MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
ILLINOIS, HELD IN THE COUNCIL CHAMBERS,
MONDAY, DECEMBER 3, 1945, AT 8:00 P. M.
CALL TO ORDER: The meeting was called to order by Mayor G. Walter Pflug-
haupt, presiding, with Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Schar-
ringhausen, McKay, Harm, Campagna and Halverson responding to roll -call.
REPORTS OR OFFICERS: The Clerk submitted the reports of Electrical
Inspector.A. Rieck, Building Inspector Scharringhausen, and City Clerk 0. Henrich
for the month of November, 1945. City Attorney Opeka reported he had investigated
the ownership of the property between Lee Street and Soo Line right-of-way
regarding sidewalks, and from the records of the County Recorder had learned tat
the premises on both sides of the street were owned by Grant Wiffin and wife i
joint tenancy. The Mayor instructed the Clerk to write a letter to Grant Wiffin
regarding the laying of a sidewalk.
COMMITTEE REPORTS: The Public Protection Committee through its Chairman,
Alderman Johnson, made the following r$ports:
That the recommendation of the Traffic Commission that "No Parking"
Signs one car length from each crosswalk, north of Prairie Avenue,
and west of Lee Street, at the Northwest corner of Lee Street and
Prairie Avenue, be placed by Superintendent of Streets, will help
eliminate a serious hazard. The Public Protection Committee has in-
structed the Superinbndent of Streets to erect signs accordingly.
The Public Protection Committee requested the Traffic Commission to
make a study of eliminating parking on Lee Street between Park Place and Jef-
ferson Street. The Commission reported that they could not visualize an un-
usual hazard other than that which you may find at all street intersections and
therefore could make no recommendation relative to a change in the parking of
automobiles. The Public Protection Committee recommend that the parking at this
particular location remain as is.
The Public Protection Committee has investigated the repairing of
C. & N. W. Railway crossings and has found that the C. & N. W. R. R. Co. con-
template installing heavier rails. There have been on order some time but do
not anticipate delivery for some time. The Public Protection Committee recommend
that the permanent concrete crossing be delayed until the C. & N. W. R. R. is abbe
to lay the heavier rails. The motion was then made by Alderman Johnson and
seconded by Scharringhausen to concur in the report. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried. The Mayor in-
structed the Clerk to keep in contact with the C. & N. W. R. A regarding the.
repair of the crossing.
Alderman Halverson reported the monthly consumption of water.
Alderman McKay, Chairman of the Municipal Development Committee, reporte d
that Alderman Napieralski attended the hearing of the County Zoning Board regarding
set -back on land of the northwest corner Lee and Oakton Streets and that there
would be no objections by the City.

MOUNT PROSPECT DES PLAINES DIVIDING LINE AGREEMENT: The Clerkthen read
the tiiiimINg proposed agreement: oncerning Mount Prospect and Des Plaines. The
motion was then ma4e by Alderman Mckay and seconded by Napieralski that the City
Clerk forward a copy of the agreement to the Village Board of Mount Prospect for
4.1,eir approval. The motion was voted upon by acclamation whereupon the Mayor de-
clared the motion carried.
Alderman Napieralski gave the City Clerk severalletters he had written
the State Representatives regarding the Sales Tax.
Alderman Kehe, Ghalrman of the Finance Committee, reported the following:
Your Committee on Finance has investiggbed the Scavenger Law being en-
forced in Maine township and has found: Nothing contained in the Scavenger Act
would assist this City. Itsown program of foreclosure of special assessment
liens appears superior in every respect.
In cooperating with 'he County Treasurer, the funds derived from such
sales wouldbe controlled by the County Treasurer)
if the County were to bid in at the sale over and above any other bids
(and the County would hot have to pay any money on a bid) it would get the certifi-
cate of purchase, and if not redeemed, the Coutny would have the power to sill
for any amount it saw fit after redemption expires.
The present method of foreclosure of taxes and specials is more de-
sirable and funds are more readily obtained than under the scavenger Act.
- 41e, your Committee on Finance therefore recommend that this Council
do not participate in the Scavenber Act proceedings, and that the Clerk be in-
structed to write the County Treasurer advising him that the City will continue

on its own by way of foreclosure of special assessment liens and thus procuring
also the foreclosure of general. taxes.

the report. The motion was voted upon by acclamation whereupon the Mayor declared

The motion was then made by Alderman Kehe and seconded_bg Campagna to adopt the
said proposed resolution. The Mayor put the question and the Clerk called the role
with the following result: Ayes: Aldermen Johnson, Napieralski, Vavrinek, Wolf,
McKay, Harm, Campagna, and Halverson. Nays: None. The Mayor thereupon declared
the motion carried and the said resolution adopted.
The Clerk then read the following letter:

I am enclosing a copy of a letter from Mr. Otto W. J. Henrich, City
Clerk of Des Plaines, Illinois. I am also attaching a map that he enclosed with
his original letter. Due to the lateness of the season, and our deficiency of
paint, it will be impossible to j]ace the centerline suggested by Mr. Henrich,
put it is my wish that this be one of the first centerlining jobs attempted
next Spring.

Alderman McKay said he thought due to traffic hazard, this should be taken care

Engineer to see if it can not be done immediately.

CLAIM OF F. J. SCHMOHL: The Clerk then read the following letter;

Mayor of Des Plaines -
Dear Sir:
Twenty-five years ago a contractor trespassed on my lots 9 and 10 for
which I have deeds. Repeated efforts at settlement have failed. When Mr. Maloney
was the lawyer the group decided to award -lie $700 damage, and when I said I'd like
a -thousand, he -said that is all they ould do. I had to sign dismissing my court
suit and nothing has been paid me up to date. An $8,000 buyer for my 6 lots re-
fused to have joint tenancy with a city when he learned of the pipes and he in-
vested his money in Barrington. About a year ago the Finance Committee was con-
sidering the width of strip along railway. Not a bit of information kas reached
me, so I have to appeal to you. My savings as a teacher are in those lots and you
may help. Yours respectfully,

TO ENFORCE PARKING ORDINANCE: The Clerk then read the following:

Dear Sir:
Several discussions have come before this Commission in conjunction
with a committee from the Des Plaines Businessmen's Association and others, rela-
tive to the Parking Ordinance. As a result of these discussions, we unanimously
suggest that the Parking Ordinance be enforced, possibly through some educational
program, in preference to the idea of immediate arrest by the police, but tole
followed by arrest for continued violation, then if found sound and successful,
to continue the enforecement of the ordinance.
We also feel that additional parking relief would be obtained through
proper marking of the parking lanes. It is again suggested that this be under-
taken at the first opportune moment when the streets are in condition to be painted.

Our streets North Golf Cul de Sac and Third Avenue have long been in
need of repairs. The turn-off on Third Avenue is especially bad with dangerously
deep holes.

on these streets for a period of years. Please accept our letter as an invitation
to inspect and repair this condition.

basis, to be furnished by the City of Des Plaines, to serve the subdivision,
which will include about 90 homes, located on property at the corner of Dempster
and Potter Road. The property is legally described as follows:
The N. 35 acres W2 of the NPT4 of Sec. 22, Twp. 41 N., R. 12,
E. of the 3 P.M. in C ook County, Illinois.
This property was within the corporation limits of Park Ridge and was
removed by an action of the County Court of Cook County on November 20, 1945.

C\ Council for approval wen it is submitted to theGbunty Zoning Board and approved.

The Clerk then read a notice of rehearing of petitionfromIllinois
Commerce Commission regarding Bus lines from Big Foot Prairie. The Municipal

RESOLUTION TO FORECLOSE THE
LIEN OF SPECIAL ASSESSMENTS
WHEREAS, the City Council has heretofore adopted ordinancesproviding
for the construction of certain water, sewer, sidewalk and paving improvements
convering in part:
Lots 11, 12, and 13 in Block in Norrie Park, a sbbdivision of part
of the Southeast quarter of Section 20, Township 41 North, Range 12
and
Lot 9 (except the West 14 feet thereof) and the West 2 feet of Lot 10
in Bleck 27 in Des Plaines Manor Tract no. 2 in the West half of
Section 17, Township 41 North, Range 12;
WHEREAS' special assessments were levied to pay the cost of said im—
provements and pursuant to the Statute applicable thereto said improvements were
constructed and the report of cost and completion was approved in manner and form
provided by law; and
WHEREAS, only a small portion of installments of said special assess—
ments levied against the aforesaid lots have been paid and all other installments
are now past due and delinquent; and -
WHEREAS, the City Council finds that it will be for the best interests
of this City that said special assessment liens be foreclosed; now, therefore:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK
COUNTY, TLT,INOIS:
Section 1. That the special assessment liens against Lots 11, 12 and
13 in.Block 1 in Norrie Park, a subdivision of part of the Southeast quarter of
Section 201 Township 41 North, Range 12; and Lot 9 (except the West 14 feet there—
of) and the 'Test 2 feet of Lot 10 in Block 27 in Des Plaines Manor Tract No. 2
in the '`est half of Section 17, Township 41 North, Range 12, be foreclosed.
Section 2. Tat the City Attorney be and he is hereby directed to
prosecute said foryeclosure suit or suits as he may deem best; and to cooperate
with the States A torney of Cook County, in procuring the foreclosure of the lien
of the general taxes upon said lots, which this City Council requests the States
Attorney to foreclose, that said City Attorney is hereby authorized to file suit
for foreclosure or to join in any suitor suits for foreclosure instituted by the
States Attorney to foreclose the lien of general taxes and to take such other
steps as he may deem proper to procure the prompt *ale of said property to
satisfy said tax liens.
Section 3. That all resolutions or parts of resolutions in conflict
herewith be and the same are hereby repealed.
Section 4. That this resolution shall be in full force and effect from
and after its passage and approval.
The motion was made by Alderman Kehe and seconded by 1°apieralski to pass the said
proposed resolution. The resolution was voted upon by acclamation whereupon the
Mayor declared the motion carried and the said resolution passed.

GEORGE H. HACHMEISTER APPOINTED PATROLMAN: The Mayor informed the
Council of the appointment of George H. Hachmeister as patrolman by Board of Fire
and Police Commissioners, effective December 1, 1945.
APPROVAL OF MINUTES: Each member of the City Council having been supplie d -
with a copy of the minutes of the regular meeting of November 19 and the special
meeting of November 27, 1945, the motion was made by Alderman Kehe and seconded by
Halverson that the said minutes be approved. Alderman Napieralski desired to have
his dessenting vote gegarding the State Highway Permit on Bussee Highway to be entered
in the November 19th, 1945 minutes. Permission was granted. The motion wasthenMis
toted upon by acclamation whereupon the Mayor declared the motion carried and the
said minutes approved.
MOTION TO ADJOURN: The motion was made by Alderman Kehe and seconded
by Campagna to adjourn. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried and the meeting regularly adjourned. ,
