APPROVAL OF MINUS: Each member having been supplied a copy of the minutes of the regular Council meeting held Tuesday, September 18, 1944, the motion was made by Alderman Halverson and Seconded by Napieralski to approve said minutes. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said minutes approved. ICH, City Clerk MINUTES OF THE REGULAR COUNCIL MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, MONDAY, OCTOBER 16. 1944. AT 8:00 P. M. CALL TO ORDER: The meeting was called to order by ,Mayor Charles H. Garland, presiding, with Aldermen Johnson, Napieralski, Vavrinek, Kehe, Scharring- hausen, Lemke, McKay, Campagna and. Halverson responding to roll -call. Alderman Pflughaupt was absent the entire meeting. COMMITTEE REPORTS.: Water Committee: Alderman Lemke reported the repair work was started on the well. Public Relations: Alderman Napieralski suggested having a book for registration for servicemen home on leave. RESOLUTION FOR SPECIAL ASSESSMENT FORECLOSURE: The Clerk then read the following resolution: TO FORECLOSE THE LIEN OF SPECIAL ASSESSMENTS OF CERTAIN PROPERTY IN THE CITY OF DES PLAINES * * * * * * WHEREAS, ordinances have heretofore been adopted providing for the construction of certain water, sewer and sidewalk improvements, and special assessments, pursuant thereto were levied to -pay the cost of said work pursuant to the statute applicable thereto and said work and improvements constructed and the report of cost and completion was approved in manner and form as provided by law and affecting, in part, the following described real estate, to -wit: ' Lots 1, 2,4, 5, 7, 9 to 36 in the Subdivision of Lot 2 of "Carl Lagerhausen Estate Division", of the SW of Sec. 20, Blown 41 North, Range 12 East of the 3rd P.M., excepting the West 468.34 feet, in Cook County, Illinois, situated in the City of Des Plaines, Cook County, Illinois; and WHEREAS, certain installments of said special assessments levied against individual lots have not been paid and are now past due; and WHEREAS, the City Couhcil finds that it will be for the best interests of this City that said special assessment liens he foreclosed; now, therefEre: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS: Section 1. That the special assessment liens against the following described real estate, to -wit: Lots 1, 2, 4, 5, 7, 9 to 36 in the Subdivision of Lot 2 of "Carl Lagerhausen Estate Division", of the Sq of Sec. 20, Town 41 North, Range 12 East of the 3rd P.M., excepting the West 468.34 feet, in Cook County, Illinois be foreclosed. 321 32 (SPECIAL ASSESSMENT RESOLUTION CONT'D.) Section 2. That the City Attorney be and he is hereby authorized and directed to prosecute said foreclosure suit as he may deem best, and to cooperate with the State's Attorney of Cook County, in procuring the foreclosure of the lien of the general taxes upon said lots, if any there be, which this City Council hereby requests the State's Attorney to foreclose, that said City At- torney is hereby authorized to file suit for foreclosure or to join in any suit or suits for foreclosure instituted by the State's Attorney to foreclose the liens of general taxes and to take such other steps as he deems proper to pro- cure the prompt sale of said property to satisfy said tax liens. Section 3. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 4. hat this resolution shall be in full force and effect from and after its passage and approval according to law. The motion was then made by Alderman Kehe and seconded by Campagna to concur in the resolution. The Mayor put the question and the Clerk called the roll with the following result: Ayes; Johnson, Napieralski, Vavrinek, Kehe, Scharringhausen, Lemke, McKay, Campagna, and Halverson. Nays; None. The Mayor thereupon &bclared the motion carried and the said resolution adopted. RESOLUTION OF PUBLIC SERVICE COMPANY RATES: The Clerk then read the _following resolution: R E S O L U T I O N WHERjEAS, the Public Service Company of Northern Illinois has furnished Street Lighting, and Municipal Pumping and Street Lighting Service, Rates 102, 105 and Rate 22 verbal contract, under contracts dated February 3, 1941 and September 16, 1940; and WHFRF4S, new contracts, Rates 102 and 105 have been tendered to the City by the said Public Service Company of Northern Illinois, at rates lower than in the former contracts; and WHEREAS, it is deemed to be for the best interest of the City to enter into such new agreements to supersede and cancel former contracts, there- by effecting a saving to the City for light and power; now, therefore: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK COUNTY, ILLINOIS: Section 1. That the Mayor and City Clerk be and they are hereby authorized and directed to execute, on behalf of the City of Des Plaines, new contracts, Rate 102 for Municipal Street Righting, and Rate 105 for Municipal Pumping and Street Lighting Service, to supersede and cancel Contracts, Rate 102 dated Febru- ary 3, 1941, and Rate 105, dated September 16, 1940, together with Rate 22 verbal contract, with the Public Service Co., of Northern Illinois. Section 2. That the City Clerk be and he is hereby directed to re- quest the Public Service Company of Northern Illinois that service to the six Ornamental Lighting Systems of the City now operated under Rate 101 dated March 3, 1941, be provided under new Rate 105, Municipal Pumping and Street Lighting Contract, cancelling the contract under which these lights are now being served. Section 3. That this resolution shall be in fullforce and effect from and after its passgge and approval according to law. The motion was then made by Alderman Kehe and seconded by Campagna to concur in the resolution. Alderman Kehe explained the reduction of rates under new contracts with the Public Service on passage of this resolution. the Mayor put the question and the Clerk called the roll with the following result: Ayes' Johnson, Napieralski, Vavrinek, Kehe, Scharringhausen, Lemke, McKay, Campagna, and Halverson. Nays; Nonw. the Mayor thereupon declared the motion carried and the said resolution adopted. ROLLER SKATING: The Clerk reported a request for roller skating in the Echo Theatre Building, but no letter having been received from the person making the request, the Mayor suggdsted that no action be taken until the letter is received. MUNICIPAL LEAGUE CONVFER'tTION: The Mayor suggested that the City Attorney, Clerk, Building Inspector and City Engineer attend the, convention as representatives of the City. That the expenses be paid by the City. the motion was then made by Alderman Lemke and seconded by Halverson to concur in the suggestion.
