The motion was made by Alderman °ehe and esea ded by Lemke to adopt the said
proposed resolution. The chair put the question and the Clerk called the
roll with -the following r4i1t: Ayes; Alderman Johnson, Napieralski, Pflughaupt,
Vavrinek, Kehe,-Scharringhausen, Lemke, McKay, Campagna and Halverson. Nays;
None. The chair thereupon declared the motion carried and the said resolution
adopted.
APPROVAL OF MINUTES: Each member of the Council having been supplied
a copy of the minutes of the regular Council meeting held May 3, 1943, the
motion was made by Alderman Johnson and seconded by Campagna that the said
minutes be approved. The motion was voted upon by acclamation whereupon the
chair declared the motion carried and the said minutes approved.
ADJOURNMENT: The motion was made by Alderman Vavrinek and seconded
by Johnson that the Council adjourn to 8:00 P.M. Monday, May 24, 1943, The

HELD IN THE COUNCIL CHAMBERS, MONDAY, MAY 24,1943
AT 8:00 P.M.
CALL TO ORDER: The meeting was called to order by Mayor Charles H.
Garland presiding,with Aldermen Johnson, Napieralski, Pflguhaupt, Vavrinek,
Kehe, Scharringhausen, McKay, Campagna and Halverson responding to the roll -
call. (Alderman Lemke was absent during the entire meeting.) The Clerk re-
ported nine (9) Aldermen present.
The Mayor then stated that this is an adjourned regular meeting,ad-
journed from May 17,1943.
PETITION FOR RE -HEARING; B(E<CKENHIUER VS CITY: The Clerk then read
the following letter:

Gentlemen:
The Supreme Court of Illinois on May 20th affirmed the judgment of the
County Court in setting aside and vacating the Judgment of Confirmation
of the assessment in the above entitled matter as affecting the. property
of the Boeckenhauers.
The judgment of the Supreme Court will be come final on June'4th unless
a Petition for a rehearing is filed before that time.
It is recomOnded that authority be given me to file a petition for a re-
hearing, if after a thorough checkup, and in mit judgment and discretion,
such an action is warranted. If such a petition should be filed, it is
understood that it would be upon the same terms as the original appeal
with reference to expenses.

The builders want to put up duplex buildings or single family semi
detached buildings, either one or two story as permitted. There
should not be any objection to buildings of this type in that sec-
tion and would be an improvement over the type now existing there.
-Also wish to include the following parcel:

If unsuccessful in getting zoning for the type requested, will you
please advise me just what type can be build on these lots, but
I hope that you will permit buildings requested, as the two builders
have assured me that they will get their quota or allotment from the
next quota of priorities, which will be granted very soon and time is
