09/20/194315S MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF DES PLAINES HELD IN THE COUNCIL CHAMBERS, MONDAY: SEPTEMBER 20, 1943 AT 8:00 P. M. CALL TO ORDER: - The meeting was called to order by Mayor Charles H. Garland presiding, with Alderman Johnson, napieralski, Pflughaupt, Vavrinek Kehe, Scharringhausen, McKay, Campagna. and Halverson responding to the roll call. (Alderman Lemke was absent during this roll call but arrived shortly thereafter.) The clerk reported ten (10) Aldermen present. REPORTS OF OFFICERS: - The Clerk then read the reports for August 1943, of the following: Frank F. Scharringhausen, Building Inspector Harold J. Ahbe, City Treasurer. ELKS PRESENT COLORS: - Mr Henry Wiese exalted Ruler of the Des Plaines Lodge of the Benevolent and Protective Order of Elks then presented the City with a new flag of the United Stated of America to be flown from the staff located in the C & N. W. Railroad Park. Mayor Garland accepted the flag in the name of the city. The motion was made by Alderman Campagna and seconded by Napieralski to instruct the clerk to write the Elks an appropriate letter expressing the Council's grat- itude for this patrioted gift. The motion was voted upon by acclamation where- upon the Mayor declared the mttion carried. OVERLOADS ON RIVERVIEW STREETS: - The clerk then read the following report: To the Chairman Johnson.- Public Protection committee, at the meeting of the City Council, held September 7, 1943, the following matter was referred to your com- mittee: The report of Alderman Halverson that the streets in Riverview are being seriously overloaded with heavy trucks. We, your Committee on Public Protection recommend however, that the city attorney be instructed to draw an amendment too our traf"ic ordinance to include Cora, Illinois, Stockton, Sycamore, Orchard and Linden Staeets in Article 6, Section 63. A. #117: The clerk then read the follow- ing letter: September 20, 1943. hayor and City Council Des Plaines, Illinois Gentlemen: Please be advised that the Supreme Court of Illinois, on September 16th, 1943, denied a rehearing, in -the matter of Boeckenhauer vs. City of Des Plaines, in re: Special Assessment No. 117. By denying the Petition for a rehearing, the order of the County Court setting aside and vacating the order of confirmation for sewer under said special assess- ment, as pertaining to Boeckenhauer's property was affirmed and is now in full force and effect. The reason of the high court was that the City had no power to assess property outside it's corporate limits for a special assessment improvement, and further, that the subsequent annexation of such assessed hnds did not grant the lack of power in an retroactive way. Nays; None. The Mayor thereupon declared the motion carried and the said resoltuion adopted. FIREMENS' ANNUITY AND BENEFIT FUND: The Clerk then read the follwoing letter: September 20th, 1943. Mayor and City Council, Des Plaines, Illinois Gentlemen: The recent session the legislature enaacted a bill entit led "A" Bill for an Act to provide for the creation, setting apart, maintenance and administration of a firemen's annutiy and benefit fund in cities, townships, villages and incorp- rated towns having a population of ntbt less than ten thousand nor more than one hundred thousand inhabitant". This is now law and will take effect January 1, 1944. It appears that the City of Des Plaines will come under the provisions of this act. It is required under the Act, that an elettion be held, under rules of the Board of Firemen's Pension, on September 28th, 1943 to elect three representatives to the new Board whichwill officially take over on January 1st, 1944= wince this department has but two members who are eligible, the law provides, tha the Mayor, with concurence of the Council, anoint the third member. So th,;l this may be in order before September 28th, a request is made that the Mayor make such. ap- pointment immediately, so that such an:e can be certified on or before September 28th, 1943, so that the names be certified as provided by law. Since it may be necessary to have a city census taken to determine whether or not the population of the City is len thousand or more, and taking such census. cannot be completed before October 5th, 1943, it is requested that the Council authorize the Mayor and City Clerk to execute an affidavit for the purpose of establishing that the population of the City of Des Plaines is ten thousand or more. This affidavit will then be forwarded to the State Insurance Department and the City placed on the list of those eligible. Very truly yours, FIRE MS PENSION BOARD By Lieut R. A. Kolze Secretary. Mayor Garland then appointed Walter Lagerhausen as the third member of the Board of The Retiredment Board of the Firemen's Annuity and Benefit Fund of the City of Des Plaines,I' ' inois, for a te-m beginning January 1, 19/4. The motion was made by Alderman Johnsop and seconded by Napieralski to confirm this appointment. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried and the said appointment confirmed. CITY CENSUS:- The moti n was made by y1dern•an Johnson and seconded by Napieralski to ,authorize and direct the Payor and L'ity Clerkdtosign aaffdvit certifying that in their opinion the city's population 10,000inhabitants, said affadavit to be made pending an official city census to be made in the near future. The motion was voted upon by acclamation whereupon the !ayor dela±ed the motion carried. Mayor Garland referreat the matter of an official City Census to the Committee on Municipal Develbpment for study and recommendation. • DEFICIENCIES IN SA # 62 and SA #52693:- The clerk then read the the following letter: COMMITTE REPORTS CONT' D Mayor and City Council Des Plaines, Illinois Gentlemen: September 20, 1943 I attach hereto a letter received from Mr. F. H. Talcott relative the deficiencies in Special Assessment Dockets 62 and 52693. The letter is self explanatory. A supplemental assessment should have been spread and levied in the years 1922 and 1932. Failure to have done so is now reflected in all title searches of property abuting said improvemt and is a lien for such deficiencies. Very truly yours,. Opeka City Attorney Des Plaines, Illinois Dear Mr. Opeka: I represent the proposed buyer of the property on Ellinwood Stree.,Des Plaines, Illinois, formerly occupied b� Mr. La P".antia as a store. the opinion of title and the torrens certificate covering this property show the following objections: - On November 3, 1922, an order was entered in the County Court of Cook County, Illinois apr-ro-;ing the final certificate of cost in Special Assessment Locket No. 62 Des Plaines, for improving Center Stre-t and Prairie Avenue, it is reported in said final certificate that there is a deficiency in said assessment." On September 7, 1932, an order was entered in the County `'ourt of Cook County Illinois, approving the final certificate of cost in special assessment law Docket T'o. 52693, County Court of Des Plaines, for widening, curbing and paving Ellinwood Street, it is reported in said final certificate that there is a defi- ciency in said assessment." -I am informed that tl1e fediciency in #62 is $1619.34., plus interest, and the deficiency in #52693 is $c1'08.86. plus interest. This deficiency is a lien not only on the La Mantia firorerty but on all other property located withinthe original special assessments and is a cloud on the tiele that should be cleared up. The owners of the property are helpless. in the matter It is the duty of the Laity Council and the Mayor to clear these deficiencies F� in any way the law perm ts, pursuant to your advice as to the method. This should have been done a long time ago. Will you please take this up with City Council of Des Plaines and advise me what steps are being taken to clear up these liens so that each owner can pay off his special assessment and clear up his property and give good title. The motion was voted upon by acclamation whereupon the Mayor declared the motion carried. The clerk then read the bids as tabulated: Bidder size of Truck Take Price Nagel Sales & Service 2 -ton Doitge $1,200.00 M. J. Lanaham 21, --ton Dodge $1,935.00 The motion was made by Alderman Campagna and seconded by Pflughaupt to refer the said bids to the committee on Streets and Sanitation. The motion was voted upon by acclamation whereupon the Ipayor declrred the moti n ca-ried and the bids so referred. After a short recess the committee on Streets and Sanittion reported thru its chairman Alderman Campagna. The motion was made by Xldermn Campagna and seconded by Lemke to accept the bid of M. J. Lanaham covering one(1) 2 ton Doge Truckfbr a price of $1,935.00. VITAL STATISTICS ORDINANCE: The Clerk then read for second reading a proposed ordinance entitled: ORDINANCE PROVIDING FOR A LOCAL REGISTRAR OF VITAL STATISTICS In complianceNith House Bi7.7. 565, 1943 General Assembly The motion was made by Alderman Pflughaupt and seconded by Lemke to finally pass and adopt the said proposed ardinance. Nays: None. The Mayor thereupon decla ed the motion carried and the said ordinance passed. CITY ENGINEER GETS ONE-YEAR LEAVE: The Clerk then read the follow'ng letter: September 20, 1943 Mayor and City Council City of Des Plaines Gentlemen: Due to the war emergency there is a shortage of Sanitary Engineers. The government has asked that I serve with the Department of Health and Sanitation with the Inter-Arneric_n Affairs Committee.. Such an assign- ment -eans that I will have to leave the Untied Sf ates for ;possibly one year. While I hesitate to leave my work here in Des Plaines and to leave my family for such a period. I feel that I sho ld serve where I can be of the most use during this emergency. I therefore ,aask fr a years leave of absence and your permission to turn my work as Engineer for she City of Des Plaines, over to }r. Frank Nelson, who has been nay partner for the past two years. Per Nelson is qualified to handle the work, he is familiar with the work which I have b on doing, and, I am sure, will prove satisfactory in every way. Very truly yours h. N. DEFER PORTION OF GARBAGE TRUCK COST: - The Clerk then read the following proposed resolution: RESOLUTION WHEREAS, The Untied States of America is now engaged in war, and to con- serve vital materials and equipment it is difficult to purchase and acquire trucks and equipment without priorities; and WHEREAS, The City of Des Plaines, to maintain its system of Garbage collection and disposal requires the use of a new truck and hoist to supplant worn out and deteriorated equipment, and has secured the necessary priorities to make such purchasd; and WHEREAS, the amount appropriated is not sufficient to Purchase a truck and hoist, the cost of whic is approximately $$2,700D0, and it being necessary to carry on the duties of preserving the health of the community; and it being necessary to purchase a new truck and hoist; and WHEEAS, t'is Council declares this to be an emergency; now, therefore: BE IT RESOLVED EY Tri CITY COUNCIL OF TEE CITY OF DES PLAINES, C0 "!K COUNTY, ILLINOIS: SECTION 1.
