAINES, 1928.
The motion was made by Alderman Johnson and seconded by Campagna to finally pass
the said proposed ordinance. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; Aldermen Johnson Napieraski, Vavrinek, Wolf,
Kehe, Scharringhausen, McKay, Harm, Campagna, and Halverson. Nays; hone, The Mayor
thereupon declared the motion carried and the said proposed ordinance passed.

The motion was then made by Alderman Johnson and seconded by Cam-
pagna to publish the ordinance in the Des Plaines Journal. The motion was voted
upon acclamation whereupon the Mayor declared the motion carried.

The motion was then made by Alderman Kehe and seconded by Vavrinek to adopt the
said proposed resolution. The Mayor put the question and the Clerk called the roll
with the following result: Ayes; Aldermen Johnson, Napieralski, Vavrinek, wolf,
Kehe, S charringhausen, McKay, Harm, Campagna and Halverson. "ay;s None. The Mayor
thereupon declared the motion carried and said resolution adopted.
SUMMONS IN MANDAMUS #45C-10584: The City Clerk had received a
summons on December 28th, 1945, to appear in the Circuit Court of Cook County on
January 7th, 1946, a petition for mandamus, PaulfA. Stoker vs. City of Des Plaines,
a Municipal corporation. The City Clerk then read the following letter
January 7, 1946

City of Des Plaines
Gentlemen:
This is to advise that the City Clerk, as an officer of the City
of Des Plaines was wervei with a summons returnable to the Circuit Court on Jan-
uary 7th, 19461
This is an action for a ''frit of Mandamus brought by Paul A. Stoker
to compel the City to levy a supplemental assessment against all properties on El-
linwood Street between Lee Street and Des Plaines Avenue. The action is predicated
on a voucher that was issued pursuant to a court decree to be paid out of surplus
funds in special assessment warrant No. 52693 or out of any supplemental assessment
that may be levied. The voucher was originally issued on April 26th, 1933, to Hoover
and Cody and subsequently assigned to Anna Moore. Now, it is in the possession of
the plaintiff in this action. The records indicate that there will never be suf-
ficient funds collected to meet this voucher out of the original assessment, and
particularly because the certificate of completion and acceptance of the improvement
shows on its face, a deficit.
I have filed an appearance in the action which was due this morning,
and am awaiting your further instructions to authorize me to defend this action.

CHAS. JOHNSON PETITION FOR REZONING: The Clerk read the following:
January 7th, 1946.
City of Des Plaines, Illinois
Gentlemen:
I herewith enclose my check for Ten Dollars to cover an application
for a petition for rezoning of the following property to be zoned for commercial.
Lot #5, Block #2, in Sunset Gardens, being W. L. Flew & Co., subd.
of the E. 503 feet, measured at right angles to the E. line of the W- of the NW
of Section 20-41-12.

REQUEST FOR WATT?. ON RAID ROAD: The "lerk then read the following:
December 21,-1945.
Hon. Mayor and City Council
City of Des Plaines, Illinois.
Gentlemen:
We hereby request water service from the City of Des Plaines to
our respective properties for use in our homes and business.
;le hereby agree, in the event that this request is granted, to
pay the entire cost of extending and installing a main from Des Plaines Avenue near
Rand Road to our properties and agree to conform to all City specifications. We
are to pay the engineer and inspector for their services, under whose directions
this work is to be performed.
Your early attention will be appreciated.

The Mayor referred the letter to the Water Committee.
Alderman Halverson, Chairman of the :dater Committee, informed the
Mayor that the Water Committee and some of the other aldermen had already met re-
garding this request. They considered granting this request. The Mayor then referred
the letter to the City Attorney Opeka, City Engineer, E. Fletcher, and the Water
Committee to draw up a contract and agreement.
THACKER-LEE UNDERPASS: The Werk then read the following letter:
December 12, 1945
Mr. G. Walter Pflughaupt, Mayor
City of Des Plaines, Illinois
Dear Mr. Pflughaupt:
For several years we have tried to get proper maintenance of the
underpass at the corner of Thacker and Lee Streets.
We require the children to go through this underpass because of the
heavy traffic conditions on Lee Street. This pass has not been kept in decent
condition and is a disgrace to the community.
Since we have been told that the City does not have the manpower
with which to maintain this passageway in good condition, our 'oard of Education
wishes to suggest that the City pay the Board of Education an amount sufficient
to'provide the necessary labor for proper maintenance. We will then see that this
passage is kept in first-class condition.

P.M., at the Maine Township High School Auditorium.
The commendable service you have rendered to your Country and Com-
munity justifies your presence on this occasion, at which time we are to welcome
back the returned veterans of World War II, and have
planned to entertain them

RESOLUTION AUTHORIZING THE EXECUTION OF A VOUCHER ON SPECIAL
ASSESSMENT 149: The Clerk then read the following proposed resolution:
A RESOLUTION AUTHORIZING THE EXECUTION OF A VOUCHER
IN SPECIAL ASSESSMENT 142
WHEREAS, in Special Assessment proceedings known as warrant No. 149 for the con-
struction of a system of sanitary sewers, Lot 4 in block 4 in Branigar's Cumberland
Terrace, owned by George F. Gustafson and Margaret E. M. Gustafson was assessed in
the sum of, $274.82 for their proportionate share of the cost of construction, and
said amount confirmed by the County Court; and
WHEREAS, said amount was so assessed in error, and should.have been assessed in
the sum of $145.60; and
?WHEREAS, the said lot was erroneously overassessed in the sum of $129.22, and it
appearing that there may be.some surplus funds in said special assessment warrait;
and that said error should be corrected; now, therefore;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES,
COOK COUNTY, ILLINOIS:
Section 1. Tht the Mayor and City Clerk be and they are hereby authorized and di-
rected to execute a voucher in the sum of $129.22 payable.to the order of George F.
Gustafson and 14argaret E. M. Gustafson,l hich said vouchers shall be payable solely
from surplus funds in the 1st to the 10th installment of Special Assessment War-
rant {o. 149; said voucher to draw no interest.
Section 2. That this resolution shall be in .full force and effect from and after
its passage.
The motion was then made by Alderman Kehe and seconded by McKay to adopt the said
proposed resolution. The motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried and the said proposed resolution adopted.
APPROVAL OF MINUTES: Each member of the City Council having been
supplied with a copy of the minutes of the regular meeting of December 17, 19450,
the motion was made by Alderman Kehe and seconded by McKay that the said minutes be
approved. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried and the said minutes approved.
ADJOURNMENT: The motion was then made by Alderman Vavrinek and.
seconded by McKay to adjourn. The motion was voted upon by acclamation whereupon
the Mayor declared the motion carried. and the meeting regularly adjourned.

McKay, Herm, Campagna and Halverson responding to roll -call. The Mayor presided.
REPORTS OF OFFICERS: The clerk submitted the report of City Treasurer
H. Ahbe, for the month of December.
COj+WSITTEE REPORTS: Alderman Campagna, Chairman of. the Streets Com,.
mittee, reported that there was no appropriation for clearing Lee Streetts underpass,
but he would see about an appropriation in 1946 and then would contact the School Board.
Alderman Napieralski reported on attending the Illinois Commerce
Commission hearing,
Chief of Police H. Becker reported insufficient parking,for taxi -cabs.
He stated that he would use the entire north side of Ellinwood Street from Center to .
Pearson for taxi -cabs and bus parking.
