MINUTES OF THF REGULAR MEETING OF
THE CITY COUNCIL OF THE CITY OF
DES PLAINS, ILLINOIS, HELD IN THE
COUNCIL CHAMBERS, MONDAY, DECEMBER
17, 1945, AT 8;00 P. M.
CALL TO ORDER: In the absence of Mayor G. Walter Pflughaupt the meeting
was called to order by Otto W. J. Henrich, City Clerk, with Aldermen Johnson, �yapieralski,
Vavrinek, Wolf, iehe, Scharringhausen, McKay, Harm and Halverson reponding to roll call.
Alderman Campagna was absent the entire meeting.

DESIGNATE MAYOR PRO TEM: The motion was made by Alderman Scharringhausen and
seconded by Mr.Kay that Alderman Kehe serve as Mayor Pro -tem for this meeting. The motion
waq voted upon by acclamation whereupon the Chair declared the motion carried. Alderman
Kehe thereupon took the ghair.
REPORTS OF OFFICERS: The Clerk submitted the report of City Treasurer Harold
J. Ahbe for the month of November.

COMMITTEE REPORTS: Alderman Napieralski of the Finance Committee then made the
following report on the ordinance and agreement which had been referred to that committee:
We, your Committee on rinance, recommend another ordinance in place of the
one submitted; also recommend the ordinance submitted be voted down and the
new one submitted be adopted.
The motion was then made by Alderman `yapieralski and seconded by McKay to concur
r:� in the recommendation. The motion was voted upon by acclamation whereupon the Mayor Pro -Tem
Henry Kehe declared the motion carried.
ORDINANCE AND AGREEMENT ON CITY ENGINEER: The Clerk then read for second
reading the ordinance on the City Engineer. The motion was then made by Alderman Johnson
and seconded by Vavrinek to finally pass the said proposed ordinance. The Chair put the
question and the Clerk called the roll with the following result: Ayes; None. Nays; Al-
dermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen, i"Kay, Harm, and
Halverson. The Chair thereupon declared the motion lost and said ordinance's failure of
passae.

PASS ENGINEERING DEPARTMENT ORDINANCES: The L'lerk then read for first reading a
proposed ordinance entitled:
AN ORDINANCE AMENDING CHAPTER 3 OF THE
REVISED ORDINANCES OF THE CITY OF DES PLAINES, 1928
The motion was then made by Alderman Vavrinek and seconded by Halverson to suspend the
rules and place the proposed ordinance upon its final passage. The Chair put the question
and the Clerk called the roll with the following results: Ayes; Aldermen Johnson, 'Yapieralski,
Vavrinek, Wolf, Kehe, Scharringhausen, McKay, Harm.and Halverson. Nays; None. The Chair
declared the motion carried, the rules suspended, and the said proposed ordinance before
the'Council for final disposition. The liotion was.then wade by Alderman Johnson and
seconded by Halverson to finally pass the said proposed ordinance. The Chair,put the
question and the Clerk called the roll with the following results: Ayes; Aldermen Johnson,
Napieralski, Vavrinek, 4olf, Kehe, Scharringhausen, McKay, Harm and Halverson. Nays; None.
The -Chair declared the motion carried.and the said.proposed ordinance passed.
Alderman Napieralski of the.Finance Committee then made the following report:
We,yaur Committee on Finance, have investigated and have found, after,communi-
cating with Mr. K. G. Meyer in the matter of .foreclosing the unpaid special assessment
in Warrant #62694, he has informed us that the bonds in the amount of the assessment
unpaid will be duly cancelled. Mr. 'leyer also informed us that the delinquent general
taxes would be foreclosed on simultaneously. We, your Committee on Finance, therefore
recommend the -foreclosure of the unpaid special assessment Warrant #62694 against the
IIIproperty described in the attached letter.
The -motion was then made by Alderman Napieralski and seconded by McKay_to concur
in the report. The motion was voted upon by acclamation.whereupon the Chair declared
the motion carried and the report concurred in. -

WHEREAS, the City Council has heretofore adopteI ordinances providing for the opening
and construction of certain paving improvements covering in part the premises herein-
after set forth; and
WHEREAS, special assessments were levied to pay the costs of said improvements and pur-
suant to the Statute applicable thereto said improvements were constucted and the re-
port of cost and completion was in manner and, form provided by law; and
WHEREAS, only a portion of installments of said special assessment levied against said
land have been paid and all other installments are now past due and delinquent; and
WHEREAS, the City Council finds that it will be for the best interests of this City that .
said special assessments liens be foreclosed, now, therefore:
BE IT RESOLVED BY THE CITY COIJNCIT, OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS:
Section 1.- That the special assessment liens ag.nst the following described real estat:
The Northeasterly 61 feet (except the Southeasterly 125 feet)
of Lot 2 in the resubdivision of Lot 1 (except the South 68 feet),
Block 3 in Parson & Lee's Addition to Des Plaines in Ebctions 17
and 20, Township 41 North, Range 12, East of the 3td P. M., also
known as the Northeastly 61 feet of the Northwesterly 75 feet
of said lot 2 aforesaid
be foreclosed.
Section 2. That the City Attorney be and he is hereby directed to prosedute said
foreclosure suit or suits ashe may deem best and to cooperate with the States At-
torney of Cook County, in procuring the foreclosure of the lien of the general taxes
upon said lots, which this City Council requests the States Attorney to foreclose,
that said City Attorney is hereby authorized to file suit for foreclosure or to join
in any suit or suits for foreclosure instituted by. the States Attorney to foreclose
the lien of general taxes and to take such other steps as he may deem proper to pro-
cure the prompt sale of said property to satisfy said tax liens.
Section 3, That all resolutions or parts of resolutions in conflict herewith be and
the same are hereby repealed.
Section 4. That this resolution shall be in full force and effect from and after its
passage and approval.
The motion was made by Alderman }lalverson and seconded by Johnson to pass the said
proposed resolution. The motion was voted upon by acclamation whereupon the Chair de-
clared the motion carried and the said resolution passed. _

Mrs. O. Pfeifer, secretary of the Safety Council, was introduced to the
Council and granted Permission to make a report of the Safety Council meeting regarding
the cleaning of streets and crosswalks in the business section during the snow season.
The motion was then made by "lderman Johnson and seconded by 14apieralski to refer the
matter to the Streets Committee for report at the next meeting.
REOUEST FOR VARIATION AS A NON -CONFORMING COMMERCIAL USE: The Clerk then
read the following letter:

for a variation from the terms of the Zoning Ordinance of Cook County, Illinois, on
December 27, 1945, at 5:00 P. M. (Central Standard Time) in the Mannheim Public School
#83, Mannheim Road and Grand Avenue. The property involved is located on the north
side of Higgins Road approximately one-quarter of a mile west of Cumberland Avenue

with a copy of the minutes of the regular meeting of December 7, 1945, the motion eras
made by "lderman Vavrinek and seeonder'i by Napieralski that the said minutes be approve,.
The motion was voted upon by acclamation whereupon the Chair declared the motion car-
ried and the said minutes approved.
Alderman Halverson reported thehazard of the car parking nn the streets
south of Oakton Street on which the buses travel. After several minutes discussion, the
motion was made by,Alderman Halverson and seconded by Johnson to refer the matter to the
Public Protection ommittee.
ADJOURNMENT: the motion was then made_ by "l4erman Vavrinek and seconded
by McKay to adjourn. The motion was voted upon by acclamation whereupon the Chair
declared the motion carried and' the meeting regularly adjourned.
