HELD IN THE COUNCIL CHAMBERS, MONDAY,
MARCH 5, 1945, AT 8:00 P. M.
•CALL TO ORDg,R: The meeting was called to order by M4Tor Charles
H. Garland presiding,with Aldermen Johnson, Napieralski, Pflughaupt, Kehe,
Scharringhausen, Lemke, McKay, Campagna, and iialverson responding to roll -
call. .Alderman Vavrinek was absent .during the entire meeting.
COMMITTEE REPORTS: The Committee on Streets and Sanitation through
its Chairman Alderman Campagna reported the securing of the new dumping
pit without cost to the City.
The Public Relation Committee through its Chairman Alderman Napieralski
reported regarding a memorial for the men and women in the service.
Reports of Officers: --The City Clerk then submitted the reports
for the month of February of the City Treasure', Harold J. Ahbe, City Clerk,
Otto Henrich, Building Inspector, Frank Scharringhausen, and Electrical In-
spector, Arthur Rieck. The City Attorney submitted the following report:

Gentlemen:
The matter of leasing the one acre plot of ground on which is lo-
cated the Imhoff Tank servicing the Cumberland Terrace area has been referred
to me for study and report.

The tract. in question consists of one acre in area and is triangular
in shape. The easterly boundary of the tract commences on South-easterly
line of Columbia Avenue and extends to the center of Weller Creek, a distance
of 255 feet. From the Southeasterly line of Columbia Avenue, north to a
point just across Weller Creek is a distance of 285 feet. The other side of
the triangle is 230 feet. It is evident from the foregoing, that this
tract is rather small for athletic activities.
Were the City of Des Plaines to lease this tract for private use
(though public in nature) and for the benefit of a particular group or club,
this property would be subject to real estate taxes, on the ground that it
was not used for municipal purposes. Then too, there exists and easement
on behalf of Weller Creek Drainage District in the possible re -location
of the course of the creek. The railroad, in selling this land, reserved
the right of egress and ingress to the adjoining tract owned by theca. The
Sanitary District of Chicago, by ordinance, acquired some rights in said
tract, and have an interest therein.
In considering all of the above factors, before use of said
tract could had by the Civic Club, who are interested, it woi{ld be neces-
sary to secure the assent of tie Weller Creek Drainage District, the
Sanitary District and the railroad. That, together with the smallness
C of the land, would Hardly slake it useful for the I)urnooes intended.

Gentlemen:
Ur. Walter W. Held, through his attorney, Harry H. Talcott, has
tendered an offer of 115.00 for a quit -claim deed to the West half of Lot 21
in Block 4 in J.C.Robinson's Addition. This half lot is 25 x 125 and abutts
an alley, and is situated on W.lnut Street near the Soo Line railroad.
The City of Des Plaines acquired tax titles•to this half loth
6ne'on April 10, 1911, recorded as doc. 4845293, and one on October
1 1912, recorded as doc. 5059866. As near as I can determine, the inv-
estment for both titles amounts to approximately $8.00
The title search discloses th'a't in addition to the City tax titles,
there are five other tax deeds outstanding. ihis property is subject to
considerable special assessments, dating back to Warrant No. 16, none of
which are paid. The Specials, by warrants are : 16,24,29,75,81, and 100.

County Board has agree to accept a bid of $50.00, plus the payment of the
1941, 1942, 1943 and 194.4 taxes.
The cost,of clearing this title would he great when you consider
the outstanding_ tax title, all of which must be bought up, and coupled
with the special assessments that are outstanding, and considering further,
that it is but a half lot, abutting an alley.

The motion was then made by Alderman Kehe and seconded by Campagna to sus-
pend the.rules and pj)ace the ordinance upon its final passage. The Mayor
put the question and the Clerk called the rollwith the following result:
Ayes; Johnson, Napieralski, Pflughaupt, Kehe, Scharringhausen, Lemke, McKay,
Campagna, and Halverson. Nays; None. The Mayor thereupon declared the
motion carried, the rules suspended, and the said proposed ordinance before
the council for final disposition.
The motion was then made by Alderman Kehe and seconded by Napieralski
to finally pass the said proposed ordinance. The Mayor put the question
and the Clerk called the roll with the following result: Ayes; Aldermen
Johnson, Napieralski, Pflughaupt, Kehe, Scharringhauserr, Lemke, McKay,
Campagna, and Halverson. Nay;s none. The Mayor thereupon declared
the motion car^ied and the said ordinance passed.
CUMBERLAND TERRACE CIVIC CLUB: The Clerk then read the following
letter: February 28, 1945
City Council, Des Plaines
Dear Sirs,
For over six months last passed, Wallin Horses, Inc. has been en-
gaged in constructing dwellings in the.West section of Cumberland Terrace
and in so doing has torn up the streets in the Terrace, filled in the
drainage ditches and generally Brough about a,condition which is most simply
described as a succession.of mud holes. We understand that -it is the duty
of the contractor to keep the streets passable and particularly to restore
them to their former condition in front of each home as it is completed.
As far as any of us can find out, Mallin Homes, Inc. has made no effort in
that direction.
We feel that the city officials have been extremely lax in this
matter and that some serious effort should be made to enforce the ordinance
which the council has adopted. We consider it pechliar to say the least
that permits for this construction work were issued without requiring the
filing of any bond to secure the city against damage to the streets.
The residents of Cumberland Terrace are both citizens and tax
payers of Des Plaines and do not appreciate being treated like step children.

REPORT ON TAX FORECLOSURE ;Alderman Napieralski reported the
County was starting foreclosure on taxes. He said the County was willing
to cooperate with the City regarding foreclosures and that the Public Relations
Committee was willing to help any property owner regarding a settlement of
his tax problem. Also asked the local papers to give publicity to this matter.

The following responding to HAI call: Mayor Charles H. Garland,
Alderman Johnson, ilapiealski, Pflughaupt, Vavrinek, Kehe, Scharringhausen,
Lemke,McKay, Campagna and Halverson,
1944 TAY RATE: Mayor Garland informed the Alderman that the tax rate
for 1944 had been increased because the coin assessor had failed to include
considerable property in the valuation. All over the county rates habe
been increased due to the failure of adding property to the valuation.
Mayor Garland called on A. E. Goll of Maine Twonsllip High School Brd.,
T. Arndt, President Des Plaines Park Dist. , W. T. Merrian of P blic School Brd. a
R. D. Hams Township assessor who were present. tilderman Napieralski had
considerable data on the subject stating that through the loss of employees going
into the war service, cases before the appeal Brd. and time limit to complete
the tax books were partly the causes of failure to get the items on the books.
After considerable discussion Alderman Campagna seconded by Kehe that the City
Attorney be instructed to draw up a resolution of protest to the county assesor.
protesting the omissions of the property to the valuation. The motion was
voted upon by acclamation whereupon the Mayor decalred the motion carried and the
