MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES,
:HELD IN THE COUNCIL CHAMBERS, MONDAY,
MARCH 19, 1945, AT 8:00 P. M.
CALL TO ORDER: In the absence of Mayor Chas. H. Garland, the meeting
was called to order by Otto W. J. Henrich, City Clerk, with Aldermen Johnson,
Napieralski, Pflughaupt, Kehe, Scharringhausen, Lemke, McKay, Campagna, and
Halverson responding to roll -call. Alderman Vavrinek was absent the entire
meeting.
DESIGNATE MAYOR PRO -TEM: The motion was then made by Alderman
Napieralski and seconded by Lemke that Alderman Pflughaupt be elected Mayor
Pro Tem to act as such during the temporary absence from the city of Mayor
Garlands The Clerk put the question and called the roll with the following
result: Ayes; Johnson, Napieralski, Pflughaupt, Kehe, Scharringhausen,
Lemke, McKay, Campagna, and Halverson. Nays; None. The Clerk thereupon
declared the motion carried, and Alderman Pflughaupt took the Chair.
COMMITTEE REPORTS: Superintendent of Streets Sam Atkins reported
a newt of a new street sweeper. The motion was then made by Alderman Cam-
pagna and seconded by Lemke that the Council advertise for bids for a sweeper.
The motion was voted upon by acclamation whereupon the ("heir declared the
motion carried.
The Streets and Sanitation Committee through its Chairman reported
on the Wallen Homes, Inc. proposed pavement in Cumberland Terrace -and the
Mayor Pro Tem called a recess so that some of the aldermen could etudy the
clans. After a brief recess, the motion was made by Alderman Campagna and
seconded by McKay that the plans and specifications be approved. The
motion was voted upon by acciametion whereupon the Chair declared the motion
carried.
The motion was then made by Alderman Lemke and seconded by Halver-
son that the Mayor and City Clerk be authorized to execute Escrow agreement
with Wallen Horses, Inc. for deposit of funds for street improvement under
official improvement plan.
CITY ATTORNEY REPORT: The C ity Attorney Frank Opeka reported on
the matter of a letter referred to him at the November 6, 1944, meeting. The
following letter is self-explanatory:

• You are hereby informed that the matter pertaining to -the
permit issued by the City of Des Plaines to the Public Service Company of
Northern Illinois, to lay gas mains along Maple Street near Howard Street
on property belonging to my client, has been satisfactorily adjusted with

RESOLUTION TO FORECLOSE THE LIED CF SPECIAL ASSESSMENTS: The
Finance Committee through its Vice -Chairman Aldermen 'eo presented the fol-
lowing prcposed resolution:

WHEREAS, the City Council has heretofore adopted ordinances providin for the
construction of certain water, sewer, sidewalk and paving improvements oovering
in part, Lots 1 to 3, inclusive, 4, 5, and 9 to 13 inclusive, in Blocvk 1;
Lots 1 to 5 inclusive, 8 and 10 to 13 inclusive, in Block 2; Lots 1, 2,
3, 5 and 7 to l5inclusive in Block 3; Lots 1 to 17 inelusive in Block 4;
Lots 1 to 4, inelusive, 6 and 8 to 15, inclusive, in Block ; Lots 1 to 4,
inclusive, 7 to 22 inclusive and 28 to 39 inclusive in Block 6; Lots 1 to
10 inclusive, 12 to 14, inclusive, 16, 13 to 30 inclusive in Illock 7; and
Lots 1 to 19, inclusive in Blook 8; all in F.C.Enderlin Jr. Des Plaines Ter-
race, in the Northwest Quarter of the Northeast Quarter in Section 29,
Township 41 north, Range 12; and
WHEREAS, special assessments were levied to pay the costs of said improvements
and pursuant to the Statute applicable thereto said improvements were con-
structed and the report of cost and completion was approved in manner and
-form provided by law; and
WHEREAS, . only. a small portion of installments of said special assessments
levied against the aforesaid lots have been paid and all other installments
are now past due and delinquent; and

WHEREAS, the City Council finds that it will be for the best interests of this
City that said special assessment liens be foreclosed; now, therefore:

in Block 2; Lots 1, 2, 3, 5, and 7 to 15 inclusive in Block 3; Lots 1 to 17

Section 2. That the City Attorney be and he is hereby directed to prosecute
said foreclosure suit or suits as he may deem best and to cooperate1 with
the States Attorney of Cook County, in procuring the foreclosure of the lien
of the general taxes upon said lots, which t"ia ity Council requests the
States Attorney to foreclose, that said Oty :'attorney is hereby authorized
to file suit for foredlosure or to join in any suit or suits for foreclosure
instituted by the States Attorney to foreclose the lien of general taxes and
to take such other stpps as ae may deem proper to procure the prompt sale

Section 3. That all resolutions or parts of resolutions in conflict herewith
be and the same are hereb-r repealed.
Section 4. That this resolution shall he in full force and effect from and
after its passage and approval.
The motion was then made by Alderman Kehe and seconded by Halverson to approve
the said prbposed resolution. The motion was voted upon by acclamation where-
upon the Chair declared the motion carried and the resolution approved.

Sanitation througb its Chairman Alderman Campagna presented the following pro-
posed resolution: •
BE IT RESOLVED by the City Council of the City of•Des Plaines, Illinois, that
there is hereby appropriated +he sum of 1`8,000.00 of Motor Fuel Tax Funds for
the purpose of maintaining under the Motor Fuel Tax Law, the following
desbribed arterial streets or State Highways, from Aril 1st, 1945, to Decem-
ber 31st, 1945.

BE IT FURTHER. RESOLVED that the Clerk shall immediately transmit two certified
copies of this resolution to the Department of Public Works and Buildings,
Division of Highways, through its district office at Chicago, Illinois.
The motion was then made by Alderman Campagna and seconded by Lemke to ap-
prove the said proposed resolution. The motion was voted aeon by acclamation
whereupon the Chair declared the motion carried and the resolution approved.
RESOLUTION PROTESTING THE OMISSION OF CERTAIN DEFENSE HOUSING FROM
1'344 ASSESSMENT :ROLL: The City Attorney presented the following proposed
resolution:

WHEREAS, the City a f Des Plaines, because of its proximity to the Douglas
Aircraft plant, has had a large building program to house defense workers; and
WHEFUAS, more than two hundred of said uhits for defense workers were com-
pleted and occupied prior to April 1, 1944 and should have been placed on the
tax rolls for the year 194'x; and

hanced by the addition of these and other improvements because some of said

IMPROVENL.NTS here omitted from the tax rolls for the year 1944, and thereby
increasing the tax rate for the City of Des Plaines; and
V11REAS it has been brought to the attention of the City Council that all of
said improvements have been certified to the County Assessor for enrollment
on the tax rolls; and that some of them have been omitted from the rolls due
to the failure of the Board of :appeals to return the boobs to the Assessor in
time to have them entered, and for other causes; and
WHEREAS, the omission of said improvements has caused a hardship on the other
taxpayers "of the City of Des Plaines; now, therefore:
BE IT RESOLVED BY THE CITE` COUNCIL OF THE. CITY OF DES PLbINsS, COOK COUNTY,
ILLINOIS:
Section 1. That the City Council of the City of Des Plaines hereby riakias
formal protest to John S. Clark, Assessor of Cook County, Illinois, for his failure
to include in the 1944 assessment, all of the improvements in the City of
Des Plaines completed prior to April 1, 1944 and subject to taxes for the
year 1944.

the proposed resolution. On discussion of the resolution, Alderman Napieralski
explained some of the causes of f}allure to place the items on the.roll. ¶'he
Chair put the question and the motion was voted upon by acclamation whereupon
the Chair declared the motion carried and the resolution adopted.

RESOLUTT_ON AUTHORIZING WA'ISH SERVICE TO NON-RESIDENTS: The Water
Committee through its Chairman Alderman Lemke presented the following pro-
posed resolution:
RESOLUTION AUTHIORIZING WATER SERVICE
TO NON-RESIDENTS AND ESTAL--kLTSHING
RATES THEREFOR.
WHEREAS numerous requests for water have been made to the City of Des Pleines
by residents andtfarmers of the unincorporated areas adjacent to and abutting
the City of Des Plaines; and •
WHEREAS said requests are predicated upon the grounds that the wells, which
is the4r cnly source of water, and which have heretofore provided an adequate
supply of water have become dry and the applicants are without water for
sanitary and other purposes, and that the farmers are without water for
sanitary and other purposes, and that the farmers are without water for their
cattle; and
WHEREAS the lack cf water in said areas will produce unsanitary conditions
and what little supply of water there may be may bring about an epidemic, both
of wh;ch would be detrimental to the health and safety of the citizens of
this city; and •
"!HEREAS the City cf Dos Plaines is desirous of preventing any menace to the
public health and safety of its citizens and 4.s desirous in assisting the
farmers,in providing water for its cattle; and

Section 1. That the Superintendent of Water of the City of Des Plaines be
and he is authorized and directed to sell water service to non -.residents,
only during such periods when there is a surplus of water and when the de-
mands and needs of the citizens of the City of Des Plaines will not be
effected thereby.
Section 2. That the rates and charges to be paid upon delivery, by water
takers and consumers for the use of water shall be at the rate of Fifteen (.15)
cents per 100 gallons, with a minimum charge of Fifty (.50) cents. All such
water supplied shall be furnished through meters.
Section 3. That all euel, v;ater provided shall be hauled by the purchaser in
a container by him provided, and said water shall be procured only at the
Water softening plant situated on Thanker Stree+, and the Belt Line. Payment
shall be made for such water service at the time of procuring said water,
and a receipt shalibe given for each container filled atX the rates provided
for in Section 2 of this resolution.
Section 4. That the provisions of this resolution shall bd applicable to
green -houses, farmers and individuals residing in the unincorporated
areas adjacent to and abutting the City ofIbs Plaines.
Section 5. That the Superintendent of Water is hereby directed, in the event
that the demands of the City increase, and there is no surplus water, to dis-
continue to so provide water service to the non-residents.
Section 6. That this resolution shall be in full force and effect from and
after its passage.
The motion was tfaen made by Alderman Campagna and seconded by Kehe to adopt
the proposed resolution. The motion was voted upon by ace?amation whereupon
the Chair declared the motion carried and the resolution adopted.
APPROVAL OF MINUTE: Each member of the Council having been sup-
plied with copies of the minutes of the regular meeting held March 5, 1945,
and the special meeting held March 12, 1945, the motion was made by Aider -
man Lemke and seconded by Halverson that the said minutes be approved. The
motion was voted upon by acclamation whereupon the hair declared the motion
carried and the minutes approved.
INSPECTION AND INVESTIGATION OF M. MAHALLO'8 PRiMISES: The :lotion
was made by Alderman Halverson and seconded by Campagna that the Healthf-
partment and Building Inspector inspect and investigate the premises of
Mike Mihalo and make a report at the next regular Council meeting. The
motion was voted upon by acclamation whereupon the Chair declared the motion
carried.
ADJOURNMENT: The motion was made by Alderman Lemke and seconded by
Scharringhausen to adjourn." The Motion was voted upon by acclamation where-
upon the hair declared the motion carried and.the meeting regularly adjourned.

CALL TO ORD: The meeting was called to order by Mayor pro tem
G. 11. Pflughaupt, with Aldermen Johnson, Napieralski, Pflughaupt, Scharring-
hausen, Lemke, McKay, Campagna, and Halverson responding to roll call. Alder-
men Kehe and Vavrinek were absent the entire meeting. Alderman Lemke, after
appr&wing the water bills, was excused due to death in his family.
REPORTS OF OFFICERS: The Clerk then read the reports of Building
.Inspector F. Scharringhausen, Electrical Inspector A. Rieck, and City Clerk
0. W. J. Henrich for the month of March.
