SUGGESTS CONDEMNING PARTLY BURNED BUILDING: The motion was
made by -Alderman Halverson and seconded by Pflughaupt to refer the mat-
ter of condemning the small residence in Riverview recently partially
destroyed by fire, to the Fire Marshall and the Health Inspector.
The motion was voted upon by acclamation, whereupon the Mayor declared
the motion carried.
APPROVAL OF MINUTES: Each member of the Council having been
supplied a copy of the minutes of the special council meeting held
Thursday, December 30, 1943, as well as a copy of the minutes of the
regular Council meeting held Monday, January 3, 191.4, the motion was
made by Alderman Lemke and seconded by Vavrinek that the said minutes
be approved. The motion was voted upon by acclamation, whereupon the
Mayor declared the motion carried and the said minutes approved.

THE COUNCIL CHAMBERS, MONDAY, FEBRUARY 7,,
1944 at 8:00 P.M.
CALL TO ORDER: The meeting was called to order -by Mayor
Charles H. Garland presiding, with Aldermen Johnson, Napieralski,
Pflughaupt, Vavrinek, Kehe, Scharringhausen, Lemke, McKay,
Campagna, and Halverson responding to the roll call. The Clerk
reported all members of the Council present.
SIGWALT VS. CITY, CASEj44-S-676: The Clerk then read the
following letter:
February 7, 1944.
Mayor and City Council,
Des Plaines, Illinois.
Gentlemen:
The City of Des Plaines, together with Harold J. Ahbe as City.
Collector, myself as City Attorney and others were served with
summons: in an action entitled "Sigwalt Co., vs. City •of Des
Plaines, etal, Superior Court case No. 44 S 676, praying for
injunction to restrain the City and the County collector from
collecting the first four installments of Special Assessment
Warrant No. 62694, it being alleged that they had been cancelled.
The treasurer's books show that the first four installments of
said assessment were cancelled as payment under condemnation for
land taken at the time of the improvement. Since the install-
ments were cancelled, there was no interest, penalty or costs
attach to said four installments.
I filed an answer on behalf of the City, Mr. Ahbe and myself,
admitting the cancellation of the first four installments, but
denying that any attempt is being made to collect any portion of
said installments. The States Attorney filed answer on behalf
of himself and the County Clerk and County Treasurer, who were
also parties defendant.
The matter came on for a hearing this morning, and the court
entered a decree awarding an injunction to restrain us from col-
lecting, or attempting to collect any principal, interest,
penalty or costs on the first four installments, and further
ordered that the City .Collector so mark his books.
Your approval of my action in this matter will be appreciated.

• TRAFFIC COMMISSION MAKES RECOMMENDATIONS: The Clerk then
read the following letter:

& Members of the City Council.
Gentlemen:
As a result of our last regular meeting held January 25th, we
recommend the following suggestions.
1. That the gates at the Des Plaines Ave. massing of the Chicago
& Northwestern Railway Co., as recommended by them, be changed
from manual to automatic, provided they are hooked up manually
at the Depot Tower similar to the operation of the other gates.
2. Also that the highway stop -and -go lights at Des Plaines Ave.,
and Miner.St., be automatically controlled by the Railway when
trains are approaching.
3. That b o instead of three flasher lights be installed on two
posts at the Depot crosswalk as recommended by the Railway.
4. That the new way of parking Busses, Cabs, and Private Cars
be permanently adopted between Lee & Pearson Streets, on the
north side of Ellinwood St., as shown by the attached platt, and
that each Cab Company be given one stall for their personal use,
and the fourth stall to be occuppied by any Company_having more
than one Cab.
5. That you have the City Engineer examine the foot bridge over
Weller Creek, and if found hazzardous to Public Safety, to have
it repaired to the line of the City Limits.

6. That you supply additional lighting at the Cumberland Circle,
and that you have the City Engineer investigate to see if other
safety measures could. be installed to prevent further accident.
We also wish to refer you to our letter of October 14th. relative
to the installation of Sodium Lights .

Gentlemen:_
This is to certify that a duly called meeting of the
Retirement Board of the Firemen's Annuity and Benefit Fund of
Des Plaines held on January 27, 1944, a quorum being present,
the following resolution was unanimously adopted:
RESOLVED: That pursuant to the provisions of an Act of the
General Assembly of Illinois, approved and in force July 31,
1943, entitled "An Act to provide for the creation,, setting
apart, maintenance and administration of a firemen's annuity
and benefit fund in cities, townships, villages and incorporated
towns having a population of not less than ten thousand nor
more than one hundred thousand inhabitants", the retirement
board of the Firemen's Annuity and Benefit Fund of the City of
Des Plaines hereby certifies to the City Council of the City
of Des Plaines that the amount of tax to be levied in the year
1944 for the purpose of providing revenue for the Firemen's
Annuity and Benefit Fund of Des Plaines is one-half of one
mill on the dollar, Three Thousand ($3,000.00) Dollars.
AND BE IT FURTHER RESOLVED that the President and Secretary
be instructed to submit immediately a copy of said resolution
to the said City Council.
We hereby certify that the amount set forth in the
above and foregoing resolution is necessary and the amount that
is to be levied in the year 1944 for the purpose of providing
revenue for the Firemen's Annuity and Benefit Fund of Des Plaines.

finally pass the said proposed ordinance as read. The Mayor put

MINUTES OF THE ADJOURNED COUNCIL MEETING
OF THE CITY COUNCIL OF DES PLAINES, HELD IN THE
COUNCIL CHAMBERS ON FRIDAY, FEBRUARY 11, 1944 AT
8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Charles
H. Garland presiding, with Aldermen Johnson, Napieralski, Pflughaupt,
Vavrinek, Kehe, Scharringhausen, Lemke, McKay and Halverson responding
to the roll call. (Alderman Campagna was absent during the entire
meeting.) The Clerk reported nine (9) aldermen present.
ANNOUNCE DEATH OF FORMER ALDERMAN COLLET: Mayor Garland announced
the death of John B. Collet who retired after serving the City as
alderman for more than a decade.
The motion was made by Alderman Johnson and seconded by Lemke to
instruct the Clerk to send a floral piece to the Collet family and ex-
press the Council's sympathy. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried.
DISCUSS WATER T: The report of Alvord, Burdick and Howson,
engineers,, dated February 7, 1944, was then discussed at length by the
members of the Council. Mr. Donald H. Maxwell of Alvord, Burdick and
Howson was present and answered any questions pertaining to the report.
The members of the Council seemed to favor Plan "A" of the report.
It was informally agreed that the Clerk arrange a conference with
Colonel Harvey of the United States Army -and Mr. Ashton of the Federal
Works Agency for Tuesday morning, February 15, 1944, for the purpose
of arranging for Federal aid to carry on the proposed project. The
following agreed to attend the conference: Mayor Garland, Aldermen
Kehe, Vavrinek, Napieralski, Lemke; Scharringhausen and Halverson, City
Clerk Friedrich, City Attorney Opeka, City Engineer Nelson and Mr.
Maxwell of Alvord, Burdick and Howson, engineers.
