Having unanimously voted against this same petition three times within
the past two years and our latest recommendation denying this same petition,
submitted only last May to the Council, we cannot change our position at this
time. All facts and information presented to the board at our meeting July 26,
1943 were the same that have been presented previously and were thoroughly
analysed and discussed at our former meeting.
As previously stated, we are not forcing this company to stop the manufact-
ure of war materials, and as previously outlined your body has given them per-
mission to stay in this location for the duration of the war and six months
thereafter.

opportunity to speak, and requested that consideration of this recommendation
be postsponed until 9:00 P. M. in order to give Mr. D. B. Maloney, attorney
for the petitioner, am opportunity to address the Council. There being no
ebjsetion Mayor Garland declared a recess until 9:00 P. M.
A+ 9:00 P. M. the Mayor reconvened the Council. All Aldermen were present
excepting Alderman Lemke.
The Mayor then put the question on the motion to concur in the pending
recommendation, and the Clerk called the roll with the following result:
Ayes; Aldermen Johnson, Napieralski, Pflughaupt, Vavrinek, Kehe, Scharringhausen
Mc Kay and Campagna. Nays; Alderman Halverson. The Mayor therefore declared
the motion carried, the recommendation concurred in and the petition of the
petition for re -zoning denied.
ADJOURNMENT: T: The motion was made by Alderman Campagna and seconded
by Pflughaupt to adjourn. The motion was voted upon by acclamation where-

MINUTES OF THE REGULAR MEETING OF THE
CITY COUNCIL OF TRE CITY OF DES PLAINES
HELD IN THE COUNCIL CHAMBERS, MONDAY,
AUGUST 16. 1943.
CALL TO ORDER: - The meeting was called to order by Mayor Charles H.
Garland presiding with Aldermen Napieralski, Pflughaupt, Vavrinek, Keher,
Scharringhausen, McKay and Halverson responding to the roll call. Aldermen
Johnson, Lemke and Campagna were absent during the entire meeting. The Clerk
reported seven (7) Aldermen present.
AMEND GASOLINE FILLING STATION ORDINANCE: The Clerk then read for first
reading a proposed ordinance entitled:
AN ORDINANCE AMENDING SECTION 9 OF AN ORDINANCE ENTITLED
"AN ORDINANCE TO REGULATE, LIMIT AND RESTRICT THE PLACE
OF BUILDING GASOLINE SERVICE STATIONS AND OF GASOLINE
STORAGE TANKS WITHIN THE CITY OF DES PLAINES, COOK
COUNTY, ILLINOIS."

WHEREAS, the United States of America is now engaged in war and as part of
the war effort the federal government has restricted the sale of petroleum pro-
ducts to conserve vital war materials, andsuch action has caused many gasoline
Service Stations to suspend business, now, therefore:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DES PLAINES, COOK COUNTY,
ILLINOIS:
SECTION 1. That section 9 of an Ordinance entilted "An Ordinance to Regulate,
Limit and Restrict the Place of Building Gasoline Service Stations and of Gasoline
Storage Tanks within the City of Des Plaines, C ok County, Illinois", passed and.
approved May 16, 1938 be, and the same is hereby amended to read as follows:

Section 9. EXISTING STATIONS. The provisions of this ordinance
excepting those regarding gasoline buggies and other portable
containers shall not affect any existing gasoline service stations
or storage tank installations in actual operation or use on the day
of the enactment of this ordinance, provided however that when any
such service station or tank installation shall not have been used or
shall have been abandoned for a period of sic (6) months or more af-
ter this ordinance becomeseffective, the same procedure, and require-
ments of this ordinance as anplicable to new stations or new tank in-
stallationsshall apply before such abandoned, stations or storage tank
canbe reoccupied or used for the sale or storage of motor fuel;
PROVIDED further that for the duration of the U. S. Government restrict-
ion on the sale of petroleum products and for threemonths after such
restriction shall be removed, the provisions of this, ordinance shall not
apply to Service Stations which were licensed to do business during
the fiscal year ending December $l, 1942, provided the,operator or own-
er of such Service Station shall pay the annual licensee fee during each
year that such Service Station is not in use or is abandoned during the
said period of federal restriction on the sale of petroleum products
and for three ronths after such restriction is removed.
,.n SECTION 2. Any person, firm or corporation which erects or attempts to
C:\.? erect or operate a service station or storage tank without first having com-
cc) plied with the provisions of this ordinance shall be fined not less than
$10.00 nor more than $50.00. Each day that the violation of this ordinance
C occurs shall be deemed a separate and distinct offense.

SECTION3. This ordinance shall be in full force and effect from and after
its passage, approval and publication according to law.

rules and place this Proposed ordinance upon its final passage. The Ma:or put

posed ordinance be passed. The Mayor put the question and the Clerk called the

Kehe, Scharringhausen, McKay and Halverson. Nay; None. The Mayor thereupon de-
clared the moti.-n carried and the said ordinance passed.
The motion was then made by Alderman Keheand seconded by McKay to instruct the
clerk to cause the said ordinance published in the Des Plaines Journal. The motion
was voted upon by acclamation whereupon the Mayor declared the motion carried.
SETTLEMENT EDGAR B. WHITCOMB vs CITY - CASE# 41S 15703: Frank M.
Opeka, City Attorney then recommended that the council authorize the advance of
$1,101.00 from the Public Benefits Fund to Edgar B. Whitcomb in full sdsttlement
of the case of Edgar B. Whitcomb vs the City, case #41S 15703, to be reimbursed
by the special assessment Fund.
The motion was made by Alderman Pflughaupt and seconded by Kehe to concur in this
recommendation. The Mayor put the question and the Clerk called the mll. with
the following result: Ayes; Aldermen Napieralski, Pflughaupt, Vavrinek, Kehe,
Scharringhausen, McKay and Halverson. Nays; None. The Mayor thereupon declared
the motion carried.

APPROVAL OF IINUTES: Each member of the Council having been supplied

PETITION TO REZONE: The Clerk then read the following letter:

Gentlemen:
There is herewith presented to you fbr reference to the Zoning Board of
Appeals, a petition to classify the premises formerly knwn as the Squire
Dingee Pickle Company property.
According to my interpretation of the Zoning Ordinance of Des Plaines the
premises in question are now unrestricted and in the interest of the city of
Des Plaines as well as our own we requesting that the said premises be
reclassified as industrial.

We draw to your attention the fact that the Squire Dingee Company onws
approximately thirty two hundredths (.32) of an acre immediately north of
our property and the Squire Dingee Company has not joined in the petition for
rezoning, therefore, the petition we are presenting does not include the thirty
two hundredths of an acre of land owned by them.
We inclose a durvey to more clearly illustrate the land in question.
We are proud of the appearance of this building since we have reconstructed it
and we inclose a "before and after" picture of the property from which you will
see how the appearnace has been improved since we took over the land.
We inclose our check to the order of the City of Des Plaines in the amount of
ten dollars which we understand is the required fee to defray the costs of
publishing the notice of the public hearing to be held by the Zoning Board of
Appeals.

also a copy to their attorney, Andrew W. Gatenbey, 111 W. Washington Street
