MINUTES OF THE REGULAR STING OF
THE CITY COUNCIL OF THE CITY ,0P DES
PLAINES, ILLINOIS, HELD IN THE COUNCIL
CHAMBERS, MONDAY, JULY 16, 1945, AT
8:00 P. M.
CALL TO ORDER: The meeting was called to order by Mayor Pflughaupt,
who presided, with Alderman Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharring-
hausen, McKay, Harm, Campagaa and Halverson responding to roll -call.
REPORTS OF OFFICERS: The Clerk then submitted the reports for June,
1945, of City Treasurer Harold.J. Ahbe and City Clerk Otto W. J. Henrich. The Mayor
ordered the reports placed on file.
TIN CAN SALVAGE: Mr. Erskine Wilder, Salvage Div., talked on the need
of a tin can salvage. He suggested that the several cities and villages in this
section combine on a drive with a freight car located at one place for loading. The
Mayor suggested this matter be taken up later uhder new business.
OTT MG. CO.: Mr. B. F. Lewis, representing the Ott Manufacturing Co.,
was then introduced to the Council by Mayor Pflughaupt. He stated their case re-
garding the use of the former Echo Theater Building as a warehouse. The Mayor said
this would be taken up later under new business.
COMMITTEE REPORTS: Water Committee, through its Chairman, Alderman
Halverson, reported the pump installed in the Softening Plant but that some of the
equipment for repairs had not arrived and as soon as it was received the repairs would
be completed.
OAKTON GARDENS WATER SERFTCE REPORT: The City Clerk then read the fol-
lowing report of the Water Committee:
Your Committee on Water , Sewer and Public Buildings has investigated
the letter regarding Oakton Gardens Water Service and recommend the Oikton Gardens
Community Club, a corporation, their request for the purchase of City water.
Contract for the purchase of water is to be drawn up by the City Attorney
for approval by the City Council of Des Plaines an Oakton Gardens Community Club.
It is further agreed that the City furnish water to the Oakton Gardens
Community Club except when an emergency arises which would jeopardize the consumption
of the residents of the City.

All installations, connections, meters, etc., to be in accordance with
City ordinances and all new water taps to said main to be approved by the(ity Council.
It is further recommended that the rate for the water to be purchased
is to be .75¢ per 100 cubic feet, net. No discount.
An amount of 0500.00 as an estimated deposit for the first quarter to be
deposited with the Water Department. .
The entire cost of constructing this main together with engineering and
inspection fees to be borne by the Oakton Gardens Community Club, without any cost to
the City.
Your committee therefore asks concurrence of this recommendation.

The motion was made by Alderman Halverson and seconded by Johnson to concur in the
recommendation. The motion was voted upon by acclamation whereupon the Mayor declared
the motion carried and the recommendation concurred in.
The motion was then made by Alderman Halverson and seconded by Vavrinek
to instruct the City Attorney Opeka to draw up a contract between City of Des Plaines
and Oakton Gardens Community Club regarding the water service. The motion eras voted
upon by acclamation whereupon the Mayor declared the motion carried.
APPROVAL OF BILLS: The Finance Committee through its Chairman, Alderman
Kehe,then introduced the following proposed resolution:

The motion was made by "lderman Kehe and seconded by Vavrinek to adopt the said reso-
lution. The Mayor put the question and the Clerk called the roll with the following
result: Ayes; Aldermen Johnson, Napieralski, Vavrinek, Wolf, Kehe, Scharringhausen,
McKay, Harm, Campagna, and Halverson. Nays; none. The Mayor thereupon declared the
motion carried and the said resolution adopted.

COMIITTEE REPORTS: The Municipal Development Committee through its Chair-
man, Alderman kIcKay, then gave the following report:
"Ere -sore" Report.
The Municipal Development Committee has considered the question of Des
Plaines eye -sores, and whether a special ordinance is necessary in abating such
nuisances.
It is the opinion of your Committee that it is NOT necessary to add
another ordinance to the City code to cope with this situation. Any so-called eye -sore
which happens to be a menace to health or safety can be corrected by existing law. We
believe any other objectionable condition within the City limits which is offensive to
the vision of any citizens or citizen can perhaps best be corrected by negotiation
between a representative of the City and the party or parties responsible for said
condition. Our counsel advises us that in such cases where there is no healt h or
safety menace it would be extremely difficult to remedy by ordinance because of the
various and sundry ideas as to what constitutes an eyeliore, and the rights of property
owners whereon alleged eye -sores may exist.
It is the recommendation of your committee that it would not be feasible
to try to remedy the eye -sore evil by special ordinance. That where menace to health
or safety are involved, prompt action be taken by the City on the authority of
existing law. That where there is an objectionable condition not definitely covered
by ordinance that each such condition be handled promptly by a representative of the
City with the offender, by letter and/or personal contact, using persuasive appeal for
cooperation. It is recommended, too, that for the sake of consistency any so-called
eye -sore condition for which the City may be responsible either directly or indirectly,
be corrected, and that all City officials be cautioned to take note of this recommendation
and to comply forthwith where there are such conditions current and to exercise due
care to avoid any future criticis* of such dondition insofar as their department is

The motion was made by "lderman McKay and seconded by Napieralski to concur In the
report. The motion was voted upd&n by acclamation whereupon the Mayor declared the
motion carried and the report concurred in.
The Public Relations Committee through its Chairman, Alderman Napieralski,
reported the C. & N. W. R. R. Co. had succeeded in employing a man to cut the grass (hay)
in their park. He also reported the Lions Club had contacted the same man with the
intention of employing him and paying him for this work. He also presented a check
for twenty -dollars (120.00) from the Lions Club to be used for cutting the grass. The
motion was then made by alderman Napieralski and seconded by McKay t� accept the
twenty dollars from the Lions Club and that the City Clerk write a letter of thanks for
same. After several minutes of discussion, the motion to amend the motion was madA
by Alderman Napieralski and seconded by McKay to accept the twenty dollars for beautifi-
cation of the park but withhold the acceptance until a legal interpretation has been
received from City A+torney Opeka.
The motion was voted upon by acclamation *hereupon th Mayor declared the
amendment to the motion carried.
After a voice vote was taken, Alderman Vavrinek asked for a roll -call.
The Mayor ordered the Clerk to call the roll with the following result: Ayes; Alder-
men Napieralski, Kehe, Cempagaa, and Halverson. Nays; Aldermen Johnson, Vavri-
nek, Wolf, Scharringhausen, Harm, Ayes: 5 Nays; % 5. Mayor Pflughaupt voted aye
and declared the motion carried. •

The Clerk then read for second reading a proposed ordinance entitled:
AN ORDINANCE REGARDING SALES TO
AND PURCHASES OF LIQUOR BY MINORS
The motion was made by Alderman Johnson and seconded by Scharringhausen that said pro-
posed ordinancd he passed as read. The Mayor put the question and the Clerk called the
roll with the following result: Ayes; aldermen Johnson, Napieralski, Vaveinek, Wolf,
Kehe, Scharringhausen, McKay, Harm, Campagna and Halverson. Nays; none. The Mayor
thereupon declared the motion carried and said proposed ordinance passed as read.

The motion was made by Alderman Johnson. and seconded by
Scharringhausen to publish the ordinance in the Suburban Times. The motion was
voted.upon by acclamation whereupon the Mayor declared the motion carried.

TALCOTT AND TALCOTT: The Clerk then read the following letter:

On behalf of Fred Hasse I offer the sum of $30.00 for q quit claim deed to himself, or-
as he may direct, for all the interest of the City of Des Plaines in:

Tp Des Plaines, a.subdivision in sections 20
and 21, township 41 north, range 12, east of the
third principal meridian.
The record shows outstanding a tax.deed to Henry Tifft dated July 29, 1901 on the
sale for the non-payment of general taxes for the year 1898.
There are also four tax deed issued to the Village of Des Plaines for the,non-payment
of general taxes for the years 1908 and 1909, No. 4845350 and No. 4845351 dated
April 16, 1911,'and No. 5059890 and No. 5059891 dated October 1, 1912.

ZONING BOARD OF APPEAL REPORT ON DOALL CO. PROPERTY: The Clerk
read the following report: July 14, 1945
Sirs:
Your Zoning Board of Appeals held a public hearing June 29, 1945, ih the Council Cham-
bers to act upon an appeal from the ruling of the building commissioner denying a
building permit for the construction of an addition,to the building located upon the
following described real estate.
"That part of Lot 3 in County Clerk's Division in the North One-half
of Section 17, Township 41 North, Range 12, East of the Third Principal Meridian lying
South of the right of way of the Des Plaines Valley Railway Company and East of a
line parallel with and distant 450 feet East of the West line of said Lot) and West
of the center line of Eisfeldt Avenue in Mechanic's Addition to Des Plaines, produced
North to the right of way of the said Des Plaines Valley Railway Company. (Except that
part thereof which lies North of. a line drawn from a point on the W est line of the above
described tract 570.0 feet North of the Southwest corner thereof to a point on the
East line 560.0 feet North of the Southeast corner thereof.)"
This request for the appeal from the building comm4ssioner's de-
cision to the Zoning Board of Appeals is made by the Doall Co. of Des Plaines.
After adducing evidence at the public hearing, the Board id unable
to find any,"particular difficulties" or "unnecessary and particular hardships" in en-
forcing the provisions of the ordinance, and therefore uphold the 'building commissioner
in his refusal to issue a permit contrary to the ordinances pertaining hereto.
We would like to point out that considerable time was given to
arriving'at our decision.
DES PLAINES ZONING BOARD OF APPEALS

Concerning the case that has come before the Zoning Board, where
the building commissioner turned down the Doall Company on a permit to establish
a frame building in an industrial zone, we have been advised by the City Attorney that
we are withouLauthority to grant a variation in such an appeal since there is no
City ordinance to cover the rules and regulations of such variations.

We are attaching herewith a copy of a letter from the City Attorney to the Zoning
Board of Appeals, referring us to certain Illinois State statutes governing appeals
from an enforcing officer.
It is our recommendation to the City Council that they pass such an ordinance so that
the Zoning Board will have proper legal status for any future appeals of this kind.

OTT MFG. CO.: Mayor Pflughaupt then said the matter of the Ott
- Manufacturing Co. of which Mr. B. F. Lewis had presented earlier in the meeting was up
for discussion. The Mayor suggested the City Attorney Opeka and Building Inspector
Scharringhausen report the fact of the case. After both officials reported a violation
.of the City ordinance the motion was made by Alderman Johnson and seconded by Kehe to
uphold the action of the Building Inspector Scharringhausen. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.
KLEIN PROPERTY -COUNTY ZONING: Alderman "apieralski read the following:
"We are informed that the City of Park Ridge has filed its objection before the County
Zoning Board, to.the development known as the Klein Property.
The municipal development committee, and the Zoning Board of Des Plaines worked dili-
gently with the subdivider to bring about a high grade development in this area, in order
to prevent the sale of this property as half acre subsistence homesteads, which would
ruin this locality for an indeterminate number of years.
We have been given to understand that the Com Zoning Board was enthusiastic regarding
the final plans, and said); off the record, that this was the most complete and the
finest development that any sub -divider in recent years has bound himself to. We
feel that the City of Park Ridge acting very belatedly did not take time to inform
itself of all the facts in the matter, and objected on general principles without
full study of the facts.
Secondly, the area in question is contiguous to Des Plaines and is far removed from
the built-up portion of Park Ridge.
In addition a large tract of forest preserve land, and the Des. Plaines Fiver form
natural barriers between Park Ridge and the Klein property, and consequently
any development west of the river could hardly be regarded as affecting the City of
Park Ridge.
We feel, -therefore, that the good work accomplished by local officials should not be
voided and more importantly in order to defend this area against a very low class im-
provement, the City of Des Plaines should contact the Municipal Development Committee
of the City of Park Ridge in oeder to inform them of the full facts of the matter,
and set out the reasons for the Des Plaines acceptance of the present plans for high
grade improvement."'
The motionmes then made by Alderman Napieralski and seconded by Kehe to refer the
report to the Municipal Development Committee to contact City of Park Ridge Committee.
NORTH GOLF CUL DE SAC LIGHTS: Alderman Napieralski presented a pe-
tition from the citizens of Third Avenue and North Golf Cul de Sac stating:
"We, the undersigned, petition the City of Des Plaines, not to
install ,the proposed street lighting arrangement of poles and overhead wires on Third
Avenue and North Golf Cul de Sac, but desire to haveinstalled an ornamental system."

dispose of the matter to the satisfaction of petitioners. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried and so referred.
TIN CAN SALVAGE: The matter of tin can salvage which Mr. E. Wilier
had presented earlier in the meeting was discussed; then Mayor Pflughaupt referred the
-matter to the Public Relation and the Streets and Sanitation Committees.
APPROVAL OF MINUTES: Each member of the Council having been sup-
plied with a copy of the minutes of the regular meeting of July 2, 1945, the motion was
made by Alderman Kehe and seconded by Johnson that the said minutes be approved. The
motion was voted upon by acclamation whereupoh the Mayor declared the motion carried
and the said minutes approved.
