CALL TO ORDER: The meeting was called to order by Mayor G. W.
Pflughaupt, presiding, with Aldermen Johnson, Napieralski, Vavrinek, Wolf,
Kehe, Scharringhausen, McKay, Harm, Campagna and Halverson responding to
roll -call.
STANL4Y REDMAR was .given permission to talk regarding a light in-
dustrial zone.
REPORTS OF OFFICERS: The Clerk then submitted the report of City
Treasurer H. J. Ahbe for the month of August, 1945.
COMMITTEE REPORTS: The Public Relations Committee through its Chair-
man,Alderman Napieralskilreported on the Home lbwners, Inc. Fair being a success,
and commented on the fine display in the City booth. The motion was then
made by Alderman Napieralski_and seconded by Halverson that a letter be writ-
ten by ayor Pflughaupt to Home Towners, Inc. commenting on the Fair.
ZONING BOARD OF APPEALS RECOMMENDATION: The Clerk then read the
following recommendation:
At the request of Mr. Paul F. M. Amling, your Zoning Board of Appeals,
sitting as a Commission, held a public hearing September 10, 1945, in the
Council Chambers of the Municipal Building on the following described property:
That part,of the South One -Third of the Northwest
quarter of the Southeast quarter, Section 20,
Township 41 North, Range 12, East of the 3rd P.M.,
lying West of the Wisconsin Central Railroad,
Cook County, Illinois, in accordance with the motion
passed by the City Council referring this proposed
amendment to this Commission.
The primary reason for this hearing was due to the fact that there was
an error in the legal description of this property as originally published
and the Zoning Board recommendation under date of November 6, 1944. The
above description is correct legally.
The Zoning Board of Appeals sitting as a Commiss ion requests that their
original recommendation under date of November 6, 1944, be followed in changing
the classification of the above described property from the classification of
Commerical District to the classification as a light industrial district.

dermeh Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen, McKay,
Harm, Campagna, and Halverson. Nays: none. The Mayor thereupon declared the
motion carried, the rules suspended, and the said proposed ordinance before the
Council for final disposition.

to finally pass the said proposed ordinance. The Mayor put the question and
the Clerk called the roll with the following result: Ayeat Aldermen Johnson,

and Halverson. Nays: none. The Mayor thereupon declared the motion carried
and the said ordinance passed. •

Coach Co. is making an investigation regarding bus extensions.
RESURFACING PERRY STREET: The Clerk read the following letter:

Gentlemen:
Last year we were able to seal coat, or surface, some of our old macadam
pavements with our local street funds. The small amount of money we spent on this
work not only greatly improved the appearance and riding qualities, but in addition
added many years to the life of the pavements so treated.
It is hoped that we may be able to dontinue to protect and improve our
old streets as long as money is available for this work.
I believe we have some money available now for this work and I recommend
that Perry Avenue, from Graceland Avenue to Northwest Highway be seal coated this
year. This street was paved more than twenty years ago and has never been seal
coated. The pavement is now badly cracked and it will soon disintegrate and have
to be completely replaced unless it is protected.
The amount of money available is so small that this work would not make an
interesting contract, however, I believe it could be added,to the contract which
we awarded some weeks ago at the same unit prices bid at that time.
I recommend that this matter be referred to the Streets and. Sanitation Com-
m4iittee with power to act.

Matteson, 2102 Sunnyside Avenue, Chicago, thought the City should purchase it for a
park...To preserve the natural wild flowers of the prairies. He referred to the
▪ Pu ie Blazing Star. The writer is employed by the U.S. Department of icul4ure.
The Mayor stated that the City is not in a.position to bug land for parks, but
▪ referred the letter to the Public Relations Committee for reply.
VOUCHERS OF SPECIAL-ASS'SSMENT 52693: The Clerk then read the following:

We represent Paul A. Stoker, the.preaent owner and holder of Class C
• Special Assessment Voucher Serial No. 412,.Voucher No. 116 for $2993.99, issued
• to Hoover and Cody and assigned t6 Paul A.,Stoker, which.voucher was issued to
anticipate the collection of a part of the.surplus in all installmentp of special
assessment 52693 of the City of Des Plaine for the Ellinwood Street improvement
after all bonds, interest and Class A and B vouchers or out of any supplemental
assessment. This voucher is dated April 26, 1933.

We are informed and believe the fact to be that after all bends, interest
and -Class A and B vouchers are paid, there will not be enough to pay the above
described voucher. Nothing has been paid on account of it.
The final certificate of cost and conformity duly approved by the County
Court of Cook County shows that there was an estimated deficiency at the time of its
approval of $7835.88
It is apparent that the remaining amounts due from the assessment will be
insufficient to pay this voucher.
Request has heretofore been made that a supplemental assessment be levied
to pay the deficiency in the amount required to pay the bonds and vouchers issued on
account of the cost of the improvement and the interest thereon, but no action has
been taken. .
We therefore in behalf of Mr. Stoker demand that the Board of Local Im-
provements and the City Council of the City of Des Plaines take the necessary steps
to levy a supplemental assessment against the public and property benefited by said
Ellinwood Street improvement to pay the deficiency in the amount required to pay the
bonds and vouchers issued to pay the contract price of the improvement and the
interest thereon.
Unless steps are promptly taken it will be necessary for us to file a
mandamus suit to compel the City to proceed.
We request the Board of Local Improvements to initiate the proceeding for
such supplemental assessment as required by law, that the City Council pass an
ordinance for the same and that steps be taken by the proper City officers and agents
to prosecute the special assessment proceeding in a court of proper jurisdiction.
We call your attention to sections 73 and 90 of Article 84 of Chapter 24
of the Illinois Revised Statutes and Section 59 of said article as to the procedure
to be taken.

CHILD WELFARE COMMITTEE: Alderman Napieralski read a letter from the Child
Welfare Committee regarding the Day Nursery which was forced to close, due to the
fact that no more funds were available through the Lanham Act. Aftersome discussion,
the Mayor instructed Alderman Napieralski, Chairman of the Public Relations Com-
mittee, to reply to the Child Welfare Committee that the Council is unable to
manage that activity.
SET -BACKS AND LIMIT OF BUILDING AREA IN COMMERCIAL ZONES: Alderman Napier-
alski brought up the question of set -backs and limit of building area in Commercial
Zones. The motion was then made by Alderman lapieralski and seconded by McKay that
the matter of the 5ft. set -back question,together with a provision limiting the
building area to 90% of the lot area in commercial zones, he referred to the
Zoning Board of Appeals for study and preparation of an ordinance, and a public
hearing. The motion was voted upon by acclamation whereupon the Mayor declared the
motion carried.

CALL, TO ORDER:•The meeting was called to order by Mayor G. W. Pflugaupt
presiding, with Aldermen Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen,
McKay, Harm, Campagna, and Halverson responding to roll -call. Alderman Johnson
was $absent the entire meeting.
PRESENTATION OF FLAG: Mr. Lester Bestwick, introduced by Mayor Pflug-
haupt, then presented to the City a large American flag which had been in one of
Douglas Aircraft Buildings. Mayor Pflughaupt accepted the flag for the City with
thanks.
OFFICERS' REPORTS: The City Clerk then submitted the reports of Electrical
Inspector A. Rieck, Building Inspector F. Scharringhausen, and City Clerk Henrich
for the month of September. City Attorney Opeka reported the hearing of the Eagle
Bus Line was continued.

COMMITTEE REPORTS: The Committee on Public Buildings through its Chair-
man, Alderman Halverson, reported that the roof on the Municipal Building is sadly
in need of repairs. The Committee has received two bids for this repair work.
The Haas Rosenow Roofing Co. and Burke Roofing Co. We recommend the contract
be granted to Hans Rosenow Rofing Co. for the sum of $580.00 Work to being im-
mediately. The project will be paid for by the Fire Department Fund $135.00,
Library Fund $150.00, and Public Building Fund $295.00. The various committees
have approved said expenditures. The motion was then made by Alderman Halverson
and seconded by-Vavrinek to concur in the report.
jhe Mayor put the question and the Clerk called the roll with the fol-
lowing result: Ayes: Aldermen Napieralski, Vavrinek, Wolf, Kehe,Scharringhausen,
McKay, Harm, Campagna, and Halverson. Nays; None. The Mayor declared the motion
carried and the report concurred in.
Alderman Halverson reported water pumped for August: maximum, 1,119,000
gallons; average, 1,012,000. September 1,028,000; and average 930,000.
Alderman Napieralski, Chairman Public Relation Uommittee, reported on
having written the letter to Child Welfare Committee and desired permission to re-
fer the letter to the Township Supervisor.. The motion was then made by Alderman
napieralski and seconded by Halverson to concur in the report. The motion was
voted upon by acclamation whereupon the Mayor declared the motion carried and
concurred in. •
Alderman Napieralski asked permission to refer the letter of R.P.
Matteson, regarding the wild flower tract of land, to the Des Plaines Chapter of
Izaak ?dalton League. KAlderman Vavrinek requested to refer the letter to the Ben-
jamin Electric Co. also. The motion was made by Alderman Napieralski and seconded
by McKay to concur in the request. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
