MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF THE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY
NOVEMBER 1, 1943 AT 8:00 P. M.
CALL TO ORDER: - The meeting was called to order by Mayor
Charles H. Garland presiding, with Alderman Johnson, Napieralski,
Pflughaupt, Vavrinek , Kehe, Scharringhausen Lemke and McKay, Campagna
and Halverson responding to the roll -call. The Clerk reported all members
of the council present.
ORDINANCE - EIGHT - FOOT SIDEYARD TO DUPLEXES: The Clerk then
read for second reading a proposed ordinance requiring a side -yard of
not less than eight feet for duplex residences entitled:
AN ORDINANCE AMENDING SECTION 14A OF AN ORDINANCE ENTITLED
"AN ORDINANCE TO CLASSIFY, REGULATE AND RESTRICT THE LOCA-
TIONS OF BUILDINGS DESIGNED FOR SPECIFIED USES; TO REGULATE
AND DETERMINE THE AREA OF YARDS, COURTS AND OTHER OPEN
SPACES WITHIN AND SURROUNDING SUCH BUILDINGS, AND TO ESTABLISH
THE BOUNDARIES OF DTSTRICTS FOR THE SAID PURPOSES AND PRESCRIBE
ING THE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS", PASSED
FEBRUARY 5, 1923, AS AMENDED.
The motion was made by Alderman Kehe and seconded by Napieralski to
finally pass and adopt this proposed ordinance. The Mayor put the question
and the clerk called the roll with the following result: Ayes; Aldermen
Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe, Scharringhausen, Lemke,
McKay, Campagna and Halverson. Nays; None. The Mayor thenupon declared the
motion carried and the said resolution passed.
The motion was then made by Alderman Kehe and seconded by Lemke to direct
the clerk to cause the said ordinance published in the Des Plaines Journal.
The motion was voted upon by acclamation whereupon the Mayor declared the
the motion carried.
ZONING AMENDMENT FIRST READING: The clerk then read for the
first reading a proposed ordinance seeking to reclassify a part of Lot 3
in County Clerk's Division from "Unrestricted" to "Industrial District,
Area District C" entitled:
AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO
CLASSIFY, REGULATE AND RESTRICT THE LOCATION OF TRADES THD
INDUSTRIES AND THE LOCATION OF BUILDINGS DESIGNED FOR SPEC-
IFIED USES; TO REGULATE AND LIMIT THE INTENSITY OF THE USE
OF LOT AREAS AND TO REGULATE AND DETERMINE THE AREA OF
YARDS, COURTS AND OTHER OPEN SPACES WITHIN AND SURROUNDING
SUCH BUILDINGS, AND TO ESTABLISH THE BOUNDARIES OF DISTRICTS
FOR THE SAID PURPOSES AND PRESCRIBING THE PENALTIES FOR THE
VIOLATION OF ITS PROVISIONS", PASSED FEBRUARY 5, 1923, AS
AMENDED.
Mayor Garland referred the said proposed ordinance to the Municipal
Development Committee for study and recommendation.
JOHN H. & Esther BOECKENHAUER VS CITY - CASE # 43-S-11629:
The Clerk then read the following proposed resolution:
The motion was made by Alderman Pflughaupt and seconded by Vavrinek to
adopt this proposed resolution. The motion was voted upon by acclamation
whereupon the Mayor declared the motion carried and the said resolution
adopted.
RESOLUTION
WHEREAS, the Mayor of the City of Des Plaines was served with Summons returnable
on the third Monday in November, in case number 43S11629, Superior Cout of Cook
County, in which John H. Boeckenhauer and Esther Boeckenhauer, his wife, are
plaintiffs, and the city of Des Plaines., is named defendant; and
WHEREAS, it is necessary that this cause of action be defended, now, therefore:
BE IT RESOLVED BY TETE CITY COUNCIL OF THE CITY OF DES PLAINES, ILLINOIS, that
the City Attorney be and he is hereby authorized and directed to enter the appear-
nance of theCity of Dili Plei.aes in the above entitled cause, and to file an answer
or counter -claim an to do everything, which in his judgment is necessary, for the
proper defense and for the best interests of the City of Des Plaines.

INVESTIGATE POSSIBILITY OF GETTING WATER FROM CHICAGO:
The motion was made by Aldermen Lemke and seconded by Vavrinek to authorize
and direct the 'ity Engineer to investigate the possibility of getting
an auxilliary water supply from the City of Chicago and to report his
findings to the Council as soon as possible. The motion was voted upon
by acclamation whereupon the Mayor declared the motion carried.

ADOLPH ESSER IS GRANTED LEAVE:
The Clerk then read the following letter:

It is with regret that I ask of your honorable body a leave of
absence from my duties in order that I may enter the Armed
Forces of our Country.
I have enlisted in the Seabees (construction battalion), and

carry on the work I am leaving.

AUTHORIZE FAREWELL GIFT FOR ADOLPH ESSER:
The motion was made by Alderman Johnson and seconded by Campagna that the
council recognize Mr Essers faithfull service by presenting him with a
gift of $200.00 ( the equivalent of one months pay), of which $100.00
is to be paid from the Streets Fund and $100 from the Garbage Fund.
The Mayor put the question and the Clerk called the roll with the
following result: - Ayes; Aldermen Johnson, Napieralski, Pflughaupt,
Vavrinek, Kehe, Scharringhusen Lemke, McKay, Campia and Halverson.
Nays; None.
The Mayor thereupon declared the motion carried.

EXPLAIN HIGH WATER BILLS: - The Clerk then read the following
report:
To the Chairman Lemke - Water, Sewers and Public Building committee, at
the meeting of the City Council held October 18, 1943, the following
matter was referred to your committee:
The matter of two high initial water bills in the new duplex area in
Riverview was referred to your committee for investigation and report.
Des Plaines, Illinois, November 15, 1943.
To the Mayor and City Council:
Your Committee on Water has investigated the above and has found:
Builders have been using water from buildings which have been completed
and meters installed - They have been notified to discontinue this practice
in future.
