03/13/194439 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, MONDAY MARCH 6, 1944 at 8:00 P. M. CALL TO ORDER: In the absence of Mayor Charles H. Garland, the meeting was called to order by Edgar J. Friedrich, City Clerk with Aldermen Johnson Napieralski, Pflughaupt, Vavrinek, Kehe, Schar- ringhausen, Lemke, McKay, Campagna and Halverson responding to the roll call. ADJOURNMENT: The motion was made by Alderman Pflughaupt and second by Campagna that the meeting adjourn to 8:00 P. N. Wed- esday, Parch 8, 1944 in order to permit the members of the council to attend the annual Dkper of the Des Plaines Business rens' Asso- ciation being held this evening. The motion was voted upon by Acclamation whereupon the chair declared the motion carried and the meeting adjourned to 8:00 P. M. Wei ;nsday, 'Ia 8, 1944. M. • CALL TO ORDER: The meeting was called to order by Mayor Charles H. Garland presiding with Alderman Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe,*Scharringhausen, Lemke, McKay, Camp- agna and Halverson responding to the roll call. (* Alderman Schar- ringhausen was absent during the entire meeting). The Clerk re- ported nine (9) aldermen present, Mayor Garland then announced that this is an adjourned re- gular meeting held primarily for the purpose of completing and passing the 1944 Appropriaton Ordianance. PASS 1944 APPROPRIATION ORDINANCE: The Clerk then read in its entirety for second readin a proposed ordinance entitled: MAKING APPROPRIATIONS TO DEFRAY THE EXPENSES OF THE CITY OF DES PLAINES FOR MUNICIPAL PURPOSES DESIGNATED'TUE " ANUAL APPROPRIATION BILL" FOR THE FISCAL YEAR COWEFCING JANUARY 1, 1944, AND };LADING DECEMBER 31, 1944. During the reading of the said proposed ordinance Mayor Garland ex- cused himself from the meeting and requested Alderman Pflughaupt to take the chair for the remainder of the meeting. Tho motion was then made by Alderman Napieralski and seconded by Vavrinek to finally pass the said. proposed ordinance. The chair put the question and the clerk called the roll wth the following result: Ayes; Alderman Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe, Lemke, McKay, Campagna and Halverson. Nays; None. The chair thereupon declared the motion carried and the said ordinance passed. The motion was made by Alderman Johnson and seconded by Camp- agna to instruct the clerk to cause the said ordinance published in "The Des Plaines Suburban Times". The motion was voted upon by acclamation whereupon the Chair declared the motion carried. "NOT GUILTY" VERDICT IN CASE OF HAWLEY V. S. CITY: The Clerk then read the following letter: March 9, 1944. Mayor and City Council Des Plaines, Illinois Re: Hawley vs. City of Des Plaines et al LETTER CONTINUED Gentlemen: Please be advised the.' the above entitled cas was reached for trial on March 7th, on which date a jury was selected and evidence presented. Upon conclusion of the plaintiff's case, I presented amotion for a directed verdict of "Not Guilty" and the motion was granted. Upon instruction of the court, the jury returned such a verdict. The Railroad's motion for a directed verdict was refused. This now concludes the above matter. Very truly yours, FRANK M. OPEKA, City Attorney. The chair ordered the said letter plaeed on file. WELLER CREEK BRIDGE: Alderman Napieralski then brief- ly discussed the propriety of the City repairing the foot bridge over Weller Creek at the foot of Perry Street. The motion was made by Alderman Napieralski and second by Alderman Johnson to instruct the Clerk to write the City Engineer ordering him to determine where the City Limits line lies with respect to the said bridge and to submit a writtenzeport on this matter to the City Council at its next regualr meeting to be held March 20, 1944. The motion was voted upon by acclamation whereupon the Chair declared the motion carried. ADJOURNMENT: The motion was made by Alderman Lemke an' seconded by Vavrinek that the meeting adjourn.
