SUGGESTS REPAIR OF HOWARD AVENUE: The motion was made by
Alderman Halverson and seconded by Campagna that the matter of the
repair of Howard Avenue be referred to the Committee on Streets and
Sanitation. The motion was voted upon by acclamation whereupon the
Mayor declared the motion carried.
APPROVAL OF MINUTES: Each member of the Council having
been supplied a copy of the minutes of the regular Council meeting
held Monday, April 17, 1944, the motion was made by Alderman Pflug-
haupt and seconded by Lemke that the said minutes be approved. The
motion was voted upon by acclamation whereupon the Mayor declared the
motion carried and the said minutes approved.

verson. (Alderman Johnson was absent during the entire meeting.)

DISCUSS 1943 TAX RATE: Mayor Garland then read the fol-
lowing copy of a letter addressed to Michael J. Flynn, County Clerk:

Dear Mr. Flynn:
A special meeting of the City Council of Des Plaines is being called
for 8 P. M., Tuesday, May 9, 1944, for the purpose of discussing
our 1943 tax levy and the resultant tax rate.
Inasmuch as our 1943 legy ordinance called for approximately $2000
less than the 1942 extended levy, and further that our valuation in
1943 increased by almost $100,000 over 1942, it was a foregone con-
clusion that our tax rate for the year 1943 be lower than 1942.
Many tax payers and officials in Des Plaines are interested in
knowing why, instead of the $80,720.50 asked for in our l=evy
CC ordinance, we have been given $84,215.24, which is approximately
5% more than we need for our corporate purposes; and whether the Cly
of Des Plaines will have the use of these additional funds, or for
what purpose they were added.
To be present at this meeting we have invited neighboring city
officials, members of the Press, representatives from the Association
of Commerce, and other interested individuals..

from your office to explain and substantiate the excess allowance
you have given us.

After considerable discussion, the Finance Committee introduced the
following proposed resolution which was read by the Clerk:
RESOLUTION
WHEREAS, the Assessor of Cook County, Illinois has, for the year
1943, assessed all taxable property in Cook County on a basis of
100% actual valuation, which method is a departure from the customary
manner of assessing on a 37% of actual valuation basis as in former
years; and
WHEREAS, the City of Des Plaines passed its 1943 Tax Levy Ordinance
on June 7, 1943, computing its. needs based on the customary and usual
37% bakis of assessment; and
WHEREAS, the City of Des Plaines passed its said levy ordinance prior
to and before any mention was made of any contemplated change in
the method of assessment of taxable property, and relied on the usual
and customary method of assessment in determining the needs of said
City; and
WHEREAS, the amount levied for theyear 1943 was in a lesser sum than
that in the year 1942; and
WHEREAS, under the 100% actual value the assessed valuation of all
taxable property in the City of Des Plaines is $14,195,804.00 as
compared to $5,225,454.00 for the year 1942; and
WHEREAS, the 1942 assessed valuation, if extended, using 2.7 as a
factor, the valuation for this City would be 14,108,726.00 indicating
an increase, when compared to the figures submitted by the Assessor
of $87,078.00; ani when using the factor 2.7 to arrive at the increase
in valuation on a 37% basis indicates an increase under the usual and
customary method of assessment at the time of making the 1943 levy,
of $32,219.00; and

WHEREAS, the tax levy for the year 1943 was less than in the previous
year and the assessed value was higher and the tax rate produced on
extensions made by the County Clerk becomes greater in computing and
comparing on the basis of the factor 2.7; and
WHEREAS, it appears that the County Clerk has added the loss and
cost of collection to the levy, thereby increasing the tax rate; and
WHEREAS, the rate as extended is in excess of that desired by the
City of Des Plaines and is contrary to the intent of the ordinance
levying taxes for the year 1943; and that since the levy ordinance was
adopted pursuant and in reliance on the customary 37% bails, the ex-
tension of the County Clerk does not reflect the will of the City
of Des Plaines and his computation produced a rate higher than was
desired and requested; and
WHEREAS, the City of Des Plaines did not request nor does it desire
to secure any funds in excess of those set up in the Levy ordinance,
and the taxes as extended are in excess of and beyond those requested; and
WHEREAS, it appears that the tax levy is lower and the assessed
valuation higher, therefore the tax rate produced should be lower than
that of the previous year; now, therefore:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK
COUNTY, ILLINOIS, That the County Clerk be and he is hereby requested
to revise the extension of the taxes for the year 1943 and recompute
the per cent required to produce only the amounts requested in the
Levy ordinance of the City of Des Plaines.
BE IT FURTHER RESOLVED that a- copy of this resolution be forwarded to
Michael J. Flynn, County Clerk of Cook County, Illinois with the
request that he take immediate steps to revise the tax extensions
as hereinabove set forth.
The motion was made by Alderman Pflughaupt and seconded by Campagna
that the said proposed resolution be adopted. The Mayor put the
question and the Clerk called the roll with the following result:
Ayes; Aldermen Napieralski, Pflughaupt, Vavrinek, Kehe, Scharring-
hausen, Lemke, McKay, Campagna, and Halverson. Nays; None. The
Mayor thereupon declared the motion carried and the said resolution
adopted.
ADJOURNMENT: The motion was made by Alderman Lemke and
seconded by Campagna that the meeting adjourn. The motion was
voted upon by acclamation whereupon the Mayor declared the motion
carried and the meeting regularly ad'ourned.
